overstaying any type of visa and later marrying a USC nullifies the overstay during AOS, IF and Only IF, the person entered after Inspection at the POE. IF that was not the case, then again AOS cannot be done from here. It has to be done in the foreign conutry and that is when the 3 yrs and 10 yrs bar trigger. This is one of the way to get the " overstayers without Inspection at POE " Must go through. By just overstatying would not and does not stop one from AOS within the US, if the person is married to a USC.

but again stamp on the back of I-94 is also a valid argument.

I Called CSC Twice on Tuesday. Below are excerpts of my conversation:

“How can I assist you?"
“Yes, I filed seven months ago and I have not heard anything from USCIS. I am curious to know what is going on."
"Give me your receipt number and I can look up"
" EACxxxxxxxxxxxx"
"Did you not get the letter sent on May 7?"
My heart sank. I have been checking my mailbox religiously. My post office is known to deliver mails to other residents in the same building. Scenes of past such occurrences started flashing in my head. All I could say was, “what?”
"Officer sent you letter in May"
I came to my senses and asnwerd in negative that I had not received anything from any officer.
She says, “Your case is pending. It was transferred from Virginia"
“Excuse me!! I am not aware of any Service center in VA. Must be Vermont”
“Vermont or Virginia, oh I don’t know, but your case is pending”
"I know that, but would be nice to know if it is assigned to any officer"
"We have 100s of officers and Millions of applications like yours"
“Ma’m, I am talking about my case, not millions of cases. I like to know if my case has been assigned to an officer.”

I don’t know the officer myself. But I called on May 6th and a person at your officer told me it was assigned to an officer and is not on the shelves anymore. But, you are telling me my file is on the filer.

My stupid RFE: Filled out I-864 for my Minor Child

What i learned and may be others after me: Fill out and submit I-864w for your child if he/she is younger than 18 years. They become a US citizen no sooner they enter the county. becasue of that , USC children, whether biological or Adopted, do not need AOS support. They are exempt from this since 2000 when Child Citizenship Act of 2000 went into effect.

BTW, here is the law:

A child who is:

?Born to a U.S. citizen who did not live in (or come to) the United States for therequired period of time prior to the child's birth, or
?Born to one U.S. citizen parent and one alien parent or two alien parents who naturalize after the child's birth, or
?Adopted (stepchildren cannot derive or acquire citizenship through their stepparents) and is permanently residing in the United States can become a U.S. citizen by action of law on the date on which all of the following requirements have been met:


?The child was lawfully admitted for permanent residence*; and


?Either parent was a United States citizen by birth or naturalization**; and


?The child was still under 18 years of age; and


?The child was not married; and


?The child was the parent's legitimate child or was legitimated by the parent before the child's 16th birthday (children born out of wedlock who were not legitimated before their 16th birthday do not derive United States citizenship through their father); and


?If adopted, the child met the requirements of section 101(cool.gif(1)(E) or rose.gif of the Immigration and Nationality Act (INA) and has had a full and final adoption; and


?The child was residing in the United States in the legal custody of the U.S. citizen parent (this includes joint custody); and


?The child was residing in the United States in the physical custody of the U.S. citizen parent.

Hello all,

I applied for my Spose and infant back in October 2008. I recieved NOA1 of Nov 5th. My case was transferred along with many VJers to CSC on January 14th. Those that got transferred maintained a spreadsheet here out of which most or all have been approved and have moved onto NVC begnining the last week of January,'09.

My petition (child) was last touched on Feb 10 and since then no RFE or any information from USCIS. I am wondering if there are many other VJers who were transferred to CSC and still waiting hear from them ? Or is it only me ( from the lot of January 13-15 transferees) that is left out ?

I would love to hear from you all . This is getting ridiculous when my calls to Customer service number is simply answered " you are witinn our processing date" yet I have seen many others who applied way later than me and have already gotten approval.

Is this time for me to start thinking about what my other options are to get USCIS moving on my case?

Well Folks,

I am sure you all know that if your spouse is in a foreging country, you can claim her as a resident on your tax filing and recieve ITIN for the Federal Tax puposes. you can find more information about ITIN here, http://www.irs.gov/p...s-pdf/p1915.pdf and can do a massive research on IRS.gov website. Once you understand it , then you can call IRS to double make sure. I have been thorugh IRS Reps who were enlightended by what i knew, rather than finging information for me. Anyways, IF you have filed married jointly with your foreign spouse and have ITIN for her, You should be able to add her name and create a joint account, with her ITIN in the place of SSN.

That is what i have done.

Well, CSC why the friggin my applciations are not touched or I have not recieved ANY information. GRRRRRRRRRRR.....Dont make me come after you. smile.gifsmile.gif

This is done easy. you should not sweat so much whether it is vietnam or china or macao or laos. The US rules are same despite the location you come from.

IRS tax laws allows you to treat your non working and non resident spouse as a resident for the federal tax purpose. What you need to do has been suggested to you from the top down below all over.

I went the same rout, and now every year i fild married jointly with her itin and she is not here but still back home.

was transferred to CSC jan 14 with whole bunch of others. Others are all done and have their sweethearts over already. I still remain wishing...for whatever is next....
called CSC last week. Spoke to an IO but thought she was just a CSR acting as IO. I was wrong. I see the Last Update dates changed. The dates changed to the one I was talking to her . I remember clearly her saying " let me pull your file" that means they have my file. but she said no one is assigned to the case, and she isnot sure who, when , how or what? She told me to wait 30 days, and if no info call back. I just with they touch my file and send me either an RFE or approval. They have no other choice but those two- RFE or approval. Rest assured.

I agree with Tbone...smile.gif we should post responsibly and should be able to back up our information. Besides the information needs to be verifiable. Every case is unique and so are the results.

I appreciate the thread starter's genuine intent to help others. The way one organizes documents will make an IOs job easier, yet does not guarantee speedier approval. I have had many arguments with users on different forums regarding Creditable source of information.

I filed two petitions last October - one for my spouse and one for my child. Looks like they have sperated the two files, and that is what a CSR at the USCIS number told me. Separating the cases doesnot make sense, especially in the case of the Child. I mean to call back and tell them that.

I have included all necessary documents and have organized it in a way that browsing through the documents is a pleasant expereince smile.gif yet, I have not heard back from them. My both cases were transferred to CSC on january 14th along with many VJers out of which now, I believe i am the sole VJer that is stuck at CSC.

Everytime I hear someone getting approved at CSC in record number of days makes me jealous and frustrates me. but i cannto do anything over things out of my control. I am very happy for those who get approved quickly or otherwise. However, I get really agitated when i hear or see nothing from CSC on my cases. Even my calls have yilded nothing.

Oh god...I wish I could do something....

I petitioned my son and spouse bak in October 26, 2008, they recived it on 28, NoA1 of Nov 5, and transfer to CSC on Jan 14 with bunch of other Vjers who are currently riding NVC smoothly ( i wish them all good luck) , but me. LOL

I have been waiting as well....and called about two weeks ago. Got transferred to CSC, spoke to a very old lady. the conversation went something like below:

" ahhhhhhhhh!! Case number" ( coughing)
"EAC02034928289349"
"your date of birth" ( by now i could tell she is an African American. and each number she typed in with a loud yaaaaaaaan noise )smile.gif
"blah blah blah" , then on hold for 30 seconds
" pending"
"excuse me"
"your case is pending, you probably know that already" chuckles
"yes, i know. Can i talk to an IO please"
"who?"
"an immigration officer"
she said something i did not quiet get it, but sounded like she said " you are speaking to one"
" Iam sorry"
"you are talking to an IO. ummmmmmmm!! do you want a RFE"
"what? no, I mean its been so long and i have nieter gotten and RFE or anything else. i just want to make sure i did not miss any of your letters if there were any"
" we will notify you by mail. check your mail"

"Your case has not been assinged. I cannot tell you when it will be assigned. but dont call before 30 days"
"yes, but that is not fair, everyone else transferred with me is done and long gone. Why me stuck "
"it has not been assinged, wait for 30 days, and if you dont hear anythign from us, call back"
And she put the phone down.


So now the 30 days are up and will call today again. Dont forget the number i dialed was this, and surely it is the IO i spoke to. Next day when i cheked my online status , I had a LUD on the day of my converstaion and again on monday another update. I am thinking she pulled the file and on Monday she put it back where it belonged. NO NEWS till NOW.

What a freaking joke immigration is. seriously, some idiot loooked into my file, saw the files seperated, and pushed it aside to rot. To be honest those who enjoy seperating families like us deserve hanging by their balls. I really get agitated everytime I think of my cases. Sense of helplessness pisses me off even more....

Good luck to me and all those are waiting. I think i am up for a long ride with DHS...what can I do ?

I submitted my W7 in June, and it was returned stating that i needed the copy of the my spouse's passport notarized by the Americna Cousular office back home. So we did that and sent in the new evindence in September. I got the tax refund in November of that year. All in all it took me about 6 months I say.

Those of us that are still waiting, our situation is like an animal in a cage. when put in a cage, the Animal would do all that he can to free himself up, and at the end , would accept his fate as it is and expect someone would throw a piece of meat or whatever. and every time the mere sound of footsteps makes him look around for something, anything, whatever it is.

At the end, I do not think those who went thorugh the process in 4 months, with so many touches, would understand our situation and Agonies. This is not a site to argue or fight or for any negative talks. Having said that, I still wait for whatever news they can give US.

Pinto, Keep me posted. As of now I have heard nothing from the USCIS. The very unreliable website update has not happened since March 23 and that was when I called and an IO looked into my file and questioned me, " Do you want RFE ?"

I hadn't heard anything again, until I finally got a touch on 3/2, but still nothing further (btw, I was never notified of the "touch" via e-mail even though I'm signed up for e-mail notification...I just happened to check the website & there it was). I tried calling too but got the "6 month processing" bit as well. I don't know what else to do but wait. I'm here 4 support if ya need me! rose.gif

And guess what, " it may be late but there is never injustice in the land of the Almighty" As a matter of fact, I take this whole ordeal as a test from HIM high above - the test of not losing Faith in him. What can we do? nothing, and that is when a human being more so falls on His feet and asks for support, help. Same here. So keep your head up, keep busy and dont lose your faith. Sorry Mohan...maybe everyone is asleep on the "couch" waiting for notices...etc. NVC was closed for a day due to snow...etc. Its always something. I would definitely call if you haven't heard anything. It never hurts to call. We were transferred to CSC on Jan. 14th and got our NOA2 on the 29th. We got several touches in between those two dates, so I think the best thing you can do is call. Also, a lot of VJ'ers have suggested to me & I've seen them suggest to others to contact your state representative to bug USCIS about statuses. As my dad always tells me, the squeaky wheel gets the grease, so keep squeaking and they will respond hopefully. smile.gif


oh thank you Amandagaram. I have a very close friend from Jordan who works with me and guess what we call him...Jordan!! he is the Jordan from Jordan. His real name is Shaher. Anyways, thanks for your nice words. I called the customer service number. they give the standard answer" its not been six months since the applciation was sent" and that's it. I am just worried if they have lost my file , since everyone that got transferred on Jan 14, me and you and others here, have gotten approved but for me.

I hope all your processes at NVC are going well.

My case was transferred to CSC together along with many more on Jan 14. And many are very lucky to get theirs approved by the end of January and My case still remains at CSC.

I know every case is different. However, the thing that annoys me is the fact that they touched my child's case on Feb 9 and 10, yet I have heard nothing from them - neither an approval nor a RFE. I am just shocked the way they are handling my case, because i filed for my wife and my infant together, both the applications got trasferred together,and after the tranfer they touched both the files until Jan 23 together. Then, there was no movement or touch until they touched only my child's case on Feb 9 and 10. Are they thinking that it is not my child? lol. That is very perplexing.

Is this normal ? Has anyone that visits this forum gone through experience similar to mine , or maybe know someone who has been through the same route ?

I am looking at the copy of what I have filed and don't see things missing to establish my relation with my spouse as well as my child. Moreover, both the times they touched my child's case, they did not touch the mother's application and that scared me for a while. I was thinking a RFE was on its way. But that was back in Feb 9 and 10, almost a month ago, yet I have recieved nothing. This is absolutely frustrating. I am wondering if they have lost my application. Do you think its possbile for them to lose my application?

I check my mail everyday very carefully. These days I have started wondereing if I inadvertently may have thrown away the letters from USCIS along with " Have you seen Me" fliers and similar sorta junk mails. but then again i have never missed out any correspondence from USCIS at my current address. I have been living here for the past three years.

Do you think it is a good idea to call them? Do i have to wait for six months before making phone calls ? Is there anyway I could talk to an IO in this case? Do you think thats a reasonable option ?

The reason I am freaking out is, those who got transferred with me ( as much as I know from the spreadsheets here on VJ ) have been approved and already half done with NVC. However my applciations are moving at all and i have no idea why.

Oh please!! I am in need of lots of advice, consolation or words of courage or whatever way anyone here could help me.

I have been a silent reader here . And it feels great to see many trying to reach the same goal.

here is my dates and process so far:

I-130 filed for wife and son October 27 ( two seperate petitions)
Two different NOA1- NOV 5, 2008
Both Case transferred to CSC: Jan 14
Both case visible online : Jan 19
Touched both files : Jan 22
Touched again both files: Jan 23
Touched only Child's application: Feb 9

I am wondering why they would only touch one application. I am nervous if i am getting a RFE. whatever

SSB , I am sorry to hear your situation. I am on the same boat, though my spouse is from Nepal.

I am thinking more of the subcontinet issue, or may be they were waiting for the Indian Election, or getting the Talibans Out of the Swat Valley...Or a Stable new Government In Nepal. or Vicotry over the LITTE in Shri Lanka.....LOL

After all that happens , we may start seeing the NOA2...I think it is more of the Subcontinet Prejuidice then anything. or the ignorance on their part. My name is Mohan, and I have been told many times in my life in America, that my name is shortened version of Mohammad....LOL

If you know, there is a huge difference between Mohammad and MOhan...And i do actually tell my coworkers to please call me MO. that is easier......i got tired of them wrecking my actual name to Mohammad even though " what is it in name , afteralll"....LOl

SSB, I pray and pray for both you and I and ask other VJers to do the same...... just think of this, They Have No Choice but to either Approve or Deny our applications...

that is a good news that you got the RFE in mail now. I know you are married, but why do they need honeymoon stuff. That is just too much.

I did not have any honey moon but spent a month with my spouse right after the wedding. Honeymoon is not a social norm , yet younger generations do it anyways. So the questions, I Since i did not have a honey Moon, now what , my case will be denied ? i think that is abosolutely absurd,.

I am happy for you Beth, cuz this is the light at the end. I wish I could be at the same point , as many VJers, So i could do my NVC with others. however, USCIS seems to have a different plan for me.

Well, I take this as a great news for the reason that now you are out of the Blackhole called USCIS.

Once you send what ever it is, they will approve it . So I was right. By May 15 you should be good to go ,if not memorial day. Now you can relax and start planning for Memorial day weekend BBQ.

Please tell me one think, How old was your stepson at teh time of filing . My child is 2 years and few months, i am not sure if and how i would have his DS230 done, or if they will generate a DS3032 for him.

This is where all my confusions rests.

It may seem a common sense that a 2 years old cant sign or read, ( there may be some exceptional cases) but not my child smile.gif so how do people take care of these issues where there is an infant involved.

Linche shortcut is great, i have been reading it for the past few months. yet it comes short on when people have infants or children involved. I do plan to help add to it after i go trhough my process, so that future paretns wont have to spend anxious hours for nothing.

Or am I thinking too much unsure.gif

no, I was not out of the country Since I turned 14. Background, I was married when a PR, and thus baby born abroad and that can not make him a citizen. I myself became a USC later on 9/11, 2008.



yes, my spouse and my child were both assinged different petition numbers at USCIS. Numbers were one off during this process. I dont have a number assinged by NVC yet. The AVR says " no record found". I dont knwo if similar numbering scheme conitues at NVC. And that , i am not sure, may also mean I need to pay $355 for each of them as the visa fee - sort of a rip off, but what can i do.

now , about the $70 dollar fee, you only need to file one AOS if the child and mother are coming to join and are my dependents. Even though the tax law did not allow me to claim my child as my dependent since he is abroad and non-citizen, he will be once he gets here. I am sure that is what will happen in my case , and i get that part.

There are some questions in 864, becaseu my situation, that give me headache. I can nto think straight answering them. ohmy.gif

Tha child, ofcourse is mine. (I am sure you were asking if i adopted him or if my spouse had it before me marrying her. )

Everyone points me to Linches Shoritcuts, however it does not talk about someone in a situation like mine , ie, having not just spouse but an infant child.

Curious to know what others who have gone before me at NVC with similar situation had to do.
