I'm sorry if this may be a stupid question but I'm still new to all of this and I read how everyone's (well the majority) petition has been touched, and yet it has been over 60 days since I filed and I see nothing since the first noa. Can some please shed some light to this question which maybe others are wanting to ask but hasn't? How can I check my status and see if I too have been "touched"? I see how many who filed their I129F are getting "approved' and I don't much happening to us who filed the I130.

Is it too late for me to filed an I129F since it's been over 2 months since I received my first noa? I'm trying to be very patience but I'm losing my mind. :help:

James's NVC Shortcuts


The following NVC shortcuts are obviously not sanctioned by NVC but they have been proven to work without fail if you follow them to the "tee." If you are not good at comprehending instructions and/or English, you are probably better off not using these shortcuts.

A Bit of Background

Anywhere from a week to two weeks after your NOA2 from the USCIS service center (and, on those occasions where NVC has gotten quite backed up, perhaps a week or so more), NVC will assign you a case number. Approximately two weeks after NVC assigns you a case number, it will generate the DS-3032 Choice of Agent form and a $70 bill for the AOS (I-864) fee. You will be able to find out that it has generated the DS-3032 and the AOS fee bill by calling the automated recording (IVR)at NVC first thing on a Tuesday morning. (Updates to the IVR for the generation of forms and fee bills always occurs early Tuesday mornings.)

The DS-3032 and AOS fee bill represent two separate document/fee "tracks" through the NVC that ultimately come together at the end. The first, shorter track involves the AOS/I-864 and can be summed up as follows: you returning the AOS fee bill with the AOS fee to NVC, and NVC generates the AOS/I-864, which you then return to NVC. The second, somewhat longer track involves the immigrant visa application itself. Returning the DS-3032 Choice of Agent form to NVC leads to the generation of the IV (immigrant visa) fee bill. Returning the IV fee bill with the IV fee to NVC leads to the generation of the DS-230 IV application, which you then return to the NVC. Once NVC has completed reviewing both your DS-230 and your I-864, it deems your case processing completed and forwards the case to the embassy.

Because its "track" has one fewer step, the review of the AOS/I-864 is often completed long before the DS-230 has even arrived at the NVC. Thus, using the AOS fee bill and I-864 shortcuts below will, more often than not, not save you any time at all. However, if you anticipate a complicated I-864 situtation and/or if you are RFE prone, it won't hurt to get your I-864 in early. (The early completion of its review will, however, generate an odd kind of RFE -- you will hear the IVR tell you that "some documents are missing or incomplete" and that a "checklist" has been sent. This just means that they still haven't received your DS-230.)

Now let's get back to the meat of the matter and then on to the individual shortcuts.

Once NVC has generated the DS-3032 and the AOS fee bill, the NVC system is immediately ready to accept both of these from you -- that very day, in fact. Therefore, when you find out on that Tuesday morning that the DS-3032 and AOS fee bill have been generated, you can generate both of these on your own and send both of them to NVC that day. The same holds true for the other forms that NVC generates -- the IVR is updated on Tueday mornings if a form has been generated the previous day.

DS-3032

As soon as you receive your NOA2, you should have your spouse download and sign the downloadable version of the DS-3032 (available by clicking HERE) and send it to you. Then, when you find out that NVC has generated your DS-3032, write the case number in the horizontal box that says "Place Case Barcode Strip Here Before Mailing to the National Visa Center." (Whenever you are asked for your case number, ALWAYS put in the three letters with which your case number begins, not just the numbers.) Use dark ink -- a black felt-tip pen would be ideal -- so the case number is legible.

Alternatively -- and this can prove to be excellent practice for the other shortcuts to come -- you can generate a barcode on your own and paste it in the horizontal box that asks for the barcode strip. Go to http://www.idautomation.com/java/linearservlet.html. Type in the case number under "Data to encode." Under "Barcode symbology," select CODE 39. Select "No" for "Add check digit" and for "Add check digit to text" and select "Yes" for "Show text below barcode." Change the "X dimension" (bar width) to 0.05 and the "Barcode bar height" to 0.5. Click on "Create Barcode." Print out the result from the resulting pop-up window, cut out the barcode and case number below it, and paste it in the horizontal box on the DS-3032.

Send the completed DS-3032 to:

AOS fee bill

Because your AOS fee bill is generated at the same time as the DS-3032, you can also create your own AOS fee bill and send it in with the required fee. Download the MS Word copy of the AOS fee bill (available by clicking HERE). Under "Bill date," type in the date the AOS fee bill was generated. Underneath the date, change "XXX2005123456" to your case number. (If you are applying for an IR1 instead of a CR1 make sure to change "CR1" to "IR1" whereever you see it.) Next to "Petioner's Name," type in your last name, first name, and middle name.

You will need to replace the barcode at the bottom of the page. Again, go to http://www.idautomation.com/java/linearservlet.html. Select CODE 39. Select "No" for the "Add check digit," "Add check digit to text," and "Show text below barcode" options. Change the X dimension to 0.07 and the Barcode bar height to 0.85. Click on Create Barcode.

In the resulting window, right click on the generated barcode and left click on Copy. Go to the Word copy of the AOS fee bill, select the original barcode, and hit the Delete key. Then click on Paste under the Edit menu (or hit Ctrl + V on the keyboard). The barcode you generated should be in the exact same place as the original one you deleted.

Detach the fee bill at the dotted line (getting rid of the blank top two-thirds of the page). Get a money order or cashier's check payable to Department of State for $70.00, indicate next to "Amount enclosed" on the bill that you are enclosing $70.00, and send the bill and fee to:

Don't worry that you are not using the "envelope provided" as indicated on the fee bill. Presumably you are in a hurry here, so you should be sending the bill and money order off in a US Postal Service Express Mail flat mailer (the USPS is the only service that will deliver overnight to a P.O. Box).

I-864

Once the NVC system shows that it has received your AOS fee, it will generate the AOS/I-864 itself. (This may take anywhere from up to a month after you send the fee in.) Note, however, that neither the processing of the AOS fee nor the generation of the I-864 is reflected on the IVR -- you actually have to ask an operator. (An operator can be reached by pressing 1 and then 5 after dialing NVC.) The I-864 is almost always generated the Monday after the AOS fee has been processed. So if it is, for example, a Wednesday, and the operator tells you that your AOS fee was processed that same day, you know that your I-864 will almost assuredly be generated on the following Monday. Check that Monday to make sure that it has in fact been generated (again, talking to an operator), and then go ahead and send in the I-864 package you have already prepared.

You should have already completed the downloadable version of Form I-864 (available by clicking HERE) and accumulated the supporting documents pursuant to the instructions that come with the I-864 and the NVC-generated I-864 instructions (available by clicking HERE).

(Note that what you send to the NVC with the I-864 depends upon your financial situation. Also, you may need to send in an additional I-864 from a joint sponsor, and/or an I-864A contract from a household member. We're assuming here that for the past three years, you have had -- and still have -- a regular job making over 125% of the poverty level and can prove it. Those who also need an I-864 from a joint sponsor and or a I-864A from a household member should amend the instructions here accordingly.)

Next, replace the sample barcode in the Authorization with one generated at http://www.idautomation.com/java/linearservlet.html. Under "Barcode symbology," select CODE 39. You should include a cover letter with the I-864 package. With the cover letter, the order recommended by the NVC for the documents in the I-864 package is:

* Cover letter
* Barcoded cover sheet
* I-864
* Authorization for Release of Federal Tax Data
* Copy of tax returns from last three years along with copies of W2s
* Letter of employment
* Last three pay stubs

Write your case number in the upper right-hand corner of each page. Send the package to the NVC address listed on the barcoded coversheet.

DS-230

After your DS-3032 is received by NVC, the IV (Immigrant Visa) fee bill will be generated. Unfortunately, because NVC generates an apparently random transaction number and puts it after the case number in the barcode on the IV fee bill, it is not possible to send in the IV fee bill as soon as NVC generates it -- you will have to use the one NVC sends you. Once you do receive it and send in the fee, NVC will eventually generate the DS-230 -- the actual immigrant visa application itself. As soon as you find out that the DS-230 has been generated, you should send in the copy you already have prepared.

Well before your DS-230 is generated, your spouse should download, fill out, and sign the downloadable version of the DS-230 (available by clicking HERE). (Generally, your spouse will only need to fill out and sign part I because he or she will be sent part II by the embassy when the interview appointment is given. However, if your spouse is from Canada, the Philippines, China, an African country, or two or three other countries for which NVC arranges the interview, your spouse may have to fill out -- but not sign -- part II. This DS-230 shortcut is primarily designed for those who only have to send in a DS-230 Part I. You should find out from a VJ member whose spouse is from the same country as yours exactly what is required.)

You will need to attach the coversheet to the completed DS-230 Part I before sending it in. Download the MS Word copy of the DS-230 Part I coversheet (available by clicking HERE ). At the bottom of the page, replace the entire phrase "XXX City" with the name of the city in which the embassy interview will take place (i.e., the "post" in Department of State parlance). So if the embassy interview is to take place in Caracas, Venezuela, delete "XXX City" and type in "CARACAS" (all caps). [/color]

Where do I put the bar code that you mention above? It looks like this form has been altered and I don't see where I would delete the old barcode and paste my new one. Please advice.

Well it's been a process... in alot of ways the CSC and NVC was easy...

As of Jan 2007 Citizens of Moldova and I'm sure other countries now have to have a transit Visa to enter Romania.. and of course you know all the problems that come with new processes in a Goverment..Let alone Moldova..
Well everyone is applying for a visa whether they need it or not so that they can sell their spot on the calendar..
Well Veronica needed a Letter from the US Consulate In Romania so that they would give her a transit visa in Moldova to go to her Interview in Romania... A Invitation Letter.. Well Romania books the interviews two weeks from the day they get the packet 3 back... by the time Veronica got the letter for the 2/22 interview all the appointments for the transit visa were taken clear to 3/18 in Moldova...
Lucky She had a Relative high up in the Moldova Government that went with her to the Embassy in Moldova.. and he pressured them to give her a earlier date because of her interview date..and our expiration on the NOA2..
So they gave her 2/12 to come and apply for the visa... she gets it this Friday... leaves for Romania 2/20 it's a overnight drive... Medical is 2/21 Interview 2/22 ...
It's not been fun but I'm sure it's worth it..

Just thought...everyone that needs to go to Romania for their interview..should check into the transit visa...ahead of time..
the lines are getting less..and less.. but it still takes time..

i think i am getting more nervous every day with our k1 application. i have read somewhere on this site that one of the red flags for the consulate might be long period of time apart. well,we have been together 2 years now, we met in Romania, then went on vacation to Italy and last year i was in usa and lived with my fiance for 3 months . when i left we agreed that he won't come over to romania because i was going to apply for a tourist visa. i did not get my tourist visa and right after we filed for k1. he is coming over in september, but since last october we have not seen eachother, although we kept in touch daily throgh yahoo messenger, texts, mobile phone conversations, packages and all that. can anyone give me an opinion? our attorney has not said anything about this, but for the whole she said we wil be ok. what do you think? :unsure: thank you!

Just make sure you have proof that you have been in contact ie., phone bills, calling cards, emails, etc. If you have these items, I don't think you will have any problems. Good Luck!!

I tried searching these forums and came up with nothing, so I apologize if this has been answered before.

I'm about to mail the I-129f for my British spouse and have been nervous about the whole affidavit of support that comes next. I'm on permanent disability and receive income under a private Long-Term Disability policy as well as permanent Social Security Disability benefits and Medicare. My husband is currently working in the UK, and we have enough savings to bridge the gap until he finds work in the US under a K3 visa, but I'm getting nervous. Since he's the able-bodied one, he's really going to be the one providing the majority of the support once we relocate to the US.

Will the SSA income be a problem, since it's technically public funds? Part of me thinks it won't, otherwise that would mean a seriously discriminatory immigration policy toward disabled Americans, but since we're talking about the government, nothing would surprise me.

Can anyone ease my mind? If it's gonna be a problem, it's better to know now. If so, I might not even bother filing the I-129f- I'll just immigrate to England instead, even though that's not our preference. :help:

I too had some concerns about my AOS at the time because I was on SSI for over 2 years and I went back to the work force on June 06 and therefore never filed a IRS return for the prior 2 years nor was I able to meet the poverty level had I filed prior to the time that I did (I currently make enough and show proof). I'm assuming that you do not meet the poverty level with both of your income? Are you filing an IRS return? When I contacted NVC they told me to request a transcript from the IRS proving that I never filed for a return and write a letter explaining why I did not file during those years. I submitted my 1099R for those prior years since the AOS requires you to show 3 years of tax filing and I wrote the letter with my explanation. I got a letter from my employer stating when I began my services there and what my salary is.
I guess in your situation it depends if you meet the poverty level on your income or not. If you do not meet the poverty level, then you will have to get a co-sponsor. I asked NVC if they would allow me to use my spouse's income since I knew he had a job where I worked when he came in and had filed his W2 for 2006 but they had told me that I could not use his income since he was the beneficiary. I don't know if it is different for an I129F. I filed for CR1. I hope this helps you. Good Luck.

We are getting ready to file and have Radu's conditions remove. A friend of mine who became a U.S. Citizens about 2 years ago told me that Radu can apply for his Citizenship 6 months before our 3rd year anniversary even if his conditions are not yet remove.
Can anyone elaborate a little on this and tell me if this is true because if it is so, we can start that process in July. kicking.gif

That's the beauty of waiting until he is eligible based on 5 years presence, you are pretty much irrelavent to the process. No need for copies of marriage certificate, birth certificates, tax forms, etc.

My wife filed in January, passed her Interview this Monday, and is scheduled for the oath on April 12th. Her application packet included the N-400 form, front/back copies of her green card, passport style photos, and a check for fees. That was it!

Hi - before we applied, I looked through the "monthly" threads. I just glanced at a few again and the quickest I saw was a November filer who finished in less than 3 months. The longest I saw was someone who applied in May and just finished, so nearly 10 months. Average appears to be ~4 months. A lot is based on where your local office is - how backed up they are in scheduling interviews and how often the oath ceremony is held. For example, where my husband has to go for his oath ceremony, there are only dates ever 3 weeks or so. Some places have the ceremony the same day as the interview.

I don't think there are any shortcuts - are you thinking of all the NVC tricks back in the day? I do remember using some "trick" about the AOS bill... anyway I don't think there is anything to shorten here... just fill out the application and send the right documents/fee, then wait for the letters to come.

Since you are within the 90-day window of your husband's 5-year anniversary of being an LPR (since May, 2007 right?) he can apply without having to prove anything about your marriage. I read somewhere else that that simplifies the process. He's been legal here for five years, he is eligible to apply for citizenship. So maybe there was an advantage to waiting...

Filling out the application I noticed on the instructions that "Only if required, send copies of the following documents (the USCIS will request orignals if needed)", should I since I am the US citizen send in my Birth Certificate, Termination of previous marriage, and tax return? I don't want to send more than what I need but at the same time, I don't want to delay the process anymore than it has to. Please advice and thank you once again.

Hi all!
It's been a while since I written anything here. First of all I want to say what a wonderful website Visajourney is. It has been a lifesaver and a true blessing :thumbs: !! I don't know what I would of done had it none been for this website. I probably would of spend thousands of dollars to hire an attorney to bring my husband here. This has been very educational for me. Not only did I learn how to fill out the neccessary papers to bring my husband, but I also helped my previous employer bring back employers through H2B visas. The Lord blessed me to give me the knowledge to fill out papers and file them. I was able to do this because of what I learned here at VJ :wow: .

Now, my husband's journey is coming to an end. We are getting ready to fill out his application for his Naturalization (N400). We didn't know that we could off done this 2 years ago based on what I've read here but God only knows why it took us until now to do so. We are excited to start our new and final journey. I was just curious as to how long its taking for the whol process? Can anyone here enlight me? Also, is there any quicker way in doing the process. I know that in the past, I used some that were posted here.

Did you received a package from the consulate when you passed the interview? This is the package you'll need to bring with you when come into the USA. They will ask you for them and if they don't you should hand them to them when you arrive at the poe in front of the officers. Good Luck and God Bless.

Does anyone know anything about this? Has anyone out there done this process? He told me that this would be the only visa he can obtain that would not hinder his I130 petition. I don't want to apply for the I129F because based on the information I see, it's costly and everyone seems to be getting approval right around or at the same time as their I130.
Any info on the above would greatly be appreciated.

I believe countries with high rates of denials on tourist visas, Romania being one of them, you are putting up some risk applying for one. The I-130 process is not that incredibly long, and if he enters on a tourist visa, he'll have to go back for an interview anyway in a little bit. If he gets denied, he'll have some explaining to do at the consulate interview, why he started for a different visa, if he had one in the works. Sorry but I would wait it out, and not risk it.

The Lord is an awesome God. I came in to work this morning at 7:00 am, turned on my computer, went to check my email and there it was! I received 3 emails from USCIS that my I130 petition was APPROVED!!! :dance:
I started to scream, my co-workers came into my office and I shared my news with them. I got into my car went to the Gas station and bought a calling card to informed Radu of the wonderful news!
We are both estactic and so happy. :D
I wanted to share our happy news with you all and tell you, yesterday I was down in the dumps about all of this, I even wrote a letter to the Congressman pleading for help. I never gave up on my faith. The Lord answered my prayers!

Place your Case Number in the Subject Line
In the area where you write your message or question to them, make sure to include your significant others
name
birthdate

To track your parcel to USPS
go to http://www.usps.com
at the top right of the web site you will see a TRACK & CONFIRM prompt in the dark red head line.
click on track & confirm
now you will see a box asking for the label/receipt number from the mail you sent.
type in the number and click GO
It will tell you when it was received and the three letters of the person who received it.
Hope that helps.

Just go to tracking, and type in your number from the express slip, and it will display the delivery message and you will know it was received.
If you call NVC, it usually says it will take so many weeks...blah..blah..blah
But it only takes up to 2 weeks in this case for that step,usually less. So be patient,which lord only knows no one will ever be on this site,including me, and check the USPS web site to help rid your self of the delivery worry.
Hope that helps resolve your worries a little bit. The days will pass like years, and gray hairs start to replace the youthful ones. But the day of holding our loved one will one day come, just think Spring, warmth, and how nice it will be to be in their arms by summer.

I mailed out my AOS bill fee last week on Thursday overnight via USPS. As of this morning, VSC is telling me that they
do not show it in their system and it may take anywhere from 20-25 days before it is process. I have my I864 package ready to ship it to them. Can I go ahead and mail the package or do I have to wait until I hear from the representative that they have receive my payment? I feel that I'm so close to finalizing all and getting ready for the interview, and yet so far from getting all this ordeal behind me.

Please advice and good luck to everyone! :)

Where did you send the AOS fee bill? You state VSC (Vermont Service Center).. is that a mistake on your part? The AOS fee bill should have been sent to NVC (National Visa Center - New Hampshire)

If it is a typing mistake on your part.. then fair enough.. if you really did send it to Vermont Service Center.. you sent it to the wrong address. If you really did send it to NVC.. then do not worry about what they said.. check next week on the status.

I'm just a little concern that they haven't post it when I see other people timeline and see that they usually received it the following day and they're working on sending out their next package. I guess I'm just trying to get this all done asap. My husband is going thru a depression stage and its starting to concern me, so I'm trying to see if I can move along as quickly as I can. I will be moving back to the states April 20th or so. I did not work at all last year because I have been living in Spain, therefore, I have no W-2 forms to show. I will be filing my taxes (because I rented out my house while in Spain) but will not have proof from the IRS in time for the interview...? Not sure if this is really important because I can have a letter from my future employer stating how much I will make starting April 23rd and so on.... And not to mention I'll have 2005, and 2004 returns.

Any thoughts?

I had the same problem for 2004 and 2005. I contacted NVC and they told me to put N/A underneath the one I did have and write a letter explaining why I did not file. You can't request a transcript from the IRS because its for the most current year that they are working on. You may want to contact NVC but that is what they informed me to do was to write the letter explaining why.

I am new to VJ and I am so glad I found this site! :dance: I need something to keep my mind busy. I filed I-130's for my husband and my stepdaughter in Feb 07. In a really bad turn of events, they ended up deported back to France after spending a month at a detention center (hell) in Taylor, Texas. Perhaps you've heard the horror stories. :protest: Our story was featured in the LA Times.

I think I will hire a lawyer because our case is incredibly complicated. My husband overstayed on the VWP for over a year before we got married and now he's been removed. We need to file waivers, etc.

But I'm glad to be here. I never thought I could miss someone this much. I'm sure many here can relate!! The time just cannot pass fast enough. I am completely crazy about this man and I absolutely need him to come home. :wub: This is simply the hardest thing I have ever endured. Please wish us luck.

So, here we go on our journey. Any thoughts would be welcome. I'll be on here as much as possible. All the advice seems really helpful and everyone sounds caring. I also wish all of you out there the best of fortune through this ordeal. (L)

I'm sorry to hear about your ordeal but I do understand how you feel about missing your husband so much. I feel the same way about my husband and hopefully soon my ordeal will be over since we are towards the final stages of NVC. I don't know if you are from Texas and it probably does not matter. I know of a good lawyer in Texas who has help us bring workers internationally with H2B visas. He handles all types of immigration visas issues and I checked all his credentials before using him for the company I work for and he checked out very clean. I live in Florida and as I mentioned, I don't think it will matter if you are not from Texas because you can consult with him over the phone and just send your documents via Fed-x or UPS. Hi All,
I with all of you! I don't understand the concept of all of this. I'm new to this website VJ and I'm still trying to learn how to insert, add, etc. This is the least of my concern. I've been reading many of the posting and topics relating to my case (I also only filed for the I130 since I was told by USCIS that it was taking about the same amount of time to process as the I130) and I'm confused!! Many are approved within 2-3 months. It has been approximately 50 days since I received my first notice and I have not seen anything else since.
What do you all mean when you state its been "touch"? As I mentioned, I'm new to all of this and I'm trying to get myself educated.

Hi All,
First of all I want to thank everyone who continues to post their processes here at VJ. This has truly been a God's gift to me which keeps me going when the going gets tough! :thumbs: I must say that this journey surely has been an experience that I will never forget. I never anticipated nor did I imagined how stressful this experience was going to be But I can also say that it has also educated me, so much that hopefully down the line I may be able to assist someone else with their journey.

:help: I'm trying to get an idea of how long does it take once the Ambassy has the package on hand til they assigned an interview date?
I would like to know for the country of Romania how long is the process?
Please, please if there is anyone who has the same type of visa as our (CR-1) who has already gone through the process from Romania to please response. I am praying and hoping that I can bring Radu home before the end of this month because I have made some plans to take him to Chicago for a family reunion so he can meet all of my family and this is taking place on May 5th.

I thought I'd also let you know , that I just went back and looked, to find the actual date when I got the "appointment package" from the NVC. I received it on March 20.

Being that I had my case completed on March 13, .........that means it took one week to get the notice.

So, depending on when your case was completed, you probably want to do most of your "stalking" sometime early next week. ;)

Wow, is this the case for everyone who files a ir1/cr1 that they will get their interview date from NVC? My case is from Romania and I can't see to get any answers from anyone here at VJ. It appears that the majority of the VJr from Romania applied for K-1. I have a husband who has been stuck over there since Oct 06 (not long for some people but for us an eternity), and just like D&E to me this has been the worst experiences I have endured. I hate that the fact that our fate is in their hands. But, I'm just curious will this also be the same rule for me?

:dance: I don't believe it! I tried calling all day yesterday until 11:00 pm and could not get through to the NVC. The IVR kept telling me that the case was being review. This morning :dance: I called at 6:00 am and still got the same message from the IVR so I decided to wait until the office open to speak with a rep. I called at 8:00 and spoke with Kelly and she spoke out those two beautiful words "CASE COMPETE" my case was completed on 4/17/07 :dance: :dance: .
I contacted Radu and share the wonderful news with him. :) Now, I'm planning to see if I can get a flight schedule to go out there and be with my love possibly this weekend so we can share some time and prepare ourselves for this interview! :dance:

I'm estactic, but I guess you can all see that! :dance: :D

Praise God, he has been my counselor and my redeemer. He heard our prayers and fulfill our wishes! (L) :thumbs:

Yes, :dance: I can't believe it! It is finally over! Radu got his visa :dance: . After all the turmoil and the stress we have endure, we never imagined that the interview was going to be so simple. We barely slept last night studying everything about each other and all they asked was 3 very simple questions.

1. When did we get married?
2. Where did we meet?
3. Did we have any children?

That's it! We couldn't believe it! :thumbs: I just glad its over. We are getting ready to go home tomorrow. We should be arriving in Orlando, FL tomorrow at around 5:00 pm. We will also post our experience once we arrive. :dance:

I just wanted to share the great news that Radu received his Green Card yesterday evening. We were amazed that it only took a little over 3 weeks. and i said no way,,i never said that,i said i was a pr and i have 3 ppl in the car with her who heared what i said,and my i-751 is still valid for 8 more months?and they didnt care,,so i was sent to the detention and ther i hired a lawyer,and at my first court the judge didnt give me a bill bcoz i was an arriving alien,so the judge asked the goverment if they have anything againts me and the DA said no,he have a clean record but he claimed to be a u.s citizen and a federal agent and an army personal???????????????????????????? and iam like whatttttttttttttttttt,and even the judge made a face and he said wait a minuite ,first why would he say iam a u.s citizen if hes giving him a jordanian passport with a valid i-751 ??and why would he say iam a federal agent and army personal at the same time?doesn't make since,so i went back to my cell and i was going crazy and then i knew it was set up from someone who knew me,bcoz i was a part of the (AVR)organization,AVR=american valunteer reserve,and we honor the soldiers who got killed in action and help the ppl in case of an emergency and things like that and we wear uniform but we'r not army,,so anyway,,while i was detained i got married to her,and that attorney i hired didnt do nothing but screwing me and lieing to me,he didnt even show up to the court,but anyway,we filed a motion to re-open my i-751 and it got denied bcoz i was divorced,,but i didnt file a new one and that was a mistake,but anyway,,the immigration judge told my wife this at the second court,,he told her ok ,,ur husband was a legal immigrant in the country,have no criminal record,not even a traffic tickit,and never stayed over the visa time,,he filed taxes for the 3 years he lived in the country,so what iam going to do is ,,iam ganna send the DA or whatever hes name is to the immigration boarder to talk to thoes officers and c if they will agree to drop all these charges ,,and if they do then i will dismes the case and put him back in mexico like he never entered the u.s,so at the 3rd court the judge said that they aggree to dropp all the charges and he said to my wife,,dont worry,,hes not ganna be deported or removal or even valunteery deportred,we will allowed him to withdraw hes application for addmition and we will put him back in mexico and u will bring him back from there,so they did and i was sent back to the mexican boarder but i wasn't deported like i said,the judge give me a paper says that i was allowed to withdraw my application for addmition and waived by both,so now i been in mexico for 10 months allready,since last october 2006,and my wife have filed an i-130 and i-129f for me back in jan-2007,so here is the bad news,,i dont have a legal status in mexico and i dont know if i can process from here?my wife is a mexican american,and the second thing is we filed my i-130 at the csc and 2 weeks ago we were suprised bcoz we recieved an email from the immigration stated that they have transferm my i-130 from the csc to the local office in LA for a standard interview??????????so why is that if iam not wvwn there? I'm sorry to hear you're going through all of that. I know how stressful it is when you have to go through all the red tape of filing for a spouse that is not a US Citizen and now you have all of this to deal with too. I would take MargotDarko advice and get yourself a good immigration attorney. This is why I'm responding to your email. I know of a very good immigration attorney who is in Austin, TX and has an office in Monterey, MX and has very good creditials. We use his service to bring international employees on an H2B visas. Had I known about him before I filed for my husband's visa I would of used his services to help me with his case. This lawyer used to work for the US Representative and so has his partners. If you are interested email directly and I will give you all the information.
