K-1 Fiance(e) Visa Process & ProceduresNo Vaccination records - Peru

Good Morning VJ,
I have filled our K1 application on the 20th of August, and decided to not waste any time and start getting things together for the next part of this journey. I spoke to my fiance, who said he never had a vaccination record...Where can he get one now (he lives in Cuzco, Peru) and will he have to take all of them again, since there is no record of it?

We appreciate any help!

~Bela & Darwin~

Hi Bela,

If he can't find his vaccination records he will have to get the vaccines all over again. Many people end up doing this anyway, especially in Colombia where the doctors conducting the medical exam are notorious for requesting another set of vaccines regardless of whether the beneficiary had a vaccination record or not.

Tax returns with corresponding W2s or tax transcripts are considered very good evidence, so I suggest you send him those. Pay stubs for the three recent pay periods are also good to bring in, as well as an employment letter.

Can someone tell me about the Embassy in Bogota Colombia? Are they rude? Do they deny or approve most K-1 Visa's? What are some of the questions they ask? Thank you for your time

the doctor said the vaccines she got from him last year expire in six months, and she also was told she needed an influenza shot . he also told her some ####### that if she visits Colombia after coming to the US, she will have to get them all over again, before coming back to the US.

It's all a whole bunch of ####### because everyone knows that as soon as you get vaccinated you don't need that vaccine anymore BUT in order for them to get more money they give you that schpill your wife got and there is pretty much nothing you can do about it if you want to get approved for a visa, unfortunately. That's Colombia for ya!

my wife had her medical exam and she got the vaccinations from the panel physician on 1/4/2011. We had to wait for an I-601 to be approved, and she has a new appointment at the consulate May 14, so obviously she will need a new medical exam and lab work. Are they known for rejecting their own records from over a year ago, and requiring new vaccinations?

Well, the obvious thing would be for the doctor to just do the medical exam since the other one was done over a year ago and not tell her she needs new vaccines, but the doctors in Colombia are famously known for saying that vaccines that were given less than a month before the medical are too old. We all know is a tactic they use to get more money out of the beneficiary but people have complained about it with them and the embassy and they still do it.

Thanks Diana, do you think they will accept a DS-3025 filled out by the colombien panel doc.

They only accept the worksheet (DS-3025) that is filled out from the doctors listed on the instructions package, no one else. But the vaccines can be done anywhere else.

I also had some questions about Vaccination, but I was more interested in finding out what the CDC in the U.S. required when she gets here from Colombia. I EM the CDC and they EM me back the next day with all the Vaccination requirements coming to the U.S. from Colombia. She will get these shots at the Red Cross in Cali Colombia. I also ask her to have the DS-3025 filled out by the Red Cross Doctor. This way we will have the DS-3025 for AOS. The vaccination in Colombia is half the price than it is in the U.S. I would not recommend getting any Vaccination from any of the panel Doctors in Colombia, they will charge more than in the U.S.

The only person authorized to fill out and sign the vaccination worksheet (DS-3025) is one of the doctors approved by the embassy in Colombia, no one else. If she gets her vaccines at the Red Cross, she needs to take that paperwork to the medical exam and then the doctor will sign the worksheet.

After she arrives in the US she can either send a copy of the DS-3025 for her AOS to see if it's accepted by the USCIS. If not, then she will need to get an approved civil surgeon to fill out form I-693 based on worksheet DS-3025 for her AOS. Sometimes the USCIS will approve an AOS based on the copy of the DS-3025 but sometimes they do send out an RFE requesting form I-693 in order to get approval.

The vaccines needed to get an immigrant visa to the US are TD, MMR, and varicella. People can get them at the doctor's office during the medical exam if they want to, some people have said it's more expensive while others have said it's just about the same as getting them somewhere else. They can also get them at the Red Cross as someone else suggested or through thei EPS if they're covered.

If they do choose to get them before their medical make sure they don't do it more than 4 weeks before their appointment since these doctors are famous for rejecting vaccine records claiming those new vaccines are too old to qualify.

K-1 Fiance(e) Visa Process & Proceduresi-129F (Approved) now what?>

Hi guys,
Thanks for taking time to read this.

My "i-129F petition" has been approved exactly a week ago.
I tried calling everywhere to get further instructions on what to do next, and nobody seems to have a clue.

Last thing i did was to call NVC and provided my receipt# and they stated that it was not in the system yet... and again the magic word "YOU HAVE TO WAIT!".

I was just wondering if you could instruct/assist me on what to do next. Will the Consulate(Bogota,Colombia), notify me or should i apply for the interview online, or will my fiance get a confirmation letter :s
I cannot really find any helpful info regarding this particular Consulate

There's a ton of info in the Colombia Club threads located in the Mexico, Latin & South America forum. You will find anything you're looking for there and if not, just simply ask and someone will chime in to see if they can help.

K-1 Fiance(e) Visa Process & ProceduresHigh fraud countries
The thing is, this is a complicated question with many complicated answers. However, an easy answer is to say that if someone has to go to an embassy to get a tourist visa to visit the US pretty much means that that country is most likely to be considered high fraud. That doesn't mean that everybody will be denied, what it means is that every group involved in the approval of the petition and the visa will be examining all evidence and information very carefully, especially if the see that the beneficiary tried to get a tourist visa before and was denied, or tried to get a K1 visa and didn't get it, etc.

Bottom line is, if you have a legitimate relationship and enough evidence to back it up without any complicated issues, chances are you're going to get approved even if you live in a country that is considered high fraud for all kinds of visas.

K-1 Fiance(e) Visa Process & ProceduresHigh fraud countries

Sorry, I meant... Which are the current high fraud countries for k-1 visas?

The way I see it, high fraud countries are pretty much those that are not a part of the Visa Waiver Program. So if you live in a country where you have to go to the embassy to get a tourist visa, that pretty much means the country is considered high fraud for most visa types. These include most, if not all of Latin American countries, and others from Africa, Easter Europe, Asia, etc.

HELLO MY NAME IS ALEX I PETTIONED FOR MY FIANCEE WHO LIVES IN COLOMBIA I HIRED AN ATTORNEY FOR HER K-1 APPLICATION MY ATTORNEY SENT VERY STRONG EVIDENCE TO THE USCIS VERMONT OFFICE THE OFFICE RECEIVED THE PETTION ON APRIL 17, 2012 DOES ANYBODY KNOW WHEN I SHOULD BE HEARING A RESPONSE TIME FROM USCIS?

An approval depends on the Service Center you sent it to, California vs. Vermont, how many applications they received during the week you sent yours, how under/overstaffed they may be and also on the person in charge of approving your applications.

In the meantime you can check out the Colombia Club threads found in the Mexico., Latin & South America forum to learn more about the process, especially the embassy in Bogotáa. Page 1 has the links to the previous threads.

K-1 Fiance(e) Visa Process & ProceduresName misspelling

Thanks for the replies. Let me try to answer the questions.

I had always seen her name spelled with a "y". That is the way I saw it when we meet. That is the way she always signs her name. And that is the way we filled out the I-129F forms together. It wasn't until a few weeks ago when I saw her passport and ID card that I noticed that it was spelled with an "i" on there.

I just saw online today that our application was approved. And they mailed the 2nd NOA letter last Friday. So i am wondering what trouble we might be in? Will it be no big deal as it is 1 character out of a 4 word name. And everything else in the application is good? Or we need to re-apply and wait for another 6 months. Waht should I do now?

Thanks for the advice.

It sounds to me that her name was always written with an "i" and she chose to write it with a "y". Either that, or the person who issued her birth certificate was responsible for the error but it is what it is, if the birth certificate says it needs to be with an "i", then that's what her name will always be unless she changes it. The US embassy will issue her visa with the name that appears on the birth certificate and passport and the USCIS will issue her green card the same way. It needs to be constant especially when flying internationally or the airlines will make a big deal out of it. Again, the name of the ticket needs to match the info on the passport and green card.

If she does want her name to be spelled with a "y", she will eventually need to start by changing it on her birth certificate, then her cédula and then her passport. In Colombia this is not so easy to do, it can get complicated and very time consuming. So it's up to her.

K-1 Fiance(e) Visa Process & ProceduresName misspelling

My fiance lives in Colombia. We filed the I-129F application for her K1 Visa at the end of January. I watching the dates on the timelines page on this site and expecting them to get to our application within the next week.

I am worried now that I just realized that my fiance's name is spelled differently on her National ID and Passport that I thought. Her name is normally spelled Leymis with a "y". But I just found out that her name on her National ID and Passport is spelled Leimis with an "i".

Does anyone know how picky they are in the Visa process with details like this? Would one letter be an issue with the middle, two last names, birthdate, and everything else being accurate?

If this is an issue, how do I correct it without waiting another 6 months?

Thanks all for the advice and feedback.

If her name appears with an "i" on her passport and I.D. card (cédula) then that tells me that that's the way it was spelled on her birth certificate, double check to see if that is the case. The embassy will issue her visa based on what appears on her birth certificate and passport.

Another issue that will arise will be with her airline tickets because the name on the ticket needs to match what shows on her passport. So if she wants to change it, she needs to get a new one but like I said, I have a feeling that it may have to start with her birth certificate.

K-1 Fiance(e) Visa Process & Procedures15 Days after NOA2????

Sooo I just called the NVC and they told me to Wait 15 days after NOA2 to see if they received my petition. As I understood, they had the case number within a week after NOA2. Can someone please clarify this for me ? I have a plane ticket for the bigining of August on hand and I want to see if it's best to postpone my trip, but in order to do so, I need to know my interview date.

It all depends on how fast the USCIS can get all approved petitions to the NVC, it may take a few days, a few weeks or even a couple of months. I wouldn't go by what the NVC tells you because most petitions arrive there and are assigned a case number within a week. If you want you can call every day or every other day to find out if they have it, you may get an annoyed rep who is sick of you calling but who cares? You need this info ASAP and an annoyed rep cannot get in the way.

K-1 Fiance(e) Visa Process & ProceduresNew to all of this and no idea where to start

Any advice will be greatly appreciated and please be kind as this is all new to me. I met the girl of my dreams in Colombia, i have traveled twice once for 2 weeks and the other for 2 months. I'm ex military, Army, and currently in college, im only 24 but after meeting her we decided that we want to pursue her coming to the US and us getting married. I just have no earthly idea where to start or what to do. I thought about hiring an immigration lawyer or the easyfiancevisa website but after readings ome posts on here alot of people say thats unnecessary. If someone could just tell me where to start or what to do I would greatly appreciate it. Thanks

You can either file for a K1 (fiancée) visa, get married here after she arrives and then file AOS to get her permanent residency, or get married in Colombia and file for a CR1 visa which will give her permanent residence as soon as she enters the US. It's up to you.

K-1 Fiance(e) Visa Process & ProceduresGot Approved!!!!!!!! Need advice!!!!

Just got an email saying "On July 16, 2012, we mailed you a notice that we have approved this I129F PETITION FOR FIANCE(E)"

I am dying of happiness right now!!!! However I do not know what to do. I planned a trip to go see my boo for a week at the begining of august (have the tickets already) and now that I receive this email, I do not know if it's best to postpone that trip. How long is it taking from this stage to the interview??

It takes about 3 days for the case to arrive at the embassy. So send them an email on Friday or Monday of next week to find out if they have it. If they do, they will send you the K Visa Instructions Package via email. Just follow the instructions on how to register on the link provided, pick your DHL destination, pay for the visa and pick your interview date. If you hurry, you might be able to make your appointment for August.

For more info regarding the process in Colombia you can check out the Colombia Club thread.

K-1 Fiance(e) Visa Process & ProceduresVaccine costs, prior B2 Visa and I134 concerns
1. The vaccinations needed to get an immigrant visa at the US Embassy in Bogotá are: MMR, TD and varicella if the person has not had the disease, if your fiancée had varicella as a child she won't need it. Some doctors are saying the influenza vaccine is mandatory but this is only true if the exam is performed during flu season which goes from 10/01 - 03/31. She won't need any other vaccines.

2.a. The fact that she was denied a tourist visa in the past will not affect her K1 visa process.

2.b. This shouldn't affect the process either but she should tell the CO during the interview that your lawyer made a mistake by writing in the application that she had been in the US before.

3.a. Don't wait for the embassy to mail your fiancée anything because she may never get it. First, make sure the US Embassy has received her case from the NVC, send them an email with your BGT case number so they can locate it. If they have it they will email you the Instructions Package which is also found in their web site. Your fiancée will have to bring form I-134 and photocopies of your financial evidence with her to the interview.

3.b. As long as you meet the income requirements as per the USCIS Poverty Guidelines you should be fine, even if it's just one penny over.

4. If you CAN go to the interview I highly recommend it just in case the CO wants to talk to you or to have some peace of mind. However, you do not have to go and many people get approved without the petitioner being present. Just make sure your fiancée goes well prepared and has all kinds of evidence of your relationship with her during the inteview.

I highly recommend you check out the Colombia Club threads that are located in the Mexico, South & Latin America forum. You will find lots of answers to your questions and/or ask any additional questions you may have.

K-1 Fiance(e) Visa Process & ProceduresAddress that applicant can use

My fiance lives in Colombia and we are wondering if, for everything with regards to the K1 visa process (including her bio information, address to where the Colombian embassy will send her packet, etc.) she can use an address other than her own? She lives in a so-so neighborhood and also in a newer apartment and is worried the mailman simply won't find it, because this has happened before. She is thinking about using her college professor's address. I am sure she could just say it's her own and no one will notice as long as she sticks to that script, but we would much prefer to just admit (during her interview, etc) that we used a different address simply because we weren't sure the real address would serve well... Is that okay?

The Colombian mail system is so unreliable and "crappy", for lack of a better word, that the chances of her getting anything in the mail are pretty slim to none. Once you know that the NVC has sent her case to the US embassy, you can contact the embassy and give them your email address, as well as hers, so they can communicate with you electronically. As for the visa delivery, she can choose to pick it up at the DHL location of her choice, no need to have it delivered.

If you have any more questions regarding the process in Colombia, you can post them in the Colombia Club thread where you'll get more detail help from other members who have already gone or are currently going through the visa process.

She is from Colombia. From the research I did, they will not physically ship anything except for the final visa. This, of course, is the most important thing. She could request to pick it up in Bogota 5 days later, but she would rather not stay in Bogota for that long.

She can choose to pick up the visa at the DHL location in her city, that way she can go back home after the interview and then pick it up herself, plus it's free of charge.

How would I handle a change of address for my Fiancés Employer in Colombia. I wouldn't worry too much about that since the US embassy is more concerned about your fiancée's background information. If for some reason they do ask about it during the interview she can just tell them what happened. No big deal.

K-1 Fiance(e) Visa Process & ProceduresDo they always check father's DNA?
Whoever is named as the father on the birth certificate is legally the father of the child. If a travel permit is needed for the child to leave the country, the notary will verify that the person is indeed the person named as the father of the child. If he is the person listed on the birth certificate, they will notarize it and that is all that needs to be presented to the DAS the day of departure.

Whether if putting the name of a different man as the father on the birth certificate is ethical or not, that's up to the person doing it to decide. It's a completely different issue.

K-1 Fiance(e) Visa Process & ProceduresThe RFE Master List

My RFE was for Beneficiary's Birth Certificate with translation. Sent the evidence in along with the RFE form and my NOA2 arrived 15 days later! :)

So I take it it is recommended to send in Beneficiary's BC when sending in the I-129F? Can it be a copy of the BC with translation or do they ask for orginals?

In question #2 of part B of I-129F, my fiance missed to include my province name which is equivalent to state in the US. My address should be ___________, Cebu, Philippines but he forgot to include Cebu. The good thing I guess is that the entry in question # 15, Fiancee's address abroad is correct and complete so as with the one in my G-325A forms. We are like sad because we double checked and triple checked everything when he was here but never noticed it... We provide many primary and secondary evidences to establish that we met within 2 years prior to filing just to avoid RFE but now I am not sure already if we can't have one....

Is the missing part of my address is one of the reasons to get an RFE? or what are the other consequences that we will get?

Please help me :help: :help: ...I am a little bit bothered/worried with this even I am at work today.... Thank you in advance for the ideas.... :help:

I know that you are worried because you left out the province/state name on the I-129F. Obviously it is minor oversight. Its not like you are withholding that information for fraudulent or illegal purposes. So, the worst thing that can happen is that the send you an RFE requesting that the missing information be provided.

It appears very likely that an RFE will be sent, especially if the box was left blank. People who leave any section of their applications blank and do not enter "N/A" always get RFE'S. Unfortunately the USCIS is extremely strict when it comes to blank sections on the applications.

As long as you respond to the RFE right away when you get it , then the delay should not take more than 3 months max.

good luck
[size=2]

So on the G-325A I should file in every last blank with either none or n/a? Hence no former wives I put none and then when it asks for family name, birthdate (of this possible wife) I put n/a? Just want to double check as I will be sending this to my fiance to fill out, sign and send to me asap. Thanks!

K-1 Fiance(e) Visa Process & ProceduresTaking too long; Lawyer Recommendations

Thank you for your input. These two really are miserable...

Does anyone know if it would be faster for him to travel to the Philippines and apply through there? He recently heard that the process only takes 90 days.

If not, the 5 months will be coming up in a few days. If everything looks good, how much longer do you think it will take? It's really hard trying to coordinate travel, renting a condo, security and all for his stay over there.

Direct Consular Filling doesn't apply to Fiance I believe, only for Immediate family of a US Citizen, and he would have to live there at least for 6 months with resident card from the Philippines to be eligible. Someone correct me if I am wrong.

K-1 Fiance(e) Visa Process & Proceduresdual citizen trying to file for k-1

Thanks everyone but I think some didn't understand what I was trying to say. I AM AN AMERICAN CITIZEN. I was born and raised here. I was just asking because I was planning to put the stamps on my philippine passport in my 1-129 package along with the stamps on my US passport. And i don't have supporting documents to support my PHILIPPINE PASSPORT. I just have the Philippine passport itself for proof for my citizenship in the PHilippines. My US Citizenship if fine and I have all the supporting documents for that(ie passport and birth certificate). So I was just worried that they might ask me for supporting documents for my PHILIPPINE CITIZENSHIP. Also i asked this to see if being a dual citizen would make me do additional things that may prolong my filing. thanks

Why would they? the US doesn't recognized other citizenship, as long as you present proof of being a US Citizen thats all is needed for your application, your Philippines citizenship has nothing to do in this process. Remember when entering the US you will need your US Passport, not the one from the Philippines.

Having dual-citizenship wont affect your petitions, the USCIS doesn't ask in any of the forms to list other citizenship, only proof of being a USC and you good to go.

K-1 Fiance(e) Visa Process & ProceduresDual Interview!

in 2009 i went 4 times. i havent been back since the earthquake though! another member said they interviewed them 10hrs and they had to come back the next day and still got denied. i dont think they should be suspisious he has my name tatooed on his arm and i have his on my ring finger. i just want him here with me!

My friend has her fiance's face tattooed on her lower back and they got grilled at the interview, unfortunately tattoos aren't a evidence of legit relationship. The good think about your relationship is the fact that you've traveled 4 times to see him.

At our interview we only had to wait 4 hours, and the interview itself took only 15 minutes roughly.

Smh this is crazy! I guess we haved no choice. I brought my ticket but I just want him here with me! I miss him so much.

How often have you traveled to visit your fiance? interviewing for 10 hrs who told you that, you might have to wait for several hours but the interview shouldn't take no more than 3 hours excluding the waiting time and that if there's suspicion about your relationship. My friend was interviewed with her fiance separately, but it was one hour each not 10hrs.

K-1 Fiance(e) Visa Process & ProceduresGeneral K-1 questions... I'm new here.

Thanks for your reply. We have already filed the I-129F so I don't know if seeing an attorney would do too much good at this point. And I honestly cannot afford it. My fiancee MIGHT be able to, but I can't, as I am not yet working the full time job I am looking for...

Why didn't you stay in the US and get married and file for Adjustment of Status?. Would have been way cheaper, k1 is expensive and you wont be able to work upon entering the US for at least another 6 months.

I would highly recommend you to consult with an Immigration Attorney about your situation, you've lived within the US for a while so I'm not sure if that might raised some serious concerns on your k1 application.

K-1 Fiance(e) Visa Process & ProceduresA background issue - to postpone or not to postpone?
Was it an accident, what if it wasn't? a waiver of extreme hardship will be needed, this individual is inadmissible to the US. The US Consulate might look at the conviction differently.

K-1 Fiance(e) Visa Process & ProceduresTattoo Evidence?
Me and my wife doesn't have any tattoos of each other names on us, and we've been through this process fine, And I forbid myself from ever tattooed someone else faces or names on my body, In fact I have 0 tattoo.

I have a friend that got grilled big time at his K1 visa interview, his fiancee has his face tattooed on her lower back. didn't help any at the interview.
