I've added 'mellie' to the list, but the NOA1 date is missing ...

I also slotted us in too. We got our NOA/Biometrics letter today with my SRC #, so I registered online and found out my file was transferred from Texas to Vermont on March 20th, 2008. They're supposedly doing Feb 2007 cases now ... So now we sit and wait.

Looking forward to getting to know more of you over the next year or two!! laughing.gif

Ok, it's the Biometrics letter... 4/18/08 at 10am... however its at the opposite side of Houston... WHY? I have no idea - there are 2 offices within 30 mins of me (ok, one of those is the district office), but I'm assigned to the opposite side of town compared to where I live.

It's something I suppose.

Hi All,

Like jayde, this is the third thread I've joined because Texas has farmed out more of their files!

We got my NOA/Biometrics letter today so I can track my case online now. That's how I discovered we'd been sent leaf peeping ... TSC excuses this by claiming Vermont has juristiction over my case, but we only live about 30 miles from Mesquite, TX (where the TSC is). I guess I shouldn't be surprised - nothing about the USCIS ever seems to make any sense whatsoever. Perhaps that's why the fees all shot up so ridiculously high recently - they have to cover all the transport costs involved with trundling container loads full of our packages to and fro across the country. whistling.gif

Hi Mohamed,

What the others have told you is right - You do have a new 90 day period to get married after you arrive in the USA.

The USCIS also expects you to file your application for 'Adjustment Of Status' (AOS) within the same 90 day period, but you must have a copy of your new marriage certificate for the application package. So why not try to prepare the AOS package before the wedding so you are ready ... get married ... add some wedding pictures and a copy of your marriage certificate, send it off immediately (or after the honeymoon, if you have one). Then you can sit back and really relax for the first time in months! If the USCIS does not receive your AOS application within 90 days of your arrival, you are officially 'Out of Status' - who wants that?????

I know it all seems like a rush to get everything done now your visa has arrived ... But do try to send off the AOS application within the 90 days if you can. Some cities take many weeks to return a marriage certificate to couples after their wedding, but that's the only good reason I can think of for a late application.

One last thing - I notice you mentioned your wife and child ? If you are coming to the USA on a K-1 visa it is for fiances to enter the USA to get married ... it is not intended for husbands/wives to use .... It is much safer to call each other fiance, just in case it confuses the USCIS.

Hi there,

I have been told by more than one POE officer that once a visa application has gone in one is not supposed to return to the USA. However, in reality it seems to be in the lap of the gods and the whim of the particular US POE officer you deal with. I'm sorry to say I have read a few horror stories from Canadian VJ'ers in the past - driving across seems particularly unpredictable.

Before we applied for my K1 visa I had some grief trying to visit my USC from the UK, in fact I thought I was going to get turned around the last time I visited him. Needless to say I was very worried about trying to visit while the application was going through, but then I found such a cheap flight that I thought it was worth the risk (I'd get the airmiles whatever happened and I wanted to start doing some wedding planning!)

In the end I landed in Chicago and pitched up quivering at the POE desks wondering if it was going to be one ot the shortest transatlantic turnarounds on record. I struck lucky though - the USCIS guy was a sweetheart - I took him the truth about it being a wedding planning trip and he wished us both the best and good luck with the visa too ... He had jumped through all the very same immigration hoops for his Mongolian fiancee, now wife ... and somewhat ironically, all her citizenship application paperwork had gone missing in the system recently, so it shows that immigration workers aren't immune to delays and bugs in the system either!

Hi Lisa,

Welcome to the wonderful world of Visa Journey!

The simple answer is that you must have your K1 visa processed at a USCIS POE on or before the expiration date shown on your visa. Going to your native country en route should have no relevance. Actually - trying to be cynical and playing devil's advocate for a moment - it wouldn't entirely surprise me if the airport staff took a bit closer look at your paperwork and/or bags if your ticket shows that your journey started out in Asia rather than because you went home on the way to America. Of course that shouldn't happen, but it doesn't mean it won't.

Anyway, regarding leaving the USA again ... Your K1 visa is one time use only. Normally you have to wait until you receive your 'Green Card' before you can travel abroad and return to the USA (or its territories) freely.

If you have some kind of emergency you can apply to the USCIS for clearance to leave and re-enter the USA again. Don't risk leaving without that unless you want to go through all the hassle of having to re-apply for another visa! Having said that, there have been a few cases reported here of people who managed to get their K1 visa updated and re-issued. I wouldn't want to take a chance on that happening though.

If you're both single and have never been married, well - like Desert Fox - I can't imagine what you could provide in the way of proof of that 'condition', so I'm glad you don't have to do it! :blink: So you simply use all the single boxes. May I politely suggest that you may be stressing too much and too early - try not to 'over-think' about things like this, this early in the process - believe me, you'll find plenty of more complicated things to worry about later in your journey through the system! :D Actually I'm kidding. Most ordinary couples without any 'issues' of any kind discover that it's not a complicated exercise, you just need an eye for detail, the patience of a saint, and money - the wheels of immigration officialdom often grind infuriatingly slowly, expensively and unpredictably.

By the way, I don't know if you've noticed the Guides, Downloads and Example Forms sections of this site yet, but I can't emphasize enough how important and helpful they are when you're trying to work through everything. There are even completed versions of the various forms that show you exactly what should be put in each space. In fact you can overwrite your own details on most of the forms. Be sure to print out at least two or three copies of each page though, because if you try to save the your overwritten version, it defaults to the original answers when you open the file again.

I don't know what we would have done if we hadn't found VJ.com - all the information contained in the various reference sections really helped us work our way through the system without any hiccups along the way - if we didn't understand something we'd read in there, we just posted a quick question and someone was here to clarify the point for us immediately. We did try to make sure that one else had asked the same question twenty or more times before though ...

I hear what you're saying about the language concerns, and I wish you luck with your lawyer ... s/he may be the best idea for you both. However, if it's mainly just language issues that are worrying Anna. ... well, that's partly why I supplied a link to the relevant regional forum in my previous post. Particularly if Anna has internet access and joined VJ.com hreself too, I'm willing to bet that most, if not all of her concerns and questions could be answered there by other VJ'ers who have personal experience and knowledge to share. 'Larry and Maria''s response to you here is a prime example of the sort of helpful advice one usually gets - I suspect that you would both be able to get all the support and guidance both there, and here in the 'K1 General Discussion' forum too.

I do agree with Larry's suggestions, plus you could ask the bilingual lawyer to provide a one-off consultation before you make your final decision - if s/he is reputable, s/he should be prepared to advise you whether or not your case has any obvious problems/issues that would actually benefit from legal assistance.

IMHO, if you don't have any specific complications that might pose a problem with USCIS, it just seems a waste to pay for for a lawyer to send off the (pretty straightforward) forms for you. Don't forget that, even if you do use a lawyer to file for you, it's you and Anna that have to research all your own facts, figures, supporting evidence, etc and then sort it all out and supply it all to the lawyer, many of whom simply delegate all the paper shuffling - which is what this process is almost all about - straight to a clerk/'case worker' anyway, so ... :unsure:

Still ... it is, of course, up to you both to make this process as easy as you can on each other. So if the lawyer is right for you, well ... VJ.com members will still be here to help if needed! (F)

So here is my question, I think we can do this on our own as long as I triple check and double check things before I send them but I would like opinions from you all. Is a immagration lawyer the way to go? Also if we do make a mistake (doing it ourselves) is there any chance that she could be denied from ever comming to the USA? I realize these are very broad questions so any suggestions or observations would be appreciated.

One more thing, I am under the impression that the paper work and visa processing is mostly on the USA side what does someone who is immagrating from Russia to the USA have to do with regards to the Russian government?

The lawyer issue is a difficult question to answer - actually most of the perfectly reasonable questions you asked are hard to answer definitively! :blink:

You'll probably have already noticed that most people here don't use an immigration lawyer to file their paperwork for them, unless - as Chuckles mentioned - they've got some kind of complicated situation, (perhaps certain criminal histories, medical issues, or a previous long overstay in the USA, for example.) Again, as Chuckles said, they can't make a simple case move any faster, in fact they sometimes seem to slow things down and screw things up! However, if it makes you more comfortable to use one, it's vital to keep looking until you find the right one with expertise and experience in immigration issues ... By the way - don't just pick someone advertising at the top of this site - Google adds the ads and they're not recommendations from VJ.com!

I think it's pretty unlikely that a simple mistake would ruin any chances, but then again, anything's possible, depending what the issue was, of course. The most important thing is to check and double check everything you do. It's a really good idea to compare what you're doing with all the examples and guides located thorought this site and then ask if there's something you're still worried about.

Regarding information about Russian issues ... I suspect you might find lots of help in the Regional Forum for Ukraine and Russia.

Well, in theory it's more or less right, but conflicting advice. The getting married and filing after entering using the VWP does seem to be a risky option to take. The lawyer did at least stress that you shouldn't lie at the POE ... But in your case lies would unavoidable if your boyfriend did enter the USA on the VWP, marry you and then file for AOS ... It's standard for POE officers to ask why people are coming to the USA, and I reckon that it would be tough to convince whoever was reviewing your AOS case later on that there was no intention to marry, particularly under the circumstances - you are together in the UK right now (possibly even living together) and you'll have arrived in the States together, his ticket's for three months, and so on. They'll keep digging away until they're satisfied one way or the other ... Your choice, of course.

One other thing - I assume your boyfriend's return flight is actually booked for three months time? I used to book mine for a few weeks and then change the return date to a much later date once I was safely in the US. Of course you do have to make sure you book a ticket that allows at least one change (and be able to pay the change fee), but it was so worth it to avoid too much hassle at the POE. Have you checked the detailed rules of his ticket? Would it allow 2 changes - one before entering the US and one after?? Something to think about anyway. ;)

Yes, you can indeed file for a Fiance Petition while he's with you in the USA. It would certainly tend to speed things up a bit. But he would have to go back home and deal with his part of the process. We've all been there and it's not nice being separated but it's doable. You'll get lots of support here if you do things the right way...

I don't see any problem with him coming over for the summer. I believe he can stay here for 6 months on his passport (no he can't work).

If he leaves the country and comes back, the time will start over.

My husband and I did the same thing. I lived in England last summer (I'm a teacher) so we could be together for a longer period of time. It was great to have that time together and for me to be able to live over there.

I would say if you can do it financially, then go for it!

Sweet Defiance-Your fiance has to leave the country by 6 months. He cannot over extend his visit. If they find out, he will be forced to leave and that could jeopardize the process.

I don't know if it's different coming over to the US (than it is going to England), but I never had any trouble coming back and forth. They asked how long I'd be staying, and I told them 3 months. They asked why and I explained that we are engaged and I have the summers off due to being a teacher. No more questions were asked.

I think your fiance can just explain that he has a few months off work and is coming to spend time with you.


I'm afraid the OP is right - the UK>USA VWP is only good for 90 days, of course the USC can visit the UK for 120 days if they want to ... needless to say it's not fair, but that's just the way it is. Plus it's important to note that one can't spend more than 6 months out of any 12 in the US unless one wants potential problems with appearancing to be resident.

I would suggest you think about booking for a shorter visit and then changing the ticket once the fiancee's got into the US. I did that quite a few times actually - being self employed I could stay for longer than the average. I did get some grief from the POE staff the last time, but I still got in OK.

Just a new angle to consider...

Here's a little information that I got, because I was in the situation about a month ago.

Now, the USCIS told me that because her pregnancy was labeled as an extremely high risk, that I would more than likely qualify for expedited services under the "Extreme emergent situation" section of the expedited guidelines. I was told to have her get a signed letter from her Dr. explaining the circumstances of her pregnancy. I was to send this in with my I-129F.

Unfortunetly, a week later (April 15th) my Fiance lost the baby due to complications previously stated by her Dr.

I had hoped to do the seed thing too, but ran out of time for it and many other things! Anyway, I was going to get Forget Me Not seeds. Very traditional 'English country garden' style flower and I think the name's very appropriate for a wedding - it's supposed to signify true, unforgettable love. Just in case that idea appeals, there are various sources in the States for customised packets of seed to use as favours - I Googled today and found some sites offering different seeds and style of packaging, and the prices and minimum order requirements varied widely.... You could do worse than to check out This Favour Supplier called 'Forever&Always'. I haven't used them, but I really like their stuff. If Forget Me Nots don't appeal they also do other seeds too. They customise the packets, the price isn't too bad and I notice they can do rush orders as well ... If only I'd found them last year ... :wacko:

Looking at all this sort of stuff kind of makes me wish I could get married again - to the same guy, of course!! :luv: Hmm, repeating vows annually, perhaps!??! :lol:

Actually the priced dropped when they changed things by £20.00!!!! LOL Medical is now done by knightsbridge drs who have 2 surgeries in London. It is still possible to do medical and interview on the same day but it would take some arranging and you wouldnt be able to get your visa immediately as they would have to wait for the medical results which take about 4 day. :)

Of course it would be even better if 'they' found a surgery that was able to process the medical in a matter of hours like the old place (pre-April '05) used to do. Being able to combine the medical and interview in one day makes so much more sense. It wasn't a huge issue for me because I lived fairly close to London, but I would still have preferred not to have had to make two trips ... Still, 'That's progress', I guess. :whistle:

As elwintro mentioned, until early 2005 the UK process was much more efficient. Medicals were done at a surgery near the London Embassy on the morning of your interview, and then you would wait for the results and carry them yourself to the Embassy for your interview appointment. Now you do have to organise two separate appointments and waste two days and many have to spend lots of extra money to travel there and back unnecessarily. It sucks, doesn't it! Oh, and needless to say, the price went up when they changed things too. :angry:

I've flown to and from the UK (between both Gatwick, Heathrow and DFW) via American Airlines three times since getting my 2 year green card using a ticket in my married name and a passport in my maiden name.

I changed the name on my AAdvantage mileage account just after getting married. When I booked my first trip back to the UK a few months later I called AA and asked which name to book in, bearing in mind my AA account and green card are in my married name but my passport was (and still is) in my maiden name. The rep said using either name was OK, but it would be better to use the name that matched my AA account and also the green card. As long as I had the original marriage certificate with me on the trip it would be fine. So (admittedly with some trepidation) I decided to book in my married name - I wanted to be sure I would be able to get back into the US without difficulty since my ticket would match my green card.

So - as you know - when checking in these days there's a pre-check in security check desk in front of each airline's own check in desks ... At the pre-check in desk at DFW, the security staff simply compared the names on my marriage certificate with those on the ticket, passport and green card to confirm I was (and still am, I hope) the same person, added a note on the computer system to that effect and on I went. (In fact I have been a useful training exercise at DFW and Gatwick because a couple times newbie checkers have been shown how to handle my situation!) The actual airline check in processing has been quick because the information is all there in the system already.

I'm pleased to say that check in has been this easy every time, both in the US and the UK.

The last time I did this was in late January this year - after the US passport rule changes came in and just over two years after we got married. Passing through US immigration, all they ever wanted to see each time was my green card.

In case you're wondering why I'm still doing this two years later ... My old UK passport ran out just a few weeks before I moved to the US, so of course I had to buy a new one and it's valid for 5 years. If it was free, or cheap to change a name, that would be different, but a simple name change costs just the same as a full renewal, and I'm stingy and just not prepared to fork out yet more money unnecessarily, so I'll keep on doing what I've done for another couple of years or so, unless either the USA or UK change their travel laws again in the meantime.

The above is a description of my experiences when flying with American Airlines to/from either Gatwick/Heathrow - DFW only. You should probably call the relevant airline yourself and then make a decision for yourself!

I agree that there is little good to be said about the US medical system. Hubby and I are enrolled in his company's health scheme, but it costs us a fortune every month and it still scares me if anything should go wrong with our health. I'm very tempted to try to get back to the UK if I ever fall ill.

Irony does seem to be such a very British thing doesn't it? After two and a bit years here my new friends/family here still start chuckling or look totally blank/mystified sometimes when some new Anglo-ism slips out or I'm being ironic. It's a shame that people here don't automatically 'get' everything we Brits say. But then again I still don't 'get' everything I hear ... here either, and it does make for some entertaining conversations. Where I live, British accents are pretty rare, so that in itself intrigues practically everyone I meet.

Luckily my darling (Texan born) hubby is nearly fluent in Anglo and Irony now. biggrin.gif luv.gif In fact he's accidentally (or sometimes on purpose) said a variety of different English-isms at work and naturally they tend to amuse/bemuse/confuse his colleagues! good.gif

Just so you know, if you fly with American Airlines to/from London, you can use your old passport in your maiden name if you want. The key thing is to take your original marriage certificate (or an official copy) and hand it over along with your ticket and passport at every inspection point.

I had to buy a new passport a couple of months before I left for the States in 2005 so now I have one in my maiden name that is valid until 2015 ... I changed my name on my AA mileage account soon after getting married, but I'm a cheapskate so I decided to try to hang on to my new old passport for as long as possible.

I've booked and flown on American three times since marrying - each time using a ticket booked in my married name. At DFW, Gatwick and Heathrow airports, the initial pre-check-in security processing took a couple of minutes longer than normal while the security staff checked the green card, the ticket and the passport against the marriage certificate to confirm both my names were there and I was me ... and added a note into the computer system. (I've been a useful training exercise a couple of times while junior checkers were shown what to do with me and my paperwork!) After that, the actual check in itself has been totally normal because all the details were already in the system.

I flew to London and back with AA this January, again using my married name with no problems, even though the US has changed its passport/ID rules.

Obviously I can't comment on what all the other airlines do ... And your experience and mileage may of course vary ...

However, as long as the US or UK don't change the rules again, and while AA sticks with its common sense approach to this issue (and I stick with them for the airmiles) ... I've got no intention of forking out such a ludicrous amount of money for no good reason.

Also, I was planning to visit him in the UK this summer anyway. Would it be at all useful for me to be present for his interview? Would they even want me there?

Anyway ... I was going to add that you (the USC) certainly can go along to the interview in London if you want to (as long as you take your passport with you for ID) and I know a lot of couples do attend together. However, there is no requirement for the USC to be there in London, unlike some more problematic countries. I suppose, if there are any special or peculiar circumstances involved in someone's case, it might be worth the show of strength. Anyway, we decided in the end that Kyle (the USC) wouldn't fly over and it proved not to be an issue at all.

Hope this all helps and good luck to your guy when he goes ... not that he'll need it, I'm sure. :)

Hi there,

I had to wait for about 3 hours in total and then was only asked about 5 or 6 very simple questions which really just seemed to be filling the time the guy (who seemed a bit grumpy) needed to stamp and scribble on various bits of paperwork before declaring me approved for the visa.

So - just in case anyone does a search for 'London interview questions' sometime in the future and finds this thread - I'm sure you realize that the list the wonderful jasman has reproduced is a collection of typical questions from loads of different interviews, not all are asked at each interview! Mind you, if one was trying to pull anything dodgy ... well, who knows! :lol:

As many have mentioned before, one's nerves before the London interview usually seem to be much worse than the actual interview itself - almost everyone reports a pretty painless experience, if you discount the waiting room itself. (I would highly recommend taking reading material and some food/drink as well.)

Removing Conditions on Residency General DiscussionTravelling with 2 year Green Card

When I travelled with my Advance Parole it was in my married name. My Passport and tickets were in my old name. I didnt have any trouble with the airline and I am using the same one again. They looked at my AP quite casually on leaving the UK. I guess at the POE they can look on the computer anyway and check your status, I am sure previous name details are shown there.

I am worried about letting my Passport out of my hands for renewal incase I have to travel in an emergency (I have an elderly mother).

Also does it matter that the new one wouldnt show my dates of entry to the US etc and my K1 visa?


it shouldn't matter at all - your K1 is irrelevant now that you're married anyway. When re-entering the US, the POE staff are more interested in your AP or Green Card, and you're right, they have got the records available if they want to check. Travelling through non-US airports, the security staff are checking the passport is yours and is still valid for travel. If in doubt however, take your old passport and marriage certificate along for the ride too! :)

I should have mentioned though ...

If you decide not to change your passport, I suggest that there are two critical things you do need to do as soon as you can, and prior to booking anything -

1: Call your preferred airline/s and check their policies regarding these issues - if they'll let you on their planes you're all set because USCIS don't care about any of that as long as you have your valid Green Card when you present yourself at the US POE on the way back.

2: Take your original marriage certificate with you on the trip for the airline check in process (assuming that it does actually show both your married and single names of course!)


Anyone else from the UK have any personal experience regarding the passport amendment thing?
