Thanks everyone! visa was finally issued today! one month minus a day from the interview, 8 months plus a day from NOA1, 6 months minus 6 days since NOA2, and almost one whole year since initial work on the paperwork for USCIS has begun. Time to celebrate dancin5hr.gif

Finally! Almost 4 weeks after I gave them the doc they requested after the interview, I got an email today asking me to send in my passport. Hoping to have visa in hand in a couple of weeks...

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsHad interview today

so, the interview went ok today...the consular officer said overall my case is pretty good...except for something he had a problem with(uh oh). The interview was maybe 10 mins or less...of them 5 minutes were spent trying to figure out why my old passport did not have a stamp that I came into the country after leaving the states in 08/08. He kept flipping through the pages back and forth seeming unpleased but not letting me know what he was looking for for the first 3 minutes, and I'm thinkin to myself what the hell is the problem...well when I came in, I used a hand print card we have here which then you don't have to wait in line and use a passport, who would have thought he'd want to see that stamp(what does he think I did, swim all the way from the states to Israel? lol)

So he gave me back my originals which is a good sign, but told me I needed to provide a document from the ministry of interior with my exits and returns to see I actually returned to Israel on that date. Now I have to wait for them to process that stupid paper, but hopefully soon I can finally hand in my passport.

So, if anyone else ever got in using a hand print and not a passport, get your paper from the appropriate ministry ahead of time!(if you wrote dates in which you've been in the states before on the forms)

Finally going to pick it up from the courier today!

It is not officially in any kind of administrative processing or review. DOS representatives as well as website(CEAC) keeps showing as 'issued' as of june 5th. But they are saying they are completing the visa file. Must be one heck of a file.

BTW, I'm the beneficiary. My wife doesn't bother with forums smile.png

Darnell I've been doing that almost daily for the last couple weeks...DOS tells me they can only oversee what the consulate puts in the system and they could see it was issued june 5th and that for anything else I need to contact the consulate, they can also see all my emails to and from the consulate. Why it is taking so long no one knows. All the consulate will say is it is in final processing and that it often takes up to two weeks but in some cases longer. Why longer? how much longer? no word about that. They keep repeating the same thing about it taking two weeks even though it's already been 3.

Well, congressional inquiries won't help either, they got the exact same response we get...what a joke...day 21.

Day 19 - my wife(the USC) contacted her congressman's office today, hopefully it does more good than harm - don't want to annoy the consulate, but this is getting ridiculous.

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsVisa issued June 5th, no passport yet

Darnell, I removed that. I accidentally put that there cause that's when it was "issued".

Anyway, 18 days since then and still no passport.

This is all they would tell me:

"Dear Sir,

Your visa has been authorized and we are in the process of finalizing your immigrant visa file. Once final processing of your case has been completed, we will send you your passport and immigrant visa packet via courier service you have selected. Please be aware that final processing of immigrant visas often takes up to two weeks and in some cases can take even longer.

Unfortunately we cannot predict how long this process might take, therefore; we advise all applicants not to make any travel arrangements before receiving their visas.

Your patience is highly appreciated."

This is really annoying. I swear even waiting for USCIS or NVC wasn't as annoying. What is there still to process if the visa has been issued? And why would it take so long?

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsVisa issued June 5th, no passport yet

Hey guys, on the CEAC website I could see my visa was issued June 5th(IR1), however there is no waybill number available yet. How long does this usually take? I was told they are processing the immigration papers, whatever that means(probably the packet but I mean how complicated can that be?), normally this should only take 1-2 weeks right?

Just because you may think it's important, doesn't mean everyone does. And apparently it's not important to USCIS.

Well I know. It's just what threw me a little off is all I'm saying...

Only those aged 11-18.

Ok thanks. That's what I read but wasn't sure I'm getting it right cause really, I don't understand the logic behind it. Hepatitis B(which I already have) also stated only 18 and under. Why wouldn't they require it if you're over 18? It's important no matter what age you are.

I cut that out because I already know it. Where my confusion was was petitioner documents, and bona fide documents. Some places said to send originals of EVERYTHING you sent to USCIS before, meaning those too. From what I understand, it is not needed. All that is needed is the beneficiary originals+photocopies, and the AOS stuff.
OriZMaleIsrael2013-01-09 09:32:00
IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsNVC Filers - January 2013

Yes, now you have to send the originals/certified copies. They'll then get sent to the embassy after your interview is scheduled along with the other forms and documents. At the interview, they'll return them to you, as long as you provided copies for them to keep for their own records

Sending originals of what went to USCIS, into NVC, is not needed.
Petitioner's documents sent in to USCIS with I-130 submittal - photocopies were sufficient, but IV unit wants to see originals on interview day - no need to send in Petitioner's Documents at the NVC stage.

See what I mean about confusing lol. I'll just wait for the interview, for now I'll only send what NVC specifically requires...if they want to send a checklist, they can go ahead...
OriZMaleIsrael2013-01-09 02:46:00
IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsNVC Filers - January 2013

Originals/certified copies (as well as regular photocopies so the originals/certified copies can be returned to you at the interview) are included in the IV package. None of the petitioner's documents are needed, just the beneficiary's (unless it's an IR-5 case).

So all of the documents that were only sent as photocopies before, they are not interested in seeing the originals? We'll bring it to the interview just in case, but good to know it's not needed at NVC...I just remember reading about it somewhere.

Sending relationship evidence is optional. Typically only those in high-fraud countries (like Nigeria and China) do this as they have more obstacles to over come to prove their relationship.

Yeah, not gonna bother. Will take it to interview though.

Yes, although it may seem weird to put 0 in for c, that's how you do it as the immigrant is already accounted for. Keep in mind, the I-864 is used in other cases, not just a spouse sponsoring their spouse.

Yeah I know this...it's just still kind of odd though so had to make sure :)

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsNVC Filers - January 2013
Thanks for the help guys, much appreciated. Now I can relax and know I have things right

One more thing though...when sending the IV package, do I just include in it what's written in all the cover letter samples? IE
Bar-coded Cover Sheet.
2 Passport-sized photographs.
Completed and signed form DS-230, part I.
Completed and unsigned form DS-230, Part II.
Photocopy of the Biographic data page of the beneficiary's passport.
Certified Birth Certificate of the beneficiary.
Certified Marriage Certificate of the beneficiary and the petitioner.
Original police certificates of the beneficiary
Original military certificate of the beneficiary

I read in some places that you also need to send all originals of what you've sent before to USCIS. If so then in what package? And does that include just, say, the petitioner's birth certificate or divorce papers, or does it also include all the bona fide evidence?

And one very last little thing...Where it says in the AOS not to count anyone twice, does that mean that if my wife puts me first as the sponsored immigrant(21a), she(well actually me being she gets to just sign it) needs to put down 0 at 21c? Cause that's weird, but that's what makes the most sense. It's like I'm married but I'm not married lol

Alright well I just got off the phone with NVC, they said that the husband of the joint sponsor would need to fill and sign form I-864A(as a household member), but we would only need the one set of transcripts from the joint sponsor, being it has all the information cause they file jointly. Also, for the current individual annual income line we use 2012 income. Just need to verify that they gave me all the correct information as far as everyone else here knows...anyone?

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsNVC Filers - January 2013
Alright, change of plans(you know how this goes...)...We are going to use both incomes of the joint sponsor and her husband, which file jointly. Does that mean that now he will also have to fill and sign an i-864? And if so, what do they check in part 1(only joint sponsor etc).
OriZMaleIsrael2013-01-08 01:31:00
IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsNVC Filers - January 2013
yeah I know thanks :) Now if I understand correctly the income to write on the i-867 is the TOTAL INCOME, right?

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsNVC Filers - January 2013

You only need your sponsor's spouse to fill out an I-864a if the spouse's money will be used as well. Sounds like, in your case, it wont be used so only have your sponsor fill out an I-864. I asked this very question to NVC.

As far as forms from the IRS, your best bet is to call the IRS and order your tax transcripts. You can go as far back as 10 years, I believe, and they are free and show up at your mailbox in less than 10 days. These TRANSCRIPTS are all you need. If you don't send in TRANSCRIPTS then you have to send it allllllllllll that other stuff that Saylin posted above.

Alright thanks very much for your reply. We will probably just order the transcripts. Now just to get the damn case number :bonk:

Thanks that brings me to my next question...our joint sponsor does file jointly with her husband however his income is not needed(she makes more than enough)...can we just use her as a sponsor or does he HAVE to also fill and sign an I-864?

I forgot to mention they use Turbotax...would it be ok to just print it out of there?

If you don't send tax transcripts (which are preferred by NVC), then you need to send copies of EVERYTHING: 1040, W2s, 1099s, all schedules, etc.

Hey guys, this might seem like a stupid question but I keep reading different things about it so it's gotten quite confusing at this point...for the AOS when sending photocopies and not transcripts, what forms are actually needed? W2, 1099, 1040, ...?

I have absolutely no idea...but do let me know what they tell you. Looking at that site, the NBC does NOT seem to even process these types of petitions, but maybe they'll change that now too. I looked at Houston and it would be 3 months...but then again, who knows how many more petitions they'll be getting now, and how many people they add to process them if any at all.

Sure, as of August there were 2,974 cases pending...with an avg completion rate of like 550 a month(I'm rounding it a bit)...that means almost 5 and a half months...

Even though the last month updated is August(so we don't know yet what it's like after they get the Sept-Oct filers volume), but just to get a general idea about field offices...when you go to National Processing Volumes and Trends(on the case status page) you can pick a field office, and it shows you the cases pending and the completions. If you do an average of the completions say in last few months, you could sort of guess how long it would take to do your case. For example, my wife is a Wisconsinite(although right now we're both living abroad - but no one knows if it gets sent to the field office in the place of residency even if you currently do not reside there or where else it goes), so in the Milwaukee Field Office it shows currently 325 cases pending. Completions average like around say 80....that means about 4 months. Again, it's very vague, but it's at least something.

What nazet has posted and some others is making me ask this next question - could it be that sometimes people get a notice that it was accepted, but it does not include in the same notice that it was transferred?

For instance, this is the email I got:

Your case has been accepted and routed to the USCIS National Benefits Center for processing. Within 7-10 days by standard mail you will receive your official Receipt Notice (Form I-797) with your Receipt Number XXXXXXXXXXXXX. With the official Receipt Notice (Form I-797) you may visit www.uscis.gov where you can check the status of your case using My Case Status. We suggest you wait until you have received your Form I-797 before checking My Case Status.

Ok so there it says in the same sentence "accepted and routed"...whereas for others it seems to go in many different ways. Anyone have enough experience with this? Who got the same message I did? Also, I've read that some of you have said that the My Case Status doesn't work for you, and some have said that it doesn't always work for everyone. Well, I guess I'm one of the unlucky ones cause it doesn't seem to work for me.

I'm going to have my wife call today(I'll do the dialing she can do the talking being they insist on talking to the petitioner) and find out if we were transferred to a local office.

Called...still in NBC, still in process, is all they said...

Here's what I posted on another thread.

Ok so yesterday I call USCIS from work, to try and figure out why two weeks after my NOA1 I STILL(and many other people with MSC numbers as well) can't see my case status. Well, they ask me if I'm the petitioner or beneficiary, I tell them I'm the beneficiary, they ask if the petitioner is with me, I'm like nope she's at home...so they're like well you need to tell the petitioner to contact us...I guess even for such a simple question they cannot provide an answer unless you're the petitioner.

So I get home, and ask my wife to call...They ask her a few questions(which I could have answered as well), and they can't find the number in their system either. Then they transfer her to someone else who asks some more questions, who CAN find the file. Bottom line they said they are having technical problems with the computer system(I guess it's just as bad as taking a month to fix a printer) with adding new receipt numbers in and they are working on it. They also told her that it's being processed and that processing time is 5-6 months, although they would probably say that whether it was 3 months or 9 months.

That's all I know folks.
