Yes, this is right. As of July 30th the fee for filing an I-129f (if filing it for a K-3 visa) is waived! Of course if you're filing for the K-1 the filing fee went sky high. I guess they had to find a balance in the money somewhere. I sent my I-129f after the 30th without any payment and a printed copy of the website page (on USCIS.gov) that stated this fact of the fee waiver along with the immigration officer's name whom I spoke with to confirm this information. Everything turned out fine. I received my receipt notice with no problems. It seems you got lucky though. Anything postmarked before the 30th should have had the fee applied. If both your petitions have case numbers that begin with the same three letters, they are together at the same service center, being processed together. They'll be subject to the same policy that has been in effect 11 months.

First I want to apologize if this is a question that has been previously answered. Really I've tried to find these things out on my own and haven't had any luck.

So, I've filed for the K-3 visa and now regret it. I see now that I should've filed the I-130 alone and just gone for the immigrant visa. At the time of filing it looked as though the K-3 would be much faster. Now it seems that the I-130's and I-129F's are being approved at about the same time and the adjustment of status (if entering U.S. on K-3) is now $1,000! It may have been a lack of research on my part, but I don't believe that was the case when I filed (please see timeline on my profile). Also, we'd like to BOTH work as soon as we arrive, not wait 3 months for him to receive his work authorization. My husband and I decided to remain together throughout this process so we are here in Italy awaiting answers on all of this.

My first question is this, is there any way to know if they are processing the two applications separately? I ask this because on my estimated time of approval through visajourney it has my I-130 being approved BEFORE my i-129F. Could that really happen? I thought they were linked? That would be GREAT if it could happen. If not, is there anyway to still go for the I-130 only? One scenario I've worked out is this...we get the K-3 approved, go to America so I can start to work so we can at least gain some money, then wait for the I-130 visa to be approved and then return to Italy for the interview. I know you're thinking that if I can afford to come back to Italy why not just pay for the adjustment of status since it will probably be cheaper? I'm in a position to fly for free so the $1,000 for adjusting status I really just don't want to spend. We are willing to do all this going back and forth because, basically, we are very anxious to start our life. You know, be where we know we want to be and start working toward a family.

My second question is (well this might be my 5th or 6th but who's counting) about 3 months before the estimated time of approval, can we go back to America with him coming in under the visa waiver program? I understand that this program is strictly for tourists. That being said, could we do it then just return to Italy when (hopefully) the interview will be ready to attend? I know that's not the way it's SUPPOSED to work, but can it be done, is what I'm asking.

I sent my I-130 July 3 and got my NOA July 13. I then sent my I-129F August 9 (to the wrong location) and got my 2nd NOA September 3. I had accidentally sent it to the Chicago lock-box where you USED to send them. That changed on July 30 with so many other things. As I'm sure you know, you now send it to where your I-130 is pending. I was lucky enough to have the people in Chicago forward my I-129F packet to the correct location.

I'm sorry to hear of your delay. Things are running smooth for me and my husband, comparatively speaking, but I'm still poised to explode at any moment. I keep thinking, we are all just human beings! Why can't we roam the world and live where we please. As we all know, it's not so simple.

yeah, my husband and I are in this boat. Our i-130's no1 date is july 13, 2007 and we've got no touches, not anything. We had our i-129f "admistratively cancelled" via my senator's office. He advised this as he thought it might speed up the process of the i-130. It didn't. Strange thing is though that I'm reading that other people are having their i-129f's also "administratively cancelled" by the USCIS automatically because it's become redundant. They are both getting approved around the same time so the initial purpose of filing for the K-3 (getting your spouse to the U.S. quicker) doesn't really apply any longer. I'm sure all of us who are caught up in this mess are paying for it with days (who am I kidding) MONTHS in waiting to start the lives we all deserve with our loved ones. I am actually in Italy with my husband which is a wonderful thing. It's that our life is on hold because we can't find work here and are moving every few months as we find cheeper rentals. Not the way I want to live but I don't want to return to America without him although if it takes much longer, I'll be forced to so I can find a job and replenish our finances. What a strain on the relationship. I just want a nice job, a decent home, and enough in the bank to start a family. Why would my own country make this so hard for me? Why is it that if you fall in love with someone from another country they make you pay such a price?

i filed my I-130 July 13, 2007 and my I-129F August 22, 2007 and both got approved the same day which was just this week on March 11, 2008. It was a real kick in the pants since I sent a letter of withdrawal to the California Service Center on March 10, 2008. I'm convinced that when they heard from Rome (where we refiled the I-130 on March 10, 2008) that we were refiling, they approved us the next day just to mess with us. I really feel for everyone who is going through this immigration process but my heart really goes out to those who have been waiting for 6 months or more. I'm so sorry.

nothing here either. Recived date is July 13. We are actually sending off a withdrawal of our petitions so we can refile here in Rome directly, now that we're able. It's so frustrating seeing August and even September filers getting approved and from the same service center where mine is apperently sitting there collecting dust. I'm happy for the applicants, I just don't see the reasoning. What happened to the "petitions are processed in the order they are recieved" #######. I know that every case is different but I don't see why our case in particular is taking so long. My husband is an outstanding citizen of Italy. He's a university graduate, he's never been arrested, he's never even had a parking ticket for christ's sake! I just don't see what they could see on our petition that would make them think, "hmmm, this one's suspicious". So anyway, we're pulling out, like I said. We've got an appointment in Rome to file the I-130 and we're just going for the CR-1. That's another thing, my Senator's office called the CSC on 12/14/07 to "administratively cancel" our I-129F because we decided we wanted to forego the K-3 in favor of the CR-1. They gave my I-130 case a new "updated date" on the website and so I assumed that they actually did what they said they did. I found out yesterday that there was no such cancellation made and that they basically gave my Senator's office lip service. What a joke.

My I-130 and I-129F were both approved on March 11, 2008. I won't be following up on them to see which gets sent to the NVC because March 10, 2008 I sent a letter of withdrawal to the CSC as you can see below. I just wanted to let you know that mine was not "administratively cancelled" (even though my Senator's office requested it in December, but that's not the point).

a reentry permit is not what I'd mentioned but rather a returning resident visa. Which we are, in fact, able to do. I am thinking now that just starting over might be trhw best option anyway. We have completely legitamit reasons for being outside the U.S. for this long so filing for the returning resident visa is totally possible. But I'm with you. I don't know if it'd just be easier to refile everything. I can, in fact, do a direct consular filing here in Rome as I have the Italian equivilant of a greencard. They issue it for life and they don't care if I live outside of Italy for 10 years. Pretty cool, I think. Anyway, I'm afraid that if we file for the reentry permit, it won't be approved in time to file to have the conditions lifted and we run the risk of having to start all over anyway. I think, in the long run, it may be easier and less expensive to just start all over. We did a direct consular filing initially and it was a breeze (after having to cancel our filing with the california service center because it was taking FOREVER). It's just such a pain to go through all the vaccine and tax ####### again. AHHH!

Hello Everyone,

My situation is this: My husband (Italian) and I (American) left the U.S. in October of 2008 without filing for a reentry permit. Time did not allow it as we were coming for his grandfather's death. He was diagnosed with terminal lung cancer and was told he only had a short time to live. We didn't expect that we'd need the permit since our visit would surely not be over 6 months, let alone a year. Well grandpa held on until June and then passed away. Timewise, we still could've returned to America without having the reentry permit but we found ourselves in another situation. I was 8 months pregnant. My doctor recommended that I not fly considering my advanced stage of pregnancy. I've since given birth, of course, but we still could not leave by our October deadline. My baby is only 3 months old and we're still getting her vaccines done and have yet to reach the consulate here in Italy to file for her American birth certificate and passport which we'll need to make the trip. We want to wait until her little immune system is stronger before we take her to a big city like Rome to file for these things. I know that to return to America we'll have to file a I-751 returning resident visa but I wanted to know if I should file to have the conditions of my husbands greencard lifted first. The 2 year anniversary date for his greencard is April 10th. We fear that if we file for the returning resident visa now, we many not get the approval until after April which means that we'd be late in filing to lift the conditions. If we're able to lift the conditions BEFORE filing for the I-751, that would be ideal.

My question is, can we file an I-751 from another country? We are not here for military reasons, as I've stated, but we do have a premanant residence in America. I've not read anything that says you CAN'T do this, in fact, I haven't found any information on this situation at all. Hence my presence here.

My reciept date for my I-130 NOA1 is July 12th and I have not yet been approved. We were going for the K3 but have since had our Senator's office "admistratively" cancel the I-129F. We decided it was best for our situation to just go with the CR-1. Looking back, maybe we should've just left everything alone and just waited it out because now I can't help thinking that this action has caused some sort of delay. I'm told by an immigration officer at USCIS that I can call back January 12th and they'll put in a request for information to the California Service Center to see what the hold up is. The problem is that they have 30 days to answer. So there goes another month. My situation is a bit different than most though, I am here in Italy WITH my husband. It's a great place to be "stuck" while awaiting our return, but I'm ready to get on with life, settle in, start a family, all the things we are all waiting for. Check out my time line. I haven't figured out how to but it at the bottome of my post, but it's all updated.

So I was approved yesterday at the CSC. Apparently my request for withdrawal letter hasn't arrived there yet. I knew this was going to happen. As soon as we sent that letter we thought wouldn't it be nuts if now we're approved? And look at this. I really hope we haven't screwed things up for ourselves. The embassy here told us it could take as little 2 monts to get through the entire process of Direct Consular Filing and from the looks of the timeline from NOA2 to NVC complete, I think it still wouldn't taken longer through them. God I hope I'm right!

Write to the service center's address on your filing receipt. Send certified mail, return receipt requested.
