no is no, you didn't even qualify to have to claim your offense. however, during background check if they find conviction they may ask for more information, police and court documents. have these ready and be prepared to send them in. also prepare any rehab or other methods of correction. If they ask for these and you prepare now, it should not delay your case much. If they are what you say they are, in my opinion, you should be ok. was it felony or misdemeanor? Do you even see your record on your own credit report?

To add more to my original posting. I am a U.S. Citizen who has the criminal background. I filed the K-1 visa petition last month for my fiancee, who does not have a criminal record. In the i-129f form Part. C question 2 it asks: HAVE YOU EVER BEEN CONVICTED BY A COURT OF LAW (CIVIL OR CRIMINAL) OR COURT MARTIAL BY A MILITARY TRIBUNAL FOR ANY OF THE FOLLOWING CRIMES:

-THREE OR MORE CONVICTIONS FOR CRIMES RELATING TO A CONTROLLED SUBSTANCE OR ALCOHOL NOT ARISING FROM A SINGLE ACT.


I checked off no since I have two convictions relating to controlled substances. I recently checked on the petition status and it said they are in the process of doing background checks. This worries me. I have NEVER been arrested/convicted for anything like domestic violence or any of the other listed crimes (which I STRONGLY feel disgust toward) like sexual assault, battery, domestic violence, molestation, etc. My two convictions were strictly all drug related. I am starting to question if I should of sent in my police record and court documents. I have nothing to hide. I will have no problem telling the truth, which i have. i checked on the UCIS website for the status of my petition, and they are currently doing background checks. I have put all that behind me long ago, and hope it doesnt effect if we get approved or not. Has anybody gone or knew people who were in the same boat I'm in or is going through the same thing? Any feedback welcomed!

Do you or anybody you know ever have a criminal record for controlled substance and they still got approved. I've been on the straight and narrow for 5 years now and have totally changed my life around. I have a good job and decent salary where I do not have to worry about affidavit of support. But my past is coming back to haunt me on this. I'd appreciate any feedback.

I have made some poor decisions in my past. Two prior controlled substance convictions. I didn't check off the box on the i-129f form where it asked if I had THREE or more prior convictions of charges pertaining to controlled substance. Since I only had TWO and NOT THREE, I am still nervous of how it will impact the decision process...

Proof of an on-going relationship definitely has huge impact on whether the visa is approved or not. The main point is that whoever is doing the interview must feel that yours is a bonafide relationship and not fake. Material like phone bills, boarding tickets, pictures, that you've met in last two years (requirement w/i-129 petition) unless you or whoever petitioner are able to document reason of not meeting. Read the instructions for the i129f form, pages 1-7 i believe.

this is the problem with the long wait for the NOA2... i cant stop thinking about every possible thing that could go wrong. and it sucks!

i know it asks if 3 or more drug possessions, but another paragraph just stated "trafficking" and i was told it applied only to human trafficking and now im second guessing that!


Stop second guessing, your making me start to freak out. I have two (one more, and I'd have to check that dreaded little box) drug related convictions and one of them is similar to what your fiance has. The lawyer said that "trafficking" is relating to human trafficking. Your fiance has only ONE conviction related to controlled substance. Correct? Your fiance will be approved, just as I will be approved. I meticulously followed the instructions on how to fill out the i-129f and i am sure your husband did the same as well. I got my certified police reports and all the certified court documents before hand, just in case. At first I was debating if I should just send them in along with the -129f packet. I came up with three reason not to 1. it said... check the box only if i had THREE OR MORE convictions relating to controlled substance (i only have two) 2. Im following their directions,crossing the Ts and dotting the i's, if I'd had checked off the box or send in the material when i wasn't asked to, that would only delay the process and give the official more paperwork 3. Don't tell on yourself if you don't need to.

Just have the certified court papers and police record for his conviction ready just in case they ask for it. We WILL get a approval...it will just take awhile if that RFE is requested.

im doing my visa with philippines embassy. i just got my NOA2 on 31 may 2012. i have yet to get my NVC case number. the NVC told me it can take up to 15 business days for them to get my packet from the USCIS. i hope that helps you with the the time frame from getting the NOA2 approval notice and the NVC case number. as far as any thing else i dont know how things work where you are. and also remember ever case is different. so yours could move faster or slower then other peoples that are doing it in the same place you are..... :star: :thumbs:

from what i understand the Immigrant Data Summary is just the information that is on the outside of the yellow folder that she cant open. just take a few photocopy of it like 5, ive read they want like 3 of them and if they have to make the copies they are going to charge you more then you would like.
