I second the information of: We lost her passport, applied for a new one (hence the new passport number). We found the old one (with the staple) and now have two. Submit both along with a letter explaining that your wife was being proactive about the situation even though you now have two, the embassy will probably ask you to appear with the new one to get it stampped. Sounds legit to me. Lost passport = new passport number as someone who found the lost one could use it for fraud and you wanted to protect yourself and your wife.

 

Congrats on being almost done. You're so close! Just smile and let all those roll off and you'll get to enjoy your wife's company soon.

Amen brother!!  I agree 100% with you.  It took me 8 months from start to finish to get my wife from Philippines to Hawaii.  We are together now and I have never been happier.  I also get sick when I see people gaming the system for years on end and then expecting us to help them conjure up ways to game it further.  I mean seriously who visits another country for 6 months??  Year after year?? I wonder what the percentage of "VISITORS" like the gamer here actually work for cash in the US, never contributing to the Social Security System or paying payroll taxes?  Of course I am sure this couple would never do that.  Give me a break!

1. If you visit the US for 6 months at a time, you'd then have to prove you still have a full time job, a house, a lease, SOMETHING that would make you want to go back to Canada after that 6 months. If you do not have this, you will not be allowed to enter or they will give you an I-94 with a set expiration date lesser the 6 months.

 

2. You need to stay in Canada while doing the I-130 spousal visa. Your wife will have to prove domicile...house, job, etc.

 

3. IF you decide to come to the US for 6 months and then AOS you are committing visa fraud. This forum is a forum for people who apply for immigration the legal way so when you talk about possibly committing visa fraud, it gets a LOT of people on here REALLY angry because we've all paid thousands of dollars to get our loved ones into the US and that is like peeing down our necks and throwing us to the birds because we did it the legal way. (Just saying)

 

4. You are looking at a processing time of around 8-10 months. Worst case.

 

5. This is my personal opinion but it seems as if you are around the immigration stuff for a few years in Canada. Doesn't surprise me it took them over 3 years with no answer. I'm sure this will get removed but it is so frustrating when people continually want to game the system when everyone on this forum providing the help and knowledge are spending THOUSANDS of dollars to do this the RIGHT way to make sure there is NO way their loved ones will get deported etc.

Stay in Canada. Keep your job. Keep your house/apartment. Visit on weekends. PROVE strong ties to Canada...via a job (letter from employer) house deed, mortgage, lease whatever you have for when you do come visit. Do not try to stay for 6 months at a time. Wait your turn like the rest of us. Don't risk being deported and permanently separated from your wife. That's so not fair to her. Not worth the risk.

Ugh! Thats a smidge frustrating, but by no means something you can't overcome. I don't have any advice as to "where to go from here". But, I'd wrap your husband in bubblewrap, sit him on the couch for a year and tell him not to move until he has to pee in the cup! (Just joking :)) But you've made it this far. It sounds like you are approved, pending 4 drug screens spaced out every 3 months.

In the mean time, sounds like you might be spending the next year in Morocco. :(

My heart goes out to you. It can't be easy to handle that, but I don't think your husband was trying to be malicious or anything like that. I'm sure he loves you very much and wants to be with you just as bad as you do.

I have my bank statements stating I withdrew money from an ATM in Canada...thats about all though because I didn't use my debit card/credit card because there are so many added fees for it with currency conversion etc. Do you think that would work?

Here is my situation:

I live in Michigan and my fiance in Ontario. Its a 7 hour drive for me to get to him. I don't have an actual passport, I have an enhanced ID that provides me the same access to and from Canada by car as a passport would.

My fiance has a passport, but because its only a short trip, the times we've met, I've driven or he has taken a bus.

I sent in pictures of us and also his bus ticket stubs, but what other evidence would they want? Based on what I've read here, is that those are all secondary. We really have no primary! I also sent a copy of text messages we've sent to each other.

We also don't have any telephone records because we Skype every night and text during the day. So its very rare that we actually call each other on the phone. Maybe 3-4 times a week.

Oh! And also, we both have Blackberry cell phones so we normally talk on Blackberry Messenger because its free. So therefore actual texts that some cell phones list on your bill showing who you texted, doesn't apply to us either really.

Anyone have any advice? I sent that all in, but have a feeling they are going to want more evidence.

Hi, my name is Patty and I'm new to this forum so go easy on me. I may ask stupid questions until I figure out the "Search" function here.

My fiance is Canadian, Jordan, and we've been together for 4 years and got engaged this March (yay).

I hope to be sending my I-129F package today. I've checked it many times to the checklist provided here on VJ (very helpful) and have a freind checking it now. I'm waiting for his photo (passport style) to arrive today.

My first question is about the I-134 Affidavit of Support. Someone (don't recall who) said I need to fill this out. I don't know when or where I'm supposed to send this. Should I include a copy with my I-129F package? Or wait for someone to request it?

I am Amberlynn, also have a Canadian fiance! If you need any help or advice or just someone to vent to (because its going to get stressful) let me know! As far as the passport picture, when I went to visit my fiance 2 weeks ago, we just went to Walmart for like $20 you can get them done and they are ready for you within the hour and I just brought them back with me along with all the other paperwork I had to have him fill out. Much easier that way!

I am wondering why it would be different than any other time they come to the US? So does the US boarder somehow know that they are involved in a Visa Process? Like are their names flagged? Just curious because my fiance will be visiting during the processing of our petition but I didn't really think is would matter... He didn't bring any of those pieces of information with him last time...



My attorney that I met with before I sent in my paperwork said its all about the "intent". I think their systems do show the names of people involved with immigration. Because K1 is an immigration process. The intent is for marriage and eventually permanent residency/citizenship. So I guess if they can prove that they are going to be going back to their countries after visiting, then they may or may not let them in. For me as the USC it doesn't make a difference on my trips to Canada and back because they know I don't want to move to Canada based on my filing of the K1.

Hi ... I am a Canadian Fellow as well and my fiancee is in Westfield MA. She sent the package in back in January and she got the NOA 1 on Jan 28th, so we are still waiting probably another 30 days for them to look at it. I have travelled from Canada to Hartford in March and have another tip planned in June for 10 days. This is all while the process is underway. She has not come to canada yet. Its all a matter of patience. Yes a long process and it may take us another month for approval and then 2 - 3 months for interview and medical and prints. I Am still going to visit in August as well. Just BREATH as my fiancee says.... good luck

There are no rules against visiting. You can go to Canada, he can come to the United States. If he does choose to visit the US, make sure he brings ties to Canada that prove he is going back. A letter from an employer stating when he's due to return, a letter from school, return ticket, a copy of a lease, etc. Of course it's up to the border patrol whether he gets in (as always) but people do it all the time. If he's denied at the border, it has no negative impact on the visa whatsoever.



Oh he can come here? I was told he wasn't able to. Well, that makes things not seem as bad then! He just has to be able to prove that he's not staying. Thanks! That puts my mind at ease. Its only a 7 hour drive, but still.

Hey Everyone!

I am new here, so please bare with me as I have a few questions.

First of all, I am the US citizen and my fiance is a Canadian citizen. We have been engaged for a little over a month now, but have known each other for 10 years.

My main question is: Are the current processing times listed on the USCIS under the CSC for I-129F visas for the entire process? Or just from NOA1 to NOA2?

I am trying to plan a wedding for October 27th and not sure if this is even realistic considering I just got a text on May 7th stating they had gotten my petition and were forwarding it to CSC?

Any advice about this process would be amazingly helpful! I'm so stressed and scatter brained about all this I need all the help I can get!

Im curious as I plan to file a Fiancee visa soon=I have noticed there is an expedited process available?? Has anyone used this? Does it actually work (providing all is in order when filed)?? What is the actual time for completion of the Fiancee visa with / without using an expedited process/at this current time ??Thanx in advance.



It is very rare for them to expedite petitions unless there is a situation with military deployment. Thats the only situation that I have seen.

As far as time frame, its about 5-6 months from the time you file for USCIS to approve the petition. Then its sent to the National Visa Center (NVC) which can take 2-4 weeks and then its sent in the US Embassy in your fiance's country. This could take anywhere from 1-3 months for them to be able to get an interview date. They HAVE to go for an interview to be able to get their visa fully approved. There is also a medical that has to be completed. If there are any children that your foreign fiance has that are coming to the US with them, they would all need to have medicals and be at the interview too. So there is a potential for there to be traveling costs for this interview as well. (My fiance lives 8 hours from where the Embassy is).

Keep in mind the filing fee is $340. Plus any medical costs, paperwork you need to get together. There is a cost for the visa itself. Depending on the country your fiance lives in. Then you have 90 days to get married. Then you must file the AOS petition which I think is $1070. Please corret me if I'm wrong. Then its waiting.

The worst part is waiting. Good luck though. And inbox me if you have any more questions.

My experience with obtaining my tax transcript was also a bit burdensome - Because I had moved a year before I could not order them online but rather had to fill out the papers and mail them in. It took about 4 weeks to get in the mail.

They never ask for them in the interview, just simply a copy of my last year return (1040)and a letter from my employer.

I'd try to send it in. Its not going to hurt anything if you already have the package assembled and ready to go. Especially if they have already sent out Package 3 to you. I'd go ahead and send it.

I'm with everyone else. I'm sorry that you were misinformed. The best thing you can do is be prepared as you can be fore Packet 3. My fiance is in Canada and I have just about everything ready to go for Packet 3, minus signatures and dates on things. That way, we can send it off either the same day or the next day after getting Packet 3. Stay informed about the next steps needed. We are going to be ordering a long form birth certificate and police certificates at the end of this month and getting more passport pictures taken of him and then we are all ready to go. Just need to date and sign all forms. Once thats sent, we wait for P4 and then can schedule medical and interview date. From there its just getting everything in a row and ready to go for interview stage.

Good luck but seriously we had to push our wedding back in the beginning too because we had no idea when this will be approved. At this point, we are planning to just get married at the court house to satisfy legal requirements and then have a regular wedding once we have his AOS sent off. Less stress. Less wasted money on deposits for vendors and venues.

I wouldn't worry about it too much. I think it is recognized that Canadians, especially those close to the border, make many crossings into the US without having their passports stamped. I don't think you will be too heavily scrutinized on that, especially with all of the other proof of your relationship you are providing. My fiance and I visited with each other almost every weekend for two years without stamps in our passports. What I did provide was a list of as many exact dates as I could since we started seeing each other. Since we hadn't really tracked the visits, we pulled the dates together by looking at calendars, our emails, concert tickets, etc. Since the forms ask for 'all' dates of visits (which would be impossible) I went back years and also stated the year my first visit was (family trip to Florida, etc.) and also that I estimated that I made on average x number of shopping trips per year during a specific time frame, and a couple of other dates I was certain of. I was as specific as I could be for the most recent years of us seeing each other. It was a long list but it seemed to be enough, since there was never any question during our whole application process. I think they understand that a lot of Canadians travel back and forth quite a bit without having their passports stamped. We didn't provide any receipts to back it up either and were never asked for any. That was our experience, anyway :)



If you don't mind me asking, how close did you guys live from each other that you were able to go every weekend? I'd LOVE that to be the case! Haha I do go out there every 25 days though! So its not TOO terrible. But definitely want this process to go quicker. Its crazy for it to take this long...its ONLY Canada!

So probably a weird question, but I have been traveling back and forth from Michigan to Canada every month since February to visit the love of my life. I have a Michigan Enhanced ID card that allows me to travel between the two countries without an actual passport.

For purposes that would make me feel better (because I don't have actual passport stamps to prove meeting) and I just have a feeling an RFE is on its way to me, is there anyway to get proof that my Enhanced ID has been swiped at the border? The dates and times that I have traveled.

Does anyone know if I were to stop in the customs building at the border, would they be able to give this to me? Or is it not even worth it?

My fiance has visited me once when we met my family and friends in March, so he does have a bus ticket. But because we are visa exempt with Canada, there are no passport stamps in his passport either.

Is this something they take into consideration? I mean, I have pictures, parking stubs from various places we've been together in Canada, texts, emails, FB messages, Skype records, gas receipts for when I've gotten gas in Canada on my travels...etc. Do you think this is enough? Should I been getting notarized statements from family and friends saying they know that we've met and that our relationship is bonafide?

Just trying to get my ducks in a row for when its time for interview and/or an RFE comes our way!

So, I know we have 90 days to get married once in my hubby to be arrives. After that, do we need to file AOS during that 90 days as well? So lets say he gets here, we get married on day 30. Do we have to file AOS with the last 60 days of his I-94? I've read a few things on here that lead me to believe AOS does NOT have to be done in the 90 days, only the marriage.

What is the time frame that the AOS must be filed after we are married?

I am so happy right now! I never imagined in a million years this would happen for us! 89 days! I had a feeling. When I saw someone with an NOA1 date two days after mine get approved today, I just had a feeling we were next! I am just on top of the world right now. I read everyone's updates and getting NOA2 stories and I dreamed about this day! I am just on cloud 9 right now. Justin and I have known each other for 11 years and this has been a long time coming!

To everyone still waiting, God has a plan for you. His timing is perfect. Pray. Stay positive! Your loved one will be with you soon. Have faith. And hang in there. Now the rest of the rollercoaster begins.

Thank you to everyone who has helped me over the last few months. I figured I'd get an RFE for some crazy reason or another, but I stayed positive and took it as a time to fall more and more in love with my amazing fiance. I am so in love with him and I know love is real.

I'm currently working on Packet 3 documents,and feel like I'm going in circles. The DS160 online, yes or no? The instructions ask for confirmation of onlineDS160? Anyone recently submit their documents? Did you or didnt you complete the DS160?

I'm mailing these in to the Montreal Consulate.


I actually just did this with my fiance last night. Yes its online only. You fill in all the information and at the end they give you a confirmation page with a bar code. It is very important that this be printed out and sent in with Package 3.

DS-160 is not for K-1. Go to Embassy link and look up Canada then pick Vancouver or Montreal to get links/instructions to Packet 3!

Because you didn't get an RFE, I would assume you're safe without having a copy of the paperwork. I also didn't keep a complete package and luckily am at the NVC stage. I got a Case # within 1 day of the petition arriving at NVC. However, the case is still "under review" and I will be on Day 13 business days at NVC now.



I did this and on the Package 3 for Montreal, it lists a confirmation of the DS 160 for a Package 3 K1. So I had no idea. Because then I saw on the Department of State website it said it wasn't needed. So this is a weight off my shoulders! Thank you

So many questions, so little time.

So I will list them. And hopefully someone can help!

1. I got NOA2 yesterday, when do I called NVC?
2. What is NVCs phone number?
3. With Packet 3 on the DS-160 applicatin it asks for the applicant's fathers name, address and DOB. My fiance hasn't spoken or heard from his father in probably 15 years. Will this deny us, if we put UNKNOWN?
4. The birth certificates that need to be brought to the interview...I am not 100% sure I can attend the interview with him due to my job. Does he have to bring my ORIGINAL state sealed birth certificate? Or is a photocopy with my signature certifying it is an exact photocopy of the original ok?
5. My stupid self was so excited to send in the petition that I forgot to make a photocopy of everything. Should I redo the forms from the original 1-129F petition and just date and sign everything again?

Any information helps! Thanks everyone. I think I have a good grasp of the rest of it, as I did most of the paperwork already. Just need to sign and date everything.
