Requesting a second interview to include the petitioner is a major development and must be taken seriously. It's is NOT a good development. It means the Consular officer thinks the relationship is fraudulent and they will try to discover any material misrepresentation to go with the denial. Expect a "stokes interview". Just google "stokes interview".

Concern yourself first with preparing to overcome the decision to deny the visa. All your other issues are minor details.


Pushbrk - Please familiarize yourself with the embassy of which you are speaking before you make a blanket declaration. This is COMMON practice in Jamaica - In fact, many used to recommend that you attend the interview so that this could be avoided. However, the embassy recently changed to not allow the petitioner (without special permission) to attend the initial interview, and will blue slip if they feel appropriate.

Most people that were blue slipped incurred the cost of the trip - only to walk into the embassy, be asked who they petitioned for, and were approved.

Your response is not accurate for Jamaica.

1. NO... it's done on the first available basis which may be after 11/23/2010 at this point.
2. After the inteview..? IT'S recommened NOT to make ANY travel plans until AFTER you get the passport back.. may take upto 2 weeks.. also if it arrives with ERRORS then it must be returned.
3. approximately up to 2 weeks currenly
4. They submit the necessary info on the computer that is linked to the SSN office/ and a back office team processes the submitted cases* Not certain on this..!

Agree again, and add to it, sometimes longer - there are people who have waited months to get their passport back, go to the portal page on here, there is a member who recently posted from JA that they have been waiting since early September and are being told it hasn't printed yet. There are others who got their passports back within a week. No way to predict a timeline, it's "soon come".

4. This is not for K1 cases - you have to wait until at least two weeks after they arrive in the US, then go apply for the SSN at your local office.

Did you file yet? Worry more about putting the K1 together - you have 6 - 8 months before he needs his immunization records, plenty of time to sort it out

Have him try the schools he attended, they may have the records -

If he can't get them, he can go to the local clinic and get them in advance, just make sure he gets confirmation that he has received them - This will be way cheaper then waiting to the medical to get them - Not having had the shots won't affect his visa - they will give them at his medical if he doesn't have proof of them, it will just cost you more.

I don't understand the whole "higher taxes" thing. USCIS received over 10.5 million dollars last year to process K-1 visa, where did that money come from? the fee you pay to process the visa. No tax money should have been needed. When it lowered the processing fee in November it cut over 2 million dollars from its budget. If it needed to hire more workers it shouldn't have lowered the fee. When I mail a letter from New York to California it doesn't cost tax payers money, I pay the processing cost. When I renew my drivers licence it doesn't cost tax payers money, I pay the processing cost. When I applied for my passport, I payed the processing cost. What they should do is if you want a K-1 visa processed faster they should charge a higher rate, just like I did to process my passport. I paid $80 more to get it faster.

What people don't seemed to understand is that K-1 are an "expedited" visa to begin with. Yes, the K-1 visa is an expedited visa thats why you get it so fast (averaging 6-9 month). Can you imagine the wait if it was not "expedited".


So, by paying the processing cost for your license, passport, mail, etc... - you are covering the cost of the employee's salary, medical benefits, the equipment used to make the license, passport, etc..., the cost of rent / ownership of the building, the cost of utilities, gas for the vehicle to transport the documents, etc.....? :whistle:

I do have the two letters of intent, however when I met with a lawyer on Thursday (NOT going to use him as I realized I'm better off on my own filing) he said that letters of intent aren't needed for the I-129F and said he doesn't understand why people do it?

Also the letter of intent and G-325a forms from my fiance was signed by him but faxed to me so it's a photo copy of his signature. This same lawyer stated that I need to sign by the signature to show original signature. Is that correct?


It sounds like you met with a lawyer who doesn't really understand immigration - cause if you read the filing requirements they ask for the letter of intent. Also, you file copies and bring the originals with you to the interview - Include the form that says you certify that everything is a true and correct copy (look in the guides here) and be prepared with the originals at the interview.

Yeah some people get really picky about people from other countries giving advice, on this front it's a bit silly but whatever :P

The TRUTH is the list I gave you is correct. Those are the shots that are required BUT some countries like Mexico don't ask for shots to get the K1, Australia does. The UK doesn't have the varicella shot available in their country so that isn't "needed" at the embassy.

Personally I don't think they would ignore the blood titer (blood titre) but knowing that it's an option and ASKING them is good. So give the doctor a call and see if he'd accept a blood titre showing immunities, he says no, then you know. Australia's list also says "immunisation records" and I wasn't aware of the the titre was even an option till someone else told me AFTER my medical.

So yes, countries do some things differently but ASKING if it's an option won't hurt anything and could save you time and money.



While good advise - She is getting advice from people with experience with the Jamaican medical that the blood titre will NOT work and is not an option.

Dealing with Jamaica, there are four options:
1, Have your medical records
2. Go to your school and see if you can obtain a copy of your immunization records
3. Go to the clinic, prior to your medical, and obtain all the shots
4. Show up at the medical without any of the above, and pay an arm and a leg for the shots.

You also have to factor in that he is getting a conditional GC, then has to lift conditions in two years - A GC puts time constraints on how long you are out of the country, so living outside of the US could lead to more problems.

Your fiance has 6 months after the visa is issued to use it - Once he enters the US, you have to marry here and then he cannot leave the US until you adjust status / get advance parole - Are you intending to leave him here in the US alone? Another factor is to check what country you are going to - he might need a visa there.

No one is talking about what is "respectable" or expected to run the decisions of our COs - What Peace is saying by her post is the fact that, like it or not, this is VERY prevalent in the country - Accepted or not, it's there, it grows freely on the sides of the road, people approach tourists all the time with offers of "tours of the fields" and similar. I even know people that have been drug tested by immigration leaving the country to check for use - And the presence of it can result in a nice hospital stay until they ensure that you are not smuggling any back with you.

What I interpret Peace as saying is the fact that in Jamaica, the medicals test for it and they ask the question - even if the test is negative, a yes admission to prior use will be marked down on the medical report - There have been several VJ members who went through this - I can think of 2 off the top of my head who got denials and a 3 year ban with a clean drug test but an admission of having tried it in the past - There was another more recent since the law changed who had their approval held and had to go back for a second medical and test one year post admitted use.

It's unfortunate - but it's a reality, and one that is applied way harsher in JA than in other countries - I remember reading about a K1 from Mexico who not only admitted using that, they also tested positive for that AND cocaine - Yet was given the visa - There are other countries that do not drug test at all. So, as for applying the standards of the country to the decisions of the COs - it appears to be the reverse in JA, don't you think?

This is a very unfortunate situation, and the first two I have seen involving a minor - I just hope and pray that the COs will be lenient and let them through with their parents.

They changed the law fairly recently - If he tests clean, even though he admitted to trying it - he could not receive the visa at this time, but have to go back for another medical 1 year from the date of last use of the drug, and if he tests clean then he could be given the visa - it's not an out and out denial, but it could be a set back of up to 1 year (that is, providing he gets it together and no more "sampling" - you need a long talk about the MAJOR effect this could have on his life and future). Search through the JA posts, there was a member who went through this within the past year.

No, it's not possible to schedule an interview before NOA2 - it's not even possible to schedule an interview right when getting NOA2 - you have to go through the NVC, then they send it to the embassy, then the embassy will tell YOU when the interview is on their schedule - unfortunately you have no control over it.

Second, having or not having a lawyer will not speed up / slow down the process or avoid a request for additional evidence.

Something doesn't sound right, T&J - I have never heard of a past bankruptcy causing a denial of the petition - Especially one that was three years ago, and you make over the limits since - Plus, if the financial reasons were the reason for the denial, they typically would give your fiance a blue slip to return and ask for a co-sponsor.

Have you emailed the embassy at all to see what they said? Did they give your fiance anything at his interview?

I think that the key to it is going to be timing - It says if the last refusal was less than 1 year ago, they schedule a new medical and he can get the interview - If it was more than 1 year ago, then you have to refile and go through all of that - He's coming on a derivative visa to your K1, right? So if you can time it right and get his interview date after June 29 and before Aug. 4th, he should be able to get the visa without having to refile it -

I think that to schedule the interview for the derivative visa, you just email the embassy with the case # and information and request an interview date.

Do you have someone he can stay with? I hope he learned his lesson (although the hard way)

Yes, that is for your fiance to fill out - Honestly, I wouldn't wait for the Jamaican mail system to see if he gets them, so many don't = You can set an email address up for him if he doesn't have one, complete the forms and PDF them to him - there are internet places all over JA - have him go download them somewhere, the cost is minimal and will be much faster then waiting to see if he gets them - The sooner you return them to the embassy, the faster your interview will be assigned.

This do-or-die focus on phone records IS NOT completely necessary, nor is it a hinge in the K-1 process.

Keep in mind it is nothing more than secondary evidence. We did not submit a single phone or email record -- just as many have done -- and it made no difference.

Make sure the primary evidence is rock solid -- evidence from visits, the Petitioner's finances -- and just gather up what you have in the way of the rest.

Under no circumstance should anyone have to subpeona phone companies. That's just crazy.

Please search the MENA regional forum for returned petitions, it has all the detailed info you will need to proceed. You must act quick. If the petition has been returned, either you will have a second chance to give your rebuttal after you will get the exact reason for denial or it will expire, at which time starting over is better than a costly and lengthy appeal. This will be a time consuming journey either way.
Try to keep the petition at the foreign post and contact the CO yourself and through your senator.
Ask your fiance for every detail from the interview, every question, no matter how small.
Notarized letters from family and friends attesting of your genuine relationship will also be helpful. This is not a document issue, this is a relationship issue. If documents were missing they would request them on the 221g paper, same goes for them needing additional relationship evidence.
Was he able to answer every question in the interview ?

To answer a few other points raised in this thread = Jamaica does not allow the petitioner to attend the interview= so being how close JA is to the US is irrelevant - on top of which, distance doesn't make a difference, ticket prices are nearly double right now. If they want to interview the petitioner, they will blue slip for them to come back. Secondly, any additional evidence (financial, phone records, etc...) they would blue slip for.

I am so sorry you are going through this but I agree with the above advise - do not wait to see what response you get before contacting your senator, you need to be proactive not reactive and fight to keep your petition in JA before it gets lost in a hole somewhere - contact anyone and everyone you can, and keep doing so until you get an answer.

I would not wait for the case to get to the US - I would have a long talk with your fiance and get every detail of the interview - Also get on the phone with your senator and congressman, and have them put in inquiries - Additionally, email the embassy yourself for information - They would not deny outright for that, they would ask for additional info and blue slip.

The children WILL need the mother permission, even id she is MIA.

ALL children and adults regardless of age will need passports and medical to migrate to the US.

If the children are follow to join, they do not need to be present at the interview with him.

IF the fathers's name was not on the BC at birth, but added later, the children will be required to obtain DNA testing.

The father should have the children's Bc before he leaves JA.


Exactly - if you intend to bring the children on follow to join, you have to have listed them on the K1 petition - within 1 year of him getting his visa you can schedule their interview and get their visa - if you wait more than a year, you have to file a new I-130 for each child - Work now on getting him added to their BC, and be prepared to do a DNA if the embassy asks for it - The mother will also have to give permission, so that is another talk to begin having.
