I'm not sure if you'll send a different form being from Canada, but I didn't send the actual form you receive in the kit. There is a template on the Wiki page here, just search for ds 3032 on the Wiki page and you'll find it. Copy and paste that into a new email, change the info and mail it off. Ours was accepted very quickly.

You can got to either Manila or Cebu to the US Embassy for that Legal Capacity to Marry document. Some things will depend on where in the Phils you get married and what docs the province/barangay require. For us we had to get quite a few docs lined up:

Capacity to Marry from Cebu
Barangay clearance for her
Marriage counceling (Certificate)
My original divorce decree
Both birth certs (Originals)
CENOMAR (made me get one too)
Affidavit of Singleness

After you submit all the documents there's a 10 day (calendar day) waiting period. If he's Catholic, have him bring a RECENT baptismal record otherwise you won't be able to have a church wedding. There is a lot of time involved even if he is - seminars and banns :(

I didn't send a lot of evidence with our I-130, but some. Along with all the required documents I sent the sworn affidavits from our wedding sponsors/witnesses, photo copies of our MasterCard statement showing the usage by she and I there in the Philippines and photocopies of my visa extension, boarding passes and hotel receipts. I just tried to include stuff that proved I was there and we were married during my stay. I saved all the rest for the NVC stage.

I am USC and paid for and sent in completed DS 230 and I864. I've seen some people talk about a DS 3032, Can someone tell me what that is?

That's the Choice of Agent form. It allows the petitioner to send and receive all future correspondence. If you don't submit that form then the documents that are required from the beneficiary will be requested from them and not you. It allows the petitioner to act as the AGENT for the beneficiary. If you've already paid the AOS and IV bills and sent those packets of info, you're already past the DS3032 stage though.

You're right, every insurance company is different and the contract they have with the employees/employer dictates their "rules" for adding someone to the policy. IMO it's asinine for them to reject or deny someone because of a "window", etc. You have a SSN, your husband works for the company, you're the spouse, he will be PAYING them for your coverage. How freakin difficult do they really need to make it?! I pay, you provide...simple. I'd say shop for different insurance M. Unless he's getting some incredible deal through work (which he's probably not, none of us do) you'll still pay quite a bit for it so you might be better off just finding another company. As one poster here said, he found a temporary policy, of sorts, until he could add his wife. No offence effieb, but this is one of the reasons people in this country are soooo pissedoff about health care - stupid expensive, IF you can even get it!! The job I'm at now offers UHC and for Merlaine and I it will run $286 a WEEK for 80/20, $750 per person deduct. That's insane plain and simple. Ok, my rant is done..in this thread anyway..sorry M, and I'd still call that comissioners number I gave you! :(

That's what we did. We got 2 or more copies of everything! CENOMAR, CEMAR, NBI, everything! I sent the originals + a photocopy of everything to NVC of course, but she had all the same documents in her folder for the interview. You'll need an NBI at the embassy if you don't have a valid photo ID. Merlaine used her NBI and appointment letter to get in :thumbs: (she has an old student ID but it's in her maiden name).

I've been reading some of the posts and i'm not sure if i didn't read enough, if i missed it or whatnot...but i wanted to ask everyone, how will this "new law" affect those who hasn't gotten NOA2 yet? As far as i know they probably haven't touched my I129F for my fiancee yet since they received it Mar 16 06.

I do feel for those who may or are affected by this. Waiting for NOA2 is stressful enough and for DHS to pull this kind of stunt on all of us is clearly not satisfactory to say the least. Good luck to all and let's pray for the best!

OKay...thanks! Another question though...I don't think i put it on my cover letter...the only other reference I can think of to let adjudicators know I'm military is by my work history...would I be able to inform them by phone or other means of communication of my military status?

my finace is in the military and there was no special consideration that we recieved this far ....

That RFE was basically a tiny questionairre which of course i sent back but to me, if that's all they asked of me, then we should be near getting approved. When I get an email from them I get it x3. It's just their email system going nuts.The email you got is the same one everyone gets when they have your RFE. The peliminary processing part of the email just means they have done something to your case already. Maybe only looked at the date to see if IMBRA applies or it could be they did more. Who knows?

Well, not only did USCIS update their CSC processing times, I also got touched 5 times today but they were all the same message saying they received my IMBRA RFE and that "although preliminary processing was complete, the remaining processing time will be less than the maximum stated in this message..." Can someone explain to me what they mean by that? It seems they also refer to a time that I see no where on on the notice. It also says that, "...*The projected processing time frame can be found on the receipt notice that you received from the USCIS...." Are they referring to the NOA1 or something else I'm supposed to have? Any thoughts?

Many VJs find it difficult to figure out how to check for touches and ask for :help:. So I thought I'd have this topic to make it easier for everyone.

What is a touch?
As JEDI's defined it (http://www.visajourn...howtopic=20192#):

Any time your application is handled by someone at a Service Centre, the barcode is scanned, which results in an update to the "last date" for your case on the USCIS website. When the date changes, this mean that someone has physically handled or "touched" your case. There are many reasons your application may be "touched" - from simply being moved from one desk to another, to RFE's, to being approved.


There are 2 kinds of touches. There are the ones that show some kind of update, there are the ones that don't bring a new message. By logging into the account, take a look at the date that shows next to your case number. If it's changed, you've been touched.

By clicking on the case number, you get to check whether it was an update touch or not. The ones that don't show updates are connected with some kind of work done with regard to your case - it merely shows that they've taken a look at it somehow.

What? Case number? Account? Hang on, let me explain it. :)

How do I get to check it out?

First thing is, get your receipt number (or case number). You can find it online on the back of the check you used to pay for the filing of the application when it's been cashed. If you can't do that, wait for the NOA1 in the mail. It'll be there.

There are 3 ways to check for updates.

1. By searching online: https://egov.immigra.../jsps/index.jsp - you'll just need the receipt number.

2. By logging into your account. To register on the USCIS site: https://egov.immigra...ectusertype.jsp

3. By e-mail (once you have registered and clicked on the "E-mail on" button.

Options 1 and 3 are good if you only wish to check for status update. Option number 2 shows the mysterious touches (somebody worked on your case but we can't be sure what has been done).

Option 2 in detail:

Log into your account: https://egov.immigra.../jsps/login.jsp

It'll show a table:

Receipt Number | E-mail | Last Updated | (mm/dd/yyyy) | Form # |Form Title

Take a look at the date in the "last updated" box. Then go to "Receipt Number" and check the message. Is it different from the last update you got?

Yes: :) Great! You got an update that changes the status of your case.
No: :( Aw. They have just worked on your case...

Please note that the date on the update notices don't change. For example, if you got a message saying your petition was approved on JUNE 20, 2006, that date will never change. The ones that might change are the ones you get to see at the chart when you log into the account.

Do I really need to check the mysterious touches?
Not at all. Only obsessive people like me, for example, will do it. I find it comforting to know that someone's been working on my case :)

Also, you only get to check the status before your petition is fowarded to the NVC...

:help: I've received my NOA1 via snail mail. I went to the USCIS status link and entered the number and turned on my email notification. But I can't see any touches. Am I supposed to look somewhere else for touches? I'm in the pokey CSC but I still see references from other members of touches within a few days of receiving the petition.

So my question is will I receive email notification from every touch, since I turned to email on, or am I supposed to check for touches somewhere else?

I was received July 11th and my check was drawn from my account on July 18th

To check for touches - even if you can't see change on status- you have to login into the account on the USCIS page. The ones you get by e-mail are the ones that show some kind of change.

It's a little disheartening that USCIS doesn't provide a decent timeline estimate to ease the tension and stress of waiting for certain petition and visa events. Everytime I log on to their site, I come in with a hope only to find the same message day in and out. When I look at my timeline here on VJ, I'm jumping for joy when I look at my timeline comment block and seeing a lovely little set of letters and numbers that is the date my "...petition could be adjudicated as early as..." For the past couple of weeks I've been tracking it and at first it was showing four weeks before I could expect something. Now I have this hopeful smile as I've seen that date come closer from mid Sept to mid Aug!!! :dance: Just little victories like that would make anyone jump for joy! wouldn't you agree? I understand that date is from an average of those who have been approved but my line of thought is, give us some kind of goal to look forward to rather than wait aimlessly for something to happen. That I think would help all of us immensely!

Aside from all that, I've got my sights set on early August....sooner the better!!!!! Good luck to all and may our NOA2s be cause for much celebration and numerous adult beverages ;) But keep it clean and safe aight? :whistle:

Yes, we sent in the bare minimum, which included our YM instant message log showing all the dates that we chatted, our pics from my visit, and my passport stamped (departure/arrival). However, for the visa application we have enough evidence to fill a stadium (LOL!). Since we had more time to put together the package for the visa interview, we are more than prepared with substantial evidence of our relationship for the Consular Officer. Good luck to you and I look forward to reading about all your success stories.



Just to piggy back on you, I sent in everything I could think of with our petition, YM chats of every single days we were online, cards, e-cards, passport copies with stamp, my BAGGAGE TAG, pics, any and all receipts I saved when I visited my fiancee, phone bill including my cell, phone cards.......my list goes on and on. Even after I sent all that, I still save whatever else we have between us. I still save our YM chats and anything else to prove our relationship.

Basically, it's a generally good idea to give whatever you have whether or not USCIS/NVC/Embassy looks at it or not. If I were them, it would tell me that you are going above and beyond to prove that your relationship exists. True that not everyone would want to go through every bit of evidence but as long as you have what they are asking for, then they have nothing to hold you down.

I, too, didn't join Visa Journey until after i sent my I129F in to CSC. My cousin's husband introduced me to it and I wish I had looked at it before I sent the petition...but thanks to him, he gave me a list of what he sent in for their petition and I copied it exactly plus adding some stuff I thought would help.

If I remember correctly, the I129F does ask for proof of ongoing relationship and proof of having met within the past two years. It DOESN'T however, say what types of evidence would suffice...and that's why I asked my cousin's husband for help since obviously they went through the same process. From what he told me, it took them six months from when they filed the petition to when she stepped foot on US soil. I wish I was there....my fiancee and I would be at her interview point if it weren't for IMBRA....BLAH!!

Whether you decide to provide evidence or not, I would suggest a little is better than none, then you won't run into any potential show stoppers on your journey. Good luck to you and hope your journey is quick

Current Status:

This case has been approved. On July 24, 2006, an approval notice was mailed. If 30 days have passed and you have not received this notice, you may wish to verify or update your address. To update your address, please speak to an Immigration Information Officer during business hours.

OMG there is hope for all of as as the CSC is approving the petitions .They recieved my IMBRA RFE on July 7th and I got my approval today July 25th...and it just so happens that i am leaving today to go visit my baby in the Philippine today also..wow THANK YOU GOD FOR THIS BLESSING.
So all the rest of you it is just a matter of a few more weeks i would think since they recieved my petition on 5-30-06 and it transfered to the CSC on June 7th..wow i cant believe it..so hang in there guys I know yours will be comming soon,

Just another stick in the fire...before IMBRA ever came about, my cousin's then fiance sent their I-129F in January to CSC. One month later, they were approved! YES! It was CSC they filed at. Four to five months later, my cousin arrived at LAX. It took her 6 months from filing the petition to stepping foot on US soil. I was nearly brought to my knees when she told me that. As you can see, according to my timeline, I filed in March and still waiting for NOA2 even though my timeline data was showing Jul 26 which was two days ago! I dont' totally rely on it but it gives me some sort of hope and ease of mind knowing I have some kind of goal to look forward to. I hope most people will feel the same. My fiancee always stresses to me to just relax and wait patiently and things will come when they are due. No doubt she is very excited about coming here and being with me but she reminds me everyday to remain strong and to not stress out over things not in our control. CSC received my IMBRA RFE on Jul 18 and touched on the 19th but nothing heard since then. So hang in there! We all want to be with our fiance(e)s yesterday. In the meantime, you'll find a lot of the things we want to do with our significant others you can also you online. Give it a try. Some thigns my fiancee and I have done online:

~played and online game
~went online shopping
~met my family through webcams and YM
~serenaded with headsets
~TALKED online

These are but a few things we've done to pass the frustrating time. It may be but a short time that you see each other but the very fact that you did is worth more than you would think. Good luck to everyone and may we see NOA2s like angels in heaven! :innocent: :thumbs: :yes:

I hope I'm not beating a dead horse here. But for those who have beneficiaries in the Philippines, what was your typical process between the time your fiance(e) sent in the forms from packet 3 and when they were scheduled their interview?

Also, let's say the fiance(e) is located somewhere else in the country other than Manila and has to fly into Manila for her interview, where can he/she do the medical exam and how long would it take usually between the med exam and the interview?

Any other helpful tidbits would be greatly appreciated. Thanks ya'll!

I am also waiting on Manila, but it looks like all the timelines are taking about 4 months from the time that Manila gets the package until the interview and visa is issued. The Manila Embassy is the slowest embassy in the world!, Oh lucky us!

The Medical is done at St Lukes there in Manila about 1 week before the interview, there is a hotle that is cheap accross the street.

Just wanted to toss out the question of proof of income and evidence required for those of us in the military. I've heard from several VJ folks that our LES (Leave and Earnings Statement) would suffice for section IIB. (Statement of your employer on business stationary, showing: date and nature of employment, salary paid and whether or nto postion is temporary or permanent). I'm planning on including a copy of my most recent tax return (according to US embassy in Manila) and a proof of service letter I got online at my virtual military personnel function.

Is there anything else I'm missing? What's really required of us because of our military status? Thoughts please. Thanks!

Just an interesting story for you. My fiancee and I filed our petition to CSC in March 06. Just recently we were wondering why it was taking so long. Then she told me that her friend was already in LA after supposedly going through the same fiancee visa process that we're going through only......her friend filed one month after we did. My fiancee also said that they went through a lawyer. But in both cases, we're very similar in that we are clean (no previous marriages, no prior kids, no criminal history, etc). The only thing I can think of is that the USC filed at Vermont but she's living in LA...hmmmm

My questions are:

How is that possible that her friend filed the same kind of petition after we did and she's already there?

Does a lawyer really make a difference if we're both "clean"

Let's all hope and pray for many approvals this week, especially those of you that have been waiting for over 2-3 months. I want approval badly but I would gladly give up another week if they just approved those that are older than mine first. I want some logic to this...although I know there isn't any.

I hear ya on that! I'm still a lil jealous of my cousin who got her NOA2 one month after filing her petition...and this was at CSC last year!..

Let's hope and pray for the NOA2s to come flooding our doorsteps this week!!!! Any bets? :whistle:

I just want to let you know that there is hope out there. I hadn't been touched since July 6, which was an email that they had received my RFE on July 5. I wasn't touched again until July 27, and then nothing until I was approved this morning! I know it may not make you feel that much better, but I wasn't touched for three weeks after they received the RFE. That means, hopefully it's coming soon! :)


Thanks, I sure hope so. It's just that whatever that lady told me when I called her didn't make me feel any better about what was going on. I guess I'll just have to stick to our usual routine online. Thanks again Amelynn!

I'm certainly happy for those who got their NOA2s the past couple days. I'm glad you're on the fast track now and that you will be together with your loved one very soon.

Behind my smile I look at my situation and can only wonder why I feel so left out and that my petition has not been touched since the 19th. So I called earlier and finally got through to an actual person only to be that much more frustrated than I already am. They said that because "they received my IMBRA RFE on Jul 18th, that the new processing date would start on that date". Confused as always, what in the world does that mean?!?! If I filed in March and they received my RFE in July, does that mean I have to wait another freakin four months from July just to hear something? Has anyone else heard something similar to this? I've been watching everyone here especially those with a similar timeline and fiancee's location as mine and I am happy, I truly am happy that they got approved. I know I should be patient still and that my time will come...I guess after talking to whoever was on the other end of the line, I can see now the true frustration that comes out of USCIS.

Anyway...off my soap box now....I just wanted to blow a little steam so I thought I'd write it here since I know we're all in the same situation.

Given my timeline below, I'm just wondering why nothing's been going on with mine...not even a tap (as opposed to touch). *sigh*

Anyway, congrats again to all who have received their NOA2s. I wish you the best of everything of things to come! (F)

You've probably seen the thread that Mew gave you. Basically if you go on USCIS.gov and set up a portfilio there, you can check on your updated status. Just a run down of how to get there:

~hop on uscis.gov

~click on "case status and processing dates" under Hot Topics on the right side of the page

~If you've set up a Case Status Portfolio, on the left side of the page, click Login. If you don't have a portfolio set you you can by clicking on "register" or towards the bottom of the page you can create a customer portfolio

~If you have a case status portfolio, simply log in, and you'll see several headings:
--Receipt Number/Email/Last Updated/Form#/Form Title

~Take a look at the Last Updated column. From what I heard, everytime USCIS handles your application/petition, the scan, I'm guessing a barcode which will update the date on said column. Everyone says this is how you know you've been touched.

Yea, don't worry much Jacquie. I haven't been touched since CSC got my RFE. I also worry but there's not much we can do but wait even though it gets frustrating. We all want to be with each other since like...oh yesterday? but you'll be okay as long as you can find something to occupy your time. It'll come don't worry. Good luck to ya!
