Soliel, We have the same case... I was also previously petitioned VIA K1 and was already approved. However we got married before my interview so I have to file again. What sort of waiver do you intend to include? Any format?

To my fellow VJer's: Just would like to ask what is written on your approved I-130 (NOA2). Does it states anything about being sent to NVC?

I have only received mine and it indicated something like "The petition indicates that the person for whom you are petitioning is in the United States and will apply for adjustment of status.....If the person for whom you are petitioning decides to apply for a visa outside the United States based on this petition, the petitioner should file form I-824 ....."

Does that mean that CSC will hold on to your I-130 and I don't need to prepare anything for the I-130 anymore? I am confused since some VJer's got both of their petition processing with NVC...

How do i confirm if my I-130 was retained with CSC? Also how will i know if my case was forwarded already?

When you received your NOA1 for 129F?
BTW,if you "touched" on I 130, it means (almost sure) that you'll be approved within the next couple days on your I 130 too.

NOA1: 04/03/07
Transferred to CSC: 06/09/07
NOA2: 08/15/07



Congrats also to my Fellow VJer's that got their approvals... since like CSC is moving... running perhaps :thumbs: .

You see a touch by creating a portfolio on the uscis.gov website.

Go here and click create/edit customer portfolio: https://egov.uscis.g.../jsps/index.jsp

Add your case to your portfolio, and a touch is when you see the last update date change (even though you won't necessarily get an email or anything else). It means someone, somewhere did something with your file and scanned the barcode on it meaning it was "touched"

My question is how do I check with Manila US embassy when my interview date is?

I guess the only way to confirm this is to check with VJEr's filing purely CR-1/IR-1 only... and see if their notice contain words saying they have forwarded the case to NVC.

I just got my medical exam today and it was quick! So my advise is take your physical exam early on Wed or thurs of the week to avoid the rush.

Also just an head's up for those going for medical, the new fees are Php6,525 payable only in cash and in Philippine Pesos so make sure to bring enough cash.

Yodrak: thanks for the clarification, so the I-824 is the same as the AOS since instead of filing AOS, you will just be filing I-824 to continue the approved IR-1? Which one would be quicker? Also in both cases will the beneficiary be in US already?

I am still yet to see how long my NOA1 would come out so as to see in the timeline if it would be feasible to be filing for a K-3. Since as Mononke28 states, NOA1 might take at most 30 days...

Hi Vj'ers,

This is my very first post, after reading tons of information with regards to IR-1 and K-3, I am a bit loss as to the advantage of filing a K-3.

My Wife just filed the I-130 last March 16, 2007 so we are waiting for the NOA1. However I am not sure as to whether I will be filing the I-129F for the K-3 when I receive the NOA1 since upon researching, some are getting IR-1 earlier than K-3. I don't want to be stucked with 2 approved petition and have to file I-824 just to transfer my approved K-3 to IR-1 (assuming K-3 was scheduled for interview first). However, part of me says my IR-1 might take longer since I am seeing some IR-1 petition that is stucked or have a timeline of more than a year.

Any advise you can provide with? It would be very much appreciated. Thanks!


A bit of background regarding my case:
I was petitioned before under a K-1 and it was approved and I was scheduled for interview March 14, 2007. However we got married married Dec. 2006 (due to request of her very old Grandmother) when wife went here for Christmas Vacation. So I called up US Embassy in Manila and was advised to still proceed with the Interview and Medical Checkup. To cut the story short, I was not issued a Visa and the consul advise me to ask my wife to file I-130 in her place of residence. So we have to go the process again of waiting. Right now I am doing everything on our own, since we got the service of a lawyer before for the K1. So I am thankful to this website/forum for all this information provided. Kudos! to this website and all the moderators.

My K-3 was just recently received at CSC which I have last March 29, 2007...

How do you determine a touch? I am checking my case status online and can only see the recent update. Funny thing is the date change from 06/10 it became 06/12 per my checking however it still states the same information that my case was sent to California Service Center. Quite confusing

Hopefully NVC works in your favor, and remember I think there is a way to push the I-130 through, but I think it is a $200 fee or what not.

For some reason my time line estimate jumped back a few weeks in the beggining of the week now it is more than a month ahead. Is it really true that I should be expecting something this week or am I getting my hopes up for nothing just to be let down again? I am really pushing to get her here for the holidays no matter what. Before I wanted the CR1, but now the K-3 is fine with me too. It isn't like she is making any real money over there anyways, so if she doesn't work for a while it is fine, I just need her here.

I wanted to go via the CR-1 route frankly since I K-3 didn't get me to US sooner than expected and I would have to go the hassle of AOS when I go for K-3...

But I guess if NVC would work on my benefit and process the CR-1 too.

Normally around 4 months. You will be receiving a snail mail from them stating that they have received your petition and due to backlog it may take till 5 months for your interview.

You may also check your case online... via the Manila US embassy website. When your case is already posted you may get an advance information regarding when your medical and interview date is. After a month you may be receiving your interview packet.
