my guess is that is the average of all 129f petitions.  Those of us that took 7 or more months are bringing the national average up.  Perhaps currently they are at 5 months, but that was not the case for the last year. I filed in Oct and was approved 7 months later

UGH!!!! I am so sorry this is happening to you! I had my US congressman contact the embassy and they did respond, took them 3 weeks, but none the less they responded. So they have given you absolutely no reason for the "denial"? Do you have anything strange about your case? I guess if it were me and there was even a slim chance of making the k1 work I would keep fighting, starting over means more time away. Can the embassy deny? I was under the impression they could only give an opinion, but I could be wrong...I'm still learning about this whole agonizing process. Whatever you decide, good luck!

Haven't heard anything yet. Emailed the Embassy last Saturday night, they have not replied. Thought I would give them a little bit of more time.....ClockWatch2.gif . How are things with you?

It must be very frustrating for you. I emailed them last Thursday to get clarification on the AP, but also have heard nothing. They do take their sweet time answering correspondance. I tried to call them too and no one answered and couldn't leave a message because all the mailboxes were full. I am just trying to learn some patience, something I am not very good at. Please let me know when you here something, crossing my fingers for you.

So.... this morning I called DoS  to check any update on my case. We have been undergoing AP for almost 13 months, so I expected the lady to tell me ( like always have) you are still on Administrative Processing, but instead she said, you are " Pending". I asked, what do you mean by pending? Does that mean we are still undergoing AP? She said, let me look..... so she came back and said, well yes you have been on AP, but your case says it is "Pending" ...

Anyone has an idea? The reason why I am asking is because on June 24th we received an email from the Algeria Embassy stating that they were getting ready to make a decision on our case within the next 10 days.... well it's been more like 20 nowClockWatch2.gif  and no decisions yet!

 

Please any input is great! 

 

 

Have you heard anything yet? I sure hope you are approved soon!

My K1 date from the NVC was 5-12, I tracked the package online and it said it was ready since 5-23. My fiance in Algiers sent and email and they didn't respond, he even went to the embassy and they would not give him any information. I the USC sent an email and it was responded to within 20 minutes. My advise is for the USC to send an email asking for the next steps. Good luck

I have no idea what is going on there. If it were me I would send another email asking for an interview date, I would also send the form as requested by email. I sent mine via email, I am happy to tell you how I did it (took me a little time to figure it out) send me an email if you want any help. I am so sorry that you are having to wait for an interview, I can't imagine how frustrating that must be. I hope that your fiancee will have her interview soon.

Sorry you were treated this way. I had a similar situation. I tried for months to get the letter and couldn't. I sent in pay stubs (6 months) , tax forms (3 years), and bank info and it was accepted without question. My embassy Algeria, is pretty tough, so you might be fine with the same.

This is my experience with AP in Algeria for k1...Husband (fiancé at the time) had interview was given a 221g form at the interview and put on AP. We heard nothing from the Embassy other than confirming the AP, at 60 days I sent an email asking for an update about 2 weeks later I received an email stating that his visa was being processed, total time in AP about 2.5 months. AP is different for everyone, but it is not uncommon in Algeria here is the email I used if you want to send them an inquiry (I used it last year so hope it is still current) IV-DValgiers@state.gov

Hi,

 

you need to email the embassy and request packet 3. Then your fiancee needs to make an appointment with one of the two doctors the embassy accepts. Once you have your medical appointment, and your fiancee has all the proper paperwork you can email the embassy and request an interview.

You most likely won't hear anything from the Embassy in Algiers. Once you have your case number send them an email requesting your packet 3. Personally, once I knew the papers were at the embassy I got the information from the guides here (it is exactly what they will email you ) and I had my fiance call and set up his medical he called both doctors and took the soonest appointment, then once he had his medical appointment I sent a email to the Embassy requesting the first interview date available after his medical date. All of that seemed to go pretty smooth for us. good luck, let me know if you have any questions

Thank you everyone for the information. I know his petition is at the embassy...NVC sent it 3 days after it arrived there, it has been at the embassy since 5-23. Does anyone know if I the petitioner get get the email, or does he as  the beneficiary get the email? So far neither of us has received anything. Also, I understand they want a lot of evidence, we have pictures (a lot with me and his mom, and sister, grandma etc) emails, skype chat, will they look at those at the interview, or has their mind already been made up from what is in the packet?

I am wondering what has been the experience of others, how long does it take to get an interview in Algiers, do they tell him when the interview is or does he have to make the appointment ? I just want to verify that, should my fiancé expect an email, or a package in the regular mail? When I look online https://ceac.state.g...ker/Status.aspx it says that our case has been ready since May 23, and to date he has not received anything. If it is just emailed I am worried that he has not received it. Should he email the embassy and ask for the status? I don't want to do anything that would upset them...Please advisegoofy.gif

Also... marriage in Algeria will take months due to paperwork, so make sure to understand what is all involved before going that option. We opted for msrriage in Tunisia.
The bottom line though is if he is denied now you will still have the same issue to address. You might just want to wait it out and see the actual result before choosing an option.

Thanks for your advise, I just called the department of state and was told it is AP at the embassy.  I feel better now.

Where did you or they get the idea that the brother was somehow involved in your his K 1 application?

As far as timing of you getting married I am sure you know you have 90 days to marry once he is in the USA so going there to marry isn't exactly rushing the idea by much anyway.

One member advises that you should wait for AP. If the brothers actions some how affect this procedure then we know the outcome of that AP. The only way around that decision would be marriage.

No one knows what the outcome will be at this point but most cases like this are sent back to the USA where people are advised to file appeals ect which never works and takes months to years.

Waiting for the AP process to occur can take many months during which you will not have any idea of what is going on nor a clue as to the outcome. Your fate lies totally in the hands of the unknown person.

I don't agree that the embassy is looking out for your interests. They are looking out for the USA. They have no way of seeing into the lives of all the people that attempt a relationship other than to ask for the info they do. If that meets the criteria they approve the case. Right after its gone thru A P. The question really is what is involved in A P in these cases.

You will have to determine what path is acceptable and how long you are willing to wait for such efforts to get what you want. Going there to marry takes time and effort. The day after you marry you could send in the forms you would have prepared in advance. Doing this is the only way to have any real control of your own future.

The way the brother comes into play is he is the one that introduced us and I wrote that in my how did we meet letter. (I was visiting him one day he forgot to log out of skype and his brother and mother called him, I thought his brother was cute he thought I was cute we started emailing etc.). I was expecting AP, the thing that has me worried is the CO telling him is file is being sent to the US, as she throws his passport at him. I have looked all over this site and I can't find anything on AP in the US. I am happy to wait out the AP if there is a good chance of approval after.

Yesterday my fiance had his interview at the embassy in Algiers. It didn't go very well, the CO was not nice and at the end he was put on AP, but he thinks the visa will ultimately be denied. They think he is being dishonest because his brother came here on a k1 and his marriage didn't work out, what one has to do with the other I don't know. It is crazy to me. The way I see it we have 3 options, wait out  the AP and hope for the best, I go to Algeria and ask to be interviewed to see if that helps, or I go to Algeria we get married and start the process over. I honestly don't know what to do, we don't want to make any mistakes, but like all of you we are tried of being apart and want to choose whatever path will get us together the quickest. Please, give me your thoughts good and bad. Thank you

My fiance had his interview in Algiers today...It did not go so well. The CO was very rude to him accused him of being dishonest, basically said that he was just using me to come to the US and I am too stupid to realize that (I find this highly offensive on many levels). They put him on AP which I expected to happen, They told him it could be up to 1 year (is it really that long?) I didn't expect her to be so mean.

 

One thing I don't understand and hopefully someone here can explain it to me is they kept all of the cards I sent him and photos he brought (they didn't make copies they kept the originals). Why would they need the originals, and will he get them back?

 

Back to the waiting game I go :(

I am pretty sure if you reread your past posts this has been covered. Anyway it takes a few weeks for the embassy to respond to any email. You need to send them an email requesting the packet, at the same time have your fiance call to get he earliest medical appointment, once you have that email send  them a request for the the earliest interview after his medical appointment.

According to our record you fiancée has been contacted and informed to provide his passport and an updated Algerian Police Certificate. Once we receive the document, the visa will be issued to him.

I asked for a year and that is what they gave me. I think if the request is reasonable they try to accommodate it. I put that I would be going 3 times once every 3-4 months for 10 days each visit.
