IR-1 / CR-1 Spouse Visa Process & ProceduresI-130 question
This is going to be long post, but here are the actual affidavits I have sent in my packet.
All names in the affidavits have been changed biggrin.gif

I, cousin of vareska, born on ... in Bosnia, daughter of ......, currently residing at ...... and the holder of United States passport# hereby issue this

AFFIDAVIT

stating that vareska (maiden name ....) and vareska hubby's marriage is a bona fide marriage based on the following:

vareska is my cousin, and I have known her for twenty-six years. vareska and I have a close relationship where we spend a lot of time together as family as well as friends. vareska and I were also work colleagues, and we attended high school and college together. I believe I am a good judge of her character because I have known her for a long time and we have gone thorough life-milestones together.

I was present when vareska met vareska's hubby online in 2003. We attended same college classes at that time and I was present when they chatted for the first time at the college computer lab. I have witnessed, numerous times, vareska chatting to vareska's hubby while in class, and later I have witnessed their chats via web-camera at home, as well as calling each other on the phone. I could see that she has developed genuine feelings for him because she spent so much time talking to him, talking about him, eagerly showing me his pictures and letter, adjusting her life to work around the time zone differences so that they can spend time together, and I have never seen her care that much romanticaly for anyone before. I have seen their relationship get serious when she went to Bosnia to meet him in person (Summer 2005) and again in 2006. Upon her return to Dallas, she shared with our entire family that they plan to marry as soon as they agree on the place of their residence.

I have had the opportunity to meet vareska's hubby when he visited her here in Dallas during the summer of 2007.
During his stay in Dallas, I spent time with both of them together and have been able to conclude that his feelings for her are genuine, and that he is as committed to their relationsip as she was. Towards the end of vareska's hubby's visit, vareska and vareska's hubby informed the family that they have gotten engaged, and plan to marry the following year (2008).
They were married on July 24, 2008 in Bosnia. Both of my parents flew to Bosnia to attend the wedding, and to meet his family. Unfortunately, I was unable to attend their wedding due to work.

Vareska has shared with me all of the obstacles of her relationship with vareska's hubby, who, at first, did not want to move to Dallas. I remember them breaking off the relationship for short periods of time because the residency issue came to be a roadblock for them. His family ties to Bosnia and his patriotism, I learned from vareska, were the reasons he insisted they live in Bosnia. She insisted that the United States was a better place for a young, college educated couple to start their life together. vareska and vareska's hubby were very determined to be together and they kept trying to maintain the relationship despite the underlying differences in their plans for future residence. They are now eagerly awaiting to begin their life together in Dallas, Texas.

As someone who has witnessed their very first online encounter, and having seen their relationship evolve into a genuine and committed marriage between two people who have overcome many difficulties of a long distance relationship and are very much in love, I attest under the penalty of perjury that it is my strong conviction that vareska and vareska hubby's marriage is a bona fide marriage.

cousin,
sinature

IR-1 / CR-1 Spouse Visa Process & ProceduresI-130 question
I guess my I-130 packet could be described with one word: excess biggrin.gif
However, we just got approval notice after 58 days, so I am going to show here everything that I have included in the packet, and maybe some of that can help you get ideas what to include in your packet.

For affidavits, I didn't keep them just factual; the affidavits my family wrote were personalized testimonials in which they described how and when they learned of our relationship, how everyone including my husband was then opposed to the idea of him coming to the US, dates and insights of when they met my husband (then fiance), their judgement of his character and of our relationship and commitment, and then the affidavits were concluded with summary of our wedding and our plans for future (where will we live, etc).

Since hubby and I don't have any children or any intermingled financial assets, our proof of bona fide consisted in showing ongoing long term relationship prior to marriage, and evidence (phone logs, emails,...) of communication after the wedding-present.

do you get that message where it tells you that your return cannot be submitted since you did not put valid social security number for the alien spouse?
Where it asks you for social security number for the spouse, what did you put?

I am following correctly, in the field where his SS3 should go, i should type in: ITIN number needed
Then, when it tells me that my return has error, I should print it out anyway?
Then, together with that form 1040 or whatever it is, you mail also W7 that the spouse has signed, and his/her certified passport?
Since you are filing married jointy, then did you mail 1040 to your spouse to sign, and then sent to IRS, or did you just sign by yourself?
What am I missing, and am i making this more complicated than it is?

Appreciate your time very much!!!

For SS# I put "none" and attached W7 with passport copy, mailed 1040, W7, passport to IRS/
Please call me tomorrow (505)660-4862, will be easy to enplane.

Thanks so much, go ahead and erase your # from public forum, I wrote it down wink.gif

IR-1 / CR-1 Spouse Visa Process & ProceduresTax Return...need advice ASAP
Svetlana,

How did you handle your return, did you do it yourself or did you have a professional tax service agent help you?
I went to HR Block and I had a W7 form that my husband signed and sent to me, and I had a certified copy of his passport and our marriage certificate. They told me they cannot help me because they would need my husband to sign a power of attorney letter and send it back to me, then they would issue an ITIN, then we can file my taxes. Some people on this site have talked about doing their return themselves and sending W7 with it, and that's all, but once I have done that with the tax software I keep getting a message that there is an error since I am not putting in my husband's social sec number (insted I put in "ITIN needed").
So, I didn't feel confident filing a form that is giving me an obvious error message. I am so frustrated. I went to 4 different HR Block offices and no one could help me. They said maybe I could get ITIN if I presented my husband's original passport?! He cannot mail me his passport, I don't even think that's legal to do in any country! I ended up filing for an extension until I figure out what to do ( I am getting refund whether I file as married or single, so I figured that was safe to do).
So, here I am freaking out still what to do.
I know this is a lot to read, but if you could offer some insight into how you have done your taxes it would help me.
Anyone else who has successfully completed their taxes and gotten a refund, do you all have any advice?

Thanks!

IR-1 / CR-1 Spouse Visa Process & ProceduresI-130 Assembling Instructions
Greetings,

I have used a 2-hole punch and punched the top of all documents and used an acco fastener to bind it all together. I read somewhere on USCIS site that that is their preferred packaging method. They ask that all tabs be on the bottom of the pages for easier filing, so that's what I did.

I made a cover sheet on which I listed everything I included in the packet in the form of bulletin points.
I had a section for I-130 and filing fee, then next section was G-325A forms, then husband's documents, then next segment was my passport copies, then affidavits, pictures, phone logs, etc ...
So I used a tab which I would label with the main idea of the section, but on the sheet where I put the tab I also typed a short description of what the purpose of that section was, any additional comments, etc.
For example, I had trouble with my international marriage certificate wherever I went, because everyone I gave it to (my bank, social security office, drivers licence office,...) kicked it back without realizing that the international certificate although in French has English translation as well as any other major world language in the back of the form:) So, I typed a small paragraph on a sheet of paper and called it to their attention that the marriage certificate included in this section has english translation in the back. Then I stuck a tab on the bottom of that page that was labeled "supporting documents".
I did this for anything that needed clarification; multiple email addresses we used over the years, proving that husband's prepaid cellphone belonged to him (made a copy of the activation card). etc.
You get the idea smile.gif

I included a ton of pictures. And I mean a ton smile.gif
I arranged them all on a plain sheet of paper, numbered them and under each picture put caption where the pic was taken ( I made sure to include pictures we took by landmarks, either here in Dallas or in Bosnia), something recognizable, and there were already dates on the pictures.
So, I glued those pics to the sheet of paper, and inserted them in those plastic protecting sheets, punched 2 holes again on top of each sheet so that they fit into the acco fastener with the rest. It looked like a mini photo album (remember that when they flip the page, since the holes are on top when they turn over the page the pictures need to be glued the opposite way than the other side, so that USCIS can view them easily without turning your folder over wink.gif ).

The filing fee check and the passport photos I have put in small plastic bags, labeled each bag with our names and my alien#, and stapled them to a blank sheet of paper ( I also read on the USCIS website to do this).

This is probably more info than you needed, but oh well smile.gif

QUOTE (Riggs @ Apr 30 2009, 07:59 PM) <{POST_SNAPBACK}>
Hi all,

When filling out the I-130 form and all other associated forms, I put "N/A" in all spaces whre the answer is either none or deos not apply; however, I noticed on the sample forms on this site that they put "none" as the answer to those types of questions.

Does it make a difference if I answer N/A or none?

Thanks much

Steve

This is a piece of wisdom one of my fellow VJers has given me:
Don't put N/A unless it really is not applicable to you, because USCIS views EVERYTHING as applicable smile.gif
For example, if the question is list your children and you don't have any, then you would put in NONE, you would not write NOT APPLICABLE wink.gif
If you answer a question, and answer is no, but under that answer there are more questions pertaining to the same matter (for example dates of birth of your children, and you already wrote NONE that you don't have any, than on the other questions about it you can write N/A because it makes sense.

I am using the children example off the top of my head because I don't remember what the I-130 form looks like anymore smile.gif

I hope this makes sense to you, it did to me. I followed this little guide someone gave me smile.gif and I didn't have any problems.
Best of luck to you!

And for the I-130, first i will try to contact the USCIS or NVC and ask for the necessary action on this matter. It is better to correct this mistake asap before you face complications in the future. Let us know how you did it so other people will have the idea when this happens to them.

This explains ALOT in my case. I wish I would have gotten this notice from NVC. They just approved my case and sent it to the consulate. At the interview we got 221g partly because of this. If I would have known, I could have taken care of it long before the interview. I was over the limit for 2007, but I owed the IRS 10k which put me below the poverty level.

Holly !@#$% how much do you make to owe 10K in taxes ?!?! smile.gif Or has this accumulated over the years?

IR-1 / CR-1 Spouse Visa Process & ProceduresAttorney Fee ? Need your Opinions.
Here is my humble opinion on the subject:
The only reason one should hire an attorney in this matter is if there is something in your or your husband/fiance's past that's not squeaky clean and in your heart of hearts you feel like it may pose a problem.
But if you're two honest people genuinely in love / marriage (together laughing.gif) then paying for an attorney is not a good idea in my opinion. The visa process has changed a lot in such short time and with the information posted here and kind people willing to help, there is no reason why shouldn't be able to complete the process yourself.
Good luck whatever you decide!

In Latin America, when you get married, your wife takes on your last name but in a different way than here in the states. For example, say my name is Jose Alvarez and my wife's name is Maria Perez. When we get married her name officially becomes Maria Perez de Alvarez. While in the US, it's usually Maria Alvarez (if she decides to take on my name)...

Which version should I use in official US forms? The english version or the foreign version? (or both)?

Whichever way it is spelled out on your marriage certificate would be my educated guess wink.gif

Hi Riggs,

When you enter your profile after logging in at VJ, at the left upper corner you will see:

You click on your log in name, and you get to your actual profile page.

Then you click on: Edit your signature

After that in the text box you type in:

Then you click on Update my signature under the box, and your signature will be saved. You need to update it every time when you have changes on your case, as well as timeline.gif - the VJ one, when your case is updated. Thanks tongue.gif

Hope that info helped you a little good.gif

I believe he was asking how to add the actual time line into the signature without typing it in, you know the one we actually update for statistics?
I don't think it can be done, but I might be wrong.

By the way, I'm tired of working in customer service too....16 hours a day facing customers is exhausting....anyone know who's hiring for data entry of back office work?
sad.gif

Moving soon to a one bedroom apartment...getting excited but don't have enough time to pack, I'm tired of paying rent to my mom and staying in her place...my toothache is killing me also and I called off again.

Oh, I feel your pain, going through toothache myself...
I am also excited to move into our apartment when husband gets here. I am lucky enough that I am not paying rent while living with my parents right now, that's a real life saver.
How come you work 16 hours per day, I didn't think that was legal anywhere any more?
I hate customer service, I am so ready to move on. And being the customer service manager is really the lowest of the low laughing.gif

Mistakenly sent the I-129 form along with the I-130 form to the Chicago lock box. The I-130 was accepted with a NOA 1 date of 4-7-2009 however, the I-129 was rejected because, of course, it wasn't filed with the Service Center after receiving NOA 1. They kept all the forms and information I filed with the I-129 and sent only the rejection notice. I decided after reading info on the VJ site to only file for the CR-1 and not re-file the I-129. Will this delay processing of my I-130 form? Will they be holding the attachments and my I-129 form thinking I will resubmit to the California Service Center? I registered with the uscis web site and my I-130 hasn't been "touched" since NOA 1, is this normal?
Great website, I have been glued to it since joining, so much good information.

Please direct all visa questions to the appropriate thread. We're trying to have fun here smile.gif

Dear Vareska:

I have filed my I-130 on 4/27/09 with CSC.

How do I find out the "touch down dates" you have quoted here? what are these touch down dates?

Thanks

Howdy neighbor!
You sign up here with your receipt number, and you can track if someone has "touched" your case. https://egov.uscis.g.../jsps/index.jsp
It really just means that, that someone is doing something with your case. Doesn't mean it's a positive or negative thing, it's just moving through the process smile.gif

Hey, will we relax in this thread, or we'll talk about the visa journey again? unsure.gif unsure.gif unsure.gif wink.gif tongue.gif

Just thought I'd start a page where you can come and vent, rant, have fun, whatever... to get your mind off of this tedious visa stuff while you wait for your significant others to come online
You could call it a pointless, mindless page smile.gif

So, this is your status page, share whatever you like

Vareska is eating sugar cookies at 12:30 am and hoping no one in the house will wake up to see me because I am breaking my diet. Every time I am on a diet I sneak around and have snacks like it's the other family member's diet that's being broken, and not mine. It's quite pathetic really this cheating game I play laughing.gif

And the cookies are some patriotic themed ones, with little red, white and red stars sprinkled all over them, which I don't like so I am scraping them off.

I think you should enjoy life and eat an extra cookie for me. I know I'll be thinking of you while I eat my strawberry shortcake ice cream.

IR-1 / CR-1 Spouse Visa Process & ProceduresWriting Affidavit Help
QUOTE (Johnnny @ Jun 11 2009, 09:27 PM) <{POST_SNAPBACK}>
Our friends just write a letter, and give there telephone number and address is this gonna work?

Yes.
You DO NOT have to get it notarized. Just writing a letter is fine.

What I was getting at is that IF you ARE having someone write an affidavit, then let them state WHY they think or know that your marriage is bona fide. The point of affidavit is not to prove that you are married, but that you are married "for the right reasons".
I decided to have our affidavits notarized so that they have more "weight"...

IR-1 / CR-1 Spouse Visa Process & ProceduresWriting Affidavit Help
I had my sister, my aunt who attended the wedding, and two of my cousins write the affidavits.
I grew up with my cousins, went to school together, even took same college classes...I am close with the youngest of my aunts, and of course I am very close to my sister...so they wrote that since they have known me so long they believe they are a good judge of my character, and from all details they know about our relationship they conclude that our relationship is genuine and our marriage is bona fide.
They included information when they met my husband what they thought of our interaction, bla bla bla
They provided their passport numbers, and wrote in the affidavit that they declare under the penalty of perjury that our marriage is bona fide. Signed, dated, notarized.

Hope this helps you

IR-1 / CR-1 Spouse Visa Process & ProceduresIV BIll Question
QUOTE (nyrhythm @ Jun 11 2009, 12:58 PM) <{POST_SNAPBACK}>
thanks guys, i paid the IV bill. I haven't reevied email as of yet.
Now what happens next? Do i get DS-230 check list or the entire DS-230 package?

If you paid your bill online, then you don't "get" either.
What happens is as soon as your payment is processed and shows PAID, a cover sheet will become available to you to print out. Just like for AOS bill...
So, you can click on the link that's on the side of the IV bill to get more information on documents you need to send in, a check list included, and that's it.
Print the cover sheet and send in with required form and documents.

Good luck!
