Doesn't mean necessarily you will be denied. It's a red flag just be ready to address the subject of asked. It may not come up at all.

What country ? I observed from experience and from other members experience that no matter what country Nigerians are residing in,

they will always be scrutinized on a deeper level. Make sure you keep your residence permit current.

Ok so it was not a 'legal separation' and therefore you can not claim it as such.
If you have anything at all that can proof you went your separate ways it would help, such as did she move out of the home,

emails, letters or proof when she was unfaithful, how did you arrive at the conclusion she was unfaithful etc...

 

Not needed for other low fraud countries but critical for Lagos due to the short gap in the relationship change.

Remember everything you claim could be verified during potential AP with home investigations.

An added separate sheet of paper saying on your previous B2 apps that you were still married but separated since .....would have been 

helpful for your petition now. They will cross check all applications and you need to convince them in detail that you were truly

separated and not seeing your current wife on the side as a means to immigrate or viewing the separation of your ex as an arrangement with your ex for her to follow you to the US later. This is the core issue you must address. Everything else should be no problem.

 

Since i don't have any paper or substantial prove to put in our package to show that i was separated b4 i met my current wife, and i wont be going trough Lagos. i will be going trough  the embassy which i went trough before during my previous B2 Apps  that was denied cos i still have my residence there. Will i be denied

Sounds like all would be easy to proof and back up with documents and papers to convince the CO so I do not 

foresee too many problems with not marrying in Nigeria. One thing is always to back up your red flags with evidence to prove your case.

If you claim something prove it. If you moved to another country to work at a company then that can be proven.

What papers do you have to prove a legal separation from your ex before the divorce was final ?

It does not necessarily prove that you were truly 'separated' just because you moved to another country for work.

So, I would focus on that and see what evidence you can come up with that your previous relationship was truly over and dead when you 

met and dated your current wife. 

 

I agree with you that i really need to back up my red flags with evidence to prove my case. But in this situation of mine, i don't  have any papers to prove my legal separation from my ex before  the final divorce. cos we separated informally, it was a spoken agreement between  both of us  cos the marriage was not really working again.

Your wife needs to make a time line for the petition and send it in.

Proof that you were separated from your ex in Jan 2011 and that she moved out of the house would help.

Thanks for all your response my wife will try and put in a time line, Me and my ex wife got separated and i left Nigeria since then, i have been working here. we planned to do our wedding in Nigeria but  during the time we planed it, my company got a new project in Bahrain which i was transferred there to go and manage it. And my wife leave have already been approved, and by that same time she got admitted into a nursing program which she is supposed to start  towards the ending of her leave and she will not be having more time to spend with me when she visit. cos of her work and school program. so we decided to do the wedding here. we are planning to travel to Nigeria by  this Dec Will this help?

Personally in my evidence submitted I would write up a relationship timeline and plug in those dates you just mentioned when wife filed, when you separated when you meet new wife, decided to have relationship, the visits, when you filed for your visas. This will help pull out all those mountain of pages the facts.

  • September, 2009 ? Trip #3 to Osaka, Japan. Sweet reunion.
  • November, 2009 ? Request assistance from my Congresswoman ? Carolyn McCarthy - to make inquiries on my behalf to the U.S. Consulate in Osaka, Japan regarding Mickey?s lengthy AP.
  • December, 2009 ? Case remains under Administrative Processing status.
  • January, 2010 ? I make a request of the U.S. Consulate in Osaka, Japan to meet with the investigator handling our case in hopes of expediting the lengthy AP period. Request granted.
  • February 8, 2010 ? Fraud investigators from the U.S. Consulate in Osaka, Japan pay a visit to Mickey?s parents house.  His parents confirm that our relationship is genuine and that they support it.
  • February 16, 2010 ? Trip #4 to Osaka, Japan. Meet with fraud investigators at U.S. Consulate in Osaka, Japan. We are both interviewed separately and asked many questions pertaining to the details of our relationship. We believe all went well.
  • March 2, 2010 ? Mickey called to return to the U.S. Consulate in Osaka, Japan on March 23rd (after almost 8 months of Administrative Processing). 
  • March 23, 2010 ? Mickey?s visa application is denied.  Reason for denial: Investigator did not believe I was committed to marrying Mickey within 90 days of his arrival in the States on the K1 visa. Why? Because at the Feb. 16th interview with the investigator, I stated that I filed a fiancé petition instead of a marriage petition so that my kids could meet him first before we get married and be in attendance at our wedding. Investigator interpreted my words to mean that I needed to ?understudy? my fiancé and that I wasn?t sure about marrying my fiancé.
  • April, 2010 ? Attempt to overturn denial while case still at the Consulate: Letter sent from my attorney ? Marc Ellis ? to the U.S. Consulate in Osaka, Japan along with affidavits from friends and family attesting to the fact that my intention was always to marry Mickey as soon as he arrived here on the K1.  Attorney letter and affidavits never acknowledged by Consulate.
  • April/May, 2010 ? Plan our wedding.
  • May 29, 2010 ? Trip #5 to Osaka, Japan. 
  • June 1, 2010 - Get married!!!!!
  • June, 2010 ? Upon my return to the U.S., file an I-130 petition for my husband to come join me in the U.S. on a CR-1 visa.

Here are the answers to your questions. i met my wife on fb, we begain as friends. then i was having issues with my ex wife things where not moving fine in our marriage, until  june 2011 when she filed for a divorce and which was granted in  july 2012. b4 then we where no longer living together cos i was living  out side Nigeria and shes in Nigeria. We were separaeted, but  my staus was still married cos i have not been offically divorced then cos our divorce case was still in court.

This are my red flags, i applied for a  visit visa in april and may  2012 and i was denied two times, cos i have no strong ties. then my status was married cos my divorce case was still in court with my ex wife. finally i got my divorce papers in july 2012.  in dec 2012, i got engaged to my fiance who i have been in a relationship  since 2011.  then we  finally got married last month. shes is almost 10 years older. shes has not been married before and she have no child.  currently she is carry our baby. she have made two visit to see me and my mum. so please i would like a constructive answers from experienced vjs , cos i cant stand to stay away from my family. she is USC by origin. i know i will get good advice on this wonderful forum, I am about to start the process but i dont want to make any mistake.

Hello, Vj family. i greet everyone in the house. i wanna thank everyone for all your support and advise that i received here. I'm  almost tru with our package but  please i have one question. In i 130 form. there is a column that asked about your other names. i added my pet name which is the short  form of my first name and other name that my family normally call me and my wife call me too by that name and  my fb  have that name also all our  convo that name was mentioned cos my wife loves calling me by that name. but the name is  not in any of my id or documents. And in my previous  b2 visa apps i didn't include it. where they asked abt it cos i thought it was not necessary. Will it be a problem for  us to result to a denial.

Please I would like to know if someone have experienced this type of error from uscis ? We checked uscis website to check our status since its 6 months since we got Noa1. But to our greatest surprise we saw our status changed to post decision and it says that they have decided to reopen our case due to the appeal tht was filed and the items we sent for review but we didn't file an appeal no negative decision was sent to us. We have not heard from them since noa1. So what can we possibly do about this mix up? Because this is an error.

Big age differences are a Red Flag to the COs depends on alot of things the only requirement for a K1 visa is that you meet face to face at least 1 time in the 2 years prior to your filing so you have that but you will need to over come anything that they will think is for immigration only It depends on if you are still in child baring years, if you are different religion, race, etc... these are things you will have to address and just prove you have a relationship... just read others posts in the embassy review that might help you...
