I have searched the forums and found tons of information but nothing that directly answers the following question. How much supporting information should be sent with the I-130 at the time of original submission?

I have read here that pictures, affidavits, emails, phone records, chat transcripts, and photos can be sent. But there does not seem to be a clear answer as to what really needs to be sent and how much of each type of supporting documentation. I have, at last count 200 emails, 180 pictures (of us together), 10 pages of phone records, 95 pages of chat transcripts. I plan to get 4 or 5 affidavits that state we have an ongoing marital relationship.

Should I include copies of ALL of this with the original submission, or should I send most of to my wife to have for the interview? If ALL of this should not be submitted then how much of what is SAFE to send without generating an RFE?

I am still at the point where I am gathering everything together and it is a bit overwhelming, especially when the instructions are not clear on this area.

I am sure you will read all sorts of answers for this question. My answer is not only coming from my experience (case will be complete tomorrow) but also from experience as a US Government Employee in two different areas.

Follow the directions. ONLY include what they ask for. DO NOT overload your application. My evidence? Two affidavit letters from people who attended the wedding and an affidavit from my mother who watched my children while I went to Africa to get married. THAT WAS IT! I have NEVER had an RFE.

BUT my OWN personal opinion is to send them in two seperate envelopes so things don't get mixed up/lost/etc. You can send them at the same time though - no big deal. We have people who have sent the IV packet weeks before they sent the AOS packet because they were waiting on things. It really doesn't matter.

It's based on Murphy's Law. You should bring everything to the interview so that if there is a question, it can be answered. Why risk an RFE if you can have it with you?

Don't rely on every bit of your file to make it to the CO's desk. Things have been known to get lost in the transfer of documents. That's why it's recommended in all of the guides to bring an exact copy along.

We actually EACH have a copy of EVERYTHING that has been sent and we will BOTH be at the interview EACH with our packet of EVERYTHING.

They will redeliver. This happened to a couple of February Filers also.

It's possible that your case will be complete before the end of the month - possible but not probable. If it were to be complete by 7/4 then you MIGHT be scheduled the second week of July for an August interview. From what I have been tracking, India is pretty quick about scheduling after case is complete.

Interesting.

I would have thought that if you didn't want an agent you wouldn't have to fill it out. If I were you I'd call NVC and ask. I know if the roles were switched in my case and I were the beneficiary I would want to be the one to be getting all the correspondence.

What type of visa are you getting? You mention getting married in the US so are you filing for a K1?


I got married in Senegal and took my husbands last name. I came back home and changed all my documents including my passport, social security card and driver's license. THEN I filed the I-130 paperwork for the IR1/CR1 visa.

How are you getting to the US to get married?

I met my husband in person for the first time 2 days before we were married. I am nearing the end of the process - just waiting for the interview to be assigned. I haven't had any problems thus far in the process. Just make sure all your paperwork is complete and accurate.

My understanding is that it will be a problem. Whether or not they will accept your explaination or not, I don't know. My guess - No they won't. Everything has got to match, especially when from a country that receives a lot of scrutiny. If I were you I'd be getting a new one ASAP.

All documents should be translated into English. Some will say you don't, but really do you want to get to the interview and then be held up in getting your visa because you don't have a translation?

You know, you never know with NVC. My guess is that since the dates aren't going to match there could be a problem. May I ask why you didn't submit the original, when the instructions say they want originals?

your affidavits along with most of what i've seen seems to be matter of fact "on such and such date...". so i will just get the third parties to stick with the facts as opposed to descriptions of the ceremony.


All of mine also included their date and place of birth, phone number, email address and physical address. My mom had her's notorized.

This is what I am doing. I fly to Senegal on the 3rd and fly home on the 7th. I'm HOPING they will issue visa the same day (they issue on Tues & Thursdays and our interview is on Thursday the 6th), but if they don't then he'll get the visa on the 11th and fly home on the 12th.

Just my humble opinion.

Also Remo has an interview on Wednesday next week in Islamabad so we'll know soon enough smile.gif


My reason to go to Pakistan is to bring her with me, otherwise it does not really work for me. I do not want to go if she is not coming back with me. Let see how Remo interview goes. Being there for her at the interview is a good reason to be there also.

I'm going not because my husband NEEDS me there but because it helps to show bonafide marriage.

Finally spoke to someone who has worked at NVC for a while now and she recongnized my concerns about filling out the form. She mentioned to me that it is better this way and even though the form mentions the Child Citizenship act, it does not follow the act to a T. It is there for a reference and she also told me it is better 'cause once my kids step onto US soil they become automatic US Citizens, nothing more to do and no green card for them.

Do my kids qualify under the CCA of 2000 - No
Did I start the whole process correctly by filing out I130s - Yes
Did I get a valid RFE - No real answer, just a better situation
I asked her to mention this to the managers and see if the wording could/should be changed

I just waited until it came in the mail. I went through CSC though when they were REALLY quick. Things all around have slowed to molasses speed. Sorry.
