K-1 Fiance(e) Visa Process & Proceduresif i get the visa, can i go to usa then come back
QUOTE (Penguin_ie @ Sep 10 2008, 04:38 AM) <{POST_SNAPBACK}>
I'm with pushbrk- your best option is to delay the interview for a while (London seems pretty accomodating with requesting specific interview dates), say till June next year or so, then assuming you get approved, you have 6 months o use the visa, which will take you to December 09.

thank you all for your prompt replies, i will definately consider delaying the interview. however you all know what hell it is waiting to be with your other half, sacrifice yes, but i dont know if i can go thru this anymore. i'm also really questioning whether its worth my while doing this qualification simply put, i will still have to study when i get to michigan, because the skills for life stuff i teach though needed is not a main subject area there. sooooooooooo once again i dont know, any teachers who have experience of transferring thier skills to the usa, can help me out .

much appreciated.

K-1 Fiance(e) Visa Process & Proceduresif i get the visa, can i go to usa then come back
we got approved on sept 5, yeaaaaaaaaaaah. and now i'm wondering if i will be able to do this professional qualification. i start the certificate on fridays, it lasts for a year, until december 2009. i think looking at things that the london embassy is pretty good with giving out interviews and such, so tops i might recieve the interview date in about 3 months. that doesnt leave me with enough time to complete. so could i get the visa, go over there, get hitched apply for some other visa and come back and finish the qualification. I need it so that i can teach in USA, though i will probably still have to do further study there anyway.

does anyone have any ideas

K-1 Fiance(e) Visa Process & ProceduresIt didn't work out

I'm so sorry..

i'm with Ellie on this one. this is a big thing to do, leave your family, go to another country, get married, and if english is not her first language, learn a new language and/or culture as well. you have several months to use the visa. Maybe this is a better thing to do right now, rather than looking for bride no.2. ( ???? strange)) give her time, and if she doesnt want to marry you, then leave it alone. I know there are two sides to every story, but i know it doesnt necessarily mean she was scamming you. when i got married to my husband my jitters expressed themselves in constant worrying, bickering about silly things. it happens to the best of us. I had no problem leaving england, i spent two years saying goodbye, maybe she has some goodbyes to do, i dont know, but what i do know its better to err on the side of caution when it comes to marriage.
i wish you all the best.

K-1 Fiance(e) Visa Process & ProceduresPolice Clearance from country other than her homeland
I just had this exact conversation with my fiancé. She also asked me to make copies of email correspondence, phone logs to Embassies, etc. to as you say, help us make a difference down the road. I did send an email to kyiviv.state.gov today asking for their help and a solution. Thanks all!

Thank you for your insight. We will try to communicate with an old friend who lives in Cabo Verde in hopes of having her seek-out the Police Clearance for my fiance.

K-1 Fiance(e) Visa Process & ProceduresPolice Clearance from country other than her homeland

oh ps. i was just thinking about that some more..If she was under the age of 16 in the 90s then I don't think it's important..I believe you only need police clearance for countries you were in since the age of 16. I do remember reading that somewhere. But also look at the items on the forms, they ask stuff like last address outside the US for more than a year..so if she had put Africa, then maybe you need that? Someone please correct me if I'm wrong!

Thanks again. Just spoke with someone in the consular section at the US Embassy, Kyiv. She suggested two options:
1. My fiance should contact the US Embassy in Cabo Verde and ask for assistance in obtaining the clearance (which by the way sounds ludicrous - why would the US Embassy in Cabo Verde even talk with a Ukrainian national?)
2. Suggested she send an email to: www.kyiviv@state.gov and explain her situation and ask for a suggested resolution.

Onward!

K-1 Fiance(e) Visa Process & ProceduresPolice Clearance from country other than her homeland

My impression is that it is very important for her to get that, especially considering it was for 3 years..I really don't know if since it was in the 90s it was less important? But I would think they need that for the background checks and things. At any rate it might raise a red flag if there is a period of time not accounted for. My fiance was in Spain for like 6 years recently. For us luckily he has a friend there who would be the "interested party" to request it. You might try asking USCIS about it; but then again you might get differing info..Some countries have a treaty between them which could enable your fiance to request through the embassy for one. In our case there was no such treaty between Venezuela and Spain. Booo more red tape for our process! :bonk: Sorry I don't have better info, we are in the midst of looking into this as well. Good luck! :)

Thank you for your quick response. She has a friend who remains in Cabo Verde and called her yesterday to request what you suggest. Her friend agreed to look into this at the Ministerio da Justico. I will call the US Embassy to verify the need. Good luck!

K-1 Fiance(e) Visa Process & ProceduresPolice Clearance from country other than her homeland
We are rather early in the K-1 process. Received NOA-1 on January 14, 2011. In preparation for the Ukrainian (Kyiv) US Embassy interview, we are compiling the necessary documents. Since my fiance lived in Cabo Verde, Africa for 3 years in 96 - 98, how important or compelling is it to produce a police clearance from Cabo Verde? The problem is that she must either present herself in-person to request the clearance or an interested person may request the document for her. Has anyone had this issue and what was the resolution. Spasiba bolshoye!

K-1 Fiance(e) Visa Process & ProceduresWould changing the interview date create a red flag?
Follow-up question: I have 3 years of 1040s including 2010. My taxes were sent electronically by the tax preparer so what I have are original copies. Is my understanding correct that since the originals were submitted, these copies I have are acceptable to produce at the interview? Thanks.

K-1 Fiance(e) Visa Process & ProceduresDocuments from my Ukrainian Fiancee - notarize everything or not?

It is common in Ukraine that everything is notarized. I guess no one believe each other without it. So my question is -- I need to get some documents from my Fiancee to get the K-1 visa I-129F submitted, such as her divorce certificate, etc. Should they be just translated or translated AND notarized? I don't see anything in the instructions from the USA web site with regards to getting anything notarized.

I appreciate any help!!
Thanks

We decided that my SO would have her birth certificate translated and notarized (apostille) for submission with the I-129F. Marriage and divorce documents were also notarized and translated. We had the same question before we sent in our petition without clarification. I found this information on path2usa.com. Good luck with the rest of your journey. We are at the 3 month mark since we received our NOA-1.

What do I do if I have a Birth Certificate in a language other than English?[/b]You are required to translate it into English. Two ways to get it done.

Can be done through a professional translator/services.
Anyone who is fluent in the language and who is not benefiting in any way from the petition can translate it.
It must state the below:

I, (translator's name), certify that I am competent to translate from (name of native language) to English and hereby certify that the above information is a true, complete and accurate translation of the attached original document.

Signature of translator.

I two-hole punched the top of our documents and followed the advice I received from the online lawyer I subscribed to. Even though I front-loaded the submission, our petition was approved in 122 days (no RFEs) by CSC. Double check everything. VJ continues to be the best source of information. Good luck David and Irina.

K-1 Fiance(e) Visa Process & ProceduresMoving from England to America on a K-1 Visa
Not simple but you both can complete the forms and supply evidence of your bonafide relationship without the help of an attorney. There is more to it than just completing the petition (I-129F). Besides including documents like birth, previous marriage, divorce records, you must show evidence that the two of you have met at least once within the past 2 years and that both of you are free to marry.

Go to the Guides link on top of each page and discover important facts about how you and your fiance should prepare for your journey. Also go to USCIS.gov for information about the K-1 visa petition process.

K-1 Fiance(e) Visa Process & ProceduresK1 dependent children

My Fiancee just received her K1 visa yesterday. We had planned on her coming to US and we would spend some time by ourselves then marry, before bringing out her boys (10 and 17) be a family However she was told by the consulate that she must bring the ten year old with her because he is on her visa. I am trying to understand what difference it could make if she brings him on her visa now or 2 months from now? Anyone who has done anything similar?

First, congratulations!

I am posting this quote from the US Department of State website for your information. Good luck!

http://travel.state....es_2994.html#16

Are My Children Required to Travel with Me?

Your children may travel with (accompany) you to the United States or travel later (follow-to-join). Like you, your children must travel within the validity of their K-2 visas. Separate petitions are not required if the children accompany or follow to join you within one year from the date of issuance of your K-1 visa. If they want to travel later than one year from the date your K-1 visa was issued, they will not be eligible to receive K-2 visas, and separate immigrant visa petitions will be required. If your child has a valid K-2 visa and you have already adjusted status to that of permanent resident, your child may still travel on the K-2 visa.

K-1 Fiance(e) Visa Process & ProceduresWhat Now

Good afternoon,

I have a quick question. Our case was approved and I'm going to visit my fiance next month. Exactly what do I have to provide him with for his interview? I'm sure the answer to this question is somewhere on here, but I don't have time to search as I'm swamped with work. Thank you so much!

You will have a few weeks until your petition is received by the Embassy. Be proactive and prepare by reading the KEV-1 list of documents that will be required. I am responding while being swamped at work too! Get ready, the journey has just begun!

Mike: Tasha will need 3 2X2 (50mmX50mm) photos for the med exam as well as 2 for the for the DS 156 for the Embassy interview. Lena took extra photos to the interview just in case.

K-1 Fiance(e) Visa Process & Proceduresmedical exam
As a seasoned VJ'er and respiratory therapist, if the scaring you refer to is in the lung(s), and the panel physician concludes with a chest film that it is from the past, she should be good to go. However, plan ahead and have her do the medical exam a few weeks before the interview in the event the physician wants to do a 3-day round of sputum cultures. This is what happened to us. It was a big hassle, but well worth the second long train ride and the cost of the hotel stay in Kiev. Good luck.

Find a court runner or attorney service in the other states where the divorce was filed. Have them go to the courthouse and obtain certified copies (get 3 of each) and overnight them to you. Then DHL them to your fiancee.

K-1 Fiance(e) Visa Process & ProceduresMarriage Broker Question

Ok i think Im going to leave the answer as "YES" and let the consulate sort it out. Just because I didn't use the tour aspect, I think they will say it's still a marriage broker I just didn't utilize that option to meet my girl. I'd rather deal with blah blah blah for 20 minutes then be denied by not telling the truth. I just got my girls info in the mail today so will be submitting my K1 next week. I'll keep you guys updated on the outcome. Thanks everyone for the information. Just when I think I have all basis covered another question comes up with no easy answer. That's what VJ is for! I'm hoping for a speedy visa. I'd like my girl to be here by December.

I labored over question #19 for 10 seconds as I remember. No was my answer since I determined that AnastasiaDate is a free dating site. Don't sweat it. Proof of an ongoing relationship is what counts. Again, good luck.

K-1 Fiance(e) Visa Process & Proceduresengaged while was married to USC wife

Two points about this

 1) His new relationship may very well be the bonafide one.  If they strictly follow the law, he may be approved for the visa, just based on that.

 2) Getting engaged while still legally married to someone else will not likely cause a problem in itself, as long as the relationship is real.

K-1 Fiance(e) Visa Process & ProceduresNew here! My concern is...

I don't know if this helps, but I also lived in two countries, and when I called police in Germany they told me to go to the German Embassy in my country and to require my documents there.
I went, filled all the data, and it was delivered to me in 2 days!

So, she just have to go to do Canadian Embassy and ask for the documents.

So does anyone has an idea of how long it will take for the Canadian Embassy in Hong Kong to process her request? I hope some Canadian members out there could see this and provide some information! :help:

Do you think I should ask my fiance to call up the Embassy and ask? Thanks!
