Hi. Sorry to hear about your interview. May I just ask, why was your case endorsed to fraud unit? I think that better to call US embassy about your case on what to do or ask your husband to call NVC (since they are processing your I-130) and ask them what to do on your case. Hope you will be approved on your K3 though so you can come to the US faster.... God bless you... keep praying..

Don't worry tngirl, there are some cases here, age gap has never been a problem to their application. Just bring all the documents you think can prove your relationships. And give them all to the pre-screener even she/he didn't ask it as long you know it would help you proving your relationship. From the email of our lawyer he wrote that the embassy said the new evidence received has overcome any issues in the case...it means, the additional documents asked by the fraud unit would be a big help if you will submit it on your first interview, As i remember, I enumerated it in my previous post here, look at it and if those documents are available bring those in your interview.

With regards to the lawyer, he made inquiries and contacted the embassy through phonecalls and emails.

To make this thread updated, my husband decided on April 20 to get a service of an immigration lawyer who will represents us in making follow ups and inquiries. Our lawyer keeps us updated and in his email last May 5 he said :

"From my several emails and telephone calls inquiring into the status of the K-3 visa, I have reason to hope that the visa will be issued within the next 10 days, and possibly sooner. I have been informed in the latest off the record discussion that your visa file has undergone officer review, that the new evidence received has overcome any issues in the case, and that the visa "is good to go." The remaining wait time appears to be for final security checks/clearance, and supervisory reviews.

In the aforementioned discussion, I intimated that you are both anxious for visa processing, and that I may have to take certain actions in this case to insure fair processing. I was asked if I was coming to Manila, and I said that I would rather avoid that, but that my appearance and other actions might occur in the event of further unnecessary delay. That is when the foregoing details were relayed to me."

WE are both happy about the news that the lawyer gave us. I hope everything will get better soon!

(to update this forum again) I just called the embassy today and asked for the status of my k3 application, and the customer service i talked to in the immigrant visa said that as of April 7, my papers are still under review and the turn-over period is 6 months so call them back after 6 months. She said I might be called for another interview, or to submit additional documents, and I will be notified for another instructions. I am very dismayed because i was done with the fraud unit, and I thought everything was okay I have submitted all the documents they required, I answered all the questions with all honesty. I am just wondering now, if my papers will be under another review in the immigrant visa unit, why my interviewer in the fraud unit returned to me the 600 pages chats, the emails from my husband, the emails to my husband, the 300 copies of pictures together i brought that day, they are proofs of our relationship. I don't know what to do next.....can i pursue my CR1 since we already paid the $400 and i already received a packet even my K3 is under review?

They never told me to withdraw directly. My first encounter with the fraud unit was last march 12, my interviewer said why I married a divorced man, i am single, i have a good job, Am I that desperate to go to the US? The interviewer tried to confuse me that this path I am going through is wrong. , My interviewer also told me stories where some applicants withdraw their application after enlightening them that this is not the right path for them, that they deserve something better. So i think its just a part of the interviewer's strategy to encourage indirectly the applicant to withdraw, it depends on the applicant on how they gonna stand out for the relationship and to prove that it is love that made them together more than anything else.
As i have read in some thread, there's what they called redflag, one of those is the big age gap. Of course at first since the consul didn't know the background of the relationship, and they think that there's something to be cleared of or to clarify, they forward the case to the fraud unit, who conducts interview in a very detailed way which takes long hours. The applicant will ask first to answer a 2 pages questionnaire which includes educational background, the name of the parents and siblings and their ages, the work history, the residence since birth, some questions about the relationship, how and where did u meet, if you have engagement ring, and even the home address sketch.
In your case, Mercy signed a withdrawal of application, its her choice. Maybe she didn't able to overcome the pressure of the questioning, since she cannot answer some questions especially she doesn't have enough information about you and that was your good chance also to explain why your income is below the poverty line. As i imagine it, she had hard time during the interview because she didn't know how to answer more of the questions especially about you. And that's how the interviewer makes a conclusion about your relationship.
Just take it positively, maybe its the best time for you to get to know each other very well, to build a good and deep relationship, and to have full disclosures about your past, your present and your future plans, before you decides to get married either here in the Philippines or in abroad.
(this is only how I can explain it based on my experience at fraud unit)

Hi Reaubean, his first visit was April 2007 he stayed for 1 week, then he came back last June 2008 to august 2008 he stayed for 2 months. We got married last June 2008.

No they didn't ask me to pay for the visa delivery. After the head consul signed my sworn statement and put a dry seal, he brought me back to my interviewer. I asked my interviewer what is next she just said, they will send it back to visa unit ( im not sure if i heard it non-immigrant or immigrant). Then she returned some original documents. I read some post here, that says, some just received a phone call that their visa is already issued and will pay the delivery on cash basis. But i am still hang up there.

(to update this thread) I had my interview yesterday at the fraud unit ( the continuation of my march 12 interview), i brought with me the 600 pages chats, All the emails i sent and i received from husband (because my interviewer said the 20-30 pages emails i submitted initially are not enough) , 300 additional photos, and my government remittances like SSS, health insurance, mutual fund, taxes certified by my employer showing I updated my name to my married name. I had 6 hours interview where my interviewer asked every details about my husband, his job, how he earns his income, his properties, information about his previous marriage - the full name of ex wife, the age, job, how long the marriage last, reason of divorce, who filed the divorce, when the divorce was filed, the name of the kids, age, bday. Also all the details about our relationship, where and when did we meet, what was the first conversation, who started the conversation, how my husband courted me, when we started to have a relationship, when was our first meeting, who initiated the visits, when he said that he wanted to visit me, when he said he wanted to marry me and how things are being said. Who organized the marriage, where is the honeymoon, during his stay here, the places we visited, the date, the reason, the name of the person we visited. In our case we purchased properties, so the proof of the purchase, who initiated the purchase, the reason of the purchase and how things are being said. I was also asked, "If ever your petitioner is not American will you still marry him?", "If ever your petitioner wants to live in the Philippines and no plans of petitioning you, will you still marry him?" , "Did you marry your husband to work in the US?" the last question was "What do you want to say?, anything you want to say".
My interviewer printed out the questions and the answers, then brought me to the office of the head consul, surprisingly, he didn't conduct another interview, he signed the printed question and answer where it says it is my sworn statement and all the information i gave are true and correct, then i signed besides his signature, then he put a dry seal. He asked me if i have question to him, but i didn't ask anything ( i missed my chance to ask if i am approve or not headbonk.gif ) then he accompanied me going back to my interviewer, i asked my interviewer what is next, she said, she will give back my papers to non- immigrant visa unit. My interviewer also returned the chats, emails, photos and original copies of some important documents i submitted.

I received a notice from NVC that my I-130 petition is approved and the other day I received a notice regarding 'Bill to Agent" $400 processing fee for I-130 petition. My husband paid the $400 for the processing. My query is that, if ever the embassy issued me a k3 visa, what will happen to the CR-1 petition? Is it necessary to continue the CR-1, even i got approved with my K3? or is there any chance for me since i am having hard time in my K3 to transfer to CR-1? thanks VJs innocent.gif

(Just to update this topic) ...I went back to FPU last march 12 to submit the additional requirements they asked. I was being interviewed but it was cut when the interviewer looked for our emails. I am scheduled to go back again on March 26 to submit all the emails and all the chats we have, and for the continuation of the interview. I hope everything goes well.

The Fraud unit gave me list of additional documents and once i completed all those, I'll call them back. I hope they will give me schedule for the next interview. innocent.gif

He probably should have been there at interview with such a large age gap but there is nothing you can do about that now.
He should be on the phone to his congressman or representative first thing Monday morning. He needs to get involved to show he is interested and you have valid marriage.
You need to show the marriage is valid not that it is viable. So he needs to get involved ASAP.


I know he already faxed a letter to his senator, but no reply yet. Do u think it would help if he calls directly to US embassy fraud unit?

If they ask you any questions you can answer "because I love him so much" or "because we are in love" Answer that way and you will be fine!

I thought if you sent relationship proof in to USCIS, that they could not use proof of relationship against you or is that a misconception, I also thought that the consulate officer was not to re adjudicate unless there was clear and convincing evidence of fraud. i presented lots of documents showing genuine relationship and marriage but it seems the issue of age difference would be a big deal. Its hard to convinced them that it just so happen that i fell in love with older man and i cannot see any wrong with that......... crying.gif
