It's your personal choice. Are you submitting any of the other suggested evidence? If not I would probaly send a couple of pictures, but if you are submitting any of the other evidence then I would not.

Photos are listed as any of the suggestions, and wedding pictures don't seem to fall into the category of "relevant documentation to establish that there is an ongoing marital union." But if you don't have anything else, I don't see how it can hurt.

Thank you SO much for responding. I am submitting 2 leases with both of our names on it dated 2005 and 2006 and my mother and father are doing affidavits as well. I think I will submit the pictures just for the heck of it! :)

I'm filing the I-130 petition tomorrow for my husband and I'm STILL confused on whether or not to submit pictures of me and my husband together?

Could someone please tell me if I do? Or do I wait for the interview and show that stuff then? I have pictures dated all the way back to 2003 but they are on the computer and are printed out on printer paper. But for our wedding pictures I just got them developed and they are on photo paper.

I used to live in C Amer and have passed through Honduras several times---and made a few trips there on purpose (mmmm, diving). I think it's one of the friendlier places in the region--can't blame you for wanting to go back for more! smile.gif

Yes, I try to be organized! I always put things in the form of a checklist so I don't forget anything. I even did when packing for my trip to Honduras lol!

I didn't know that you can do a part typed and part hand form, I'll remember that for future reference.

I didn't go diving when in Honduras but next time I go, I think I'll check it out! Seems like A LOT of fun! Where abouts in Central America did you used to live? Yes, Honduras really IS friendly and it's true, I can't wait to go back for more lol! :D

You know something? I realized that they gave me bad info at that consulate and I cannot believe of ALL the places that THEY would give me bad info! Very disappointing! But better finding out late than never I guess! :)

I am still VERY nervous about filing and plan on doing it this week, either Wednesday or Thursday. I'm sure you're right though, everything will start to make sense once the ball gets rolling!

As for my only option is mailing in the petition, well I found that out too! lol Cannot BELIEVE still that the Consulate told me to go to my nearest DHS office and file it there! lol :wacko: Glad I didn't listen to them!

I know it's a bit confusing.. the Consular staff work for the Dept of State. They don't have anything to do (generally) with the submitting the petition part of the process. What they told you WAS true---about 5 years ago. :)

As for forms, I generally used fillable forms. If you download the demo version of Adobe 7, you can save your completed docs on the computer. Otherwise, just capture a couple of photocopies for your records (I keep a complete copy of everything submitted for my own records.. all the way thru N-400).

Yes, reading that page did help me. Now I have a check list written out and I'm checking things off as I put them with the forms.

The fillable forms seem really like a good idea but I've just decided to do it the "written way" lol! (Hopefully that won't count against me...I doubt it, but you never know!) I'm just going to make two copies of the package that I send, so I'm sure it will be okay. I'm also making a copy of the check I send them too as well as anything I get from them!

You said that you wish you were going back to Honduras? How did you like it there? It was my first time when I went and I loved it!

The one that you can type online and then print out? Or the one you do by hand?

I would think that it would be better to type your information, save it and then print it so the processing center won't have to guess what you wrote.

My name is Megan and I married my wonderful husband in Tegucigalpa, Honduras January 13, 2007! A few days after we both visited and talked with someone in the U.S. Embassy with DHS who gave us the I-130 form, 2 G325A forms and a list of everything that must be submitted with it. She also told me to go directly to the nearest DHS office (I live in Savannah, GA) and submit the paperwork and file everything.


Megan, they gave you bad info at the Consulate. You must file to one of the national Service Centers unless you're in Dallas, OK City and the one other DORA test site city.

Was anyone REALLY nervous when filing and wondering if they were doing it right?

We all were--well, I was, for sure! The stakes are high! But give yourself a couple of weeks and it will all start to make sense.

What is really better? Filing in person or doing it online or sending it in? I would think filing in person would be better, but I'm no expert!

Where you file depends on where you husband currently is.

If your husband is NOT in the US, you mail the I-130 Package to the USCIS. Section 10 of the I-130 instructions lists where you should mail the completed form(s). If you live in the United States this will be the Service Center with jurisdiction over the petitioner's place of residence.

If you reside in the United States, file this form at the USCIS Service Center having jurisdiction over your place of residence.

If you live in Alabama, Arkansas, Florida, Georgia, Kentucky,Louisiana, Mississippi, New Mexico, North Carolina, Oklahoma,South Carolina, Tennessee or Texas, mail this petition:

USCIS Texas Service Center P.O. Box Mesquite, TX


If your husband is ALREADY in the US and the Form I-130 petition is being filed concurrentlywith Form I-485, Application to Register Permanent Residence or Adjust Status, submit both forms at the local USCIS office having jurisdiction over the place where the Form I-485 applicant resides.

I had a feeling that the NOA1 was just to let me know they are starting to look at our case. The last time it says it was touched on the website though was the 14th of February. Is that normal? Shouldn't I have another touch by now lol?

I forgot to mention that mine was transferred to the California Service Center, so me and my husband are probably in for a really long wait!

NOA 1 is basically a receipt notice which says your application is being processed and shows a probable--highly unlikely--time range for completion.

Hmm, i just looked over my NOA1 and it has no probable date for completion at all. The priority date space on it is left blank. Is there usually a date there?


Actually I was looking over mine last night and forgot to mention that I don't have a probable date for completion either. My priority date space is blank too.

Ok, so I am wondering what happens after you receive the NOA1? Do we just wait and keep checking the USCIS website to see if our petition has been touched? Or am I supposed to send something else in?

I read the NOA1 paper several times, and from what I have read, it doesn't say to send anything...so I think all we do is wait now, right???

This is probably a dumb question but I thought I remember reading somewhere that you have to send in something else after getting the NOA1.

I'm just a little bit confused here and I don't want this process to be delayed because of something that I might have misunderstood!

Ok! So after doing SO much research I've made a checklist with what to submit with this I-130 package! Please let me know if there is anything I should add OR if there is something that I don't need to include with it.

1. My husband's original birth certificate and copy (front and back)
2. Copy of my birth certificate (front and back)
3. Copy of ALL pages of passport
4. Original marriage certificate, copy of it and translation
5. Passport pics (one for husband, one for me)
6. Both G352A forms
7. Affidavits from my both of my parents (read on USCIS.gov website to include this for additional proof)
8. A copy of my I.D. to show that I changed my last name and that I really am serious about this marriage!
9. And of course, the I-130 form!

Now for a few questions:

1. Do I need my original birth certificate? Or ONLY if they request to see it?
2. Do I need to submit copies of ALL pages of my passport? I think it is a good idea because my passport is stamped with the Honduras stamp. Or maybe they won't care and wonder WHY I included a copy of my birth certificate AND copies of the pages of my passport? Maybe I just need a copy of my birth certificate?
3. Do I include the pictures that I have of me and my husband together? I have them dated from 2003-present. OR Do I wait to submit those with that other form?

In the end, the K3 is more expensive, especially for couples married less than two years at the time of adjustment of status, because they would receive a two-year green card and also have to go through removal of conditions. Adjustment of Status and applying for work authorization is currently more expensive than removing conditions and may be raised to even more, plus there's time spent not being able to work.


Yes, I know it is. I'd rather just wait because in the end for us it will be a bit easier especially the whole work thing. He wants to be able to find a job right when he gets here and not have to wait for a few months or more if we did the K3.

Hi babybunny! Actually, at the time I didn't have the money to do it and my husband and I had agreed on just doing the CR1. I had a passing thought tonight if I should just do the K3, but him and I have decided not to and just to wait it out and be patient.

I know it hasn't been that long, but I feel like this process with the I-130 is going no where anytime soon!

Is it normal not to have any touches by now? (My timeline is posted in my signature).

Are the K3's faster than what I am doing? Or should I just be a little bit more patient?

This is the hardest thing that my husband and I have had to go through! :crying: It is just awful and I feel for everyone going through it!

Oh one more quick question: Is the K3 process more complicated?

No. USCIS service centers are concerned that the petitioner meets the requirements of the petition. They will process and approve the petition even when the petition clearly states that the beneficiary was illegally present.

Also, the petitioner is required to provide 100% truth on the petition - tell her that there is no reason to lie and lying on the paperwork will result in much more serious problems down the road.


Thank you kitkat 1, that is what I thought but wanted to find out from the experts (you guys, of course) first! :D I'm telling her today to get the process started and just see what happens and hope for the best!


It is not likely at the USCIS stage that a petition will be denied due to a visa overstay. It is very likely that the visa WILL be denied at the consulate and therefore requiring a waiver application.

Yodrak, I should have just asked my question in one simple sentence lol to avoid confusion! I'm a very detailed person so sometimes that can confuse things even more!

Anyways, I'm not even talking about a visa. I know the difference between a petition and a visa application too. I might not know too much about the roles of the USCIS and the DoS consulates, but that is why I'm asking this question.

I'll try asking my original question in a less confusing way! Could a USCIS Service Center deny an I-130 petition because of illegal presence (over 180 days) in the USA? Have you or anyone for that matter heard of that happening?


And would the USCIS Service Center send a denial letter saying that the person needed a waiver first? Or is the ONLY time you find out if you need a waiver or not is at the interview?

And I read on a previous post that NVC cannot deny you when it comes to the visa, that isn't their responsibility, it's the beneficiary's country's responsibility. Is that true as well?

The first part is true, the second part is not. The NVC does not make the decisions on visa applications. Neither does the visa applicant's country. The immigrant visa unit at the US consulate makes the decision.

Whoa! Nobody has addressed how the overstay would be viewed at interview, just who would be making the decision. An approved petition only means the beneficiary is allowed to apply for a visa. Overstays are not generally ignored by Consular Officers. All this information is disclosed on the visa applications and is a matter of record in the passport etc. These situations are best dealt with by consulting qualified immigration attorneys.

As for the overstay or the out of status, I am pretty sure if she petitioned an I-130 for her husband, it wouldn't be overlooked at the interview. But would the USCIS Service Center (whether it be VSC, CSC, etc.) overlook it and would her chances be good for approval based on showing she has a very strong marriage and that it does exist?

Maybe I'm confusing everybody, which I hope is not the case. For example, she applies and gets her petition approved, it is forwarded to the NVC and she does all the necessary paperwork and everything and then she and her husband get an interview date after its sent to his country and the day of the interview she finds out they need a waiver because of the out of status situation in the U.S. That could happen, couldn't it? I tell her to just do the paperwork for the I-130, submit it and see what happens. But she feels that her husband will get denied because of his illegal presence in the U.S. So USCIS could deny his petition because of this or would they hear this at the interview? And could a USCIS Service Center send them a denial letter saying that they need a waiver?

Or could it be a deeper reason than that? What if someone overstayed on their visa or if they were out of status for more than a year? I'm sure USCIS would deny that person because of that, right? Or would they let the beneficiary's country decide that? (the reason I ask that question is because my friend has a husband who was out of status in the U.S., received voluntary departure in front of an immigration judge, and her husband is now back in his home country. She is afraid to file a petition on him because she believes it will be a waste of time and money.)

Well that part is not correct of course. But since he wasn't deported he doesn't need a 212 waiver for deportation - only a 601 for illegal presence (assuming he was in the country illegally for more than 180 days).

Meg, voluntary departure is much better than official deportation. However since he was illegally present and since he was arrested, he will need a waiver. The good news is that it's 6-8 months for waivers there (it could be much worse) and of course the fact that he's eligible for a waiver at all.


Yes, I do agree that voluntary departure is much better. I thought maybe it was a blessing in disguise that Immigration treated it that way instead of a deportation. My husband told me that the day before he was sent back to Honduras, the "friends" he had made in the detention center received papers saying "You are deported for 5, 10 or 20 years". My husband became concerned because his name was not called for one of those papers. Finally his name was eventually called and he asked the ICE officer "For how many years will I be deported for?" He responded while looking at his file on the computer and in front of him: "Oh you're not being deported. You'll be able to come back in 6 months because we gave you voluntary departure." This still seems weird to me though because I didn't know that Immigration could do that.

And like you said about the other good news. It's only 6-8 months and he is eligible for a waiver thank God. Him and I discussed it tonight that it will be hard but we will get through it, just like everyone else on here has/will.

As hard as the Immigration process is, I truly believe that it makes us all stronger in the end (like aj1 said). :)

It might be easy, but those who enter the border and actually cross it and not get caught, they will suffer the consequences in the long run. I met my husband (was my boyfriend/fiancé then) and he had crossed the border illegally. We fell in love, in July 2005 ICE arrested him, and in October he was sent back to Honduras. He now looks back on his decision to come to the states illegally and really regrets it. The Immigration officers told him that he was not being deported and that they were going to treat it as a voluntary departure. Could that work in our favor? I'm hoping so, but I honestly believe we will need a waiver, and God knows how long that will take. :crying:

Sorry this is so long, but I'm just trying to let you know that I do feel for you and I believe that the U.S. needs to fix the government when it comes to Immigration issues. Being separated from our loved ones for this long is completely ridiculous and an outrage! :angry:

Congratulations! There will be two fees that you would pay to the order of "Department of State." First Fee is, the AOS Fee Bill which is $70.00 and the 2nd Fee is IV Fee Bill which is $380.00. As the others said, check with NVC forum. You will be able to finish up the NVC process in 2-3 months range.

You're referring to the IV fee and it's $380. Once you send back the Choice of Agent they will generate the IV bill. Also you CAN email the NVC on your husbands behalf BUT open a new acct for him instead of sending it from your own.



Oh it's $380, I forgot to add the security enhancement fee of $45 didn't I? Sorry about that. Ok, so I will be sending that to the NVC once the bill is generated and sent to me.

Oh, I can email them on his behalf. I didn't think it was a problem and opening up a new acct for him is what I would definitely do! Thanks for your help! :)

I read that site about what's needed for the NVC and I see that you're right Mononoke28, all I need is that 1st page of that Ds-230 form filled out and his bio page of his passport. He's getting his passport on the 15th this month so we're all set there.

The Choice of Agent part I read (and re-read again lol) but I'm so nervous right now. I just hope we do things right! I've just got to keep thinking positive! :)

About the Choice of Agent email, could I write it pretending to me my husband? Or does my husband HAVE to write it himself? I'm just wondering if it really matters because it's hard for him to get to the cybers sometimes!
