IR-1 / CR-1 Spouse Visa Process & ProceduresCase complete!!!
QUOTE (ivy88 @ May 28 2009, 04:53 PM) <{POST_SNAPBACK}>
I just thought I would let everyone here know that our case was completed yesterday.
My husband and I filled out the Ds 230 again and sent it in and it got approved. I called our lawyer today to let him know and as usual he was not in the office. I spoke to his secretary and asked her if they receive the email from NVC about the RFE and she said no, so it's obvious they don't check their emails. If it wasn't because my husband called and gave NVC our email addresses we would still be waiting for the RFE package.
Anyways, we're so close to the last step. I don't post that often but whenever I do you guys always give me great advice and support. Thank you so much for all your help!
Now we just have to wait for NVC to set up the interview

Congratulations for your completed case.I pray every go well at the interview. Some lawyers only take peoples money and do nothing after that.Pls try and keep track of things with ur husband.I wish you both best of luck.

FINALLY!!!! THE HEAVENS SMILED DOWN UPON US!! HABIBI PASSED HIS INTERVIEW AND WILL BE WITH ME NEXT WEEK GOD WILLING, IN TIME FOR MY BIRTHDAY BBQ WITH THE FAMILY!!! THANK YOU GOD :-)))

OUR INTERVIEW EXPERIENCE -HERE U GO:
congratulations

Here are the details of hubby’s interview. I figure it might help someone out there....maybe calm some nerves or give out some information that might get u better prepared smile.gif
Hubby arrived at consulate. Was not allowed to bring in any of the stuff he carried such as albums, wedding memory gift box I had made for him, diaries, etc. Was asked to leave bag @ cafeteria. Was only allowed to carry a folder with documents in there and some pics.

He first went to window # 6. They took the medical envelop from him, officer then got our NVC file, went over the DS 230 info. with hubby to ensure he knew all the details. He was asked my DOB and job, among other info. Then on to waiting….he was the last in. Others scheduled the same day all had left as he was called in. The consulate officer was a nice man of Indian descent. He didn’t want to c anything hubby had brought- no chat logs, no letters, not even wedding pics!!! He was most concerned with pics of family (especially one with the parents, with my mom and dad).
First was first asked to tell our story. How we met and how we know each other. So hubby reached to get him chat logs and first initial meeting on Facebook (for those of you who don’t know our story, we were each other’s true love 14 yrs ago when I was in high school and hubby was in college and were then separated by family, friends due to our differences in religion, and my family moved us to the US and hubby and I lost touch but found e/o again on FB). So CO was very interested in hearing details of the story and wanted to hear hubby relate it rather than look at paperwork. He flat out told him that. He said I want to hear u tell it to me, I won’t look at any papers. So he asked hubby “How do u know e/o?”

CO asked if we kept in touch with me all these years. Why not? Who found who first? AT THIS POINT UPON HEARING OUR FB STORY HE PULLED UP MY ACCOUNT ON THE PC AND LOOKED AT MY FB PAGE!! MY STATUS AT THE TIME READ: AWAITING TO HEAR THE BIG NEWS IN 4, 3, 2, 1!!!!
WOWWWWWWWWWWWW……=D HAD NO CLUE CO WOULD BE CHECKING OUT MY FB PAGE!!
He tried to find hubby's page but hubby had set his on private and told him u want my password, u can have it laughing.gif My silly hubby!! tongue.gif CO said "No, it's ok."

He then asked hubby a few more qs:
Where was ur wife born? What’s her DOB?
Why did u guys decide to not live here? Whose decision was it to choose America over Lebanon?
Why family wasn’t all present at the wedding?
How many times she came to visit you, will she come back?
Does she have family here?
Asked how we found e/o? Who found the other ( I did!!)? How come he didn’t find me or try to call me or write to me all these years.
If u don’t understand ask 4 q to be repeated
Demanded hubby speak English.
Asked about my divorce and ex’s nationality.
Saw my facebook page cz hubby said we found e/o on fb.
He asked hubby what time I go to work and when I come back. Wanted to establish if hubby knows my routine.

The CO did not even want to see my 2008 taxes!!! He only asked to see a copy of the police records and hubby’s original birth certificate, individual registry (Lebanese equivalent for ID) and family registry.
So glad it’s over!! Thank you for all my VJ buddies who helped me through this tiresome and stressful journey!!! Thank u guys! Special thanks to Lisa, Steve, Serendipity and Queudeup for answering of all my qs and the laughs we had =D And my newfound buds in the Awaiting Interview Thread: Champi, Gixbr, ATK, Amanda, K.D. , Princess, Corinne, ILMDD, vny, Noosh and th3mo, sorry if I missed any1, I am still in shock!! U are all so sweet and know that going through this with others kept me halfway sane lol Above all thanks to my hubby for riding this giant up and down roller coaster with me throughout all the ups and downs. And Thank God cz he showed us how to make our relationship even stronger through all this mess!!Hubby should arrive next week, Inshallah! I can’t wait for the big reunion!!!! No more goodbyes!!

BEST OF LUCK FOR THOSE OF WHO WAITING. HOPE UR EXPERIENCE IS QUICK AND SMOOTH LIKE OURS WAS!! star_smile.gif star_smile.gif star_smile.gif star_smile.gif

IR-1 / CR-1 Spouse Visa Process & ProceduresSome help here please
QUOTE (shwekhaw @ May 22 2009, 10:27 AM) <{POST_SNAPBACK}>
We did not hire attoney and did all the filing ourselves thinking we can understand them. Now I am not even sure what stage we are. Or which visa we are applying K3, CR-1, or IR-1. I see none of those visa types in the applications we filled out. So here is what we did so far.

I filed I-130 for my husband on October 6, 2005. I was still green card holder then. I got my citizenship in January 2009. I called USCIS a few days later and upgraded the status. They told me to mail over citizenship document which I did.

On March 9, 2009, we got a notice says following.
Case Type - I-130
"The above petition has been approved. The petition indicates that the person for whoom you are petitioning is in the United States and will apply for adjustment of status. The evidence indicates that he or she is not eligible to file an adjustment of status application. The determination is based on the information submitted with the petition and any relating files. If the person for whom you are petitioning believes that he or she is eligible for adjustment of status, then he or she should contact the local USCIS office for more information

Because the person for who you are petitioning is not eligible to adjust, we have sent the approved petition to the Department of State National Visa Center (NVC), 32 Rochester Avenue, Portsmouth, NH 03801-2909. NVC processes all approved immigrant visa which consular post is the appropriate consulate to complete visa processing. NVC will then forward the approved petition to that consulate."

Here are my questions:
Are we K-3, CR-1 or IR-1?
Why my husband is not eligible for adjustment of status?
If we go thourgh with NVC process, we have to travel back to our home country to take interview medical exam etc,
Do I have to go interview with him or he can go alone?
After interview, will he get visa right away to come back to US or he has to wait for some processsing time? If so how long?
What can I do to secure his reentry to US? Is there visa we should apply so even if there is waiting time after interview, he can come back and wait in US?

Im sure everything is going to be fine with ur hubby,im praying for u

IR-1 / CR-1 Spouse Visa Process & ProceduresMy wife got her visa
QUOTE (Malik2008 @ Jun 4 2009, 12:13 PM) <{POST_SNAPBACK}>
Hi everyone,

My wife's interview was yesterday, June 3rd and she got her visa. I am very happy and excited. She got her passport back today. Here's what they asked:

1) Why are you here today?
2) What does your husband do?
3) Why do you want to go to U.S.?
4) When was the last time you saw your husband? When did he visit?
5) Was it an arranged marriage?
6) What is your husband's favorite food? Did you cook it for him when he was here? Did he like it?
7) Do you have kids?

The thing is they returned the original documents before the interview. I am not sure if it's a standard procedure or if it means they had already decided on issuing the visa. Anyway, I would like to thank everyone here at VJ for their support and valuable information. I wish everyone good luck on their journey's.

Congratulations!!!!!!

IR-1 / CR-1 Spouse Visa Process & ProceduresConsul approved my CR1 VISA today!
QUOTE (jiskat08 @ Jun 16 2009, 06:37 AM) <{POST_SNAPBACK}>
Today is my interview at US Embassy in Manila. Last night before was terrible, I can't sleep because I was so anxious and something is really bugging me. I dunno what it is so I started to pray and read the whole chapter of Psalm 91. It was already 1:40am and I told my husband to wake me up at 6am even though I have my alarm clock. It's more effective if he is the one waking me up by calling me in YM! lol

Interview schedule time is 8:30am. I left the house at 6:40am. While i was inside the MRT, the rain started to pour out - I have no umbrella at all and my bag is so heavy because of my 2 kilos of evidences and forms.

I arrived in USEM at 8:10am, the guard told me to go to Gate 3 for Immigrant Visa Interviews and Appointment. As i entered, the guard said cellphones are not allowed inside, so I asked him where can I leave my phone and he replied - I don't know Mam - we do not allow phones inside.

I was frustrated because last year, they kept our cellphone and digi cam. I just found out that If you are a US Citizen - they will keep it but if you're not, good luck! The good thing is, there's some ladies outside the building wherein you can entrust your phone to them(just turn it off and put some password for assurance that they can't open it) however you have to pay them P150 from 8:00am to 12:00noon and additional P50 in the afternoon. I have no choice but to give my phone to this lady named, Dragon! I asked her, can i trust you mam? She said, of course and at that time, there was a lady who just claimed her phone from Dragon.
I felt relieved but still in doubt. It's not just a phone but an NSeries 82 lol.
congratulations!!!!

Anyways, I went inside the USEM and I followed the Green Lane (Immigrant Visa Section). I fall in line at the ticket booth and showed my Appointment letter. The lady gave me my number (6099) and a form stating about my immigrant visa.

I sat down and waited for my number to appear on the queuing board but the thing is they called my name for the fingerprint scanning at Window 33. (you have to be alert while you're sitting coz you will never know that your name was already called).

I went to Window 33, they scanned first my 4 left fingers then the lady inside the window asked my name and my date of birth. After the left hand, they scanned my 4 right fingers then after that they scanned my left thumb & right thumb altogether.

After that, you have to go back to your sit and wait again for your number to appear on the queuing board.

This time is for the pre screener to collect your documents. I was told to go to Window 25 and the lady is soft spoken. She startd to asked my name, my husband's name, my age, where did we met and she asked for the pictures. I gave her some of our wedding, YM & Skype screenshots & honeymoon pictures. After that, she told me that I didn't submit the attachment to my DS230 Form - I told her I submitted it and in fact I have my xerox copy with me.
She said, I dont have here you see? (gosh in my mind i was like, NVC is really a ####### or whoever checked my documents how come i have no RFE about this?!)

She put some white paper to erase the word SEE ATTACHMENT and she told me to write down my home address & she told me to sign the last page of the said form. After that, she told me to wait again till my number appear on the queuing board.

This is the waiting time. I've waited from 11:15am to 12:00noon until the operator said to go back at 1pm since its already lunch time. Grrr!

I went out and look for Ms. Dragon who kept my cellphone - good grief she's still there. I told her that I need to go back at 1pm and she said, if you will give your phone again, you have to add P50. Gosh, my money is not enough because I also have to pay the Air21 for visa delivery of P205 (it depends on the location).

I called my husband and he was waiting for the good news but I told him I have to go back again at 1pm.. I didn't eat lunch since im not really ok (I just want to hear the word "visa approved" then that's the time that I can eat! lol)

I went back again at 12:45noon and started to wait again.. My number (6099 and Window 32) appeared at the queuing board and that was past 2pm. I waited for a few minutes since the door are still closed. After few minutes, this couple opened the door since they're done. As i go inside the room, I saw this young white guy. He looked at me and he said, Magandang Hapon. I replied him in tagalog also. He said, sandali lang po (he was typing in his computer and he was reading this blue paper in his table) I was nervous since it was also cold inside the embassy and I started to look at him in the eye while he is looking at the pc and he looked at me back as if he was shocked. He asked me, can you speak English, I said yes. He told me to raise my right hand and swear that I will only tell the truth. Then i said yes. He said, now put your hand down..

This time, he started to look at our documents with his hands on his forehead as if he saw something.. I was worried and then he started to ask the following questions:

(this is a random question)

1. What is your name?
2. How old are you?
3. Where did u meet your husband?
4. Does he have kids?
5. Is your husband married before?
6. Does he have any kids? If yes, how many? Where are they?
7. What's the job of your husband? I said he is working in casino as a night auditor, he replied in casino???? I was like gosh, what's on his mind? So what if he works in casino?!

8. Is he college graduate?

9. Where does he live? I said, my husband lives with his parents, he asked why? (gosh I started to think but I told him, his mother asked him to stay with her but the consul said in our nature, its different he should moved out and I replied, once I get there, we will find an apartment on our own, we also need privacy. He was silent...

10. When did you meet him? I though he asked me WHERE that's why i replied, in Myspace.. at this time - he was kinda pissed and he said why you keep answering me the same answer even I'm asking you WHEN not WHERE. I said i'm sorry. Then i gave him the correct answer.. what a snob consul!

11. What is your job?

12. He started to look at our pictures, he asked me why you dont have any pictures that you are together? I told him, its there! If you want I still have here and by the way, I brought this 2 kilos of evidences. He replied, I don't care about your 2 kilos documents.. I asked him, what do you want? Honeymoon or wedding? He said anything.. So i gave him the honeymoon pictures.
(I really want to tell him, can you just please check first before you ask! lol)

13. How come you were thinking to marry him even without seeing him in person? I said, i love him...and we've been talking straight for 2 years before he went here to marry me... I have chat log and emails here if you want. He was silent again.

14. How long did he stayed here?
15. When did he arrived here?

Then after the assessment.. he paused and review the W2 of my husband and he started to file the papers in order and stamp it and encircle something in the paper and he told me, ok your visa is approved! I replied, Oh GOD thank you! He asked me, WHY?? (gosh this consul is really weird! I don't know if he wants to approve me or what?) I told him with a teary eye, we've been waiting for this moment! The consul said, just wait for your number to be called outside for the next further instruction about the visa delivery. I smiled and said, thank you sir.

His name is Thomas...

So, I went outside and waited again for my number to be called. The operator called my name and said to go to window 37 for the visa delivery pink slip.

After that, I went straight to AIR21 booth and I asked the lady if I can pay them once the visa is delivered in our house and she said yes you can.. (Cash on delivery). So she gave me a form where I have to fill up my name, address and cellphone number. Then finished!!!

What a day - tiring yet fulfilling! THis is the moment I've been waiting for. Thank GOD for the visa approval.

My husband is so happy and he will start to paint our room and buy some stuffs for decoration, I will start to go shopping.. again!

Praise GOD and Hallelujah!!!

regards, Kathy

K-1 Fiance(e) Visa Process & ProceduresWould you let him take a crap on you?
QUOTE (jegcs @ May 28 2009, 06:43 PM) <{POST_SNAPBACK}>
I came to the US through a Fiance Visa. My fiance is a doctor. When I got here, we decided to wait at least before 90 days to get married so we would know each other more because though we've been talking with each other for almost 4 years, we've only spent time in person for a week.

To cut this story short, my fiance had been seeing this girl whom he dating or have been dating for 10 years. Because of my work background, I am able to access information from him including emails, pics, call logs, sms's and other information which he is unaware that I have access to. So basically, this is not accusations, I have profs and picture with dates on it. The worse part is when they both flew to vegas 2 months before I came here. This is evidenced by dated pics and credit card bill statement and confrontation with him which he admitted.

I am decided to go back home to my country because I can't marry him because of what he did and his incapabilities to recogniize his mistake and make amends to them. I have given him lots of chances, tried to work things out with him and compromised for him. I have dealt with his repeated infedility to me until my few days before my visa expires. He is unwilling to correct things and that is why I am going home.

Is there anyway for me to stay in the states "Legally" without having to marry him? What processes would there be? If none, I am more than happy to go home and restart a life and hopefully get my job back.

im not sure u can stay in d US without marrying him.It might be good 4 u to go back home cos it looks like ur marriage may not work if u eventually marry him.Im sure u come to US cos of ur love for him,not cos u want to come and live in d US.
