YES hun, there will be more, of course the subject is so intense and after much bashing of USCIS lol - there was so much to do and they want to do in studio feed where people can call in. There were so many calls that could not be taken and alot from VJ - we plugged VJ as much as we could - but the message was heard loud and clear - the host want to support our efforts and so after I send them flowers this Monday, I am full fledge ahead.

The notion that Natz apps are taking priority right now (if they are) has a foundation in law. The petition for Naturalization is the only one that has a codified time line - the service is bound to have a decision to the petitioner within 180 days. No other petitions have these stipulations. You may not like it but it's the law.

I disagree that the service does not realize the system is broken. There's too much congressional testimony from Aytes where he acknowledges that it is. The system is technology arcane and understaffed - it has been funded by fees and not tax dollars. You cannot compare it to other governmental agencies because it hasn't got a bottomless money pit.

When calling in to check on my husbands case during the K-1 process- the woman told me something totally different from what I'd been told just a few days before, and when I asked her why she was telling me something different- she actually started yelling at me like you'd expect a toddler to, saying, "You are a liar! Lying! Liar! Liar! That's a lie!"

I think a lot of the officers treat us badly because they have a cozy government job, with no real requirement to strive for good quality services. It doesn't help that the ones treating us this way, probably get a power trip over the fact that many of us are afraid to complain or 'ask for a supervisor' like we would for ANY other service in this country simply because we don't want to jeopardize our efforts to get our loved ones back to us as soon as possible.

Hear you loud and clear, today is the day - spent alot of time last night on the phone with some wonderful people from VJ - have many stories and will try to get the jest of them in.

The one that made me fall off my chair and hopefully Taf post today although I think he is still in shock is this - His application got approved after his Senator sent in once again the request for expedite due to his mother's illness and a little note stating that " oh did you know this topic was going to be discussed on a FOX broadcast channel in the next few days" - could be just a timing perfection, but Taf thinks not. He also received a call from some head hefa at USCIS saying oh wow we couldnt find your paperwork but we have it now and will be approving your application immediately and then sending to NVC post haste. Hmmmm............

His story is one of many, but the more that call the more our voices will be heard. I know that there are people that will say "YOU CAN NOT FIX THE SYSTEM" but I can not accept that, for we know its broken, but with everyone doing what they can with their hammer and nails, we can try to mend parts of it. If not for us, for future Visa Journey people.

This show has a great audience and the hosts are super. Jamie and I will do our best to represent a broad area of what is going on, but I think our jest of the conversations besides the heartache and waiting will be this area:

MISINFORMATION - this is the biggest cause of frustration to many in all the threads - the CSR level of information is lower than McDonalds - I mean a person reading from a script is ok, but when a question is asked and I mean THE SAME QUESTION in one day (and yes we did this) and you receive three different answers for the same question, that tells me something is drastically wrong - this message needs to hit home. I get better responses from the WalMart greeter!!!

The government is unwilling to admit that the system has fallen apart, but yet we know different. Why, because of the experiences of this forum and other forums. Read the topics, and you will see - ask a simple question, get a million different answers and no clear guidance and if they had the thought to do so, at least update that website of theirs to reflect truth instead of totally insane timelines and did they ever fix the Chicago Lockbox blunder???

When you say that your file will be adjudicated within 9-10 months then act upon your words - when you say that the Chicago Lockbox is up to January 11, 2008 and there are so many that do not even have a NOA1 from September forward - that does not make sense. Reflect that SOME application are being processed from receiving date of January, but dont mislead people to believe that wow I filed in October and my check has not been cashed - keeping this in mind, maybe people would not be dialing that 800 number to inquire as to what to believe.

Dont tell someone that they are in FBI name check for security and then Congressional inquiry discovers that the file has been misplaced and approved the next day - That is inhumane and has incompetent written all over it.

Dont tell someone your file is lost on one day and yet the person receiveds an RFE the next day in the mail - if a file is lost and can not be found, then how can you possibly send an RFE -

So many more.........we all know the stories by now......but now they get shared and hopefully someone can walk in our shoes for once and have some better clout than any of us and get something done about this mess!!!

This will definitely go out to the heart of Floridian's and to many. Let me see if I can do it justice in conveying the story to you. It is a real current situation.

The USCIS is reviewing my expedite request. It has taken them a little over month to get the details. Normally I would of not requested it, but my mother is dying from cancer and wants to see my fiancee and I married before she dies. Hope that happens, however, I am assuming we are minimal 2 months to 3 months out even if it goes quickly and mom is starting to show signs that things are getting worse. She was diagnosed with stage 4 cancer, unable to opperate and it now has speard to her spine, brain, lung, liver and who knows where else. Looks like it is moving rapidly. Unfortunately she is also the caretaker for my 76 year old father and my 91 year old aunt and without her there, I will have to take care of them to keep them in their home they worked for their whole life for. I am making plans to temporalily reside there in Florida, not change my current address as I have a job where I can work form different places in the US, but to provide them security in their home. I sent off the heart felt request to the USCIS begging they help honor my Mothers wishes to us married before she passes and to allow my Fiancee and I to provide care for them as my Fiancee wants to help. My mother was a school bus driver and my father, a painter, both retired for a good number of years and have paid their dues in life. Anyway the USCIS requested additional information back on December 20th, 15 days after I sent the request, which I found to be some what unresponsive, but I provided a two page letter from me and the Doctors diagnosis, limited in detail because of Hippa laws. To date, I have heard nothing. I have made calls to the USCIS an been told literally "so what". Gee you think they would have a heart. Also, I called and was told they can not find my expedite request, so I faxed it to them again, pleading my case. Again, a week or so later I called the USCIS, now 5 months into my Fiancee Visa request asking for some update. At this point, I am told "nobdy has access to your case file and can tell you anything. Sit back and wait and we hope your Mom can live several months more, because it may take us some time to find your request. Say what? Find my request, your kidding. Nope, we do not see anything from you yet. At this point, I am speechless, begining to loose faith in anything happening and wondering what to tell my family. I can not imagine our Government being so unresponsive. I still pray I will make it in time and pray for a response, whatever it will be. I am not looking to bypass anyone but to just honor a life request. The last call I made this week, a kind woman from the USCIS practically was crying with me on the phone and said to me she was so sorry that the USCIS had not responded to me about my request. She read my plea and said she had recently lost her mother and would give anything to to do something her wanted to do for her. Well enough said, I thanked her and assured her this was not her fault but she felt compelled to me it is, because the USCIS should take ownership to answer the request. She had seen other requests for military personnel or ranking Gov officials that did not have anything like I was facing get approved quickly. Again, she appologized and said she was sorry. For now, I am left praying for help.

In the last week I have appealed to my congressman and so has my mother. There must be a better way.

I met mine in Elementary school back in 1987 in Lima Peru. I was born in NY but gre up in Lima
I had a huge crush on him! and used to follow him around like a lil stalker very terrible of me! ha ha !

Then in 1989 I moved to a different school closer to my house and he moved to Mexico. Never saw eachother again. Years passed and I moved back to NY went to college here in NY Ive been here for 9 years. In 2005 my friend told me to go check out this website hi5 that I could find some many people from Lima AND OLD FRIENDS so I did and found a lot of older friends, Then I wondered how this lil kid that I used to follow back in elemntary school was doing?! and looked for him and indeed found him..

We started messagin back and forth until we started chatting on the MSN and became good friends. months passed and In jan of 06 went to Lima to visit my family and to meeet him again ha ha.

IT WAS AMAZING we saw eachother and felt as if we have never lost contact I mean 19 YEARS HAD PASSED! and it felt as if we were friends FOREVER!
we felt we were meant ot be! We kept our long distance relationship alive i started travelling there every 6 months since 06, its hard to give tourist visas to come here so as much as he wanted he got denied. So we just kept positive and Of course I didn t mind traveling there! went there in jan 06, october of 06, april of 07 and last trip October of 07....

Oct 07 He proposed in front of hundreds of people at the airport in one of my trips there! and now we are engaged.
Came back to NY and sent the application with ALL of its requirments. I sent everything translated emails, letters birhtdyas cards, declarations of love , tons of pictures. Notarized Letters from my parents witnessing our engagement, what they asked I sent. =)


I also met my wife on hi5!!!!

I don't know if you want, but I feel like my husband and I have had a fairly easy time of this visa process so far, so if you want a "best case scenario" you can use ours. We met at Michigan State the day after my husband got there, August 11th, 2005. I was showing all the exchange students around. Most of them weren't from Europe, so when I saw this blonde haired guy sitting with a lot of the other US students leaders, I figured he was American as well, but was too cool to wear the required shirt. I sat down and said hi, then heard his accent and was like, "oops, not american". Anyways, we wound up living very near each other, so we kept running into each other over the next few weeks. We started talking, realized we had a lot in common and he practically moved in for the next 4 months smile.gif I called my mom 2 weeks after we started dating and told her I was going to marry him one day. He left Dec. 2005, we continued to visit back and forth every few months when we could afford it (not very often when we're both students!). I went over there January 07 and he surprised me with a trip to Prague and a proposal overlooking the city at midnight. Very romantic smile.gif I got everything together when I got home and filed the end of that month (I'd been doing research on VJ and other sites for some months so I knew what to do). Our NOA1 date was Feb. 2nd 07, NOA2 date May 3rd (though I never received notification via e-mail, the website or paper copy, so it wasn't until I called 2 weeks later using the RFE trick that I found out. I then called USCIS 2 weeks after that about the paper copy, saying my case had left NVC going to the embassy and was told K1's don't GO to NVC blink.gif ). We got his interview scheduled in London for July 3rd and he moved over here July 25th. We got married August 30th, big wedding and all that I got together in 3 months, go me smile.gif We filed for AOS, EAD and AP Sept. 21th, got both AP and EAD Nov. 26th and we have our interview in Cleveland Thursday. Crossing our fingers it all goes well and we are not stuck in FBI name checks. So, from start to finish, Feb to July to get him here (back in 07, now its just that for an NOA2!) and almost exactly one year from filing the K1 to our green card interview.

Looking back, I feel SO lucky and blessed to have gone through with no RFE's, the quickest possible approval at the time, my husband has VWP so could come visit the US and fast interviews both at the embassy and local stages. However, the last year has been AWEFUL, while all my friends and family have been planning their weddings for months/years, I threw mine together in 3 months. While they got to see their fiance for more than 10 days since they got engaged, I got to talk to mine a few hours each day. We met in college, fell in love, very typical for people our age, but we had to spend $1000's that we didn't have and months apart just to be together. Compared to most on VJ, I don't have much to complain about, but when you are out in the real world and everyone asks where is your fiance, when do you get to see him next, questions why he's even marrying you, it really really hurts. Then having to provide your entire life story, including love letters, financial documents to some unseen face who determines the rest of your life... Its degrading and frustrating. Necessary, but still frustrating all the same. Like you said earlier, if the employee's who answer the phones could at least be civil, knowlegable and truthful, it would help SO much. Thank you for getting the frustrations of US citizens who just want the simple right to be with their loved ones out there. Everyone cares about illegal immigration, but it seems like legal immigration, especially family based visa's, are left on the back burner.

we felt we were meant ot be! We kept our long distance relationship alive i started travelling there every 6 months since 06, its hard to give tourist visas to come here so as much as he wanted he got denied. So we just kept positive and Of course I didn t mind traveling there! went there in jan 06, october of 06, april of 07 and last trip October of 07....

Oct 07 He proposed in front of hundreds of people at the airport in one of my trips there! and now we are engaged.
Came back to NY and sent the application with ALL of its requirments. I sent everything translated emails, letters birhtdyas cards, declarations of love , tons of pictures. Notarized Letters from my parents witnessing our engagement, what they asked I sent. =)

CSC is still taking a little longer than VSC to process applications. As long as you know they have it, there is not much else you can do by calling them, unfortunately sad.gif

Yes dont worry mine received in Texas on August 30th and they still have not cashed - patience, pffttttt. but tis the only word i can give you....they told me to wait the 90 days before asking for more information - and oh yes, we had a lawyer do all paperwork. System pretty messed up now but at least your found this fourm like I did, helps us understand what is going on each day. My kudo's to all for the help

It's been an interesting week. My fiance did make some calls, and it turns out, our application was very likely lost. Of course, they don't actually say "lost", they tell him that they have been "experiencing some glitches" with the transfer of the system. Apparently they're now working with an outside service provider to help reduce the backlog, and as we know, have 'streamlined' the service centres that are now dealing with the K-1 visa. Since we sent our application to the Texas centre back in May, and now our area is the Vermont centre, I'm thinking that our application might be somewhere around Nebraska? no0pb.gif

Anyhow, the supervisor that he spoke to will be sending him a letter acknowledging this 'glitch', and for the system to indicate that it's ok if we have two applications in process at once - just in case they find the old application. No word yet on whether she can expedite the process now that we've been waiting six months (on their error). Nor anything on whether we will be grandfathered in under the old fee, or if we'll have to pay the difference, or just cancel the old cheque and pay the new fee.

Once again, lots of hurry up and wait! Oh well, at least contact has been made.


Just glitches for explaination for 5 months suffering wait? its really not responsible to say this by taking our huge tax every year!!! The hardness for the visa is insane...sad.gifsad.gif

Sure no problem we are almost at ninty days and its with California (with no receipt or money order being cashed). I took matters in my own hands yesterday after reading alot of threads here and thinking our government is screwed up and emailed my Representative here in Florida about did he want my vote or not and a bunch of other votes for that matter. We have a lawyer but they say the same thing.....wait for the 90 days. I have read some post where a NOA1 was never received and yet the NOA2 came along in the mail.

Not sure what to tell you here, except the following.....60 days is nothing compared to some here, one person is on five months but I think that is an application gone astray.............five months I would be flipping out with them.

Good Luck and read some post on this issue - helps me sleep sometimes knowing we are not the only ones in this messed up system of trying to get our so here.

I too am awaiting my divorce to be final here in the States. My SO is from New Zealand and had travelled back and forth on the vwp several times throught the past year and a half so that we could spend time together as I worked out my own mess. On his last attempt to enter he was turned away at the POE and told he would have to wait for the K1.

You could file for a waiver or a new visa but that takes time too and even then it's still up to the CBP at the POE who will already know about you in the system. You could get lucky but that's alot of money and emotion to put on the line.

I'm sorry. sad.gif I know just how difficult this is. We will need to wait until April to even begin the K1 process to get Russell home.

My husband applied for the six month visa also from the UK to come here and of course denied even thou we had not filed any papers yet. We totally understand why he could not come here aka strong ties to the USA - but when he asked them if he could do the VWP they said sure but make sure you check the box that states VISA was denied and after speaking with a good friend in charge of customs at JFK - he said this" You stand a 99% chance of him being sent back period. So we opted not to even try. If you do try make sure that you check that box.

No there are quite a few of us waiting since august for this little item - I made the call, did a tracer and got email yesterday and it stated...you are not in the system, please provide us with your receipt number.....ummm hello that was the jest of the tracer lol.

So what you want to do is check out the Guides here at VJ, look on the left and choose either the K1, K3 or CR-1 options and then you can have a look at the requirements, etc.
Then there are also our VJ Timelines that will help give you a rough estimate on what to expect time wise.

The K1 is slightly faster than the K3 or CR-1 but not by much at all. The whole process takes anywhere from 6 to 10 months processing time, so a move in early 2008 (which isn't far off) is quite unlikely.

I'd do some research, read it all over, take a break, come back and read it all again. It's a lot of information to absorb but once you do, it's pretty simple.

I was waiting for her at the gate, as hordes of people came out of the baggage collection area to leave the airport.

I kept waiting, eager to see my love come around the corner, but after 1 hour, there was still no sign.

After 1 hour and 30minutes, I went to Customer Services and asked what was going on, they contacted Immigration and informed me that Immigration was holding her there for further questioning.

She had brought ALL the documents and proof she would of needed to get by easily, especially as she has never left the US before, no criminal record, nothing which would of affected her at the POE, but this is the FIRST ever time I have heard of a USC being held by UK immigration.

The Immigration people called me and asked me several questions including:

- How did you meet?
- When did you meet?
- Do you have a job?
- Where do you live?
- Have you filed for any Visa?
- How much money do you have?
- Will you support her whilst she stays in this country?

The list goes on and I found out later she was asked those same questions before me, and they were comparing our stories together.

After 4 hours of waiting at the airport, upset, scared and worried that I would not be able to see my fiancee that day, Immigration finally called and said that she would be with me in about 10minutes.
And 5minutes later, I saw her come out of the baggage claim area, I ran up to her and hugged her close.


Although the Immigration officer PREFERRED that she would stay in the UK for 3 months, he did stamp her for 6.
She would not of got through if she didn't bring the following:

- A copy of the NOA1
- A copy of the whole I-129F package (We did not have the NOA2 at the time, but after I booked her flight, we got the NOA2 notice online)
- The IO made her get onto the USCIS website and show that we were approved for the NOA2 (So keep your receipt number ready and remebered!)
- Since we have been together in real, we have made a scrapbook of eachother with tons of pictures during the timeline of us being together, and this really did help support our case about how this was only for us to be together, not as an intending immigrant.


I advise that you try your best to not do this, which unfortunatly she did:

- Bring too many clothes (she brought two big bags full of clothes, hair stuff, etc)


This is only OUR experience with UK Immigration, others might of had it worse or better, but be prepared if you are a USC wanting to get through UK Immigration.
