Actualy I am filing a 2555EZ form " Foreign Earned Income Exclusion" along with 1040. I qualify for the Physical Presence Test since I was Physically present in a foreign country for at least 330 a year. I hope that helps us.

No, you can use an employment letter, and pay statements as proof. You will have to provide evidence, as to why you were not required to pay taxes, as you have not submitted federal tax returns.

I have been working in the Middle East for the past 18 months. I plan to return to US at the end of this year, and start immigration process for my Lebanese husband. I am being payed well above 125% poverty level but my salary is tax free. Since I didn't pay taxes to US government, well, does that mean that USCIS will look at it as my income was ZERO, and I cannot sponsor my husband ?

i do understand everybody has to have a medical record, but if there is no record available can they take the vaccines all over again ? at the time of the medical for instance ( he didn't have his medical yet )... unsure.gif i think i just answered my question

also, do the vaccinations include the series of 3 Hepatitis B shots that have to be taken now, 3 months after, 6 months after...

    Hello everyone... Thanks for all the great information on this forum... wish i would have discovered it before visiting my @#$% lawyer... dont want to make a long story short, so here goes:

    My wife is an American citizen and has been living in Canada for many years. We met here (i.e. Canada), got married and are now both living here while I finish my MBA. We want to move to the US, and so I have already filled my paperwork and even had my interview with a consulate agent, but they sent me home citing that I did not provide evidence that my wife is domiciled or has taken concrete steps to prove she will be domiciled in the US on or before the date I intend to enter.

    I have made a list of the documents that intend to submit to the consulate to prove her intentions. I plan to send the following:

    1. Offer of employment as of May 1, 2009, as well as her acceptance of this offer
    2. Her 2007 tax returns (although there is not much income; but my father in law is a co-sponsor... his tax returns have already been submitted)
    3. A letter from the bank (or a bank statement) showing that she has an account in the US with some money
    4. A letter from her parents stating that we will be living with them for the time being and that there is ample room for us


    Is this sufficient evidence to support our claim that she is setting up domicile in the US?

    Any suggestions/advice is more than welcome!

    Hi all, i'm new here. I am getting ready to start the immigration process for my Lebanese husband. It looks excrutiating. My question is about I-130.

    Question 14 is asking if I am a permanent resident alien. I am not, I am USC. However this is the story. I was born and raised in Europe. I got married to an USC, and I became USC through naturalization in 1997. My marriage to the USC lasted 17 years and died of natural causes ( the marriage not the husband :))).

    Questin 14b " Did you gain permanent resident status through marriage to a U.S. citizen or lawful permanent resident ?" So should my answer be yes or no ? I'm confused.

    If I file married filing separately how bad will that look at the interview ? I am planning to DCF in about 3 weeks

    I I file married filing jointly and the spouse did not have any income what do I have to attach to show that the foreign spouse didn't have any income ?

    It's almost April and I can't figure out what to do. It doesn't help that in the past H&R block did my taxes. Now I'm in a foreign country, with no help, and tax stupid headbonk.gif
