No, pregnant women are not disqualified for medical exam, she can take all the examination except for the xray and shots, in that case she needs to get those in the US after she gave birth and prior to applying her AOS.

Applying for a Visa

An appointment package is sent to the agent or the applicant. (See note below.) The appointment package gives the applicant an interview date and tells you the specific requirements of the visa. It includes instructions on where to go to have the required medical examination. During the interview process, an ink-free, digital fingerprint scan will be taken. In general, the following is required:

A passport valid for travel to the United States and with a validity date at least six months beyond the applicant's intended period of stay in the United States (unless country-specific agreements provide exemptions).
Birth certificate
Divorce or death certificate of any previous spouse
Marriage certificate
Police certificate from all places lived since age 16
Medical examination

Thanks Spidergirl, but I had already found those. The question I am really posing is that, why were the petitions returned to me? They should have been forwarded to Chicago Lockbox or CSC.


I guess they want you to send it to the right Service Center by yourself so that you can track it, because there are cases of packets that were lost before and they don't want to be resposible for that, and since it was sent wrongly, they can't accept it and they can't put it in their records and give you a case number in this case they have no way to track it. So its easier for them to send it back to you.

I am getting ready for my trip to the philipines. If everything goes well with the woman that I am falling in love with, should I try to do the 129-f application myself or hire a attorney? What does the majority of the people here do? It doesn't look that hard to do except for mounds of paper work but if it's better to get a attorney then this is something I have to start thinking about. How much does a attorney usually charge for something like this? Any suggestions would be appreciated.

You dont have to hire a lawyer, i did mine by myself. Just be resourceful, just stick around in VJ there are lot of people who can answer your questions here. You can go to USCIS site and the site of US Embassy in Manila.

If she go to DFA, don't tell them she is being petitioned (as K-1) or they will be requiring her to attend the CFO Seminar first.
Per Republic Act 8239 and Department of Foreign Affairs (DFA) Order 28-94, Filipinos proceeding abroad as fiancé(e)s and spouses of foreign nationals are required to attend the CFO's guidance and counseling programs as a pre-requisite to the issuance of passports.

But if she still have the time she can attend the CFO Seminar (Guidance and Counseling) first, anyway she will also be needing this prior to her departure (for the CFO stamp on her passport when she gets her visa).

When I applied the first time for y passport, they only asked me for one ID (I showed them my PRC ID). NBI and the driver's license will suffice as ID.

Your advice confuses me... You are recommending that they disregard Republic Act 8239/DFA Order 28-94 by concealing the fact that she already is in the K-1 petition process, so that she can postpone going to a required guidance and conselling program?

What advantage does postponing this required program give that outways the potential issues of disregarding that rule?


You dont have to tell them that you are being petitioned as k-1 just say that the purpose of passport is for travel abroad its not a big deal, you do need to attend a CFO seminar but you can have it few days before you leave. CFO seminar is not a big deal in getting passport but you will be in trouble boarding a plane if you dont have it.

In most cases processing in the philippines for I-129F to approve is 6 to 8 months or sometimes longer and interview schedule will take 4 to 6 months from the approval of the I-129F. If you really miss her you can go back but it will not affect the proccessing.

Normally they will give you MMR (Mumps ,Measles and Rubella) they will give you Varicella as well if you havent had chicken pox before. Tetanus and Diptheria (TD) is not available in the philippines so you will get that when you arrive in the USA. Other vaccines aside from these are only given for people below 18 years old.

She can call or send an email to the US Embassy in Columbia that the packets will be sent in her new address. I did that before, i send an email to the US Embassy in Manila to send my packets to my work address, indeed they sent me 2 sets of packets, one addressed at home and other at work, they delivered it both at work though.

I-129F is the fiance'e visa and 1-130 is for K-3 which is spouse of the USC.That lawyer is a fraud. Tell your friend to read first from the USCIS website before hiring a lawyer.

You have to send a copy of your birth certificate. Dont leave any question blank put "none" if theres none and "n/a" if its not applicable. For more details check the example forms above in the site.

Yes thats what it is. She will take the counseling from the religious organization authorized by the CFO and after the counseling she will receive a cerificate, and bring it to the CFO office for Passport Stamp and CFO Certificate.

There are two offices that conducts counseling in Metro Manila but she might choose to go to "St. Mary Euphrasia Foundation, Inc. Center for Overseas Workers " at 1043 Aurora Blvd., Quezon City, this center has there own CFO Office inside, in that case she doesnt need to go from one office to another.

The date that i chose was fully booked so they put me in waiting list, after 2 days they call me and informed me that the schedule is confirmed and i can go ahead and purchase the ticket. They can put you at any date you want with the price you want, so be sure you have enough time when you book the ticket. My flight is direct (no connecting flight) from Manila to Las Vegas, we had a two hour layover though in Vancouver where the plane refueled and get cleaned up.

About buying a ticket i suggest that you should send her the money and let her purchase the ticket herself. Since she will be flying alone get her a direct flight (no layover, no plane transfer) as possible for her convenience. Check with Philippine Airlines(PAL) if they got a direct flight from Manila to your area.

The receipt date is June 6th ( thats the date the receive your petition), They send NOA1 on August 8, 2007(this is the actual date they sent your Notice). I can't find any problem with that, the date is not a problem the important number is your case number. Just relax, dont' stress yourself they are already processing your case. Good luck.
