Removing Conditions on Residency General DiscussionAnyone out there got his 10 Years GC from TSC

Hi everyone.
I'm just so keen to know if anyone got an approval from TSC in the last months for I 751, and if so, how long did it take them to approve it.
Here is my timeline:
Dec 11th 2006 I 751 was sent
Dec 13th 2006 was recieved
Dec 21 2006 extention letter arrived and the biometric in the follwing day
Jan 11th 2007 fingerprint was taken
Jan 12th 2007 touched
still waiting.......

Give USCIS within a year of the NOA (I-797). You have your green card being extended for 1 year.

Removing Conditions on Residency General DiscussionQuestions of NoA-2

I'm very glad that you join me if you have time. I received NoA-2 and I have some questions. I found it has new header words on it..."TCR (blank)" and "CODE 3". I've been searching about that, but I couldn't find out. I'm just wondering...just wondering, but I really want to know that  Would you tell me what are them if you have some information, please? I'm afraid if I took your time.

That's only for biometrics code.

Removing Conditions on Residency General DiscussionExpress Mail & Return receipt

Hello all,

I saw someone in an earlier thread asking about sending return receipts etc. I want to let people know I sent my package to the CSC in Laguna Nigel via express mail and included a return receipt. It got delivered this morning and CSC signed for it no problem so there does not seem to be an issue.

Hope this helps. I will post my time-line once the check gets cashed etc.

Dave

I did the same (use signature confirmation from USPS) when I sent my petition to CSC. I got it in the mail with the USCIS's authorized signature.

Removing Conditions on Residency General DiscussionCorrescting a Mistake in I 751 form

Submitted my I 751 last week. I noticed that there was and entry made on it which is a mistake. How do I correct it. Would a simple letter explaining it along with Noa1 or Noa2 suffice? or do I have to refile with new fees again? How do i make corrections on an already submitted I 751 form?

Thx

What mistake did you made?

Removing Conditions on Residency General DiscussionJan 07 filers about?

Just wondering if there are any Jan 07 filers around, mine has a receipt date of January 25th. Nearly there *bites fingernails*

We filed on Jan 17 and we are finished with the I-751 process. It was approved on March 16 & received green card on March 20. Your case is very long.

Removing Conditions on Residency General DiscussionThe time has come

it is ok to send stuff in each other's name if it shows the same address....

I included some evidence with just my hubby's name and some with my name on it but they both showed the same address...

The documents should cover, but not limited to,the following examples:
1. Birth certificate(s) of child(ren) born to the marriage.

2. Lease or mortgage contracts showing joint occupancy and/or ownership of your communal residence.

3. Financial records showing joint ownership of assets and joint responsibility for liabilities, such as joint savings and checking accounts, joint federal and state tax returns, insurance policies that show the other spouse as the beneficiary, joint utility bills, joint installments or other loans.

4. Other documents you consider relevant to establish that your marriage was not entered into in order to evade the U.S. immigration laws.

5. Affidavits sworn to or affirmed by at least two people who have known both of you since your conditional residence was granted and have personal knowledge of your marriage and relationship. (Such persons may be required to testify before an immigration officer as to the information contained in the affidavit.) The original affidavit must be submitted and also contain the following information regarding the person making the affidavit:his or her full name and address; date and place of birth;relationship to you or your spouse, if any; and full information and complete details explaining how the person acquired his or her knowledge. Removing Conditions on Residency General DiscussionGC Expires While Waiting for I-751?

I'm sure this question comes up a lot, but the search feature isnt working atm so maybe someone can humor me? :)

What happens if your 2 year conditional GC is set to expire on October 1st of 2007 for example, so you'd mail the I-751 with all your evidence in 3 months before. But what happens if they still havent approved the I-751 by October 1st? Are you just screwed, up poopy creek with an expired GC? Or what?

The I-751 NOA serves as an added 1 year extension.

Removing Conditions on Residency General DiscussionChange Address

Hi!

I just submitted my I-751 and realized that when we bought a house about a year ago, I may have forgot to inform the USCIS of the change of address. It was a short move within the same zip code, but I guess that does not really matter. I will have to check with my wife if I did file or not, but I am slightly concerned that this will be held against me during the I-751 process. I did fill out the two addresses on the I-751 application as instructed.

Does anyone have any experience with a similar situation? Any thoughts?

Thanks!!

You should be fine. As long as you did the address change, they should change your address. You might want to call them to see if your current address is up to date.

Removing Conditions on Residency General DiscussionI-751 will be submitted tomorrow, August 1 to VSC

The I-751 packet for my spouse and I has been assembled any ready to drop off at the post office. The spouse's 2-year GC expires on 10/29/07. The 90-day window began today, 7/31/07, where we missed getting in under the old fees by two days.

Hope VSC can speed up the processing of the I-751's.

That's unfortunate but good luck!

QUOTE (EricC @ Sep 11 2007, 12:09 AM) <{POST_SNAPBACK}>
Hello. My fiancé's birthday is Oct 4 and I have a card all ready to send out to her. I never really sent mail to the Philippines before, and I was just wondering around when should I mail it, to get it the closest to her birthday. I am mailing from California if that makes any difference.
Most mail will get there in about two weeks. Sometimes there are delays. Send it this week. Postage ranges from 90 cents- $1.07 depending on the shape of the envelope. If you use Global Express, it can be pricey.

Hi guys.. I've been here in VJ for quite some time and I never saw this part of VJ.

Can anyone here assure me how long does it take to get the NOA2 after getting the update from USCIS that they have received my RFE reply and the case has resumed? The only reference I have are the other timelines from different cases that had RFEs and noticed that it only took days or upto two weeks to get their approval. Until now I don't here anything yet and I have called a few days ago and nothing either. I guess we're one of the couples that have it hard and have to wait much longer while others sails through smoothly. I filed back in March and I was really anticipating her to be here this year even with an RFE. Thank you guys.
2-4 weeks give or take a week.

I know other service centers are slower than VSC but I am concerned because there is no approval yet. Anyone else have this many days at VSC? Seems march filers from that date are all approved.

Any ideas what may have caused delay?

I do have past DWI charges. Would that slow the process?

Are you kidding me? Have you looked at the processing times at VSC yet?

K-1 Fiance(e) Visa Case Filing and Progress ReportsHELP.. poverty guideline

My fiance is already divorced and has 3 children who are partially dependent on him. They are currently staying with their mom. My fiance filed for K1 petition for me and K2 for my 2 kids. For us to check if my fiance meet the poverty guideline, should we count his 3 children and the 3 of us (total of 6)?

You forgot to add your fiance. Your fiance + his three kid=4.

You + your 2 kids= 3.

4+3=7

So he needs to make at least $38,862 for 7.

K-1 Fiance(e) Visa Case Filing and Progress ReportsGood things [can] come to those who wait .... and wait

Up until now, our K1 Visa application has been very slow going through the process. I've constantly monitored the other CSC applications filed around the same time as ours, and each step of the way, it seems like we were in the slowest 10 percentile. It felt like our application was made of lead or something, and it was very disheartening to see people who filed at the same time, several steps ahead of us in the process.

Anyhow, that all changed these past few days .... praise God! We appear to have made up for much lost time (and may have even set a new speed record) as NVC issued the letter on July 16th confirming receipt of our file from CSC, and her interview is scheduled in Sydney for July 31st .... which is only 15 days from NVC receiving the file from CSC, to her interview date in Australia!

That's great news!

IR-1 / CR-1 Spouse Visa Process & ProceduresFor those who already interviewed and had Joint Sponsor

For the interview, do I have to bring my Joint Sponsors ORIGINAL birth certificate? We are interviewing in Montreal. I can't find anything online to state whether we can bring a copy to prove citizenship of J. sponsor.

You should bring it just in case. Nothing wrong to bring back up documents.

Becca,

You can go to your K-3 interview and mention to the consul that you have a CR-1 case file here. I've heard from two other applicants with the same situation and got the CR instead of K-3.

IR-1 / CR-1 Spouse Visa Process & ProceduresHi All!!!

Our question is this, the big visa has been approved on this side, now we are just waiting to send in the 70 dollar fee before they can go any further. What would cost more? Doing the AOS, or following through with the CR-1. Can anyone please help us with this? I thought that the AOS would cost more money and take longer. WHat are the opinions of the group here???

If going thru with AOS, filing fee is $325 + $70 bio fee and possibly an interview, if your going with the CR-1, your fee is: plane ticket + Affidavit of Support fee ($70), the visa fee ($380).

IR-1 / CR-1 Spouse Visa Process & ProceduresHelp on timeline

I call NVC, and all they say is that my case was complete September 28 and that it has not yet been sent to Manila.

Manila only has so many openings. NVC operators refuse to give any hint at all of what months people were last sent on to Manila.

Anyone here have any idea how long between "case completed" and forwarding to Manila?

I tried looking at the NVC timelines. I do not understand it, I guess. There isn't a date entry for "case completed at NVC" and "case sent to Manila" there.

It varys from a month to 6 months. Have you visited Pinoyinfo.net ?

IR-1 / CR-1 Spouse Visa Process & ProceduresFiling taxes before spouse gets here

To use the filing status Single you have to be unmarried as of Dec 31st 2006, to file Head of Household you have to be divorced or hold a legally binding separation agreement and have a qualifying dependent...

The correct filling status for someone married to a non-resident alien should be Married filing separate or Married filling jointly... you can reduce your tax liability by filing married jointly all you need to do is request a ITIN from IRS for your foreign spouse at the time of filling or before....

For more information see IRS website or IRS publication 17

Be that as it may but it worked for me. That's what filing an amended return is for.

IR-1 / CR-1 Spouse Visa Process & ProceduresFiling taxes before spouse gets here
If you all know Mr. Ray Bacon, he suggested me to file as single or head of household if you don't have ITN or SSN. Then when my wife arrived & got her SSN, I amended my return by changing it to married filing jointly. This was no problem.

IR-1 / CR-1 Spouse Visa Process & ProceduresWIFE CASE COMPLETED, But ...

My wife's case was completed today. But before even we finished celebrating the good news, I learned that NVC has sent an RFE today on I-864 for my daughter. I was told that I need to fill out I-864W and NOT I-864 as she is less than 18 years old. I-864W is apparently an AOS exemption!

I am sending it by overnight and NVC will receive it on Monday. Can you please let me know how long it will take to process the RFE and COMPLETE the case. My wife's case is completed and waiting.

Usually in the 2-4 week range depending on the time of mailing.
