Just so so - he speaks to me in Spanish, I respond in English. That's what we did in the interview. The CO saw that we communicated very well in English/Spanish. She questioned him if he speaks English...I answered for him and said yes, a little, but his first language is Spanish so he needs his interview in Spanish.

He understands very well but his speaking skills are not 100%. I understand perfectly so him speaking to me was fine.

Yes....it will say that it has been approved and where it was forwarded.


2:-How i will know that NVC issued me a case number,How much it will take to issue me a visa number?

You will know once they have sent you a letter OR you can call and once they issue the number they will give it to you over the phone. It can take a few weeks for them to process.



3:-form DS 3032 is filled by benificiry. If benificiry fills person (A) as aggent ,and askes any person B to pay fee for AOS and IV.Can person B pay the fee for these two things or is it compulsory that the agent mentioned in ds3032 is allowed to pay only.


Anyone can pay the fees as long as they have a US bank account (if paying online).



4:- How much is the fee for these both things AOS and IV?


AOS is $88 and IV is $404


5:-What is IV?

IV is the Application for Immigrant Visa - so you are basically paying for the application to be processed


6:- IF visa number is not available then how much have to wait to avail a visa number?

Thanks to everyone that responded.

He actually went to apply for his SS card yesterday but was told that, since he had been here for less than 10 days, they would accept the application but not be able to process it until that 10 days was up. And they mentioned his full name needs to be on the mailbox or they will not leave the card.

He also went to the DMV (Massachusetts). He can get his license without GC, just passport and stamp.

Hello!

I have the same questions, particularly concerning how long it will take to receive the Green Card after David arrives in the US and if he has to wait to have the physical paperwork before working. Also, what are the rules about leaving the country, before receiving the green card and after? I know you're not supposed to leave for over 6 months at a time if I remember correctly, but what about a quick week or less trip?

AS far as leaving, he can come and go as he chooses with his passport because it is stamped....I know that much. But of course it would be better to wait for the GC, as we know how from many horror stories what can happen. He does not have to wait any period of time to travel. And he can stay for an unlimited amount of time. The only problem is if he spends more time out of the country than in. When the time comes to remove conditions he will have issues as to why he's been out of the country for more of that time. but for quick trips its not a problem at all.

The stamp in his passport acts as a temporary, but fully legal GC. I'm not sure if the DMV or Social Security Administration will see it that way, but legally, there is nothing stopping him from getting a job.

So, he arrived on Saturday. My mind is not 100% yet to do all of the research about the GC ordeal so I'm taking the easy way out and looking for a short and sweet answers to my questions.

GC should arrive within a few weeks?

He can apply for SS without GC?

Does he need GC to apply for license?

Is the stamp in his passport sufficient enough for him to work or does he need to wait for GC?

Can I check status of GC production on USCIS site with initial EAC receipt #?

On 43a, the first Yes, Yes and No on the far left should be blank. In the middle portion of 43a, check the first No, check the 2nd Yes, and leave the 3rd No-blank.

On 43b I only see one Yes and one No. You mark Yes.

What you chose for 45 is correct.

On 39 - list your husbands full name, full address, email and phone number.

And no, although it appears as though you would list your address and name, they are only requesting the petitioners name in this portion.

But on 44 you will say that you are the person who completed the form.

FYI, English isn't my first language, so i'm worried that i misunderstand these 45 questions. i am reading each word and trying my best to comprehend, still i'm not confident with my own comprehension:( i mostly answered NO, how about you people? i was thinking "why did i answer NO to every question, is it really? should i answer NO to each Question?" i'm worried more since it's all abt Law in the US..can any1 of u guide me? which question i should answer yes, which one i should answer NO (i thought these questions apply to every beneficiary as individual wherever they come from) :unsure:

43 A is NO on the first and YES on the 2nd portion of that question...that is, if you want the SS Administration to issue you a number. 43B is YES also but everything else would hopefully be NO

You will not do anything having to do with K3


Now that the petition has been approved, you will wait until NVC receives the case which takes about 1 week. Once they process it, which will most likely take one additional week, they will assign and give you a case number. Then you will be prompted to pay AOS and IV bill, as well as submit documents. If you can pay the fees in one week and send the documents out quickly, it will take them approximately one more week to go through the documents you sent and get an interview date for you.

So from the moment it leaves USCIS until the interview date given, its about 1 month or less.

Per NVC guidelines, you will need to submit a police clearance certificate for each and every residence that you have held:

1. In your country of domicile and you have been living or have lived at this residence for a period of more than SIX MONTHS and you were SIXTEEN YEARS OR OLDER when you started living there.

2. Any international residence outside your country of domicile if you have been living or have lived at this residence for a period of more than TWELVE MONTHS and you were SIXTEEN YEARS OR OLDER when you started living there.

Inferring from the guideline above, it appears that you will need a police clearance certificate for all 3 of your residences.

This is just general information I extrapolated from DS-230 instruction package. There may be country specific instructions you may need to follow. I urge you to take my response with a grain of salt (as in not written in stone) and make sure to research Country specific information thoroughly.

Well, if and when the petition is approved at USCIS, you will get an email/text alert as long as you include the proper form to receive this, but more importantly, you will want to know the hard copy has been received (which will arrive via postal mail) and you will want to put the away for safe keeping/future use.

Once at NVC, you can rely on email for that entire process - pay online, receive receipts online, etc.....and eventually your interview will be given via email.

Well, anyone can get denied and people have been denied regarding age gaps, but they have also been approved with those age gaps. You situation in particular has a VERY large gap and although you have all of that evidence, they could think that you are using her or vice versa. I have to admit, I see age differences on here but I haven't seen one this large. But hey, you have nothing to lose and so much to gain so don't let anyone tell you to stop or discourage you from being hopeful. It's a 50/50 chance for all of us and people get denied all the time for anything and everything. Just continue to accumulate the evidence you need and hope for the best.

I'm not sure if the rules/regulations are different from employer to employer, but I am in a similar situation. My "husband" arrived a few weeks ago and my HR dept said that I had 30 days from the date of entry to the US to submit a change of benefits form, which I did immediately upon his arrival.

So if the rules are the same across the board, you do not have to wait until open enrollment, but in stead submit the change form within 30 days of his arrival to the US.

It sounds like someone in the company is hesitant on adding him on....which is strange since you said the premium wouldn't change.

There were several high profile cases where a USC Petitioner used a K Visa to bring an alien "fiancee" to the US and either trafficked her for sex (not always personal use only) or physically/sexually abused her and/or her children. This was back int he days when K Visas processed quicker than CR/IR Visas. The IMBRA requirements were put in place to protect the Alien Fiancee from USC Petitioners with a history of Domestic Violence etc. Apparently they assume if you married someone you know them a bit better...


OMG!!!!! That's horrible!!! Well, thank God those requirements are in place......but unfortunately, for us married folks, we don't always get to meet all of those skeletons in our SO's closet prior to marriage or petitioning. Too bad people don't come with WARNING lables <_<

You can't compare the 2 cases, Davani filed for a K-1 Visa which requires disclosure of past criminal history so that the CO can ensure the Finacee is fully aware of them at interview time.

For CR/IR Visas there is no such requirement. If the charges fall under the Adam Walsh Act then the petition won't be approved in the first place but that is another story.


Oh...ok....didn't realize there was a difference between the CR1 and K1....I assumed they would drill the person either way but this is good to know. And now that you mention that, I wonder what they even consider one visa more necessary for disclosure of criminal history than the other. You'd think it would be important, either way, married or not, for their partner to know this info. Nonetheless, thanks for clearing that up.

Any help here please? I have convictions on my record for drug and DUI also was arrested for domestic violence but was found to be innocent. My convictions are 12-25 years ago. Anyway going to file a CR-1 and am wondering if our petition could be denied for this. I have worked for the same company for 9 years and also have my own business. I have changed my life for the better and hope my past will not hurt my future. Thank you.


It all depends......your charges are old, but DR has been strict on these types of charges. Not long ago (2 months), a USC went to the DR interview with his girl and was she was denied the visa because of his criminal record. He had charges of DV and I can't remember what else, but, they were more recent than yours are. I think his were within the last 5 years. You would need to get the reports and all documents relating to the charges, how they were handled, etc. At the interview, they could absolutely bring this up and request documentation. It's better to be prepared and have everything at that moment, than to go in to AP, send the documents in, and wait months. I think because it was so long ago that you may be safe but it's hard to know what they are looking at and how concerned they will be with your past record.

If you're a college educated professional, save the money and do it yourself. There's a trillion horror stories about lawyers making major mistakes and you probably don't want to be added to that list. It's very easy and to tell you the truth, the lawyer may have an extra set of eyes but they aren't seeing your visa approval, they're seeing dollar signs. The instructions on this site are extremely helpful and anyone, educated or not, can and has done it alone so it's worth a try. Save the $1000 for the cost of things you'll need to purchase for your SO once they are here.

So, I sent my I-130 in and got an NOA (I-797 ??) back within a few days. It had no instruction on it as to what the next step was or what they were doing...nothing...so I called the service center and they said to send the I-129F packet in to the address on the bottom of the NOA (which was the Vermont Service Center). Now I'm thinking this is incorrect. Should I have waited for another NOA? Is another document coming my way from them with instructions? So, I called again today and they said that if it was premature then not to worry, it shouldn't cause any problems, and that they will hold it on file until they need it. Basically they have no straight answer for me. I thought I had it all straight but now I'm confused and I don't want to screw it up. Any suggestions? Guidance? PLEASE HELP!!!

There has been a lot of issues when it came to paying someone else to do their I-129F packet. When I called to see how much mine packet was going to cost. They told me 1,100 US dollars. I decided to do my own packet. Did anyone else do their own or went through a lawyer?


I did my own, with only the VJ info to rely on....still waiting on my approval but it could be a couple more months. I have to say, it was extremely easy. I cannot see paying a lawyer that much money. Follow the directions, ask lots of questions on here....and you'll be fine. ;)

God forbid if this happens, but i beleive one should be prepared on all ends...



From what I've read, you can request a Consular review if you are denied at the interview stage as long as you request this very soon after the denial. I've also read about many people contacting their state representatives to intervene in the matter. It will take time, persistence, and patience....and be prepared for any outcome. If you are denied at the USCIS stage, you can appeal but it will cost a pretty penny. And again, time and patience are required.

Again, this is just from what ive read on here. But stay positive and be very accurate at every stage of the process. Only the strong and legitimate survive ;)

I noticed the processing from NOA1 to NOA2 increased from 70 to 88 over last month or so.

How would the file dates being processed go backward. I think I must not understand the data being reported. Can someone explain this?


I thought the same thing but it's just an estimate according to the information others submit on this site. I would check weekly, then daily because I noticed the same thing. I got my NOA1 in mid July and the NOA2 on Aug 24. That timeline estimate kept giving me earlier and earlier dates and I thought that was very incorrect, especially since many people had been waiting four months or more.....,but it was on the money with the estimate. I would say, don't get your hopes up but know that it's very possible it comes earlier that you initially expected.

Hey guys,

So we finally have prepared the last of our evidence to send to our lawyer to file our I-129f. I have pulled our skype records dating back to 2008, email records from both our accounts to and from, plenty of pictures of us together in the US different locations, in Toronto recently and in Ireland this year. We have proof we lived together at one point, i took screen shots of or viber log, the application we use to call each other, she made copies of cards i sent to her and cards she gave me and proof that her boss sponsored me for a J1 after we met.

I just want to make sure that everyone feels this should be sufficient evidence of our relationship and if anyone thinks anything else should be included?

1.when was the first time you had sexual intercourse, where?
2. When was the last time you had sexual intercourse?
3. They asked him if I was using birth control while in the US.
4. Also they asked if I had given birth to my daughter (from my previous relationship) naturally or by C-section
5. Where was he on Nerw years, Did you dpeak? WHo called who?
6. Name of his parents and mine.


Holy ######! is all I can say about this ..... these questions are so out line and I never see any post anything like this but I'm sure it happens. The I-129F petition is usually approved at the same time as the I-130. When this happens then NVC will administratively close the I-129F, and proceed with the I-130 and CR1 visa, which means the I-129F was a waste of time. This happens the overwhelming majority of the time, so the advice you were given was accurate. You are a relatively unusual exception. K3's rarely happen anymore.

The main point you were advised was wrong was your comment that you have to wait two years for adjustment of status. In reality, you have two years to submit the adjustment of status or the K3 visa will expire. You should submit the adjustment of status as soon as the beneficiary arrives in the US.


You are correct. I was given some wrong information, all from NVC, and this is continuing to happen, even as of today.

That is not true at all. First of all K-3 Visas approval and CR-1 are taking about the same time to approve and recently couples that have gone the K-3 have had more delays at USCIS and the NVC. The other thing is that you don't have to be married 2 years to go the K-3 route. You have to be married more than 2 years to obtain IR-1 status once your visa is approved and you enter the US.

Not to be rude, but please read the information provided on the WIKI. You can cause alot of confusion if you are not sure about something. :)




My Timeline - which clearly reflects that I have not been married for 2 years, shows that I filed a K3. Furthermore, NVC are the ones who told me to continue on with the K3 and not wait for the CR1, that they had already sent my file to the embassy. Also.....my Timeline (which is real time) reflects that my process has been very short.

I speak from experience, from my particular situation, which is what I clearly stated in my post.

I understand that WIKI and all of those resources list information, but realistically, with the changing times and specifics about each individual location, there will be changes and this includes time frames.

Again................looking at my timeline would clarify my post and your opinions.

I already did contact my senator and the response i got back is on my original post. We received a yellow slip not white or blue. Unfortunately my whole issue with applying again is that its going to take the same amount of time as if i just let USCIS review it. Economically right now, I can't take another trip and do a wedding right away so its going to be a few months anyways before I'm able to do that. If anyone has had my same experience and had a positive outcome after USCIS reviewed the case please let me know.


Just for the record....I applied for the K3. They were going to process it as a CR1 but the K3 was going faster so they went that route. All together this will have taken me about 5 months in total. The only difference between K3 and CR1 is - with K3 you need to married 2 years and then the spouse can apply for an adjustment of status, which will cost $1000, and then they are a permanent resident.

With the CR1, you wait longer and you pay $500 in the beginning instead of 2 years after.

Either way you'd have to be married so I'd say just get married and decide which visa is better for your situation.
