Yes, so you are right. I was incorrectly assuming the "3 dependents" included the intending immigrant. She would need to meet the requirement for five people, which looks like it will be pretty close in your situation... If her income isn't enough, she can make up for it in liquid assets equaling 5 years the deficiency of her income. For instance, if she's $1000 below the requirement, she can show $5,000 of assets to still be "ok" .. There is more detail in the FAQ. Some sources state that it's only 3 times the deficiency, not five. I'm not sure which is correct. Hopefully your mother can qualify either way.

I'm gathering up the financial evidence just have a couple of questions. I currently attend college full time, therefore I'm not working or haven't working for a while now will that affect the interview? Another thing is I'm going to use my mother's income tax returns now she makes 30K annually with 3 dependents is that ok? or will I need another co-sponsor?

Then if take home your co sponsor is well above the line on income alone and should be fine without showing any assets.

Tax eats up at least half a persons income, gross income should be well above 20K.

You use the gross income amounts reported on last year's return, NOT the take home income amount.

If visa interview falls after April 15 (Tax day) the counselor officer can ask to see 2007 return.

One thing about I-134, the directions included with I-134 are very old, USCIS has no reason to update them since USCIS has no application for that form.

The consulates tend to treat the I-134 like a mini-I-864 as so prefer the same financial evidence as the I-864.

In our case this what the I-134 included.
  • I-134 signed and notarized.
  • SIMPLE Tax transcripts from the IRS for past 3 years, (Redundant for the (1040,W2,1099) but are free from the IRS http://www.irs.gov/faqs/faq1-6.html
  • Photo copy of IRS form 1040, and W2s for past 3 years (Not necessary if you provide the transcripts)
  • Letter from my employer stating annual salary, job responsibility, and that is full time, on company letterhead.
  • Photo copies of past month or so of pay stubs up to a few weeks before the interview.
My income was well above the povertyline so I did not include any asset data (LIKE BANK STATEMENTS or property values).

If your income exceeds 125% or (100% for military) of the povertyline when counting yourself, prospective immigrant and any dependents, then don't bother with assets (401K, Bank balance, Stocks etc..), it is just extra un-needed data to provide, the consular officer is most concerned with INCOME.

Thanks, another question is anything else needed from my co-sponsor I heard a copy of my co-sponsors birth certificate or U.S. Citizen certificate is needed is this true?

I have a person willing to co-sponsor me but that person makes roughly about 12K a year, but she does own two properties one is worth about 130K and another one is about 450K. Is that good enough to co sponsor? I haven't work the past 3 years therefore I have no income to show, but I do have 7K deposited in my bank account is that also good? Finally, what other information is needed from my co-sponsor? do I need a copy of her citizenship? etc...

Our loved ones coming here legally...my assumption is all of them are more than willing to learn English and the "American Way" to live here, and that's the way it should be.

Just a quick update on our status... The Consulate at Guayaquil received our application on 12 November, and sent out the Packet 4 to Belen. Belen received the packet yesterday, and scheduled her interview today. She has a tentative interview set for the 23rd of January. The reason this date is tentative is because we requested an expedite on her interview due to military reasons. We requested a date between 17 and 21 December, as this is the very soonest we know they will be able to accommodate us. Anyway, hopefully we find out if our military expedite for an interview is approved by the end of the week. We are keeping our fingers crossed.

Best of luck to everyone. Once our package made it thru USCIS, the whole processed went a whole lot faster.

It's good to know that after the NO2 is approved it's quickly sent to Guayaquil. Hopefully by March we should have our interview since i will be in Guayaquil.

Mirla and everyone else who wonders about the status of your package after it leaves NVC:

Call DOS @ (202) 663-1225. option 1 then option 0. They can tell you if the embassy has received it, when the embassy sent package 3 (if applicable), when the embassy receives your package 3 response (if applicable) and the date of your interview. If you do not have your new case number they can provide it based upon your USCIS EAC #.

They may be able to also tell you if your package has arrived at NVC, but I am not positive about that part.

One thing to keep in mind is that DOS has no music while they have you on hold so you will wonder if you have been disconnected. Do not hang up, they will eventually pick up the call.

That DHL tracking is a mystery to me. I've tried so many times and it never works. I've settled on just waiting for the embassy to contact my fiancee.


Here is what my snooping self found: there was a package that left NVC on 1/2/08 and it got to Bangkok on 1/5/08. There is also another that was sent on 1/7/08 and signed for in Bangkok on 1/10/08.

I tracked mine by reference on the DHL website. I used this as my reference: example: EXP 14 JAN 2008A (use the date that it was mailed to the embassy) You will get many results scroll down until you see the embassy that your paperwork was sent.

The advantage of a personal cheque is that you can read the case number from the back of it when it is cashed because they don't always send you and NOA1 with the case number.

So I sent the petitions for the K-1 visa, there was in issue. The USCIS sent my forms back and it said the application or petition cannot be accepted because the proper fee of $170.00 U.S. is not attached. Now my issue is the money order I sent was of $171.00 can I deposit this in my bank account and just write the USCIS a check? and the other is should I fill out the I-129F Petition since it has this red mark on it? I'm kind of pissed why did they make such a big deal about $1 extra :wacko:

Does anyone know exactly what does the Yellow document contain??? The one that is giving to the immigration officer at the POE into the U.S.? There's an issue my fiancee got approved after sending in proof of pregnancy but this was sent in about 3 weeks ago, 2 days ago my fiancee had a miscarriage is this going to be an issue when she comes into the country?
