PhilippinesCulture, misunderstanding, or just plain used?

Ok guys, I have an interesting story to tell concerning a friend of mine and his filipina fiancee. I am just going to give the facts as I know them relayed to me by my friend and what his ex fiancee had said to him vs what she told my filipina. He is an american and shortly after I met my baby online nearly one and a half years ago, he went to a dating site and met his now current ex fiancee. She was working and has 2 kids, never married. He visited her for 10 days and came back and announced to me he was engaged and was filing for K1. I sorta advise him to know her better, as I had spent time with my fiancee about two months before that for 21 days and returned, but not engaged yet. I wanted to see her on a longer time frame before I went that step. Shortly after that he filed the K1.
During the waiting for the NOA2, he revisited again but this time for 21 days. He was coming up on 7 months waiting and was approved while he was away. He came home and told me he was going to cancel the K1 and return in about 6 more months and marry and then revisit her every 3 months until she was approved and came to America. Now I could not understand the logic but the following was his explanation and where their breakup begins and I sorta cannot figure out if he is crazy or if she is just used him...
My friend is a truck driver and always on the road, sometimes week and a half before he gets home. His last marriage broke up because he was gone a lot and the wife cheated and left him. He is real concerned about that happening again. He wants a family, but also time with them as a normal working person and not sporadic as being a truck driver can be. His home was foreclosed due to his divorce and he had a chance to move to his parents rent home with 5 acres as long as he paid the note on it. Currently renters stay there, so his plan was to cancel the k1, stay on the road, make oodles of money driving and pay the principle on the rent home, and since renters are there now paying the mortgage, he will pay extra for 2 years and own a home debt free, he could quit being a driver, get a regular lower paying job and be able to live easy life with filipina wife and her kids without fear of another foreclosure and home taken away, and fear of being away and fear of infidelity as with last marriage. It sounded ok to me, but I questioned that if he knew the girl really well, then the fear of the cheating would not be there. But stuff like that happens, so I understood his motif for thinking like that.
He gave his fiancee the choice to come now on the k1 since it got approve or he could do as I said above and have a better future finacially. She chose the latter. After she made this decision he then returned home from 21 day trip, canceled the k1 and began his many days of driving. But now she has closed her phone and will not answer his emails. Now me and my fiancee were concerned so my fiancee called her at my friends request to talk to her. My fiancce had talked to her before so they knew each other by phone only but not really good friends. She told my baby that her pc was broken the last 3 days and was waiting for my friend to call, but he never has. She also expressed he was an indecisive guy and if he did not call soon to talk to her she would move on. She expressed how very hurt she was on him canceling the visa. But according to my friend, she decided to go that way and get married later and allow him to get finacially on his feet first.
It is sad they stop talking. My friend is devastated cuz he gave her a $3700 ring before he left and she seemed very ok with his new plan and now cannot understand if she used him or not. She never really ever soliciated money from him during their online time together, seemed sincere whenever my fiancee emailed and talked to her. But according to what she tells my fiancee, her decision was based on him not being decisive and wishy washy in his decisions.
Now, my fiancee and I have talked many times and I have come to the conclusion it is part of the filipino culture not to be too confrontational with anyone and say what you must to avoid trouble. If this is true, then she did that to my friend, even accepting his engagement ring. I really do not think she scammed or used him, but she did tell him it was ok for him to go the marriage route later, and if the k1 cancelation was a big hurt for her, she did not express it to him.
There are other factors involved, so if you want to ask questions, I can give more info but will just keep this post at a reasonable size for now. I would like to hear opinions, especially from those that are currently married to filipinas and maybe about some culture issues. I am waiting for an my fiancee's interview in July, so I, myself will be married soon and could use some insight too. Thanks guys...

edit... this was posted by me, uverseman, i was logged into my fiancee account and did not realize it. So the posters name is different..

If you dont mind, just want to know, how old is your friend and the girl... sometimes this vary on the age... but i am still trying to comprehend the story, for sure there is some miscommunication happened here.

PhilippinesLost Passport
Hello, the Philippines passport fee is 1200 pesos plus 180 pesos delivery fee (this is optional, but very convenient for u do not need to go back to the passport office they will deliver it right in front of your door) so all in all it is about 35 dollars... She needs to bring an affidavit of loss and it will cost her 10 dollars maximum, and then she needs to bring her birth certificate (orginal copy from nso) and Identification Card.

She must go to the new building which is near SM Mall of Asia (just in case she doesn' know).

The important thing is that she must go online to have an appointment, this is the difficult part because appointment sometimes take a month before her appointment date.

Its a walk in clinic, so you can go ahead without scheduling an appointment. Just bring all the documents needed.

PhilippinesForm I-134 for USem Manila Interview (Please reply)
Hello Everyone,

I just want to address this topic to all who went through the interview at the US Embassy Manila... I am little bit confused about the I-134 Form which is the Affidavit of support. Is this really needed to be shown to the Interviewer here in US Embassy .....because I read in the USCIS site that

Affidavit of Support For Fiancé(e), Spouse, or Child as a “K” Nonimmigrant

"If your relative is either a “K-1” fiancé(e), a “K-3” spouse, or a “K-2” or “K-4” child of fiancé(e) or spouse, you do not need to submit an affidavit of support at the time you file your Form I-129F petition. Instead, you should submit an affidavit of support at the time that your fiancé(e), spouse, or child adjusts status to permanent resident after coming to the United States."

Thank you so much and God bless

PhilippinesMail to Philippines

I wanted to give an alternative to DHL and LBC and the post office for sending mail and packages to the philippines. I used a company called Johnny Air to send my I- 134 and tax information as well as other embassy required papers to Cebu . From Hawaiii I sent the packet by priority mail to the California Johhny Air. I talked to them and asked them to expect it. They were very receptive and helpful. They in turn sent it to thier storefront in Cebu. It took 10 days but I knew where the packet was the whole time and they notified my fiancee when it arrived so she could pick it up. The cost was 13 dollars from California for the documents. The priority mail was another 8. So the total cost was 21 dollars. There are storefronts in Legaspi Village, Makati,Mandaluyong,Baranggay Palanan, Makati City,Dagupan City,Naga City,Laoag,Ilocos Sur,Bacolod City,Cebu city,Iloilo City,McArthur Hi-way, Matina Davao,Limketkai Center, Cagayan De Oro City

Several things I sent by different carriers never got to her. We did not have to worry about it getting delivered (or not) to her barangay. Hope this helps someone. http://www.johnnyair.com/?page=85

PhilippinesMNL applicants

I got my NBI clearance started today.

there was a sign that said it takes 30 working days.

has anybody gotten their NBI Clearance sooner?

Hello, if u are in the province and getting if from Regional, then this is true you can get your NBI after 30 days, but in UN Taft Manila (NBI) you can get it within the day.

What other ladies did was, as soon as they have their MNL CAse number, they went to Manila had their medical for two days, then interview after and add another day for securing their NBI Clearance.

Print your interview appointment form, bring this with you in NBI so that when your name got "hit" you do not need to wait for ten days, just tell and show the supervisor your Interview date at the Manila Embassy and they will release your clearance at once. I remember we went to EDP Office where the supervisor is located. He will get a copy of your passport and Interview Appointment Form.

The only sacrifice you need to do is to go there early in the morning. I went there around 10 and finished at 8pm

First, let your fiance write at the US embassy, maybe they will review again your papers, and who knows they will consider your evidences...

Also age, and the time that you have been together i don't think this is a big factor sa lahat ng consuls, because so many ladies passed the interview who has at least 20 to 30 years gap between her and her fiance. Also they passed even they only been together for a week, and one time only...

I think the CO who happens to interview you is medyo may gusto pang hanapin sa iyo, or sadyang mahigpit siya...Let your fiance send them letter also if he can ask for his senator's help...

K-1 Fiance(e) Visa Case Filing and Progress ReportsReceive Notice of Approval from USCIS Case Status
Praise The Lord! Just now I checked out the USCIS Case Status link, and found out that today the USCIS mailed to us the approval of our Petition (which is the NOA2, I think?) It has been 106 days since we filed our K1 application. Earlier than we expected, our God is so good. As we put out trust in the Him and increased our faith, God is so faithful and answer us, and it has always been a perfect timing, today is Tim's last day in school and its vacation time. Now all he needs to do is to focus in my moving to the states and our soon US wedding. To GOD BE the GLORY!

Here's the message from the USCIS Case Status Inquiry:

"On May 31, 2011, we mailed you a notice that we have approved this I129F PETITION FOR FIANCE(E). Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283."

May i suggested that you contact your senator or congressman, they can be a big help... Tim and I did this, and in less than 4 months our aplication has been approved, just yesterday we read from our case status inquiry in USCIS that our K1 petition has been approved (and I believe this is the NOA2) and they already sent through mail the paper....

Will be praying for you.

K-1 Fiance(e) Visa Case Filing and Progress ReportsSTILL awaiting NOA2, 8 months after filing for K-1...

Today marks eight months exactly since we shipped our K-1 visa packet off. I continue to wait and to wait. To update those who do not know my story:

- I have called USCIS multiple times. They are rarely helpful. They just read off the same script in robotic voices. The times where I have had a helpful Tier 2 officer put in a Service Request (happened twice) I get a form letter later stating that my case is still under review, background checks, etc.

- My Senator's Aide has contacted Vermont Service Center congressional liaison several times and is told the same thing we are told. She has no pull whatsoever. We are either told we are still in administrative processing, or that they have sixty days to reply from the date they received my RFE repsonse.

- We did receive an RFE at six and a half months. Requesting passport photos of myself. Which I had sent with the original petition. Regardless, I took the photos and mailed them back the same day. I mailed them back on April 20 - almost 1.5 months ago. They were received on April 22 but VSC did not confirm receipt officially until May 2 - buying them until July 2 for a response.

I am so happy for all my VJ friends who have received approval lately. But it makes the fact that we continue to wait, even though we filed before 99% of these individuals, even more difficult to swallow.

There is no reason on God's green earth that we should be waiting this long. I have no criminal record. I pay my taxes on time every year. I am an upstanding, professional citizen in my late twenties. I have been dating my fiance for four years. He is also an upstanding, law abiding, tax paying citizen in his country in his late twenties with no criminal background. He works for the Mexican subsidiary of a large U.S. corporation. He has a valid US tourist visa. Why would they have issued it if he was a criminal? Why are they taking eight months to verify our "background"? We have never been married previously. Neither of us have children. We met in real life, not through some online dating site. You would think we would be the perfect example of a case that should get whisked through the immigration process in 2-3 months. NOT EIGHT MONTHS.

I am at my wit's end. My patience is gone. It has been gone for awhile. I maintained a positive, optimistic outlook every day for eight months. Every day for eight months I woke up with renewed hope at seeing a change in my case status. That hope is gone. Everyday I wake up depressed, knowing another day will pass with no news. Every day ends with a soul-crushing disappointment in my heart. I am despondent and depressed. My life is on hold. I can't make plans going forward because I don't know what the result will be.

Although my fiance and I mutually agreed the US would be the place where we want to get married and put down roots, I am starting to second guess that decision. Mexico has a plethora of security and economical issues, and I would miss my family here and all my favorite stores like Whole Foods and Target - but other than that? At least in Mexico I was treated with respect and dignity by the government there. Neither my fiance nor I have received such treatment from the U.S. government here. It is enough to make me vomit.

My country has let me down.

and oh hey, how did you find out about the available interview date? :)

Just last week someone here says that the only available slot for USem embassy manila is july 20, 2011, just dont remember if its 15th or 20th. She says that there is some trouble in the system the last few weeks and when she booked herself for interview it came out that 3rd week of july is the only available slot.

I wish it can be but when you have your medical, mnl case number is needed as well as to scheduling your interview!! You better have to call the NVC to ask for your mnl case number so you can have your medical. And you cannot schedule your interview if your case is not yet in the system of US embassy Manila.

I hope you will get your mnl case number so soon!!

Thank you so much for the info. God bless.

K-1 Fiance(e) Visa Case Filing and Progress ReportsInterview Scheduling

Hi everyone! Is there a way for me to know if my preferred schedule date for interview at USEM is still available? I am hoping to get a slot on the last week of October yet, but, when I called the USEM, I was just prompted to an answering machine (pre-recorded voice). I have to fly to get to Manila so I wish I could have first my medical then proceed for interview after 1 or 2 days, if in case the medical result is fine. And, I have kids with me for K-2 visa, so I thought of booking our flights ahead so we can still avail of promo fares and minimize travel cost. Can anyone advice me what is best ? Anyone knows that October 2nd and 4th week are still available?

I would really appreciate any answers. Thank you so much in advance ! May God bless us all....:)

Hello do not worry about October slots, there are still lots, once u get the MNL Case number you can go online appointment and it is very easy at you can choose which day on october you wanted to be interviewed. Hahanapin din kasi ng operator yung MNL Case number mo plus yung payment mo sa visa fee. you must have at least 4 days from your medical to your interview, 2 days ang medical sis, 1st day is yung process itself then yung 2nd day is result and i you pass they will give you and your child immunization. Sa SLEC naman walang booking first come first serve doon.

IR-1 / CR-1 Spouse Visa Process & ProceduresHOW LONG WILL I WAIT TO RECEIVE NOA
hello, usually it taskes 5 to 6 months before they will give you the approval which is the NOA2, this depends on the officer who will handle your application, some people here in visa journey receives their approval in less than 3 or 4 months .....the one that you received from the text messages is an acknowledgement that they receive your application and will review it, and that is the NOA1. For sure you will have an email from them about this receipt.

I would suggest that you do your timeline here in visa journey for they will give you an idea to when is your application be adjudicated, here you will see as to when is your approval will possibly arrive.

Also there is a site in USCIS wherein you can check your Case Status, as to where is your paper now.... all you need to do is to get the Case Status Number which will be provided once you receive the copy of your Receipt, it starts with 3 letters and the rest are numbers.. http://www.uscis.gov/.

If your paper doesnt have any problem and you submit the complete requirements possibly you will not be required to have a Request for Evidence (or RFE).

God bless you

IR-1 / CR-1 Spouse Visa Process & ProceduresMedical Test Syphilis +

Back
Will get result back from doctor on wednesday.
Was not aware of this, no signs or symptoms on both of us. so this caught us by surprise.
I will be also going for a test myself soon because of this even though I had my blood test for std last year. Note not a sexually active person nor she trust here. so this probably has been domaint in both or one of us since a couple years. but then again we are waiting the result on wednesday this is bascially our guess that we have it as of now.

Wednesday will be a big day for both of us, ignoring the fact of the visa and interview process now.

syphilis is totally curable, hopefully if we do have it is a single shot pencilin or a couple of time depending how long we had this .

this is not the kind of test i wanted for our relationship, but things happen for a reason. this subject made my heart stop a second then i realize I love her unconditional and she me...we go through this together...only time will tell..but its curable thank god...

I admire you for you courage and love for your wife. Its not the end of the world for you and believe me there are so many couples who's passing through the same situation like yours, God must have a purpose why this happened. Also the fact that this is curable, wow! this such a blessing, knowing that you will not suffer this for a long time.. Just keep the faith everything will gonna be alright for you and your wife. We will be praying for both of you. God bless you -Tim & Tess-

IR-1 / CR-1 Spouse Visa Process & ProceduresI-130 petition for a Tourist VISA holder fiancee

Hi,

I'm a U.S. Citizen and my fiancee is Filipino Citizen working in Dublin right now. We've met already here in the U.S. 2 weeks ago using her Tourist VISA. We want to get married. I did some research and actually spoke to two lawyers and also read the help page from Visa journey (very helpful by the way, but im still confused).

Lawyer #1 told me that we should "NOT" plan to get married prior to her arrival here and we should "decide" on getting married after staying here for 60 days. His recommendation was to use the 1-130 but my fiancee should go back to the philippines while paperwork is being processed. He said not to use the Adjustment of status route.

Lawyer #2 said that we should apply for a fiancee visa and have her go back to manila and wait for another 6-9 mos till she gets the visa.

Visa journey: It said that we can get married anytime but if my spouse has an intention of getting married and immigrating here which really is our intention then she might get deported or denied. And that she should go back to manila after getting married and then wait for the paperwork.

I'm confused. From the USCIS it said that as long as she entered legally here in the US we can apply for the 1-130 and at the same time apply for an AOS.

Confused Reggie

IR-1 / CR-1 Spouse Visa Process & Proceduresdecided to take early dna testing before the interview , result is negative..what to do?

Does she know who the real father is? Does the father know she was pregnant? Is the father somebody you should be afraid of? Does the child look like you? Do you think the child should have a relationship with his biological father? You have to consider all those ethical and legal questions, discuss them with your wife, her family, and with a lawyer, or parish priest if that seems necessary to answer all your questions.

Well, first of all I would like to say that I am so proud of you for still loving your wife inspite of, and since she told you beforehand that you might not be the biological father you still chose to love her. Betrayal is not the question here, she still became honest with you ... as what you have said that she told you before hand.

I don't think this will be a big big trouble in the US Embassy, if you will just get a proper advise. I would suggest that you will seek an expert to this kind of case, try to look at the internet if you can find a US immigration lawyer that is free and then you probably can email him or what about this case. It would be better not to listen to anyone but to an expert to this, so that u will not get confused.

K-1 Fiance(e) Visa Process & ProceduresFacebook Status?
I dont think USCIS mind whatever status we put in our facebook, what important is that our documents are authentic and not fake, and all the informations that we give to them are true and correct.

God bless on your journey...

Congrats! You will receive a mail from the US Embassy of eligibility for the interview. They wouldn't approved your case if it lacks of evidence or for further review. Thus you only saw it 2 days ago so it takes weeks or months before you'll receive the letter. In my case, I got the letter like more than a month after approval. The petitioner and the beneficiary will both receive the same letter.
About the email, I'm not too sure about it.

Good luck! :)

Thank you for the reply and some infos... God bless you...

K-1 Fiance(e) Visa Process & ProceduresSome Few Questions
Got some few questions:

1. Once you are approved does it mean that you will not be given an RFE.. I am wondering if there is a case here that they got approved and then they received an RFE? We have not receive the Paper yet, (I only saw 2 days ago from USCIS Case Status Inquiry under Post Decision Activity that our K1 petition has been approved).

2. Do they usually send a notice through email that they approved? Because we havent receive any email concerning this up to this time.

Thank you
