Hi everybody,
I was wondering if quitting my job before the interview could lead to a K-1 visa denial? I'm going to visit friends abroad and I want to spend some quality time with my family before I leave for the US. The only employment gap I have is from june 2011 until february 2012 (I went to the US twice and spent 6 months with my fiance. 3 months I spent looking for a job in my home country).
Just want to make sure it's a safe thing to do.


My wife quit her job early and I supported her and it caused no issues.

Interview was on as scheduled today Oct 3rd at the Dallas Irving Office.  They were running a little behind and may be a little short on staff but they are still holding interviews.  I was surprised at how many people did not pass.  We were an hour early but they let us go in anyway since they had room upstairs.  Had to get fingerprinted and picture taken for some reason but everything went fine.  Should get a letter in a couple of weeks with the oath scheduled.

Do you change your name? Why does it take that long (45 days)? I thought it is only a few days.

 

 

No name change in our case.  I guess it could happen quicker but this is what other people have told me.  Our oath will probably be in Tyler if given the chance to pick.  They may not have as many oath taking times as other locations.

The interview is in the late afternoon.  From people I know who have gone through the Irving location they did not have the option of same day oath.  It happens about 45 days later.

The alien may request a waiver of the joint filing requirement if unable to file with the spouse. The alien may request the consideration of more than one waiver at a time. Please read the instructions accompanying the form I-751 for information on the waiver of the joint filing requirement.

So you want to get an annulment because your wife does not want to be divorced twice? I think that once you have been married for a considerable amount of time it is very difficult to get one. This is not the Philippines. Each state has different rules on annulment. I think after everything you have gone through you should file for divorce if that is what you want. If you wife does not want to be divorced tell her to spend some effort trying to make the marriage work.

You can not file until you are within 90 days of the expiration date. Try to get your application in as soon as you can when you are in the 90 day window. You can not send it in before the 90 day window. They will usually send you a one year extention while they are processing the application and it will take some time ( months ) before it gets processed.

If your divorce is final by the time you have to file, then you can ask for a waiver of the joint filing requirements based on your divorce. It is on the I-751. As long as you can provide the proof of a "good faith" marriage, you should be able to remove conditions.

Hi everyone,

I posted here a while ago and I was complaining about my lawyer not wanting to request an update on the status of my case.
Here's a quick remainder: I filed for the removal of conditions in april 2011 with the good faith marriage waiver, did my fingerprints in december 2011,
got RFE in march 2011 (my lawyer responded to it right away) and there has been no progress since then.
It's been 18 months since I filed for the removal of conditions and as you can imagine, tracking the "I-751 waivers timeline" topic on this forum makes me even more nervous, because everyone gets approved withing a normal processing time and it seems that they're not even using the attorney's help.
I've been sending a number of emails to my lawyer asking whether my case is ok and what is the current stage at which my case is being processed,
but it seems that the answer is always the same: "dont worry, everything will be ok". Like seriously?! I'm frustrated. I even asked him is it ok for me to ask the congressman to request the update on my behalf but my attorney hasn't answered that email. If I didn't pay him all the money, I'd consider hiring someone else.
From the other hand, he has a great reputation, answered the RFE right away and says there's nothing to expedite the I-751 process.

What do you all think? Is there anything I can do?

Hello, I submitted I-751 early June and have finished Biometrics in July. Nw I am waiting. I heard it takes about 3 months to finish processing I-751. My file went to the Vermont Center.

But on USCIS' website, I saw the average processing time for Vermont center is 8.5 months!

Anybody has any recent experience with I-751 at Vermont Center?

Hello,

I need some advice.

My husband and I jointly filed I-751 in February (Vermont SC) but ROC has not yet been approved.

We are now separated and, for reasons too complicated to go into, I want to get a divorce as soon as possible. In fact, I want to file for divorce this coming Friday. I do want to be connected to this person anymore.

I am unsure what to do. My husband is not a petty person, so I think he would be willing to stay married to me until I get my Green Card (especially because that means he would be able to stay on my health insurance). However, it seems that the Vermont Service Center takes a *long* time to process ROC, and I do not want to have to wait that long to begin the divorce proceedings.

I am unclear whether I should just wait this out until I get my Green Card (and hope we don't get an interview) or inform USCIS that we have split up, and send them proof once we get divorced. I am also not sure whether I have to withdraw our joint application and now just apply alone with a waiver. If this is the case, would I have to begin the ROC process all over again?

I'd appreciate any help. Thanks!


You are opening up a can of worms. I would wait for the green card since you have already filed but that is just me. If your application was complete your chances of an interview are low. It will take about 8 months or so to get ROC so you are looking at just a few more months. Try to stay on good terms with your spouse. I do not know what the problems are with your spouse but life in the US is not always easy and your relationship might improve if your situation improves.

BRB Removal of conditions approved, dated 9/15/2012 Online it says the card was mailed today.

FYI, We did not send in any affidavits with the I-751 but I sent very detailed information on Bank Account, Medical, Auto Insurance, Beneficiary, Tax Transcripts and Residence. If anyone wants a detailed list of what I sent let me know.

maplestar is right. Form I-551 is your green card. Government IDs have a "form number" at the bottom - another example is Military Dependent IDs, that one is called DD Form 1173.

I-797D is just the mailer (piece of paper that your green card will be attached to) that will have info about your green card / permanent residence status. Your old conditional green card would have come in the same type of mailer. :)

It is around the corner by the Greater Dallas Employment Office
Office opens at 8:00 am - They will not let you in early!
We were number 8 in line and it took 55 minutes to complete. Just took prints and picture.



Good news to share with my fellow Dec filers....BIOMETRICS letter in the mail this Thursday 1/12 from CSC!!! :) updating list. appointment is for Feb 6th, exactly 2 mos from noa1.

I've had very good experience with Xoom. I do agree the first time you have a bank account withdrawl it takes about 4 days. When you see the money leave your account they change the amount by a few pennies and you can enter this and speed up the process and get the money in a couple of days. The next time you do a bank account withdrawl they have the money ready for pick up in an hour or so.

With the new USCIS website you can see what the status is of your application before it is approved. Right now mine is under review and it took between 90 and 100 days. Before that it just said it was accepted. Hope that means NOA-2 will be soon. My I-129 and I-130 both went under review at the same time.

Give me a little slack this was the first time I ever did a poll. I really was only interested in people that were sending money and I know there are some who don't send anything.
