Wow - That was a long post...
To answer your questions. If your parents surrendered their green cards and have abandoned their residency then your household size is 4 (you, the 2 children and your fiance). The minimum income requirement is $32,137 for Hawaii. If your income will be $29,000 then you don't qualify on your own to sponsor.

Using an asset such as a house is a difficult thing with today's housing market. MOST Consulates will not allow the use of a house as an asset if their is a lein or mortgage attached to the home. Additionally, proving a home value is extremely difficult and Consulates that allo asset based income typically want to see LIQUID based assets (ie: money in an account).

To use asset based income you'll need 3x the deficiency. So in your case, your income is about $3,200 short of what you'll need. You'd need to show 3 x $3200 (about $7000) and even then there is no guarantee that the Consulate will accept cash on hand in lieu of income.

Your situation is even more difficult because typically Manila does NOT permit co-sponsors. Your boss may not be a suitable co-sponsor for this Embassy.

I highly recommend you post this question to the PI regional forum to get more exact answers, but I would think you may have problems at the interview...

Thank you for the reply.. I do state though that I have around $10k in my bank account, this would cover the deficiency right as 3*3200 = 9600.. if so, how many months of bank statements do I need to send with the suport?

And I know housing Market is BAD.. but I live in Hawaii in the Island of OAHU, our Housing Market is not as BAD as Las Vegas or other states.. :) and I thought they will will compute Home equity in housing value coz, it very rare for an american to have a house with no mortgage at all.. :) with the exception of the very rich peeps and the people who have been working for at least 50 years :)

I May add that, I also included on the Sworn Statement signed by my BOSS(co-sponsor) and notarized that if neither of the documents above are accepted and my income does not meet the federal Poverty guideline, that my boss is willing to send a CASH BOND to the Embassy <----- is this OK? Is it Legal to state like this? I'm doing all my best just to get my fiance a visa as we missed each other so much..

To all VJers,

I am confused on how to compute my Household size... I am divorced, and I dont have physical custody on my 2 sons but I pay child support for them and I have my kids on weekends. I also did sign an I-864 for my mom last mid 2009 and for my dad on early 2010. So with my fiance, I assume my Household size will be 6.. which i need $43,112 for 125% in Hawaii based on 2011. poverty guideline.

But since my mom and dad went back home already and has been in the Philippines for more than a year, and Just last week, I have them go to the US Embassy in Manila and have them surrendered thier green card and filed I-407 Abandonement of Lawful Permanent Resident Status. So would this mean that my new household size is 4 now? less my mom and dad since they have left US and have surrendered their green card last week? If so, my new income needed based on 2011 Poverty guideline for Hawaii at 125% is $32,137 right?

Here's what i'm doing, I wanted to use my 2011 tax return, so this is the reason why i scheduled my fiance's interview on Feb 29, 2011 as I'm sure my tax return will be done before then, and my estimated income will be $29,000 from my tax return and would declare the condo that we just purchased with the help of my Boss, so the condo is on Joint Tenancy. The 2011 state's assesment on the COndo is $157,000 but we purchased it last Oct 2011 for $149,000. The amount owed is around $110,000. Which value do i use for the form? I can also use my bank account as I have about $10,000.. so how many months of bank statements do I need to send with my affidavit of Support? With what i have right now, I'm sure i can meet the poverty guidelines right? Pls correct me if I'm wrong.

Now... my worry is... what if the consul will still count my mom and dad on the Household size? I will be in big trouble as even with my assets, It can't reach the household of 6 which is $43,112.... :( I hope this wont happen but if it does, Here's my contingencies:

I already asked my BOSS to co sponsor with me on I-134, now.. I know that Philippines consulate is very strict on co-sponsor for fiance :( I will also ask her to sign an I-864 as a co-sponsor too, just in case they will ask for it instead. I also have her signed and notarized sworn statment that she will co-sponsor on our AOS if needed. <--- is this OK?

On the sworn statement, it also states the relationship between me and my BOSS(co-sponsor), How long we've know each other, that I am like a son to her and that she helped us buy a condo for the future dwelling of me and my fiance. <---- Is this OK?

I miss my fiance so much and we both are so inlove with each other, I just want to be sure that she gets her vias without RFE's :)

I received the NOA2 on January 25, 2012 and would like to know the next step? Should I go ahead and contact NVC to follow up on our Case Status or just wait until we received the mail coming from them? Also, what are the documents do we need to prepare after getting the NOA2? How soon should we start gathering these documents? My Fiancee lives in the Philippines and I would like to know what she needs to prepare? Any help from you guys will be greatly appreciated. Hi,

Pls let me know the date of your NOA2, not the date the you receive the hard copy. Give 7 days from the date your Petition was approved. then call NVC at 603-334-0700, just give them your USCIS receipt number to pull out your file. The operator can give you your case number if they have received the petition already, the number will start MNL********** and they will also inform you if your petition has been forwarded already to US Embassy in Manila.

Wait at least another week or 10 days and email the US Embassy in Manila ( IVManilaReplies@state.gov ) and ask if they got your Petition, If they will respond that they got it already.. you are now ready to start the processing of your fiance's visa and follow the guidelines and instructions below:

Just to give you a time frame.. mine was approved last Nov 14, 2011 and US Embassy in Manila received the approved petition last Nov 29, 2011.

My fiance resent the i-129F packet last December 10 (Backstory: wrong address for the first time hence it was returned to him) and we haven't gotten an email or text from USCIS that they've received our packet yet. My fiance sent it through USPS and didn't use certified mail so we have no way of tracking it. We hopefully wait but our heart breaks a little more everyday with not hearing anything about it. He even tried calling USCIS and they said there's no file under his name yet and that they really couldn't help with anything unless we have a case number. And i also know its because of the holiday rush since we sent it december. I just wanna know if anyone else is on the same boat? And if anyone has been here before and if so, how long did it take for you guys to receive an email/text from them?


I'm sorry for this dear.. :( I hope you'll get your notification soon. Let's hope and pray it gets there and processed ASAP.

It's also a good idea to have any sort of tracking, every time we send something to USCIS.

3. Bank certificate ( signed by the manager)

    - indicate the open account date and current amount

   a. Bank statement in a year

 

4. Internal Revenue Tax (2011 and 2012)

    a. Form 1040

    b. W2

 

5. Proof of Citizenship or Legal Permanent

Co- sponsor is rarely accepted in the Philippines (Manila US Embassy)

 

If you're fiancé started working last June 2013, Have him file his 2013 tax return as soon as he gets his W2 by the end of this month or early february.

 

If his income going forward 2014  is enough to satisfy 2013 Federal Poverty Lines, You guys should be OK.( Just bring proofs: Employment letter, pay stubs). Otherwise, there will be a problem sad.png and you need to marry and file I-130 petition for you and start all over again sad.png

 

With I-130, Co-sponsors are accepted in the US Embassy in Manila, Philippines.

Wow! 17 days good.gif that's fast. But we're not yet married and on K1 Visa process, she's from Negros Occidental. Do u think we can avail for the expedited processing?  thanks and congrats on your son's fast approval. 


We didn't even request the expedite, they did it automatically, I don't know if they would do it for Negros residents though, just file for it & they would expedite it at their discretion.

We thought the expedited processing was mostly for spouses and K1 only but we got my son's petition via My USC husband's petition for stepson approved today, 17 days after NOA1 date and they approved it today, Jan 17, 2014, my son's Bday. :)

 

By the way, what province in the Philippines did your spouse live?

         It has been a long process in our k1 case.It took 4yrs since the k1 petition filed 12/2010,got petition approved 6/9/2011,finally we got visa approved 1/21/2014 ..lol,i guess we got the longest waiting period in the K1 visa ...above all thanks God and  thanks also to vj,it has been a helpful tool for us. 
  I just had my interview yesterday & I want to share my experience for some reason it may help others to be confident & be prepared.
 
 
      January 21,2014,tuesday..the appointment letter i presented  is an e-mail reply from manila US embassy,because of my medical due date,we asked for expidited interview which indicates that i can go walk in at embassy check in counter at any day from monday to thursday 7:30am-10:30am for my interview  ounce i have completed all my documents & medical.I updated  first my medical last jan.16,2014 then headed for interview.
      I went to embassy Monday,huh.png its holiday,my fiance & I didnt knew  that day is martin luther's day in the US.Was glad i got a friend residents in manila who put me up for a night..Then i came back tuesday,arrived 6:30am.There's somebody outside who could take care your things & gadgets but you have to pay them & i got annoyed because they asked too much,P400 for my 2 gadgets,no wayno0pb.gif ,lol.I told to a woman that i can afford only P200,she agreed but i think it is still too much,anyway wether i like it or not i have to leave my gadgets to them..
     At the front gate,theres a line for IV(k1 included),NIV,ACS,& sea fearers.they asked the passport & they get ds-160 here & they mark on appointment letter & gave me ziplock for the passport before entering the entrance building,once you got in,your things were put in machine scan as part of their security check up,then take the exit door going to another lane.In front are 3 windows either which you may proceed,show your passport & appointment letter here to give you ticket number for the queue board that you will  look out later,my # was 6141.I was instructed to give my appointment letter at window 39 inside the next building..then my waiting turns started...
    1st @ window 41- finger prints & biographic details.
    2nd @ window 48- filipino consule screening,she took the documents such as NBI,BC,CENOMAR,VISA Receipt,I-134.then she looked our photos & tried to read some chats history from folder i showed her,lol....she also asked some details, name,address of my fiance,my  phone#,age,bday & email add,although they already have these,theyre still checking it.Then she also asked questions like,when & how we met,how many times he visited me& why,prior marriage of both parties...lol,her voice is a little high pitch,she sounded like a strict person.
    3rd @window 59- american consule interview,upon arriving in front of window & seeing her face,my nervous was gone because she looks nice person.I smiled at her first & greeted her good morning. im surprised ,several questions being asked,were not those what we really expected,first question was,is he drinking alcohol?lol,i said no,he dont drink hard liquour,only light beer,.many questions had followed & i was able to answer it all by heart until she took a look at  the ITR 2012 & said   this is low,i wanna see 2013 income,then i grab my folder,& i gave Tim's employers letter & checks stubs,then she got satisfied and said ok,this is good,she asked me whats his job.then i replied and  mentioned also the date he got hired & month he got permanent,she nodded and then said ok..after shes done writing,i anticipated shell be asking me some questions again but finally she said this with smile,"im going to approved your visa",.you may take a seat now & you'll be call back..then i said,thank you ma'am..,dancin5hr.gif my heart jump  with joy while walking back to the waiting area seats..
    4th @ window 71..rechecking of documents,the guy only asked me if  i took 2nd medical,i said it was just updated.. then he told me to fill out a delivery form slip and submit it at window 69smile.png ..im done@ around 1:30pm...
  yes.gif  I could totally feels now the real feeling after being approved,there are some pressures & stress but trust,believing & preparedness is 100%

Since you now have your MNL case number, your fiancée should pay the visa application fee. Then, she can schedule an interview appointment online. Then, a week or two before her interview, she can complete the medical.

By the way, your case will arrive at the Embassy in time for her interview, so you have no worries there.

my husband had is interview in mumbai consulate and 221g was given with need for following additional doc. I am a uscitizen and had been living in India with my husband since marriage for abt 9 months.

1. proof of domicile: I had already submited a copy of my bank acc and copy of my us driver lisence showing my permanent residence address. they have asked for copy of electricity bills. i live on rent with my dad and so dont get it on my name. so what else can i submit?

2. joint sponsor: i had already given 1 joint sponsor and a household membeer and they still require more. i have not been earning since i was in India. they require i-864 for joint sponsor and i-864a signed between sponsor and houshold member. and copy of bank acc statement for joint sponsor. could it be because we didnt mention any assets or cash while filing the earlier 1-864?? and can a person who has already sponsored 2 people be a joint sponsor for me and how to calculate the income requirement?

First of all... To establish domicile, you need to go back to US and find a job. Examples for proof of domicile is but not limited to: Voter registration; Bank statements; if you found a job, employment letter; and a permanent address in US or any proof that you could think that you live and will be staying in US already for good.

The only people that are exempted of the Domicile requirement for petition are miltary who are working in other countries or other government employees that are outside US to serve his/her country or if you live in a territory of the United States.

A co-sponsor needs to meet federal poverty guideline on its own but if he/she doesn't. A household member can sign I-864A in order for them to combine thier income and hopefully meet the poverty guideline. A household member is somebody that is also living in the same Household or address in order for them to qualify to sign form I-864A.

If your co-sponsor can qualify by it's own, a form I-864A is not necessary..

Note: You could have left India and went back to US already weeks after your petition was filed. In this way, by the time the interview come, you already have established domicile in US.

Be careful though. There is no hard and fast rule that her spouse has to physically reside in the US at the time of the interview. Since he has spent very little of his life in the US, he may have a higher bar of evidence to surpass, but that does not mean he cannot sponsor his family while living abroad if he goes about this the right way. Many a couple have successfully navigated the process with both residing abroad at the time. The catch is to prove "intent to re-establish domicile" or "having never abandoned domicile." Here's the other half of the story to follow up on what merkin78 has quoted you from the NVC website; this from the I-864 instructions:

15. Country of Domicile. This question is asking you toindicate the country where you maintain your principalresidence and where you plan to reside for the foreseeablefuture. If your mailing address and/or place of residence isnot in the United States, but your country of domicile is theUnited States, you must attach a written explanation anddocumentary evidence indicating how you meet the domicilerequirement. If you are not currently living in the UnitedStates, you may meet the domicile requirement if you cansubmit evidence to establish that any of the followingconditions apply:

B. You are living abroad temporarily.If you are not currently living in the United States, you mustshow that your trip abroad is temporary and that you havemaintained your domicile in the United States. You can showthis by providing proof of your voting record in the UnitedStates, proof of paying U.S. State or local taxes, proof ofhaving property in the United States, proof of maintainingbank or investment accounts in the United States, or proof ofhaving a permanent mailing address in the United States.Other proof could be evidence that you are a student studyingabroad or that a foreign government has authorized atemporary stay.
C. You intend in good faith to reestablish your domicile inthe United States no later than the date of the intendingimmigrant's admission or adjustment of status.You must submit proof that you have taken concrete steps toestablish you will be domiciled in the United States at a timeno later than the date of the intending immigrant's admissionor adjustment of status. Concrete steps might includeaccepting a job in the United States, signing a lease orpurchasing a residence in the United States, or registeringchildren in U.S. schools. Please attach proof of the steps youhave taken to establish domicile as described above.


Thats why I said.. proving DOMICILE is a complex case and the determination of you satisfying the DOMICILE requirement lies on the CONSUL... and it really doesnt matter how long you were out of the country before as long as you established DOMICILE by the time of your fiance's interview. I have experienced this personally with my sister.

If you review the I-864 instructions, you'll see that he will need to show either intent to re-establish domicile in the US or continued domicile in the US (even if he uses a co-sponsor, this requirement will need to be met). Since he didn't reside there very long, he may have the burden of presenting more proof than someone who resided in the US most of their life. The domicile issue is one that everybody filing through DCF has had to deal with since they're residing outside the US too. I recommend you go to the DCF forum to look for some examples or do a general search for threads where people have described what evidence they used.

In our "re-establish domicile" case, for example, I showed documentation of the following: where we would live, where I (USC) would return to work and study, maintenance of voter registration and drivers license, maintenance of US bank accounts. All of these things demonstrated the means by which to reside in the US and the intent to immediately return.

"Filing" taxes and "paying" taxes are sometimes two different issues. It's possible the Consulate told your husband he did not owe taxes. But as Anh map is urging you here, you really need to have him determine if he needs to file, even if he was working abroad.

To be honest, I'm not familiar with how tax works. That's just what the US Consulate said to him before. I already told him to double-check with IRS. He said he'll do it this January.



How can he go about proving domicile? Like what documents does he need to show?

Actually, he has already bought a return ticket to the States. He will be here for a month. For sure, I'll show this information to him. I hope it will be good enough to convince him to hold on just a little bit longer..=)

Proof of Domicile includes the Following but no t Limited to: Bank Statements, Permanent US Address, Filing Income tax Returns with US address, Having A Job, YOu can also ask him to take pics on a Government Building with a date on it, Voter's Registration and anything you can think to tell them that he is already in US and will be staying there for good.

If your husband will be in the Philippines for 1 month, this shouldnt be a problem. But just dont let him stay there long enough and wait till your interview comes, coz im sure you'll get the DOMICILE trouble.. Guaranteed. I've seen one case here that has that problem. I think that was from India.

Yes, he worked here before. I just spoke to him about it. He said he asked the US Consulate here in Cebu if he had to file US taxes, and they said he wasn't required because he also holds Filipino citizenship. Thus, he works here as a Filipino.

The reason behind he does not have to file tax in US is an exmeption .. and i think it's huge.. maybe about $90k? you need to check on IRS but technically, if YOu are a US citizen, you need to file taxes anywhere you go and USA does not recognize dual citizenship...

With regards to Affidavit of Support, I don't see this as a problem as long as you already have a co-sponsor in line that can qualify by itself and is willing to sign I-864 for you and your son or daughter.

The only problem I see is the requirement that for you to get a visa is that the petitioner needs to be a Domicile of the United States. So he really needs to go back to US before you can go with him and let him establish domicile, What he's trying to do is not really helping shorten the time that you guys will be separated, It will just make things more complicated as the Domicile requirement is a very complex requirement to prove.
The consulate will not give you a visa until he establish domicile in US.. which could take between 3-6 months and the decision if you met the domicile requirements is up to the hands of the consul :( I suggest your husband not to do this.

I would suggest him to stay with you guys for a month vacation and let him keep his job. Tell him.. for sure it will just make your case complicated.

I know this coz my case was like this b4 I became a USC now. :)

Hi everyone,

I just arrived here in the US last December 11,2011. and i need some advised on what to do first. I am on an immigrant visa, and im trying to get SSN and my green card.what shall i do first? process the SSN then the Greencard or is it the other way around?

How long will it take to get the cards, and will it be expensive? and also i cannot get a job if i don't have those yet?

During your interview or somewhere on the forms you filled up, there was a form for you to sign to give them authority to get a SSN for you.. If you did that, you just need to wait till it comes in the mail, but if you didn't, you can go to your local social security administration to get it.

For your green card, you don't have to do anything, they will mail that to you as soon as its done.. :)

By the way, none of these cards needs to be paid :)

No.. That's not right.. $1K+ is for Adjustment of status and s for K1 visa. Your next bill is Visa fee and medical exam for your benificiary which is roughly $500 + Correct me Vjers if im wrong..

You also need an Affidavit of support (I-864), since you are on Medicaid and Food stamps, you need a co sponsor, there's no way you can waive any of the affidavit of support otherwise your wife's visa will be denied due to lack of support.

Log in to ceac.state.gov and pay whatever fees are available, this is why I am against lawyers, they just delay the process, especially if your case is not the Out-of-the-ordinary case.

There is nothing anyone can disagree with based on what you posted. You're a US citizen filing a K-1 petition for your Filipina fiancee. Under US law, with your divorce decree, you are free to marry, Philippine law has no bearing on you in this case.
