Hi All. So by the looks of things CSC are zipping through their I-130 applications whereas Vermont are on a bit of a go-slow. I'm guessing the answer is no but thought I'd ask anyway.... Is there any chance you can get your petition transferred to another office and if so is it worth it (I mean if they do allow it does the transfer take as long as it would've taken just leaving the petition where it is and waiting for the NOA2?)?

Just a few chat records over the span of you guys being seperated. As far as Im aware NVC will only forward the docs they've received so any evidence you intially sent to USCIS wont be present at the interview hence the need for possible duplicates of pics etc. Remember youre trying to covince the interviewer the relationship is legit so take anything (even if its been provided before) to show this. After coming this far you dont want them denying you for something trivial which could have been avoided like lack of evidence. Too much is better than not enough.

You will need to show proof of an ongoing relationship between you and your wife so yes the skype chats and so on will be needed along with anything else like pics etc. Your interview appointment letter along with the copies of the docs already submitted should suffice. Good luck

Hi to any South Africans who may be able to share their CR-1 visa experiences with me.

I am at the initial review stage of my visa application, which was initiated on May 21st 2012 and has been transferred to the California Service Centre.

I would very much like to visit my husband in September of this year, and then travel back for the interview at the Johannesburg consulate when they let me know it is time, but am not sure how much notice they give you for your interview and medical exam. Can anyone tell me how much notice they got for the interview? Did they set the final date, or could you?

How long did it take for others out there from the time of submitting their I-130 until their actual interview? I am not sure if going to America in September is cutting it a bit fine...it seems there is a 6 month processing time, but I would like to hear others' experiences.

Any help or advice would be greatly appreciated!


Hi. I also just sent my I-130 for CR1 in April so cant speak from experience but rather from what I’ve picked up on researching this process. Firstly, apparently you'll probably have issues entering the US as you’re an intending immigrant. You will need to show strong ties to SA proving you will come back. Secondly, in regards to the interview date, it would depend on how busy the JHB embassy is at the time your case is complete at NVC. I would say, if you’re successful in entering the US, you could probably stay until you reach NVC stage as this should be rather fast, depending on how proactive you are and how fast you send the fees, forms, and docs. This should be a safe time to come back to prep for your interview. Hope this helped somewhat.

It will obviously vary by country. There are only 3 docs you can go to in Canada. The one I went to in Toronto had a website listing all the things you need and what is required. You should try looking it up or try posting in the SA forums

Absolutly! Do you have a vaccination record? I only had to get 2 and I got them done before my medical so the medical could be completed the day of, and not have to return with an updated vaccination chart.

Hi All :) So hubby and I sent off our I-130 to VSC and our priority date is April 23rd 2012. I'd like to be proactive if possible so was wondering if I could get my immunizations done in the meantime. Can I or do I have to wait? Also, I had a US Student Visa and for that application I had to go for vaccinations, can some of the info from this record be used or no? Your help would be appreciated.

Hi all. Hoping you could shed some light on this for me please. My husband and I filed the I-130 in April and are currently awaiting our NOA2. Im gathering all the NVC docs and just had a quick query- When we filled in the I-130 we stated my husbands job title at the time, he has since received a promotion and he's title has changed (still with the same company). When it comes time to fill in the I-864 will it matter? Should we enclose a supplementary letter explaining?

Kinda same situation. I alread paid and sent in my AOS pack. I emailed the DS3032 on the 4th of October and posted the original on the 5th of October. I know the original was received at NVC on Friday Oct 12th but shouldnt I have had a acceptance or rejection to the email yet? They do take quite long to reply. I emailed them on the 31st as well and still havent had a reply. Noting from previous email correspondence with them, they take about 2 weeks to reply. You should try calling again. I just did, was on hold for only 4 mins. Late at night is also best. Good luck

Hello.

I have a question/concern and I am hopefull that you may provide your opinion.

Background info:

* I am a US Citizen
* I am married and I have petitioned for my husband (I-130) and the petition has been approved by the USCIS
* We have submitted all the necessary packages to the NVC and have been told by them that the case is closed and they will be scheduling an interview
* My husband left the US in 2010 and hasn't been back
* When he left the country he was on F-1 international student visa studying in a university
* In the past, while on F-1 visa in the US, he has worked at several places WITHOUT WORK AUTHORIZATION, however he always paid taxes, filed tax returns etc
* The employment history goes back more than 10 years and so it is not on DS-230
* He has been able to exit and enter the US and receive new visas on several occasions during the period when he has worked without authorization
* He has never overstayed his visa time and has made sure that he always maintains his status (no out-of-status periods)

Pretty soon he will have an interview in his country and we are very concerned that he may have problems. I have read literature online and have got mixed opinions.

FYI, we are aware that if one has claimed to be a citizen on documents when he/she is not, will have a lifetime ban to enter the US. Thankfully, my husband has not done such thing. Moreover, we intend to be very honest and forthcoming about this issue if asked during the immigration process.

My quesiton is, since I am USC, will my husband be considered inadmissible to the US for certain period of time because of the past employment without authorization?

Are there any other complications that we can expect?


This issue is very urgent and we would be very thankful to receive opinions soon.

On what basis did he get the employment? When I was in the States on my student visa I could work on campus for 20 hours a week. If this is what he did it is completely legal. My SS card also said something along the lines of not for work purposes without EAD card but the 20hours/week on campus work was an exception so if that was the case youre all good.

Hi all. I am a newby to the site and am in the hopes you wise owls can help my fiance and i along our K1 journey :)
Our story goes like this... My fiance and I met back in 2007 whilst I was in the US on a student visa. I was there for close to 2 years and we were together pretty much throughout that time. Unfortunately there were some problems with my student visa sponsor and I had to return home to South Africa. A few months after my return we decided we'd like to get married and we filed the 1-129F petition. I was 20 at the time and coming from a very devout christian family, my parents would not give their blessing on the marriage as they believed i was too young and they had not known much about my fiance and his family. This caused lots of problems in our relationship and after 3 months we decided to seperate and attempt to move on. Low and behold a month or so later the I-129F petition was approved. I did not go to interview and nothing came of the petition. Throughout the past 4 years we have kept in touch but as friends. Around October last year we started getting a bit more romantic and we both realised that the spark was still there and very strong at that. My parents even admit that theyve known my heart was always with him and they gladly give their blessing now (they've met again a few times upon visiting the States). In Jan this year he sent me a ring with a beautiful proposal and a ticket to come visit in April. I of course said YES and even though we havent seen each other in quite a while I know in my heart this was always meant to be (L) We plan to fill in a new I-129F when i get there in April but my question is will it be to our advantage or disadvantage that this is the 2nd time we're doing this? And is it in a bad light that the previous petiion was approvied but we didnt act upon it?

I know I've said a bunch but I wanted to give all the logistics.

Any comments would be greatly appreciated. :help:

Hi Kory. Fellow South African here. As mentioned by others it is a personal decision as to which route you should take but from personal experience, if you are READY to get married, then the CR1 route is best. Get married in SA or the US (Might be a prob convincing the Point of Entry Officer that Celeste will return home so take ample evidence that she has ties to SA, maybe a letter from her job to say that she is still employed, proof of things in her name etc). After all the necessary steps have been taken she will have an Immigrant Visa, less hassle and cheaper. Thats just my opinion though. All the best, whichever route you take :)
