I see them requiring originals of everything but nothing was mentioned about Petitioners Birth Certificate. I was born in Kenya. Of course I sent a copy of my Naturalization Certificate (which I am not willing to part with) and I sent a copy of my Birth Certificate. But I am trying to avoid him being sent back to get my originals. I am sure a few people have already gone through the K3 interviews. I realize that this may be Embassy specific. I will also post in the Regional Forum.

To those who are about to get I-130 approved or are just about to start the NVC process, I read somewhere on VJ, that EMAILING to NVC the details required in DS 3032, saves you time from waiting on the form to be sent to the Beneficiary to complete and sign and send back to NVC. We tried it - It worked.

I think it helps if both email addresses spell out your full legal names as Sender even though the actual address is not.
e.g., Sender is Paul Van Buren (showing up on From: Field) with email address papab2K@yahoo.com

We got the email confirmation from NVC the same day the system said that the form was sent to the Beneficiary. I called NVC just to confirm that they will not be requiring the form back and they said they do not need it.

I know this may be already known information but ..............if it helps someone new to the process.......well!!

If I am right, then I would suggest to the OP's spouse to seek posts in Rural Areas where there is dire need for physicians and maybe the employing hospital will sponsor. Happens a lot in rural Texas. Also the OP needs to clarify if the Residency(ies) completed in Canada are US recognized. If not you are looking at doing ECFMG which takes up to 2 years to complete and then repeat residencies in the US. AGAIN....that latter scenario is ONLY IF, 1) the OP's spouse is a Physician and if Canadian residency is not US regonized (Majority/Most of Canadian Residencies are recognized in the US). All in all, wish you well!!

Hi All

My husband (and my two step-sons) completed their interviews today. He said that he was given a blue slip with a line across it and at the end of it was Date February 6th which he was told was when he could come back for Visas. The Embassy also kept all three passports.

I thought the PINK Slip was the usual indication that the interview was passed and that Blue meant, additional information needed. He wasn't asked to provide any further documentation.

Am I freaking out for nothing? Please let me know.

She has been here over five years now, speaks perfect teenage English, gets on her mom when she replies in Spanish, was on the high honor roll in high school and getting excellent grades in college. But was really embarrassed as to why she couldn't vote in the last election. If the USCIS wasn't so damned slow during the initial process, we would have made it.


If the child has got her own Green Card, what has her mother's N-400 application timing got to do with it? The only way your question makes sense to me IMO is if the 18 year old is not living in the US or if she is in the US without status.

If you just filed your N400, you applied to be a US Citizen. I am assuming then you are a greencard holder. I would advice you to wait till you gain your Citizenship before filing I-130 for your wife. Reason being, after Citizenship she will be wife of a US Citizen and not Wife of a Permanent Resident. Big diference. As wife of a Citizen she does not have to wait for Visa Number Availability (which could take 5 years or more to see the fruits of the I-130). As a citizen's wife, she will not need to wait for a visa to be available, and the I-130 could be approved in less that a year (depending on various situations).

Thanks Gracey but i am of the opinion that if the i130 is approved and i became citizen , i can request to change the status of approved petition according to my lawyer but the issue now is that, if it is already sent to nvc, i might not be able to change status as a friend told me. Pls advise and help post to fellow VJs. i am a green card holder as you said since 2001 but because i only started residing in 2005, i was denied initially on ground of non maintating my resedency but am more than 30 months within now and i can file back. You can always upgrade a petition submitted as an LPR after the alien becomes a US citizen. My question is only this. Did you acquire PR through a former marriage? If so, I believe an alien must wait until they've been an LPR for 5 years before petitioning a spouse.


NO. I came with green card in 2001 stayed 8 months and i went back. Came in after 11 months stayed 4weeks and left again, stayed another 11 months and came here for visit of 5 wks. I only started staying permanently in 2005 April. Like someone already... and here are the points to note

1. If you are a green card holder, AND have consistently resided in the US for five years AND did not get your greencard through marriage to a US citizen, THEN chances of getting your Citizenship approved are very good.

2. If you apply for your spouse the form I-130 before you become a citizenship, you are just wasting a lot of time since you will not be given priority like the Citizens do. Check the processing times for greencard holders who applied for their spouses in the USCIS website, last time I checked they are now processing early 2002 applications.

3. If you apply for Citizenship (if determined eligible) you will probably be sworn in in less than 8 months (at least in Texas Service Center) and turn around and file your I-130 to bring your spouse which should be approved in about another 8 months.

If you do the math, its more worthwhile to file as a Citizen.

My wife has her Citizenship interview next week. She has a 10 year old son from her previous marriage. He is living in the United States with us. His father is living somewhere in Vietnam. When my wife and her son become citizens I would like to get them both Passports. I noticed that one of the requirements for a minor child to obtain a US Passport is for both parents to be present when submitting the application. If one can't be present then they can fill out a form for consent. We are not sure if we will be able to locate his father to get this form filled out. Is this required even if his father consented to him coming here to live with us? I thought that pretty much gave up his rights.

Anyone familiar with this process?

Did he give up his rights in writing? I had a friend who went through the same situation, maybe not exactly. Child was born in the US so was already a US Citizen but father had to consent in person and he was abroad, That consent in writing by notarization was not sitting well with the Passport guys here in the US. They gave her a rough time with it. She ended up asking him to go to the US Embassy abroad to give that consent in person.

Here is our situation: My husband is a new USC as of last month (yay!). Our son (my stepson) is 16 and came here with his dad on a K1/K2 visas in 2005. We have lived here together as a family since that time. So he is now, also, a USC. So here's my question:

Under what circumstances would a US passport (for our son) NOT be sufficient proof of his citizenship? It works for CPB/re-entry into the US, getting a driver's license under tighter DMV rules, opening a bank account, proving to an employer that one is a USC eligible to work, so who, precisely, would say "a US passport is not sufficient, you need a Certificate of Citizenship".

Has this actually happened to ANYONE, and what were the circumstances?

If a US passport has already been issued for your son, then that is all the proof he needs. Maybe I did not understand your question.

Do not return the green card. If you ever want to apply for the N600 when they issue the COC they want the original green card back! I had the green card of my kids in the safe deposit box until the local office asked for the original green card.
We are on vacation now, so I don't know whether they mailed the CoC or whether I have to pick them up at the local office.

In your case, why did you opt to get the COC instead of US passports? What is it that a COC can do that a US Passport cannot. Just asking, since I don't know. That is actually why I was asking in the first place to see if I can save my $600 and just spend the $100 for the US passport.

I think this is a case of wanting to know from those who have walked in those shoes, rather than those who respond based on what seems to rational/sensible.

Your son will be a US citizen automatically if he is under 18 upon entry with the IR-2. He should only refer to himself as a US citizen.

Get him a US passport. Return his green card to USCIS with a photocopy of his US passport and explain that he obtained US citizenship under the child citizenship act.

Maybe someone here has a clue.

I am a USC and my son just arrived on an IR-2 visa. The POE told him he will receive his 10 year greencard in the mail within 6 months.

So since he is automatically a USC because his is my minor child, he can apply for a US Passport. I already called the Passport section of Department of State and they asked that he complete the DS-11, take his greencard and my naturalization certificate to the post office when applying for his passport.

So here are the questions.

What automatically happens to a greencard when a US passport is issued. I doubt that the Department of State will alert the USCIS/DHS that a greencard holder has been issued a US passport, so as to void the greencard. Is that why people go ahead and apply for the naturalization certificate for minors, so that USCIS/DHS can update that status in their records? Why would a person have a valid green card and a US passport at the same time? When asked, what is your immigration status, does he say he is a US citizen or a green card holder? If he was in Arizona (wink...wink) What does he carry with him at all times when driving? No one carries their passport with them when driving, while greencard holders are supposed to carry that document with them at all times.

What are your views on this matter?

Bad news for me. I was expecting a case complete but instead when I called the Operator Cindy told me that I should not have filled the I-864 but the I-864W. I guess this is the difference between petitioning for a minor (I-864W) while a spouse (I-864). So I will complete the I-864W and FedEx it on Monday.

Also they want me to send an email explaining (once again) why the police certificate is not available for minors in Kenya. I already put the explanation letter in the IV packet as one operator had instructed me to do. Now Cindy says send an email with same explanation. Like I mentioned before, unless you are 18 and have been issued the Kenya National Identification Card, the CID (Criminal Investigative Dept) will be unable to issue you with a police certificate. My 16 yr old son already went to the CID and they told him that.

One more wasted week.

Honestly I don't know anymore. I had started to believe NVC gets the available slots during the second week of April, but all the interviews assigned today contradicts that. And it wasn't even people who got their CC recently, it was people who got their CC even before me so that means that a new list must have arrived today. I guess some consulates just give NVC the list a little earlier. Who knows!!!


Nevertheless congrats to all who got their dates! Can't wait to be in your shoes.

I always thought an Embassy was a permanent post and a consulate is semi-permanent. For example Kenya has it's embassy in Washington DC, which is the permanent base while it's consulates in LA, California and New York are junior offices.

A consulate is like a junior embassy. It's generally located in a busy tourist city, and takes care of minor diplomatic tasks such as issuing visas. The word consulate literally means office of the consul, who is a diplomat appointed to foster trade and take care of expatriates.
Embassies are much bigger deals. The word embassy comes from the French ambassy, or office of the ambassador. Ambassadors are high-ranking diplomatic representatives who serve as spokespersons for their national governments. If one country recognizes the sovereignty of another, they generally establish an embassy there. Embassies take care of the same administrative duties as consulates, but they also represent their governments abroad.

My policy is never leave anything blank. Either "N/A" where not applicable and "NONE" where none, e.g.,like A# for beneficiary would be "NONE" and not "N/A"and also "UNKNOWN" if information like fathers' name, if one does not know who their father is/was. Reason being, that it makes it obvious that the field was not un-noticed by the person completing the form.

Saylin, please update the spreadsheet that I mailed my IV packet yesterday 4/2/2012. I also got a check list email in the afternoon, but that was just asking for the IV packet.

:ot: Just dodged a few tornadoes here in North Texas, and more are on the way. We had to go to the stairwell for safety 3 times over the last 1 and 1/2 hours. I am afraid to go see how my car looks like after all the hail that passed through.

It's true.. They are raising the cost of non-immigrant visas and lowering the cost of immigrant visas. The change was release last week.


Any link from a government website? Couldn't find any at the USCIS website, under NEWS or the DOS website under VISA NEWS. Only Immigration.com and visajourney.com have "new immigration fees" news. That's why I thought it was an April fools prank.

I was so excited over seeing our AOS as paid and sending our package in today I sent hubby an email to his work account, it was all gushy and I love you's etc so on. At the bottom in big letters I put I LOVE YOU.

Keep in mind my husband is a heave equipment mechanic, you know the type.. all manly man and macho..

I get a text about 20 min later, "Keep the mushy stuff outta my work email :P " after that I got a text from his buddy at work "Awwww he wuvs you too!" Apparently the buddy was looking over hubby's shoulder and is now giving him heck over it. :lol:

Tomorrow I'll send a big heart picture...

Ummm...just got an email from the congressman that we'd contacted with our USCIS concerns. We did NOT contact them yet about NVC...and they've already been following up with NVC about our case, to help out. WHAT?!?! :thumbs: :dance: :wow: :D :o


That's interesting since USCIS is under Department of Homeland Security, while NVC is under Department of State...... as some rude NVC operator reminded me last week, when I called NVC wondering how my son would go around getting his citizenship after he got admitted at POE. I was just asking if he would get a green card first, then when he is here we can apply for his citizenship and which path to use. She said "that is an immigration matter....these are two different departments. We are under the Department of State and you should call the Department of Homeland Security, USCIS about that matter........ I said, "okay!" :bonk:

I'd suggest calling back and asking specifically: "Has my package been reviewed and accepted?"

And no, you won't get any emails from NVC confirming they got it or accepted it.


Actually I did. I specifically asked, "so does that mean my AOS packet was accepted?" But she responded by saying "nothing else is needed from the AOS ma'am. Everything is in order, you will receive another email for the IV.............".

I'll call again in the evening and see if someone else can actually use the word "accepted". Then I can sleep better.

Thanks. Too bad I slept on the wheel and I don't have all my IV packet documents. Really it's just the Police Certificate that I don't have. Had issues with getting those from my country as the Criminal Investigative Department of my country says they issue Police Certificates ("certificate of good conduct" as they call it) only to those with a National ID. In Kenya you have to be 18 to have an ID/DL, so the CID is having a hard time issuing a police certificate to my 16 year old, because he is not in the national identification database. I have emailed the US Embassy in Kenya to see if they have a specific contact that they use to get police certificate for those under 18.

The Kenya forum on VJ does not have a precedent for this issue.

I didn't think the NVC process would be this fast for me and thought I had some time left to sort this matter out.

I emailed DS3032 on 03/22/2012 - same day I got my case number. On 03/26/2012 I got my emails for AOS packet and Bill had been invoiced and paid it. Yesterday, I called NVC for another matter but decided to ask whether they had received my choice of agent. She said go ahead and email it again, so I did so yesterday. Today, the choice of agent was accepted. They referenced the Choice of Agent I mailed again yesterday and not the one I emailed on 03/22. I know it was the latter and not the former email coz I tweaked a few things (Made lower case changes to the email addresses that had been upper-case) and gave a different phone number.

It is a little weird. It's usually the other way around, the money is taken out first, and then shows as PAID. Is there any pending charge on your account that you see?


No. And I just checked again just to make sure. And I know we don't have the same bank (NVC and I)coz my bank is a Texas only Bank. Maybe they have an internal automated thing hooked up to the finance systems' Electronic Funds Transfer. Or maybe the PAID is activated when an NVC person reviews/accepts the payment. OR I am in the hook for the money even if the check bounces, so I would end up owing the bank if the check bounces. (not that I would ever bounce a check - I swear!! :lol: ) Just thinking of all the different scenarios.
