You have the right form. You have to submit all four pages, even though they are the same. And they all have to be signed. Letter of intent from both of you is needef for the petition and than for the interview (except this one should be dated closer to the interview date).

YuAndDan provided some great input good.gif I'll just add, that at this stage, do not worry about chats/emails. All they need is hard evidence that proves meeting in person in the last two years. For this, pictures are considered secondary. What they need to see is passport stamps and boarding passes. Throw some pics and missing docs menionted and you are good to go. Best of luck!!!

There several more reasons why the rule may apply, even if you were not funded by the government. I myself had four J-1s in the past and only after the first one I had to stay in Ukraine for two years. There are two ways to check. First of all, look in your passport as to what your visa says. I just checked my 2004 J1 (four months on Work & Travel Program). It says at the bottom: "Bearer is not subject to section 212(e). Two year rule does not apply" Second way is to request authoritative opinion.

My latest J1(18 months 2006-07) did not have anything marked on DS-2019 either. However, my visa had the same note as I just cited. Thus, I did not worry about it.

Now, even if you do find out you are subject to two-year rule, DS-2019 shouldn't be included in the petition package. You will have to get a waiver and take it to the interview.

And last. If you did a four months summer program, I assume it was W&T. If so, do not worry about it. This program is not subject to 212(E).

If you do a K1 and you two do not get married, it indeed will be considered fraud and u will screw up chances of your gf to ever get another visa. Expedite or no expedite, there is no way you will be able to get H1B this year. The deadline for fiscal year beginning Oct. 2008 was April 1, and trust me, by now cap is filled up. The only feasable option I see, is applying for a tourist visa. If she will be able to show strong ties to Ukraine: real estate property, college or job with above-average Ukr. salary. Best of luck!

As was mentioned before, ur fiance can come and visit you while you guys wait for K1 approval. For some countries it's much easier to get a tourist/visitor visa to spend some time together, maybe some Italians can chip in as to how hard it is to get a visa.

I'll just say that going to college might be a bit easier and much cheaper once you two are married and Mario gets his GC. In some colleges he can qualify for in-state fees rather quickly. Just something to research. Good luck with the divorce!

Most of the time 2 year home residency requirement applies to scholars/students on some programs with J-1 visa. If it applies it would say so right on that visa, though.

Ur fiance can visit you and it will not cause a denial. There are many couples, especially from Canada that are coming down for a visit. It is at discretion of the officer at POE to either let her visit you or deny entry, though. Thus, strong ties to Australia should be shown: like job, appartment lease, bills, etc. Just ask around in the Australian forum to share successful stories of border crosing on VWP while in the process of wait.

Please don't confuse "getting married", and using a tourist visa to enter the US with the intention to immigrate.

There is NOTHING illegal with getting married on a tourist visa.

I would say try to avoid submiting evidence like that. Instead of printing out emails that have "husband" and "wife" mentioned in it, you can do the screen print of your inbox that will show emails from your SO. Same goes for the chats. Instead of printing a whole conversation log, pring beg. and end. Good luck!

This should make it a bit easier. Those are attachments I've created when filling in my form. We printed only one copy and even forgot to date and sign it and still got approved without RFE. To be on a safer side, print four copies - one for each page of G-325A, sign them and date them!

Edited to add: You don't have to fill in your full employment history on this extra sheet. On Form G-325A, on the last line available put: See attachment A (or B.) and than just continue on the extra sheet!

Does it really matter "why"? The question states:

Applicant's employment last five years. (If none, so state.) List present employment first.

They say they want it, so give it to them. 5 minutes of annoyance on your end could be potential months saved of annoyance later on for an RFE over something so silly as this.

Why would they? You are entitled to enter anywhere, it's convinient for you. I will be traveling to Orlando in Florida, but most probably my POE will be JFK in New York. If they ask you as to why you are entering there (which I doubt they will smile.gif), simply explain that you guys are getting married in Hawaii smile.gif. You are not required to marry in California, it can be anywhere in the 52 states.

Any US airport/port/land boder crossing point can be POE, so if you have a direct flight anywhere in the Hawaii, that city will be your POE. If you have to make a stop somewhere in the US on the way to Hawaii, your POE will be the first US city (airport) you arrive into. After getting your visa activated at the POE, you can travel anywhere in the US, no problems. You can also search the timelines (through "Immigration Timelines" link on top of the page for Casablanca consulate cases. It really is different for each case/consulate. While general petition approval can take 4-6 months on average, consualte stage is different for each country.
