K-1 Fiance(e) Visa Process & ProceduresNBI clearance problem

another question,
so even if i dont have my nbi clearance yet,i will still have my interview and they will still decide if im approved or not?

Yes.

I don't know the "exact" words that you will hear, but if you show up on your interview WITHOUT the NBI clearance, you can expect a 221g from the consul.

You will need to send in your NBI via 2GO and wait for your passport with visa to be delivered/picked-up. You can email or call the Embassy in between for follow-up.

K-1 Fiance(e) Visa Process & ProceduresNBI clearance problem

When my Fiancee renewed her NBI in Las Pinas she picked it up the next day. I am amazed how it varies at the different NBI offices in the Philippines.

I'm from Las Pinas too. If a person doesn't have a "hit" (same name with another person/s) they will receive their clearance on the same day. If there's a "hit", like in my case, clearance will be released after 10 working days.

K-1 Fiance(e) Visa Process & ProceduresNBI clearance problem
Do you have a "hit"?

Try to go and claim your clearance before your interview date. When I renewed my NBI clearance last June they told me to come back after 10 working days because I have a "hit". I tried to claim it a day ahead (because I happen to pass-by the NBI office), luckily it was already available for release.

You might want to try it too, but if no luck, you can go ahead with your scheduled interview. Expect a 221g though.

K-1 Fiance(e) Visa Process & ProceduresStephen vs Steve- "other names used"?

So as to not add a not a new post, I'll ask my question here. For other name, If my legal name is Stephen but I mainly go by Steve would I add this here? Or is it for cases where one might use a middle name or another name, and not just a shortened version of our legal name?

As far as I can understand, "Other names used" refer to all the names you have used in your legal documents (birth certificate, marriage certificate, passport, naturalization certificate etc..) and identification cards (driver's license, state ID etc..). Nicknames are not included.

K-1 Fiance(e) Visa Process & ProceduresUSC fiance lost his job

Hello!
I was searching for similar situations, but didn't find any. My fiance has lost his job right after i've received K-1 visa. of course, we are both upset and have postponed my coming to States. so the question is : what should we do? may this thing happened to us hurt my coming there? fiance keeps telling me i can be denied at POE because of his unemploymence. is it true? or he has to have job and incomes only for applying AOS for me? i want to calm down him and myself, but can't find any information about that.

You can come to US. You will not be denied entry at your POE because your fiancee is jobless at the moment.

But he will have to find a new job SOON... for your everyday living expenses, your upcoming wedding and AOS.

do my daughter need a visa? or her name put also on my visa?

If she's your daughter from another man, she will need a visa. She will be issued her own visa, attached to her own passport.

K-1 Fiance(e) Visa Process & Proceduresk2 visa
Is your daughter the biological child of your US citizen fiancee? If yes, you should file CRBA in order to acquire the child a US passport. http://manila.usemba...th-abroad7.html

If not, your daughter will need her own Philippine passport for the K2 visa process. Your daughter will also undergo a medical exam and she should be present during the Embassy interview.

If your fiancee changes her mind and would want for the kids to immigrate ASAP, then you file i-130 for them.

K-1 Fiance(e) Visa Process & ProceduresChildren to join

9 & 6 ... assuming were married (but the kids aren't mine) she has to be the one to file? I guess there's nothing technically wrong doing adoption. Just sounds strange to me. Joint adoption, adopting her own kids. Mmm just more complicated than I thought.

You don't have to adopt them. They become your stepchildren.

You have 2 options:

1.) You can file i-130 for them.

2.) Fiancee waits after 3 years, then file i-130 for them. The faster route is if she becomes a US citizen too. She will qualify after 3 YEARS of being married to you, just in time for her desired timeframe. After she gets her Naturalization certificate, she can file i-130 for the kids.

Either way, it'll take less than a year for them to immigrate since they will be under the IR category (Unmarried child below 21 of a US citizen).

To me it sounds like an engagement PARTY, but then again if the picture shows you in a wedding gown and the guy in a tuxedo, I (or the consul) might assume it's a wedding.

You might want to consider using that as evidence. Just my opinion.

You can put either: Travel to USA or US Visa Application

You will get it right away if your name doesn't have a "hit".

You will get it after 10 days if your name has a "hit".

Hit means you share names with another person (or people) and NBI will need time to verify your record.

wht am now asking if i produce legal police certificate requested will i be good to go with now ?

Submit the Police Certificates as soon as possible. The Embassy will review your case after you submit the lacking documents. There's no specific time frame for Administrative Processing. It could take days, weeks or months. The sooner you act on it, the better.

K-1 Fiance(e) Visa Process & ProceduresUpdated police cert asked for- what now?
Here is the answer to your inquiry:

POLICE CERTIFICATES: Each applicant aged 16 years or over is required to submit a police certificate from the police authorities of each locality of the country of the applicant?s nationality or current residence where the applicant has resided for at least six months since attaining the age of sixteen. Police certificates are also required from all other countries where the applicant has resided at least one year. A police certificate must also be obtained from the police authorities of any place where the applicant has been arrested for any reason, regardless of the length of residence. Police certificates from certain countries are considered unobtainable. The consular office will advise you about any particular country.

If the spelling error is on the IMMIGRANT DATA SUMMARY SHEET, then it won't cause any problems at POE.

But...

If the spelling error is on the VISA ITSELF, then you should have it corrected right away at the Embassy. The name on the visa should match the name on the passport.

The children will not use the surname of your husband, as they are not his biological kids.

Whatever names the children are using in their NSO birth certificate and Philippine passport, that's the name that they will use in all of their paperworks in the US.

Adoption is another thing.

You're probably referring to the Xray CD from St. Luke's Extension Clinic (SLEC). She needs to bring that to the US.

After the interview, the US Embassy will send via 2GO courier her passport (with K1 visa attached) and the yellow visa packet that she would give to US immigration at POE.

She should NOT, in anyway, open the yellow packet/envelope. It must be kept away from tear/damage.

Bear in mind that the medical exam is only valid within 6 MONTHS.

If your child's BC is not yet corrected within your 4-month timeframe and still no passport for him, there's a big chance that your fiancee's medical will expire. She will have to undergo another medical exam and pay another medical fee.
