I used the NOA date since that's what was used on the ROC forum, I don't think it matters. Mine are 2 days a part.

I'm guessing none of us applying for the N400 work for the postal service since you have to be a US citizen ;) Though I guess our spouses could... Not long everyone and we can apply to work for the postal service... Let's not all rush at once :whistle:


In our case, it is my wife who will get citizenship. She asked me to do the VJ for her as she is 'shy to do it'... as she says. In truth, I have found, in my wife's case, that the USCIS has been one of the better governmental agencies with which we have dealt. Yes, they are a bureaucracy! But if you follow the rules to the letter, don't assume anything and send more, rather than less, it all seems to work. So I don't have any animus towards USCIS. Heck it was the USCIS that allows me to live a good life with my wife here in the USA. It's hard to be angry with the folk that, as opposed to other countries, do not require bribes, get work done, treat us with respect and consideration and in general make me proud to be a citizen.

Your comments about the speed of bulk mail as opposed to the first class of the biometrics letter is probably correct.

On the table we have...As a matter of form... I will stick in some date for the check cashed that is not meaningful..

You realize that even if the notice has a 12/4 date it doesn't mean it left the USCIS facility right away and entered the USPS mail stream on that day?


Oh man, let me guess, you work for the post office! No matter... when it takes two, to three, days for 1st class mail to go from my house to the house across the street, it's a dying service. And for the record it does.

OK I have a couple of dates to deal with but have questions. (First a confession - I have not been keeping up with the conversation here, so if this is redundant, I do sincerely apologize).

1. The NOA (797C) has both the Notice date [30NOV2012] and the Priority date [27NOV2012]. It seems to me that the priority date has more value that does notice date. While date have you all been using?

2. The Check Cashed date. I sent a postal money order. Leave it blank? They do acknowledge it as paid on the NOA.

We did log into the USCIS site, see our case and note that the Biometrics letter is in the mail, having been sent out on the 4th. The 1st case mail took sent days to get here. The US Postal Service is dying a slow and ugly death.

Hi, sorry to break into your thread on the mail forwarding, but I have some recent damned close to first hand knowledge on this. My Sister-in-Law, Rosie (my wife's sister) married one of my best friends, John, and they are in the AoS process right now. John had an apartment in Connecticut when they filed for the AoS. But because of work they moved to NY. I was panicked over the forwarding issue. John was not and as it worked out, he was right. The USCIS stuff did forward. They got things a week late, but they did get things. Now granted Rosie is still waiting for her 2-year GC, but mail did forward.

And on another note, congratulations to Greg and all those we were with two years ago at this time but who got their cards a bit earlier than my wife did. We wish you all the very best.

Mike & Sachie, thank you so much! still waiting what my lawyer has to say about it. I asked him about 2 months ago if i can go to an interview with an expired passport. He said,"yes and it s not a problem at all" I think the only reason they need my passport is to stamp it because they will take my 2 year expired card. So i suppose they will stamp my passport while i'm waiting for my 10 year card (if i get approved)
Mike&Sachie, when you went to the interview, did they check your passport? what did they do with it? and what did security guard check on the door to let you in? I mean i was told to bring my expirec gc, passport and DL or ID.
It's funny how they don't need your passport to file I-751 and everyone says you don't need it. And then out of a sudden they need it for an interview :angry: There is no clear instructions!!!

You are correct the process is not clear and sometimes it can be aggravating... however the assumption that your passport should be current when in another country is not a stretch of understanding. It is 'assumed.' That may not be agreeable to you but it has always been something that I have understood and I suspect that, while it is not in the 751 instructions, there is in more basic info about being in the USA, a requirement that your passport be valid.

You are going to spend how much money, stress, time and worry to 'argue' with a Government process? It will likely cost you more than doing what they ask. It will add stress top your life you don't need and then there is the risk... The risk is you lose... not just once and then win on appeal, but lose completely. Granted the likelihood of that is small, but the heartache, time and treasure you will spend fighting what could have been a fairly easy if delayed process, is a poor choice.

'Playing chicken' with Government is not something you should choose to do unless you have no choice. Governments can and will be arbitrary and frustrating. That's just life. Swallow your pride, accept the fact that your lawyer is wrong and get the damned thing done and over with.

Congratulations Lisa and Ian!
We got a letter saying we have to go for an interview June,26. It says (among others things) to bring VALID UNEXPIRED PASSPORT. The problem is my Russian passport is expired. I only need it to travel to Russia and i wasn't planning on doing it for a while. It costs a lot of money to renew it. I wasn't planning on doing it in the near future...What do i do now.. :wacko:


Ask for a delay with the interview and get your passport renewed.

Thanks HeatDeath! Yes we are relived though we are currently in the Philippines and our neighbor is collecting our mail! I received notice in the last few hours of production of one of the two cards (mother and daughter) and mailing of the same. The second card - if it is anything like the approval notices will follow tomorrow. The first time through was a nail biter. This time I didn't have as much to send... go figure. We did send a sh*t load of photos covering events over the entire two years. I know they said two affidavids but we sent three. Last time we were interviewed. This time has anyone been interviewed?


My wife says she will start studying for the naturalization test as soon as we get back to the states.

Crying now.... This is taking way too long. We are headed out of the country in a month! What do we do?


We are in the Philippines at the moment. We have a neighbor checking our mailbox in the USA. I went to the USCIS in April and because the letter stating my wife have a year's extension had a typo on the name, they gave her and my daughter 551 stamps. We left the US with the 551 stampts in their passports. Maybe it would be worth trying to get that. FYI the WEBSITE four days AFTER the approval was created and after we got notified of the letter still said our app have not been touched since November.

Decision date 21 May 2012 APPROVAL!!!! Received on May 25. Hoorah. We are currently in Manila, PH and flying to General Santos City on a 551 stamp, as the green cards are being sent to our home in the USA.

On the same day Beth and our daughter Nicole got notified of their approvals, I filed in the Philippines for a ACR I-Card (Alien Registration Card, as we are living here 3 months a year and I need such a card to open a bank account.

His wife's residency has not started until arrival at POE in January 2010, but I agree that it's up to OP to explain.
As we all know, sometimes RFEs are kind of confusing and I think they are maybe asking for 2010 and 2011 tax years? For tax year 2009, the OP should have filed as 'Married filed separately', so I don't know how that would help... on the other hand can't hurt sending them tax transcripts for all 3 years in response to RFE.


Personally I would send all three, but 2009 is critical along with an attached affidavit explaining why it is not a joint filing. It is always best to send more than they need as opposed to deciding for them what they need!

They did CR-1/IR1 process, not AOS from K-1.
AOS fee was paid to NVC well before she interviewed, received her visa or entered at POE.

That being the case, and I sure am not an expert of such matters, the 2009 tax return would still need to be submitted with the accompanying explanation. The rules have no nuance, even if the process permits nuanced actions. Note Mike & Sachie initial post and the language they quoted.

My wife didn't arrive in the states until January 2010, so I don't think supplying a 2009 tax return would have provided any evidence of a entering a good faith marriage or continuing to share a life together since the time she received her conditional green card.


I'm sorry and I guess it's none of my business, but your sig/timeline says:

In light of that, I have one question: How do you file for an AoS for a person who hast yet to arrive in the US?

IMHO, the USCIS is looking at the filing date for the AoS and saying you are short a tax return and indeed you are! If there is a legal way to file for an AoS for a woman who has yet to enter the country, you need to explain that as part of the RFE along with your 2009 return which shows your legal status at the time.

Received RFE today dated 04/30. (The first RFE in our entire journey)

(1) You submitted one joint 2010 Federal tax returns [sic]. Please submit tax returns for the 2 years conditional residence period.

At first, I thought, that's strange! I could not have possibly submitted a tax return for year 2011 at the time I submitted the petition. Then my wife pointed out that perhaps it was just timing - if our petition was processed after the 4/17 federal tax submission deadline, maybe they would require both years. That'd be bad news for everyone else still waiting. Then, upon reflection, I remember I only submitted a partial copy (perhaps only 1 page) of the 2010 tax transcript. I don't know why I did that, but this is the price I'll have to pay for it. I have until July 23 to submit both returns, but I'll almost certainly submit sooner, probably this week.


You should have submitted both the complete 2009 (filed in April 2010) and the complete 2010 (filed in April 2011) Your original filing USCIS filing for AoS would have been before the 2009 tax filing.

FYI, in our state, NJ they give the DL until NOA Expiration date + 5 months.

Let's say your NOA dated September 16, 2012 they give DL expiration date as February 15,2013 & indicating the licence written "TEMP. IMMIGRATION STATUS".


And in Wyoming it expires on the day the card or the letter expires.

We drove to Casper today as a Walk-In. They took our daughter's Biometric AND agreed to give my wife and daughter 551 Visa stamps in their passports! Now we can travel to the Philippines next month without worry. Hurrah. The Case Officer looked at our filing, said all looked to be proper but it had yet to be worked by the California office. There was no way to predict from what he could see if we would need to come in for an interview. But that if we did, he would be the one interviewing us.

Our daughter was thirteen when we filed. I knew she would turn fourteen in March and pointed that out to three separate USCIS folks both on the phone and in person. They all just ignored me. Yes now that she is 14 they now decide to get the biometrics they could have had in December.

When we were there in December we asked about it and we were told the USCIS didn't need it. Now five months after we filed they want us to take her the 250 miles round trip on a school day. Well, for the CSC group there could be one more this week but it's not clear to me. Next week should produce two more. It's not like I have a crystal ball and more like a statistical thing... and you know what they say about statistics... There are lies, there are damned lies and then there are statistics.

Never the less. good luck to all of you, our fellow travelers, from my wife Beth and me. It may take some time but may we all get to the end in good shape. For those who are VSC filers... I don't know what else to say other than it seems fundamentally unfair that you have to want so long.

Yes Vermont is so slow that some people waiting for their ten year GC have actually filed an N-400 as they now qualify!

Those of us who filed with the CSC should see at least two more GC announcements this week. It is unfair, but my best guess this has more to do with Congress, budgets and such and far less to do with anything else.

Unless the CSC is slowing down even more, we should see at least one approval announced today or by Monday the latest. VSC folks are unfortunately screwed as there is clearly a problem there. But CSC is about 75% complete within the six month group which right now are the September filers and 50% within five month filers. I did a search for reasons why the VSC is so slow and found nothing. Oh well, as my Filipina wife might say, bahala na.

Yes and as of now the CSC September filers are at 57.47% (19 out of 33). Vermont filers are in a far worse situation. Our local office has not had an officer staffing it for over six months and the local gal there who does the Biometrics says they can't find anyone to take the job. She told us people are being told they must wait a year for an interview. From here it looks like USCIS is in a mess. We will be travelling back to the Philippines third week of May and I doubt my wife will have her green card by then.

Don't worry too much. When I applied for my 2-yr Green card in 2009, the same thing happened to me.
When i entered the receipt number ,it always said "error".

I had to call the 800 number to check my status.

Casper has no 'officer" and so they can not do interviews or stamp passports with a stamp, but they can do the biometric. However we are hours from Casper.

I didn't pay for my 6 year-old son when we filed. And they didn't ask us to pay either. How old is your daughter,may we ask? The USCIS officer told me on the phone that if the child is under 14, then he/she doesn't need to pay the fee coz he/she doesn't need to do the biometrics. Hope that help.

I paid for the Biometric for my 13 year old step-daughter. She will be 14 just 12 days after the current card expires. We did not get a letter for her for a biometric. We were told that they haven't made their minds up yet as to her. As it costs over $100 in gas and a day's traveling for the biometric, I was unhappy that we could not do it with my wife. They are not refunding the money.
