Tom sent a priority mail BOX of evidence of meeting in person and got approval in less than 30 days, here is what I sent:

copies of my airline tickets, receipts and itenerarry
copies of my hotel receipts
copies of my luggage tags
copies of my boarding passes
copies of my receipt for the engagement ring
copies of my passport with Thailand stamps
4 photos of us together

All this was sent for 2 trips I made to Thailand in April and July of 2006

The RFE specifically requests copies of bank statements or credit card statements showing withdrawals and purchases made in Thailand that include my name, location and full date.

I don't care what anyone says MORE EVIDENCE IS BETTER, THE MORE THE BETTER!

Maybe some of you have been approved with less than what I sent, and maybe it depends on who the person who is assigned to your case, maybe other factors play a role, but I am convinced beyond doubt that to send 'too much' is way better than not to send enough!

They also want more details on how we actually met.

I don't understand. You sent all of that information and then got an RFE for you to clarify the unsolicited information you sent? And this is good? And you encourage others to do the same?

Did you know that Adjudicating Officers are required to look at (and then vet and evaluate) every item that you send in? Did you know that sometimes the evidence raises more questions than it answers?

Well I finally got the RFE I have been awaiting since Jan. 16. They sent it to my OLD address! Thus the delay. Geeze, I had received a letter from DHS to my NEW address confirming the change in early November! What do you make of that?!

In my initial I-129F I had only send 4 photos of us together and copies of my passport, showing arrival in Chennai in May 1989 and exit in Aug 2005.

Now I will search my apartment for further proof that I was in India, I guess. I have copies of the airline ticket and boarding pass stubs, I have Exit Permit issued by the Indian govt as well as visa renewals for every year I was there. I’ll only submit the ones from 2004 & 2005, I suppose. I never had credit cards there so… that’s out. Too bad I never got printouts of my bank statements, accounts which I closed when I left. I might have dollar to rupee exchange certificates with my name & address within the two years, which I can send.

Any other suggestions? For your info, please find the letter below.

LAST MEETING: the petitioner and the beneficiary must have met in person between October 17, 2004 and October 16, 2006. Submit evidence of meeting the beneficiary in person within the two-year period preceding the filing of the petition. The primary evidence may include copies of passport pages that show the identification page and admission stamps, military orders, letters from Commanding Officer, or any evidence that will help the Service to determine that the petitioner has met the beneficiary within the two years. The secondary evidence may be airline ticket stubs and receipts (that indicate month, day and year), ATM and credit card transactions, flight itinerary on airline/travel agency letterhead, etc. NOTE: secondary evidence is used to support any primary evidence that has been submitted. The following DOES NOT constitute evidence of meeting: disc, videos, emails, letters, phone bills, and greeting cards.

The petitioner may also submit bank statements and/or credit card statements and receipts showing that a withdrawal/purchase was made in INDIA. Please ensure that any documentation that is submitted has the petitioner’s name, location, and the full date (month, day and year).

Recap: I sent in copies of my passports (3 total) and all stamps in them, showing I lived in India for 18 years. I also sent pictures of my fiancé and me together, dated. I then got an RFE requesting further evidence of meeting (post above). I sent in the following documents and within 3 days got the NOA2 approval.

Though my case is unique due to staying on in my fiancé’s country for so long, I list below the documents I sent that resulted in the approval, for everyone’s info!

1. Plane ticket and boarding pass showing flight from Chennai.

2. Travel Confirmation from Expedia.com.

3. Exit Permit issued by the Office of Foreigner Registration, Superintendent of Police, Anantapur, Andhra Pradesh, India.

4. Hotel bill while renewing my passport in Chennai.

5. Encashment certificates, with my name and passport information.

6. Applications for visa extensions.

7. Visa fees paid to the Government of India.

11. Certification from Karuna Society for Animals & Nature, where I worked in India.

12. Statement from my banks in India.

14. Copies of passports (AGAIN).

15. Photos of my fiancé and I (AGAIN).

Hello Everybody!
I got my NOA1 in Dec, and as I know we did not include the letter of intent. My fiance hired a lawyer, and we were not aware of the need of this letter. Is it mandatory? I did email the lawyer and asked him about it, and he told me we´ll need one just farther in the process. Now I´m confused. Any help?

The letter of intenet (with your signature) is necessary. Get it ready and send it to your fiance. He will probably receive an RFE soon, asking for it.

I know the all of the VJ have sent the letter, but my lawyers keeps saying the letter can be sent later on

Dumb lawyers! :angry: I have heard more delays and troubles from them... most of us just read the directions and did it on our own - which works out wonderfully, usually faster and MUCH cheaper! (Unless the case is very complicated).
Instructions on the I-129F application form, the backbone of the whole fiance petition and process:

7. What Documents Do You Need to Prove That You Can Legally Marry?

B. Provide original statements from you and your fiancé(e) whom you plan to marry within 90 days of his or her admission, and copies of any evidence you wish to submit to establish your mutual intent

I WISH I had come accross this site before I sent in the I-129F, then I would not have gotten the RFE.

I just got an email from my lawyer about the letter of intent..She said the I-129-F changed right before we applied, Dec/06 and we´ll probably be fine without the letter. Do u guys know when the I-129F changed, and they started requiring the letter??

I started filling out the I-129F form with the version that expired on 06-30-2006 (waiting during the looong 8 months that my fiancé was going through getting his passport). Then I sent in my application (in October) with the version that expired 12-31-06. There is a new version now, valid until 01-31-2010. ALL THREE VERSION HAVE THE EXACT SAME QUOTE THAT I GAVE ABOVE. I have copies on my computer if you want proof to show your lawyer! :devil: Grrr, you should fire her and continue yourself.

Add this one to the list. The US citizen must show proof that they are a US citizen. We already know that but they are pretty picky so your birth certificate MUST show BOTH parents names. Fortunately I had already ordered the long forms and they arrived while we were waiting but my opinion is GO GET YOUR PASSPORT!!!!

I just sent a copy of my passport (I didn't have my BC at that time) and had no problem about that. So you're good to go, don't worry! :thumbs:

I made the check out to the Department of Homeland Security as the instructions said, but the note said we need to make the check out to USCIS.

You have a reason to be confused! We all made out our checks & money orders to the Dept of Homeland Security because that is what the instructions said, and they all were approved fine. It is a mystery why you got that note. :unsure: Anyway you have now followed their instructions so here's to a fast NOA1 & NOA2!! :thumbs:

We got a RFE because my fiance didn't send in enough proof of our meeting - he had to send in more evidence! It's not enough just to fill out the form and say 'we met on X date' - you have to provide photos too :) And then he got another RFE because they needed more financial information from him. Combined the two held us up for three months which seemed like an eternity but wasn't really a big deal.


Oh My God! THANK YOU SO MUCH FOR PUTTING YOUR POST UP! My fiancee did the same thing. He filled out the I-129F and the G-325A form, photocopied his passport, and sent a pass port pic for the each of us. I've been freaking out when I realized that no *proof* of our relationship was sent and have been contemplating send all that stuff in since we just yesterday got our NOA1 and the case number!

I've been beside myself thinking what if they just outright reject us cuz we didn't send enough proof in and don't even bother to send us and RFE!

Did anyone get an RFE for leaving the Apt# empty (instead of writing N/A)?

I left Apt# blank (cuz I was living in a house at the time) and did NOT receive an RFE for it.

We got a RFE because we took "passport OR birth certificate of USC" to mean "passport OR birth certificate of USC" LOL. We put birth certificate and not passport, and they RFE'd for the passport so my advice is read all OR's as AND's ;)


I just sent in copy of my passport and no birth certificate and there was no problem. I have heard of a number of people sending in BC only not passport, with no problem. As usual, it all depends upon was employee is looking at your case, NOT about the hard and fast rules! :blink: :wacko:

Please resist the temptation to send anything in now! Just think, they receive HUNDREDS of applications every single day, and they pile up for MONTHS before employees have time to get to them. The one you sent in is now somewhere among tens of boxes stacked high around rooms and against walls. There is no way they will be able to match up the info you send now, with the application you sent in several days ago.

Be patient and wait for the RFE, when your application is sitting cozy and safe on someone’s desk. Have everything ready to send in immediately when you get the RFE, then the info you send will go straight to the correct employee’s desk and within a handful of days you will get the NOA2 approval! That’s what happened to me! Good luck! :thumbs:

What if you have a boarding pass to a different city than your fiancee lives in? It's rather hard to get a flight to Boondockyville, Idaho.

A different city is OK, the main thing is the COUNTRY. I landed in a city a good 12 hours bus journey from where my fiance lived, and had no problem. :yes:

I can top this one. I am still waiting on my RFE. Filed for NOA1 on 24 April (VSC). Called the VSC two weeks ago and they said that an RFE is in process. Not gone to clerical yet which they claim can take two weeks and then mailed another 2 weeks. I asked what on earth it was for as we have sent in everything. I mean everything. Long form birth certificate, passport stamps for the past THREE years (past the two year guideline), photos, (we have a website as well and have had one for two years), social security card copy, military ID copy with MY picture and Social Security number on that as well, statements from friends and family members as to our meetings in the past THREE years, letter from my employer (even though the Embassy is the financial decider), even though I am over the guidelines for finances we have a back up co-sponsor as well, my fiance' divorce decree from the UK and my divorce decree (signed and notarized by the Clerk of Courts with a current date). There response relative to the REF from the woman on the phone is that she does not have all of the details but she said that she is reading on the computer that my divorce was not final and that my name does not match up! Match up to what? A). you have my Birth Certificate, My military ID card with Photo, my passport photo...errr ummm am I a phigmant of my imagination? I pay taxes, I work full time, I have been part of the U.S. Military world (NAVY) for over 15 years! as for my divorce in question it was granted to me and signed by a judge of competent jurisdiction in 1997. I took it upon myself to go down to the court house this past Wednesday for another certified copy of my divorce papers and the clerk said you were here for this not too long ago and I said why yes I was and I explained why I was back. The clerk then said you are legally divorced and have been since June 3, 1997 and are free to marry per the laws that govern our state! So someone PLEASE tell me how VSC can claim that I am not! and that I am NOT ME! and lawyers they are not help. "We will just send them waht they need and in two weeks time or less after that you will have your NOA2. What kind of response is this? It still does not clear up how VSC puts out the info that they put and how they conjur up some of these things.
Frustrated is MY WORD for the day right now!


Did you include a copy of the marriage certificate from your previous marriage? If you changed your name with your first marriage, you should have included it in your I129f packet. If you didn't, that could be why they are saying that you aren't who you are ....the marriage cert shows your name changing from maiden to married name. As for why they state you aren't divorced? No clue! Just resend another cert copy of the divorce decree. Good luck!

First realize that you have received a form letter and everything may not apply to you. However, I think it is safe to bet at least one of the things on the list does apply to you. Since they did not include the copy of the petition, you need to look at your own copy and figure out what they are looking for.
  1. Make a copy of your I-129F.
  2. Review it carefully. If there are any fields where you entered N/A that could also have been answered with "None", write in "None".
  3. Make sure you have answered all the IMBRA related questions properly, also using "none" instead of "N/A" as appropriate.
  4. If A-11 was answered yes, provide the required names as indicated. If not, make sure you checked the no box.
  5. Prepare a cover letter explaining that you did not receive a copy of the petition with items circles as indicated in #1 nor did you did you receive a list of questions indicated in #2. Include a list of what changes you have made.
  6. Sign and date the cover letter and the copy of the modified I-129F.
  7. Send everything back. I think they give you a special address or an envelope or something. Use express mail.
  8. As soon as they have received your package call the RFE line every day.
You may find that the information that you provide will satisfy them. If not, they will send you another RFE that hopefully will be more complete than the last one. I know that sucks, but I think it will get things resolved as soon as possible. To wait around for a week for someone who may or may not call you back seems like a waste of time to me.

Our petition got approved without my hubby's birth certificate, it was only required at the Consulate interview in India. yes.gif

If you get an RFE, you can certainly send in the birth certificate. If you don't get an RFE, just include it at the Consulate stage. good.gif

First of all, if you sent in evidence that you have been to USA many times, it should be enough (along with photos of both of you together too). Copies of your passport will also confirm your visits. They just want proof that you two have met, it is not required that he show proof that he has been to your country. However if asked (and for the Consulate interview), it would be great if you could provide the proof of him coming to visit you in Japan also.

Certainly they have proof of your visits to USA, but when you submit the immigration paperwork, they want us to submit the proof we have in a nice, neat packet. That's a lot easier than have the employees do extensive research on their own, for every case.

Second, this thread is specifically for people who have received RFEs (Request for additional Evidence) so not many people read it. If you have other questions, start a new topic so more people can see it and reply! good.gif

I sent in only my US passport, copies of every page, but no BC at all (I only have the "short form"), and got approved fine. Make the passport copies and keep them safe. If you get an RFE, you can send them in. Otherwise, just make sure you send the passport copies to the Consulate when your honey has an interview. yes.gif

I would not worry too much about it. Don't call up USCIS (when you contact them unasked, it only confuses them and complicates the case) and if later you are asked in an RFE, he can just explain the truth. There were no dates on the pictures I took with a cheap camera in India. When I sent in the K1 application, I guessed an approximate date and wrote it on the photo. Then when I sent in the same photos that were submitted at the Consulate for the interview, I could not find any copy of what I had submitted with the I-129F, so I had to guess the dates again, which were different! No one asked me about it and all went smoothly. So you two kiss and make up, it is an honest mistake he made, under the stress of paperwork, poor guy. No big deal. no0pb.gif

Copies of Passports that show entry into countries you've visited together, or when you visited eachother's country, are also very useful. Thats one we used, and on the photocopy pages I just noted that he visited me from this date to this date, etc. You should be good with the other things you described, in addition to passport copies.

I also didn't have pay stubs because I was just working for a small honorarium. So I sent in copies of all my visa extensions and evidence I gave in India for that (bank account statements, letter from my employer, visa fee payment copies), money exchange certificates, hotel bill (I only had one, for a one-day stay while doing visa extension), boarding pass and itinerary for my trip home to USA, and I again sent in the same copies of my passport and photos. I also sent in a cover letter explaining how long I was in India and what I was doing there. I was approved soon after I sent in all that evidence. good.gif Good luck to you, too!

My mother lost my birth certificate mad.gif so I ordered another one from Pennsylvania, where I was born. They sent a "short form" (it is half a page in size) which did not have my parent's names on it. I sent it back requesting them to send the "long form" with parent's names. They sent back the same "short form" with parent's names added.

There's some talk that some state policies are different. Someone said that the "long form" is not issued to adults, they only give a re-issue of the "short form."

The Example Forms on VJ are a great help! The Example Forms show "NONE" under that section. I hope the additional N/A will be ignored and it will be OK! whistling.gif

Usually there is only one RFE and then processing is resumed, but on rare occasions people are contacted with a second RFE (because the adjudicator goes through your file a second time and might catch something missed the first time). But that really doesn't happen too often. no0pb.gif

72 days since they received the RFE - that is waaay tooo long! However ever since the fee increase, they are really totally backlogged with files and everything takes longer. It was touched on Jan 10 so that is a good sign - someone is working on your case again. Let's hope you get the approval soon. Yes probably futile to call them again, since it was touched a week ago. Give it another week or two then call them again, or schedule another Infopass. Good luck! good.gif

Nao, I think the packet is received and only basic things are checked quickly, like the amount of the check and valid application date (new, updated forms come out now and then). After which, they send out the NOA1.

After that, the file waits for months in a storage room until an adjudicator gets to it (first come, first served - and they are ALWAYS waaaay behind mad.gif ). Then, all your paperwork is gone through carefully and it is at this stage that an RFE, if any, is sent out. So basically, the RFE is usually sent out at the very last stage of processing. On the bright side, if you get an RFE, your files remains at the top of the pile and as soon as you send in the needed info, the file is usually approved quickly. yes.gif

You can copy passport stamps and send copies of things like proof you changed money, a notarized Affidavit from the friends you stayed with, and any travel itinerary you may have. Actually the second trip is more recent so most important. Sounds like you have plenty of proof, at any rate! good.gif

They are mostly concerned about the COUNTRY not the state in the country, so as long as you have proof that he was in USA, you are good to go! good.gif (When submitting my proof it just showed I was in India, nowhere did we have any proof that we were in the same state at the same time, except photos).

I don't know about the photo thing, haven't heard of a similar case. Hopefully they will not send it back. If they do just write his name on the photo and return it immediately!

I think as soon as you get your NOA1, your name is sent to a separate agency (FBI) to do the security/name check. Meanwhile, the file is waiting on a shelf until an adjudicator gets to it. Usually the security check is finished first.

Usually people get one letter with multiple (if applicable) RFE requests. However after receiving the RFE info, they might go over the case again and find something else missing. However usually that does not happen. no0pb.gif

If you have any idea what the RFE could be for, you can start preparing the paperwork now, ready to send immediately. Many RFEs are for W2s or other tax info; or concerning co-sponsors (like their proof of citizenship or W2s/tax info). You could also go over all your copies of the applications you sent and double check that the info is correct and you signed everything, etc. Good luck with a fast approval! good.gif

When you send in the RFE, definitely include the cover letter they sent you. First make a copy of it of course, for your records. You can also put "RFE Reply" with your case number on the cover envelope you send it in, that is what I did when I got an RFE for our K1 (it was for more proof of relationship). And of course, include a cover letter clearly stating what documents you are sending.

You can certainly send in more proof if you want, other than the RFE they specifically request. My motto throughout this process is, "Better safe than sorry!" and to drown them in paperwork! good.gif

As for the special envelope, they sent a plain white 9 by 12 one with their address on it; it did NOT fit all the piles of paperwork I had to send, so I got a similar, bigger envelope and copied the address on the "special envelope" exactly.

Sounds like your RFE would NOT be for proof of relationship, you sent TONS of that already! (I had not found VJ until I already submitted the I-129F, so all I sent was copies of my passport pages to prove I was in India. After the RFE I sent in copies of plane tickets, itinerary, visa extensions, etc.).

Usually The petition is approved fast after receiving the RFE. For us, we got approved 12 days after I sent in the RFE.

NN1980, sorry about the RFE. Be sure to send in some SOLID proof of meeting, because that is the important thing at this stage, NOT of ongoing relationship. Send them things like more photos together of course, plane tickets, itinerary, traveler check encasement receipts, hotel bills, etc. Anything showing your name and address in the foreign country showing both of you were at the same place at the same time. Send again all pages in your passport and any visa paperwork. Read carefully the RFE notice and send them exactly what they ask.

NN1980, besides the additional evidence, we also RE-SENT all the other evidence, like the same photos (there were only 6 photos of us together in existence at that time), passport pages, etc. I also wrote a cover letter certifying that we had met on such and such dates and describing every bit of evidence proving it, all attached paperwork. I suggest you write an explanation letter how you stayed with your fiance so don't have hotel receipts, etc.
