hello. need some piece of advice from you guys. i was admitted in the US as k-1 and right now, done the marriage and AOS as well. a sudden change of plan. i will go back to Philippines to get my son. i did  not bring my  son here anyway because our plan before is me and my husband should wait that my son is  a bit matured that he can take care of himself like eating, changing clothes and taking a bath by himself because my son is still 5 years old and i will go to school,so, i can't eye on him always and i don't want to bother my husband too because he have a lot of things to take care of. But as time flies so fast, i can't stop   missing my son everyday, that's why, i wil  lgo back and get him and i will just be  having home school so that i can do both, eye on him and studies too.

HERE'S MY QUESTION:(S)

1.) does my son still need passport also even if he is still 5 years old? Yes.

2.) does my son have visa interview and i will set an  appointment on that too? Likely, check with US embassy.

3.) does my son need cfo seminar? Check at Phil. Regional Forum.

4.) do i still need to pay visa fee for my son or he was already part of my visa fee before? Likely, check DOS FAQs

5.) what are the process to follow for my son's visa processing? where should i start first,second, third and so for...? Check at Phil. Regional Forum.

Question:  Was your son listed on the I-129F petition with you?  If yes, has it been less than a year since the issuance (issuance date is listed on your visa) of your visa (months less)?  

 

As for your questions.

 

1)  Yes your son needs a passport to travel international, all people need a passport regardless of age.

 

2)  Answer to this one depends on your answer to my above questions.

 

3)  Your son needs a CFO sticker, just no the seminar.

 

4)  Yes a visa fee has to be paid for your son's visa. 

 

5)  Answer to this question depends on your answer to my questions above.

I have read many posts and it seems that the fiance in the Philippines are less likely to receive packet 3/4....I have also read Hank's guideline, but I just wanna make sure I understand correctly...Please correct me if I understand it wrong..

 

After I get my case number...

1. fill out form DS-160 - need a passport photo to upload....and print out receipt...this is the only form tat we have to fill

2. Pay visa fee of $265 at the Bank, but print a deposit slip before going there....i should save the bank receipt..need it for the interview.. - deposit slip can be obtained at http://ustraveldocs....paymentinfo.asp

3. after paying the fee...i can schedule an interview online at this website... https://cgifederal.secure.force.com/ - i should choose Immigrat visa instead of nonimmigrat visa - save 3 copies of confirmation

4. then on interview date...i just need to bring all of these?

 

  a. (DS-160) confirmation page

  b. passport

  c. birth certificate  NSO birth certificate

  d. NBI clearance

  e. evidence of engagement

  f.  certificate of no marriage record NSO CENOMAR

  g. evidence of support

  h. 3 visa photographs

  i.  medical examination SLEC delivers this

  f.  RECEIPT FROM PAYING THE VISA FEE AT BPI; ORIGINAL AND COPY. 

 

Am I on the right track? Please correct me or guide me if Im wrong. Thank you.

 

 

1) Yes the DS-160 is the only form needed for the interview.

 

2) Yes pay the visa fee at BPI, and yes you need a deposit slip, and yes keep the receipt safe, I suggest scanning and making copies also.

 

3)  Yes choose immigrant when scheduling.  Print 4 copies of the interview confirmation, SLEC increased their requirement (I just updated the guide to reflect same... sorry)

 

For the interview follow the EMBASSY INSTRUCTIONS LETTER, use it for your checklist.

The embassy will not send anything out that is needed.  Most never receive the letter

One caveat to Hank's instructions some have been asked from the bank for their passport when making the payment. I suggest you bring it along in case it is needed. Otherwise, follow Hank's handy dandy guide and you will sail through the process with little or no problems. 

 

No caveat... no fish eggs either!   ;)

sure - take the receipt notice, formletter I-797, on the I-485 (not the I-130) 

make a photocopy of it, 

 

include it with the I-765 application - the fee is waived when you include a copy of that receipt notice. 

 

did USCIS upgrade petitioner's status, showing USCitizenship, or no ?   If he's still pegged as a LPR, that could add some slowness to stuff.

Once you have the EAD card in yer hand, you can get SSN easily, then start participating in USA society with easier stuff like being able to get a drivers license, handle bank accounts, get a job, etc.

If that's going to be her permanent address once she arrives, then yes.

London is more flexible on the I-134 than many consulates. They will accept Mom's I-134 and supporting documents alone. That's been their practice. However one person who interviewed recently said they didn't have one from the fiancé and so they asked if there was a new letter of intent from the fiancé. I don't know if that was a one-off situation because kinda odd from how they normally are. So really nothing from fiancé, but maybe get another letter of intent to say he still plans to marry you within 90 days of your entry on a K1 visa.

London does not require any specific list of income proofs. No tax return is fine if there is other proof. Mom needs something stating her salary. Does her Notification of Personnel Action include salary? If so, that will do it. Is she a doctor? Maybe she doesn't get a salary like a typical employee. What can she prove her yearly income with?

Yes they accept scanned copies of evidence, but you likely have a month to receive something in the mail.

Is the person paying for the filing fee living outside of USA? I'm not entirely sure how that works or of that's the best way since the instructions on I-129F just mentions check or money order.

ok will have to check again, as i just checked on the website. 
 
its him petitioning, so will have to sort it out with him. i will get him to do the $340 that we had written a check for anyway. 
 
the visa payment i thought was $240/new $265 i was to pay per visa on day of the interview at the embassy.




Petition fee must be by check or money order and each embassy does the visa fee differently I believe.

thanks, i have been but most of it i did and sent to him as he is the petitioner and just works crazy hard. so he has spent the last week doing his last bits, passport photo copies, boarding passes etc. i think thats my problem is that i have no control over how it gets sent off after doing all the research etc. 

 

fingers crossed, once its sent of i will hopefully calm down, HOPEFULLY haha

After you AOS and receive the AP or GC......but if you mean to go back to the Phils to live permanently.....then the K-1 and AOS and the GC is NOT for you.  The GC allows you to permanently reside in the US and you have to maintain a minimum presence (I believe min is 6 months) in the US for the GC to be valid.

Where do you intend to permanently reside?    If it is in the Phils, then you only need a visitor visa to visit the US to get married there.

Yes but not until you AOS and receive the AP or the GC.  If you both need to return to the Phils for a short time, then that would be OK, but if it may be more than 6 months.....then you might want to take the route below.

 

and what visa should I get the next time I go to US to stay there permanently? ? sorry kinda complicated. 

 

Alternate if need to return to the Phils for an extended time (6+ months following marriage).

 

Plan A:  Apply for a visitor's visa, travel to the US, get married and return before that visa expires.

Then when you plan to move to the US permanently, apply for a CR-1 or DCF visa while in the Phils, obtain that and move to the US.

 

Plan B:  Apply for the K-1, travel to the US, get married but don't AOS. 

Then do the same as above for the CR-1 or DCF.

Once in the USA and married, you file AOS to get the conditional green card (good for 2 years), can travel outside the U.S. but can't be gone forever or USCIS will consider it to be abandoned and you will have to start over with the IR/CRI-1 visa.  There are limitations on how long you can be outside the U.S. for ROC which will get you the 10 year green card.  With the 10 year green card can still travel outside the U.S., (of course) and there are still restrictions on how long you can be gone before USCIS considers the green card abandoned ... again.  But there is a rainbow after 3 years of being an LPR, you can apply for citizenship, once that is completed you can stay outside the U.S. as long as you like and still be able to enter the U.S. at your whim.

Yes, that is what everyone refers to, but I am actually interested WHY the sample response is "N/A"? Anyone hace this from a USCIS source or similar that question 11 is not relevant and that "N/A" us a suffiscient?

 

The only proofs are the tons of K-1 filers who answered the question as stated and none were denied due to it.

 

The 134 is used for many other purposes where that question would be germane.  The assumption is that the sponsor will take care of the beneficiary forever.

Not a wise idea at all. :no:  If you present anything that looks like a marriage at your K1 visa interview, the CO may assume that you are already married and are therefore ineligible for a fiancé(e) visa.

In a nut shell, I had a small wedding with my fiance when I went out there. It was only legal through our church. Not the government. I'm bringing her here as fiance. During interview if they ask for additional evidence should my lady show our wedding pics? Or would that not be wise?

 

There was a couple with the wife from the Philippines that did something similar, then posted the pictures all over facebook and bragged about it not being a problem. They found out it could have been a problem, except for the long delay between the ceremony and the interview proved no paperwork was ever processed or it would have been in the national records office by then. The CO even told them had the time period been shorter, they would have had a denial. In another country without the record system the Philippines has, it could have been a denial also. Be very careful about blessing ceremonies, particularly if you're dressing as a couple being married. Even engagement rings that look like wedding rings have been known to cause trouble. As has calling each other husband and wife. Much of this has to do with the country and the local customs too. If it looks like a wedding, if they act like it was a wedding, if they treat each other as married, they must be married, sorry here's your denial. Don't be that person.

Be very careful in some countries if it was performed by someone who is allowed to marry ppl it will be considered a legal wedding. For example in Canada if you have a priest do a religious ceremony even if you do not sign anything it is considered a legal marriage and you are not elligible for a K1.
