My husband is from Mexico and I was born in the US. We have been married for 2 years. We were married here. We went to an immigration lawyer to see if there was any way to get him a legal status. He didnt give us much hope. I am new to this site and need help. I am not sure if the lawyer is being truthful or if there is something else that we can do. If anyone has any advice please let me know. thanks

That depends...

Is your husband DOCUMENTED as being in this country????

If Immigration KNOWS that he is here (illegally), then he's dead meat (i.e. as soon as found, he will be deported and BANNED from this country for TEN years).

However, if they DON'T KNOW that he's here, he should get OUT A.S.A.P. without them knowing (easy enough), and then you should file a I-130 and I-129F with Immigration to bring him here legally (as long as they have NO history/documentation of his having been here illegally, he should be approved. If they DO have histroy/documentation of his having been here illegally, then it's 10 years exclusion).

GOOD LUCK and G-D BLESS.

how would they explain their meeting, their marriage?

now that's the million dollar question laughing.gif

I hope someone does have some information/experience for you. I would try posting this in the "waivers" forum, you may get better results.
I would NOT suggest him going home and trying to "hide" the fact that he was in the US as someone else suggested.

This is totally off topic, excuse my selfishness but Im always curious as to how someone files tax returns without a ss#. how is that possible?

with an itin.

i'll move this from K-3 Spouse Visa General Discussion to Waivers (I-601 and I-212) and Administrative Processes (221g)

would it be called germs of endearment?

Charles apparently studied about STDs the same place he studied humor and politics. That's why most of his posts about the election were a ###### joke.

But, I digress.

It's a virus, stupid.

Symbiosis, this is a ridiculous and unnecessary post. Shows some insecurity on your behalf. If you don't find the posts funny, then don't read them. By the way, here is the definition of irony in case you are unfamiliar, "the use of words to express something other than and especially the opposite of the literal meaning".

I disagree.

Charles' post was the unnecessary one in my opinion. Trying very hard to be funny and have SOMETHING to say in about every post sometimes gets a little tiresome.
Especially if somebody askes for advice about a health issue and is worried about this - no need to make fun of them, IMO.

But hey - maybe it's me, I'm German and have no sense of humor after all! whistling.gif

Mrs. J - I agree with you completely, except the part about your not having a sense of humor! star_smile.gif

why am i not surprised? unsure.gif

Because you continuously post unhelpful and inappropriate responses?

oh well, shoot me for that will you. then again, don't. because if you did, you'd have no life and no one to follow around.

Talk about unhelpful. Julez' your post is unhelpful to the say the least. Get off charles' case just because you disagree with him. He is one of the more helpful people here when it comes to administrative functions on VJ. If you looked past the small world you lived in, you would see it and not be so snarky.

Please tell me what is helpful about posting the response, "Germs of endearment". The OP had a serious question and deserved a serious answer. Charles needs to learn to not derail threads and the only way for this to happen is for others to remind him that his stupid comments, photos and emoticons don't fill the bill in the so-callled "upper forums". He has OT for all that nonsense. If you would look beyond the walls of Charles' fan club, you'd know he is not actually that helpful.

physician, heal thyself. you're doing a great job derailing too. good.gif

If you are married, and filed I-130, why is this post in the K-1 forum? K-1 is a visa for fiancees and un-married couples. Shouldnt this be in the CR-1/IR-1 forum or perhaps the "Waivers (I-601 and I-212) and Administrative Processes (221g)" fourm.

Anyway, you need to let the petition work it's way to the consulate, and then file a waiver of the ban at the request of the counselor officer.

Time to do a timeline: http://www.visajourn...le.php?id=50894

Also time to update profile, you filed for CR-1/IR-1 visa: http://www.visajourn...h...rCP&CODE=01

good point. if you see any mis-filed threads, feel free to pm me or other organizers.
i'll move this thread now.

I have a question... has he ever been caught or been deported? Is there any record of him coming into the USA? If ther is not then you do not need a waiver. You just simply have him leave the country and carry on with the normal process of the Fiance visa.

What you are proposing is illegal and is fraud! This carries a penalty of jail time, fines and a permanent bar from the U.S.

correct and it is a violation of tos:

By way of example, and not as a limitation, you agree that when using the Service, you will not:

• Condone or instruct, either directly or indirectly, others on how to commit fraudulent or illegal immigration activities in any way, shape, manner or method.

vj terms of service
