Big question. After his first illegal entry, how long did he stay in the US? If he entered illegally, stayed for more than a year and entered illegally again, he is subject to 212(a)(9)©, which makes him ineligible for a waiver for 10 years. It's not the number of illegal entries that is the problem, it is the cumulative total of time spent here illegally. Once this total reaches more than one year and you enter illegally again, 9C kicks in and there is a 10 year bar with no possibility of a waiver.

As suggested a few posts above by emt103c, go to immigrate2us.net and read and read and then read somemore. The waiver process is much more involved than spending an hour writing a letter. If you are going to attempt this yourself, you need to spend many hours reading and researching. It takes a big effort and a lot of time to do this if you hope to have any chance of success. You must document all of your hardships. You need to do a lot of research and start over again. Don't waste your money submitting a waiver until you have done everything possible to maximize your chances of success. A good lawyer will charge $5000+ for waiver, plus the filing fee.

You are barred for 3 years due to the overstay. You will not be eligible for a tourist visa. In order to get a waiver for the K-1 visa, you must prove extreme hardship to the US citizen if the alien is not allowed to return to the US. The entire process from K-1 filing, to denial at K-1 interview, to submitting waiver and awaiting a decision is at least a year, and probably longer. You are getting close to the point where you should consider waiting out the ban, unless there is a charge of misrepresention for using another passport. I would definitely do a consult with a good immigration lawyer before I did anything. I believe the time for the ban will begin with your denied entry is Sept.

Suppose someone is granted the D3 waiver and comes to the US and gets married. Are they able to adjust status without leaving the country? What happens if they overstay again? Is it commonly granted? Is it a long process like an immigrant visa waiver? I am only asking out of curiosity as I never knew of this waiver when my wife and I went thru the waiver process.

I am so sorry .(: I know the feeling. The best you can do is NEVER GIVE UP. I know it is frustrating that you can't prove at times that you are right, but you have to buil up the faith in you that soon it will be over.

Don't give up, try all the possible ways that might help you. If you can , visit your the conslate and try to talk with consul general, try to get direct answers, try to know what they want. Hopefully sooneverything will be over.

The problem is the people in charge of all of this are morons and they have our lives in their hands. It is an absolute disgrace to have this happen as often as it does. There is more compassion for the illegals than there is for anyone who tries to follow the process according to the law. Make lots of noise. Go to the newspapers or tv stations if necessary. Sometimes you have to think outside of the box.

Some drug convictions can be overcome with a waiver, depending upon the charges, length of time since offense occured, evidence of rehabilitation etc.

This has happened several times in the past few years. Usually it's back up again in a day or two. They had a bad crash a few years back and a lot of posts were lost. Your visa will be denied at the interview due to the overstay. You will be give the official reasons for denial and if you are eligible to apply for a waiver. There is much more to it than filling out a few forms and writing a letter. It must prove extreme hardship to the US citizen if the alien spouse isn't allowed to return to the US. There is a wealth of information available at the site I have suggested. It is lengthy, involved process, but it is doable. You may wish to consult with a lawyer if you feel it is beyond doing alone. Quite true. A short period of time may be accepted, but not a year and a half. And if it was 6 months or less, no waiver would be needed.

Being voted best immigration lawyer by a magazine doesn't mean he has any experience with foreign filed waivers. You need to ask specific questions. How many foreign waivers has he filed? How many in Costa Rica? What is his sucess rate? The majority of immigration lawyers have little experience with foreign filed waivers. You want someone who specializes in this area. The links posted above by emt103c are two of the finest in the country. It may be worth your while to do a consult with either or both of them and compare their plans of attack to those of your current lawyer.

The consulate should send you notification of the waiver approval and a list of what you need to bring for the visa appointment. In Brazil, they asked for proof of an ongoing relationship while the waiver was pending along with the updated police certificates, medical exam, passport photos, affidavit of support, etc.

Your best source of waiver information is a immigrate2us.net. There is a section for Mexico there, lots of helpful, friendly people who will help you through the process. There is many hours of reading and research to learn about the wavier process and this is vital if you attempt it on your own. There are many examples of approved hardship letters there too. It is wealth of information and a friendly online community. Check it out. Do your research. Juarez is one of the most lenient offices to get a waiver approved. Your chances are good if you prepare and present a good hardship package. It takes a lot of time and effort but you can be successful. If you have any other questions or need info, I will do my best to help you out or point you in the right direction.

emt103c is a very helpful and knowledgable member here and at immigrate2us.net. You can trust her to provide accurate information.

My wife went thru the wavier process from Brazil. From the day of NOA 1 for my fiance petition until the day her visa was issued was exactly 30 months. They are both first rate. Personally, I would probably go with Laurel, her practice is based on waivers and she started her practice doing waivers only. What is your gut feeling? I would go with whoever you are comfortable with. They are both good. I gave my reasons above for Laurel and that is not a knock against Heather at all. I respect Heather's honesty. When I contacted her, she gave me her take on my case and suggested that I get a second opinion from Laurel Scott. So I really appreciated her honesty. If you are more comfortable with Heather, then go for it. They both have a good reputation over at immigrate2us.net, but Laurel has handled more cases from those forum members than Heather. It's all personal preference. The are both honest and tell it like it is. I don't think there is a wrong choice with either of them. Rio doesn't accept the waiver at the visa interview. You must make another appointment in order to submit the waiver. When the visa is denied, they will give you a paper with the reason for denial and information to prepare your waiver. Rio doesn't make the ruling on the waiver, it is sent to USCIS in Lima, Peru for adjudication.

If you are doing this on your own, you need to do a LOT of research. Lima isn't an easy office for approval, but if you document your hardships well, it is doable. Misrepresentation can be diffcult to overcome in Lima too. It is not simply a case of filling out a few forms and writing a letter.

Since your fiance was deported, I strongly advise you to consult with a good lawyer who is experienced in this. Laurel Scott at visacentral.net and Heather Poole at humanrightsatttorney.com/ are two of the best.

The best site for waivers is immigrate2us.net. Please provide more information so we can try to provide you with the most accurate advice possible.

He feels that we will be going to the interview for no reason, only to be denied. I told him that is the way things have to be done. But being aprt from me and the baby is hurting him so bad.

Carefully read the thread that I linked to in my last post. It seems that in the case stated there, the alien didn't attend the deportation hearing, was detained at the interview and deported. He was denied a visa in Rio and is not eligible to apply for a waiver for 5 years. It appears that this is something new that they have just started to enforce.

Are you married or not? You are calling him your fiance, yet you say you went for an interview in Miami. I am a bit confused what this interview was in Miami if you aren't married.

Waivers (I-601 and I-212) and Administrative Processes (221g)can anyone help me figure this out??

Hi everyone,

I need advise on what i should do, here is my story:
My fiance was deported, in january of 08. I just had our daughter in august 08. I have filled out all the paperwork for the fiance visa, I also have filled out the paperwork to waive the deportation. Then I found a sponsor for him to have a job as soon as he comes here. I am trying to figure out if i should send ALL these papers in together, or to send in the fiance paperwork with the deportation waiver, and send in the sponsor paper by its self.

PLEASE, if anyone has advise on what to do, or knows something else that will help our case, PLEASE PLEASE PLEASE tell me. i am desperate for some help here.

he was deported for being here illegally. that was it. they found him in our apartment looking for someone else. that man was not there. he has no criminal record except for this. we talked to a awyer and they said to do the forms i already explained. but now i need to know how to send them all in


I gave you a detailed response in the other topic you made about this in the K-1 forum. I'll copy and paste it here in case you missied it:

If he was deported, his visa will be denied at his interview. He will be given a paper with the reason for denial with the section of the law that applies to him. He will also be told about his waiver eligiblity. You will not be able to submit your waiver package at this interview. You will have to make another appointment to come back to submit the waiver. There is much more to the waiver than filling out the form. You must show extreme hardship to the US citizen if the alien is not granted entry to the US. You need to write a letter detailing your hardships and provide supporting documentation.

I highly recommend that you consult with a lawyer who has extensive experience with foreign filed waivers, specifically for waivers adjudicated in Lima, Peru, which is where waivers filed in Brazil are processed. Two excellent lawyers are Laurel Scott at visacentral.net and Heather Poole a humanrightsattorney.com. The best site on the internet for waivers is immigrate2us.net. Many hours of reading are necessary to learn about the waiver process. There is a section of the forum just for Lima, Peru. This is not a simple process. It takes a lot of time to prepare a good hardship package to increase your chances of success. The job sponsor is irrelevant in the waiver process. It is all about extreme hardship to the US citizen if the alien is not allowed to return.
