I just want a timeline of when he could come back if this is reapproved......with him having a warrant....and him being an overstay. I would like to be prepared for what's next.


OK - got it.

I-130 re-approved date - no idea -
USCIS to NVC casefile travelling - 2 weeks
NVC processing - 1 to 3 months
NVC to Embassy Travelling - 2 weeks
Interview Scheduling queue/processing - no idea
Interview Date - 4 to 7 weeks after NVC ships the casefile out to the Embassy.

ON INTERVIEW DAY - he's gonna be denied (I mentioned this way back when) so
--have the WAIVER ready to hand over, in his hand, on interview day. Give it to the Visa Officer /Consular Official that interviews him
and then

be prepared to wait again, anywhere from 4 to 18 months, whilst the waiver application winds through .

Now, if I remember, he had a K-3 interview, yes? It may be that what is 're-affirmed' is the entire K-3 visa packet. If that's the case, then no NVC processing. IF the casefile travels to NVC, and NVC wants you to do NVC processing for an IR-1 visa, (you'll know, within 3 weeks of it arriving, as yer calling in then, checking on status of the casefile) then, thankfully, NVC Processing is very straightforward. Whew !

So, sorry to say, IMO, too many variables in there for me to accurately give a TOTAL TIME LINE, from today till then, but I do know a bit about what the TIMETICKS are, and on some of the timeticks, I do know (and listed) the current durations. These durations could change, especially the NVC 'turnaround', as NVC can 'go fast' when the queue is not so frickin dense (as it is now).

DS-2100? IIRC, that's for a DCF'd I-130 , not a 'regular' I-130 -
so the I-130 was filed to US Embassy in Columbia, not Chicago, yes?

The 601 waiver must be filed , for 'best result', on same day as the interview, immediately after the interview is concluded.

Not certain on the 'time' - but it will be, or not be, approved, sometime after the interview date...

I remember some stuff about your case, actually. Just re-read your prior posts, too.

ICE is being pro-active now.

If you wish to be married to this man, suggest you marry him when yer on that maternity leave, in Belgium, then when you return to USA, file the I-130.

Down the road, expect to be 'found inadmissable' on interview day, and have pre-filled waiver papers in hand to turn in, on interview day.

I've no other advice for 'now', except to inquire about any attorney-engagement during his incarceration .

hey - just reviewed yer timeline - thanks so much for updating it.

re: petition validity - yer ok - that dates covers 'up to interview date' and if needed (prior to interview date), can be extended.

Since you've already had the interview date, the 'validity duration' is null and void.

Currently, since the casefile is under 'administrative review' - is different process, and in the end, if the visa is issued, this 'petition validity' notice is ignored, has no bearing or weight on the matter.

there are some countries and regions of the world, where a proxy marriage is recognized by the US Embassy in 'that' Country, as a legal marriage - if all the rest of the legal marriage paperwork is stellar.

I'm thinking it might help ANYONE ELSE who reads this topic of yours -
if you'd please TELL US, IN WHICH COUNTRY the marriage took place...

well idk they told my husband on his interview that everything was great and that they only needed to do ap. But now that i think about it if proxy marrige is reconized in the country were we got married but not in the state we will be living in we will have problems with AOS correct.


No. Wrong. is no AOS for a CR-1 visa.

A Proxy Marriage in Palestine is fine - you have no issues about it. It's something else, truly.

as far as 'idk' -

I'm strongly suggesting that you FIND OUT. Call the DoS Hotline # (# in my profile), get a Human™, inquire for casefile status, ask why he's still in 'additional processing' and ask why he was put in 'additional processing' in the first place.

AP in Palestine normally is focused on additional namechecks - and NOTHING ELSE - so this concept of 'you worrying about a valid marriage' is bullcrap, IMO - if there was any issue about 'valid marriage' - he would have been told, on interview day: 'The USA cannot recognize your marriage. If your petitioner returns, and has a legal marriage ceremony, you can re-apply later'. So - he wasn't told those words, on interview day.

THE AP IS FOR SOMETHING ELSE. You really need to find out what's going on - call the DoS Hotline, get a Human.

can you tell us exactly why he was deported ?

usually, a DWI is not directly a 'deportable offence' but it can be an indirect consequence if he had 'entered USA WITHOUT INSPECTION'.

Normally, people will file an I-130 petition to the lockbox in Chicago, which will culminate in a CR-1 visa stamp in passport, stamped at US Embassy in Mexico, after a successful interview.

'Being Deported' will also require a waiver to be filed, as well. Once deported, a ban will be in effect, cannot enter the USA for a period of years - this period does vary, depending on what was said at the deportation hearing, and HOW he was deported (forceable deportation vs voluntary deportation).

OK - so he was EWI. I understand 'why' he was deported, now.

Most of the process we cover here at VJ does not have EWI issues, at all.

Suggest you review http://immigrate2us....rum/content.php and also look up 'Laurel Scott' at http://www.scottimmigration.net/ - she has a free chat every wednesday, IIRC. Whilst she specialises in this type of casefile, her articles can be useful to you (reading is free, ya? ) and do take advantage of her 'Free Wednesday Chat' as well.

IMO, you could have gotten your citizenship 3 years later after arriving in USA, then filed for your father (immediate priority date, no waiting)

But - you didn't do that. Perhaps you filed petition (with you as the Petitioner) when you were a Permanent Resident? Instead of USC ?

AP is AP -is not any published timeline - they need to complete namechecks on your father.
Is strange, really, as USC cannot petition for father in law. USC can petition for father, sure, but? Ya, I get it - your husband was some co-sponser on the I-864, but that doesn't matter for why your father is in AP.

For this type of situation, USUALLY, engaging with an immigration attorney is your best bet, as this is a 'Do It Yourself' Immigration Web Portal.

Someone in Deportation Hearing really needs more than a DIY stance, IMO - but there are many things you can read here.

Use the search engine here, search on 'deportation' - show posts - there are good nuggets in there that might help you understand what's going on, a bit.

ya - you need some 'path' to get this stuff back to the IV unit. I guess I could be more helpful if I knew exactly which Consulate/Embassy you were dealing with ?

Yer official VJ timeline says 'Armenia' but I'm guessing that is wrong, that's the first Embassy/Country in the list - maybe you never set it..

Then there's no mention of 'where' in yer member profile, either :(

Now - you need to contact the 'Immigration Liason Staffer' at either a US Reps office or a US Senator's office. This is a human. That 'title' is common, may have some derivation, but you mention those 3 words at the switchboard, they'll get you to the right person.

For any 'Immigration Liason Staffer' to initiate an inquiry on your behalf - you have to sign a release form - be certain to ask for the release form - and note it can be 1--emailed to you 2--downloaded by you from a website 3--sent to you via postal mail.

The Immigration Liason Staffer will NOT jump, based on a phone call - you have to:
1. submit the signed release form
2. submit a narrative of casefile history

There are 3 offices you have potential to deal with:
1. The US Congressman for your district
2. One of the US Senators for yer state
3. The other US Senator for yer state

If you have no resources that list these 3 offices, go grab a telephone book, look in the front or in the government listing section or in the white pages under Federal Government. Those 3 names will be there, you betcha, with telephone info.

IMO, you should make initial contact with all 3, and inquire if they can make an inquiry for you. Surely someone will say no, or that they are too busy - so pick one that has the time to deal with this inquiry. Make those 3 phone calls, sure - but pick only one. If you try to have all 3 offices inquire on yer behalf, it makes each Immigration Liason Staffer LOOK BAD back at the Embassy IV Unit - and trust me - these ppl never want to LOOK BAD at the Embassy IV unit - an ILS wields a bit of power, and uses it with the hope that the Embassy won't cut them off when they submit frivolous or repetitive inquiries.

Now, if you can't understand stuff from yer prior posts, and what I've written here, please, not only read it twice, but get another human to read this , put paper to pencil, and map out a plan of attack with that other human. You should choose a human that you see, every day or every week - don't rely on any 'internet friend' or 'internet acquaintence' . I know it's hard, being a 19 year old female in your household, but you really need to get assistance, a Human at yer Elbow™.

That's a material mis-representation. But even then, you could file a NEW I-129F, with some wrangling on a waiver (covering both issues).

Suggest you engage with Laurel Scott for a few hours of consult, have set you on the proper path.

IMO, that order of removal is still in place. She's chosen to ignore this order of removal. IMO, if ICE runs into her, she'll be deported quickly - there's a removal order already in place.

Some have success getting the COPY notarized at a US Embassy/Consulate - this bypasses all 'apostile' and 'Hague convention' issues.

Perhaps you should get a notarized copy from the US Embassy/Consulate, somewhere in India?

Administrative Review has no timeline, no fixed duration.
I would suggest you contact the CIS Ombudsman's Office with all of these details, and ask for assistance in sorting out the perceived miscommunications between these two entities.

Three people have been dinged with an RFE in the last 45 days for NOT having this document submitted to NVC, at NVC.
