1 and 2 he's supposed to present on interview day, but 2 could be sent in during NVC processing, as well.

Since they kept his passport and mentioned 3 weeks - this is NOT (IMO) the additional name checks version of AP, at all.

Suggest you call DoS Hotline once a week, ask for casefile status - DoS Hotline and the Embassy 'share data', so about a day after any status change on his casefile at the Embassy, DoS Hotline will have it but you must call, get a Human™.

the regs are a bit different on a visa extension.

suggest you email the IV unit in PI, inquire about 'computation of overstay days'
as

it's smelling like someone at the IV unit DID NOT compute using the visa extension.

just for follow up -
call DoS Hotline (# in my profile, click the girls, read left panel)
and
inquire for case status - ask if casefile was put in AP or was denied or exactly WHAT.
THEN - ask for the IV email address there in PI whilst on the phone -
explain to the DoS Hotline Human™ that you're pretty certain the IV unit did not see the visa extension, and are doing the math wrong.

your husband applied for a CR-1 visa, an IMMIGRANT VISA, which has total reverse of what was printed in that letter - ie -
he DOES have immigrant intent.

so - I'll suggest you call DoS hotline (# in my profile, click the girls, read left panel)
and then find out exactly what's going on.

On first blush, it smells like the CR-1 visa was denied on interview day, for some other reason - but

Sheesh - prepare for a long long long AP process, lass - as
USUALLY - a short AP - USEmbassy IV keeps all.

How much is 'all' for that visa packet?

(Not trying to second guess here, but.....)

FWIW - yer husband doesn't need to escort you into the US Embassy - yer a US Citizen - and by right - you can go alone....

OK -expect AP on the casefile, post interview, because of his citizenship. It's standard, for males from IRAN.
As to 'how long it will last' - hard to determine - anywhere from 1 to 11 months.

yer not talking to a Consular Official, yer talking to a 'local worker' and they don't really ahve any input into the system, they can only review what's on a computer screen.

OTOH, an Immigration Liason Staffer, from US Senator/US Representative's office, CAN get direct input from a Consular Official.

If you want to 'make the time', suggest you talk to an ILS human, this week.

If Embassy says they are sending the petition back to USA, back to USCIS, then you have no recourse today -
there is nothing to do to HOLD the casefile at the Embassy, nothing that YOU can do.

HOWEVER -
this sounds like massive mess -
and

IMO
you need a Senator's office in USA, Immigration Liason Staffer Human™, to sort it out with the Embassy -
so
talk with yer USCitizen Fiance today - tell him/her to get an ILS with the US Senator's office, now - get/sign (her) the release forms today, and be prepped to 'run' a Congressional Inquiry on Tuesday.

It's hard to know - I'm guessing you not talk with USCitizen Worker, US Embassy Consular Officer, but instead spoke with 'local worker', a Pakistanian, and they've screwed you over.

yes talked to local local Pakistani lady, they haven't send 221g document to me or my fiancée yet, she told me verbally, said we are sending case back to U.S, will send latter to your fiancée about it.



FWIW, 221G document allows you to submit more evidence.

You won't get this document now, as the casefile is tagged 'to go back' to USA with 'denied' status.

I think is procedural error, that's my opinion about your casefile,
and
you have small 'time window' to engage with Senator's office today,
to
remedy problem next week.

If you fail to give your lass this info
and
if she fails to get the Senator's office engaged today
then
the casefile, next week, will be shipped out to USA.

It's yer choice, really.

Do nothing? expect to know something in 11 months.
Do what I've described? GOOD CHANCE to keep casefile in Islamabad, have Senior CO fix all of this, because Senator asked him to.

ya, sorry, CO won't talk to him, at this stage.

The ONLY way to get any CO to re-evaluate, prior to shipping off to the USA/USCIS -
is for an ILS Human to engage the CO to actually re-evaluate.

Sure, it's not easy to do - if it was, you'd hear more success stories about it.
But it IS possible - and takes much diligence when talking with the ILS human, as
this is much more than a 'simple Congressional Inquiry'.

I am very sad for the both of you, I do recall the same situation where the embassy called the father and said that the couple was married and confusing him. I kinda agree with either getting an attorney and or going ahead with the marriage. So sorry there's nothing else we can offer to say to help.

that has more than 2 years experience in handling immigration matters -

when you call - ask these questions:

--are you the Immigration Liason Staffer?
--are you an intern or a paid employee?
--how long have you been acting as the Immigration Liason Staffer for this office?
--How are your contacts in the East Jerusalem Embassy?

now - when yer asking these questions, WRITE DOWN THE ANSWERS.

When you finish up on both ILS humans, compare the answers.

You DO NOT want to engage with an intern, ever.

Now - once you decide which one to use -
you must absolutely contact them back and
fax over a signed release form
then
send over a timeline'd narrative of events, with the final query of 'where's the casefile today?'

Remind the ILS Human™ that since the casefile was lost, it will be better for the ILS Human to talk with a Consular Official (US Citizen with power) instead of just a Consular worker (indiginous worker with no power).

2. My father told the consular officers on the phone that yes we were in the ceremony and we did marriage, and the councilor officer was asking again in actual what happens marriage or some thing else? my father agreed for marriage.

then you shouldn't have any problems.

If it wasn't a legal marriage on march 13 2009

Then he wasn't eligible to file the I-130 .

I guessing the VO was confused, and wants more time to validate things.
