usually, if the casefile is forwarded from uscis to nvc to the embassy,
then uscis is upholding their approval and the entire casefile is forwarded on with that I-130 approval notice.
I believe the label is 're-affirmed' . Unsure, though.

Regardless, with a re-affirmed I-130 petition in play, the Visa Application still has to be adjudicated at the IV Unit in Lima, again, a 2nd time.

Suggest you call DoS Hotline and ask about casefile status, once a week, until you hear 'interview scheduled' as the casefile status.

It's a dead shame you and your wife not file Adjustment of Status, and get the green card, before you left the USA.

Now that you've been out of status in the USA for 18 months or more, you've incurred an automatic 10 year ban for re-entry (perhaps more than 10 years?)

so.. be patient, follow through with the two petitions and the two visa applications, and get ready for the waiver that must be filed.

If you want to come back to USA, that is.

i think he was found ineligible.
the issue is that we do not know what he misrepresented. this forum is for help and exchange of ideas not for judgement. when he says he does not know i believe him and thats the end of it.
as his wife i will file the i 601.i am not a lawyer but i know i have to know what this misrepresentation and how should i find about it. the vo could indeed be right. he could as well be wrong. it could be simple misunderstanding , it could be a big problem.. it could also be a mistake somewhere ...

1. go over every piece of paper submitted to USCIS and NVC (you kept copies, yes?) to glean 'inaccurate data'.
2. review his prior visa application stuff with him.

You MIGHT be able to glean where the inconsistencies are, from reading that stuff. Maybe. Do all that, and still not glean anything? Get an attorney specializing in misrep and waivers at an IV unit.

So far I have emailed the Embassy to see if we can discuss this or get another Interview and I have had no reply. I tried calling them many times but I get a message and then it disconnects me. I have sent a detailed letter to my state Senators and to President Obama ( I am trying anything)but as of today I have not received a reply from anyone. I am getting recommendations on reputable lawyers in my area now and I hope to speak to someone for a consultation. I am going to call on Monday to the Senators office and see if I can make an appointment to come in and talk in person.


You need to FIND
and ENGAGE

There are 3 possibilities for choosing an ILS Human, as you've 2 senators and one representative.
but.

You've got to fill out a form requesting confidentiality something something.. It's available (usually) on each congressman's website.

And the ;)

Once that signed disclosure thing is in place at the Congressman's office, THEN you send over yer pile of stuff, and
tell the ILS Human that
There was a procedural error at the IV Unit in Islamabad and the petition was closed then let the ILS Human 'run with it' for two weeks.

I've not heard of this one in some time:

but it was used for K-1 visa denials in Guangzhou for almost 4 years - the last I heard of it was circa March 2010..

I've not heard of it being used there since, though.

Guangzhou isn't Islamabad - I wonder if the Visa Officer that issued those in Guangzhou has transferred to Islamabad ?

re: Marc Ellis - ya, I read that ages past - it's a procedural thing that the Visa Officers in Guangzhou did with much frequency.

if you are in AP, then getting sent back again to uscis is sorta 'iffy'.

It was already sent back once and re-affirmed, but you won't know the next step until AP is completed.

AP takes some time.

Many instances here on VJ where the visa was issued after AP is completed, though, so that's a plus...

Ultimately, it's up to the VISA OFFICER handling your casefile, for what's next after AP is completed. IF, he's satisfied with the results of the AP, and sees no other reason(s ) to deny your visa, he will most likely issue the visa to you.

But, just remember - it's the 'totality of the casefile' that's in play, here, not just the fact that the casefile was sent back, not just the fact that USCIS re-affirmed it, and not just the fact that you got a 221-g for expired documents, and not just the fact that you are currently in AP. There's other things a Visa Officer must consider when deciding if you get the visa or no.

Your casefile was returned back to USCIS for possible revocation and review. Once it's there, it has to be re-evaluated and possibly re-affirmed by USCIS.

You are asking, repeatedly, what YOU can do in this instance.

There's nothing YOU can do, alas.

Instead, yer USCitizen Spouse, the PETITIONER, must wait until USCIS sends back to her a postal notification that contains HER OPTIONS. One of the possible options that MIGHT get presented to HER is for her to send back additional information, additional evidence, as a REBUTTAL to a Notice of Intent to Deny/Revoke letter.

YOU WILL NOT BE TOLD ANYTHING.

It is your wife that will be told something, and (sorry, I'm repetitive here) it will fall into two categories:
1. notice of re-affirmation of case (nothing to do, casefile is being sent to IV unit for 2nd interview) or
2. notice of intent to Revoke or Deny, with POSSIBLY an intake mechanism for HER to submit more stuff.

So, YOUR WIFE can find out current casefile status by calling into NVC and USCIS hotlines, asking for a supervisor, and inquiring for current casefile status, inquiring for the next step.

YOU, otoh, can do nothing. NO ONE at DoS, USCIS, NVC, will talk to you.

Guangzhou IV used to do this, a lot..

the letter had the labor thingie in it.
In essence, they found they could not grant a visa based on the visa type applied for (Usually a K-1)
then they tried to use the rules of the labor thingie, found they could not, and quoted that section on INA.

It seemed to be a kiss of death at Guangzhou IV, those years they were doing it. The IV Chief has been replaced, and those notices not have that wording anymore.

If it's not a USCIS address in the USA, yup, sorry, a scam attempt.

OTOH, if this is a real address for USCIS, then you've been pegged for a local interview .
