1.  Returned petitions to VSC are never re-visited and

2.  Returned petitions to CSC usually are revisited.

Many gold collar workers go to Dubai for shopping, as it's the cheapest place to purchase gold and Swarovski and Gucci. (No, I'm not kidding) .  Lots of special package tours headed there, also.  So, if she went there for shopping, I think it doesn't matter.

 

What probably does matter is the CCP membership.  If she actively resigned 3 years prior to the interview date, well, mostly, she'd be OK at the interview.

 

For further clarity, suggest you engage with Eunice You in Guangzhou, she is Marc Ellis' point of contact there, pay for an hour of consult.

She terminated in Jan of this year, and admitted in the interview she had been a member.  We knew that would place us into AP; but for it have been this long since they'll need to be doing more than looking at just her time in China.  She's only lived in Gonzhou and her college city within China.

i was studying 212 recently for something else, and reread the Communist Party stuff since I was chin deep in the 212 doc, and what I read there - if the applicant terminated CCP membership 2 years or more, prior to interview day, then a waiver isn't needed.  Just FYI. 

 

Guangzhou IV has other guidelines they use, though.  In some instances, I remember people writing up a letter of attestation about this, covering why it was necessary for work or living quarters, and that was sufficient, even with a recent termination of membership.

and you're given another chance to source out a joint-sponser that meets the requirements and submit back to the IV Unit.  If I were in yer shoes, I'd go fast, to make that happen, this week.

i say file the I-485 now. 

 

apparently something has changed, no more queue. 

 

FWIW, your step son cannot pursue a CR-2 visa, as the primary person holding a CR-1 visa; well, they have no status at the moment until green card in hand. The step son is a derivative on the primary, and the primary holds no status. Can't successfully issue the visa for a CR-2 until the primary has some status.

Im a Green card holder im peticioner my step son he went to his visa interview and the co put him on ap 2 months ago askin for mother and son DNA and the results was fine now they ask for my wife resident card and we dont have it yet because im lpr and we waiting until i get citizen .... I send them the i130 approved for my wife and they respond that until my wife send them the resident card they will hold my stepson visa on Ap.....what can i do please help me thanks

so, your wife's status was F2A 

 

F2A were 'current' in August and September (don't know about October) and allowed to 'adjust' inside the USA, if they had legal presence already. 

 

so with an approved I-130, 

what has kept you, prevented you, from filing the I-485 in August month? 

 

IMO, if you had filed then, your wife would have had an interview already, for the green card. 

 

But, that's just my opinion. 

 

The IV Unit wants her proof of USA Residency, as the step-son's visa is a derivative visa.  Since she cannot show valid USA Residency, the son's visa will be denied or delayed (the IV unit decides which) .

Need some advice please what can i do after the us emnassy respond the truth about my stepson case to my congressman there is what they said: the vice consul has asked to interview mr........ And mrs...... At us embassy in Panama due to a previous visa activity that indicates possible inconsistences.


Do you guys think can i do something before i become citizen and my wife a green card holder????? Now im sure they want to make sure that my relationship is real.. Can i send a packet with evidence of bonafide relationship with out they ask for it?????


I think you made the wrong decision, ages past, to file for the step-son. 

 

You are playing the 'waiting game' on your uscitizenship, once you have that you are planning to file for your wife, who apparently is still in the USA on an overstay. Legal Entry, but now in overstay status. 

 

Of course, the overstay is forgiven as the wife of a USCitizen, but you aren't one yet, so you must wait until you are, to finish the 2nd half of the adjustment of status for your wife. 

 

Once she has a green card, THEN it would have been 'safe' to file for the step son. 

 

You decided, earlier, to do something else, 

and now it's bitten you in the backside 

and now you are seeking opinions for what to do. 

 

That sum it up, nearly ?

Because the visa is for family reunification, and the kid's mom is living in the US illegally and can be deported at any time.  I guess the embassy doesn't want to send a kid to a mom that is illegal in the US, because if she got deported the kid would be stuck there.

Ya, the OP is hoping to get the overstay forgiven , when he files the I-485 after he becomes a USCitizen. 

 

IMO, his timing was off, for the filing for the step-son. 

 

Now his decisions have caught up with him - he did the wrong thing earlier.

Hey Sasan - ask yer USCitizen Petitioner to call into DoS Hotline and ask for casefile status.

 

'headed back to DC for AP' is not done, for administrative processing stuff, so I will suggest to you that the PI worker that spoke to you made up some #######.

 

OTOH, if a detailed namecheck is needed, then it's ordered from the Consular Services office in DC, so that might be what this piece of dung human was trying to tell you.

 

It's a good sign that the passport was kept - usually if the AP time is to be short, the passport is kept.

 

I suggest you contact Manila IV on Friday via telephone and inquire for status, and ask yer USCitizen Petitioner to contact the DoS Hotline on Friday, as well.

Caught inside the USA took photos and fingerprints and deported back.but like I told u ive talked to alot of lawyers and theyve said that she dosent need a waiver because she has never been in the USA for 180 days ...

I dunno.  If she went up before any immigrant court for anything - even if for 2 minutes,

Your FOIA was filed with USCIS/DHS. To get consular notes, one should have been filed with DoS.

USCIS is being nice, since DoS doesn't allow USCIS to release anything with a DoS stamp on it -
your FOIA request was forwarded to DoS by USCIS.

Now you have some new calendar - awaiting on DoS to do something.
