The advice given in this thread is largely good, but unless I'm misreading things terribly, all but Brother Darnell are missing the central issue.

An "extended fraud interview" usually means a Stokes interview, wherein the couple attends together and are grilled separately, and their answers are compared.

It appears that the OP/petitioner was not physically present for the beneficiary's interview, so this would not have been a typical Stokes interview.

The OP/petitioner was not called (by phone) by the CO.

Accordingly, the reasoning in the refusal letter is faulty, and Darnell is correct that this was a glaring procedural error that could work to give the couple a second chance, if the U.S. Congressman's immigration liaison staffer is involved immediately.

Furthermore, such a blatant error by a CO could come back to bite that CO, and rightfully.

Buddy of mine (fellow Ecuador filer & VJ member) had his petition reaffirmed after the ####### Guayaquil consulate hosed him. I have no data, but I suspect that a goodly number of other Guayaquil refusals are reaffirmed and sent back down there.

We need to know EVERY question and EVERY answer from the interview, as completely and accurately as possible. So does the attorney whom you NEED to hire as your chief priority.

The OP was part of a Stokes interview, which means that suspicion existed before the visa interview or that suspicion was raised during it. The interviewees failed the Stokes. The best-case (really, least-bad) scenario is that a very, very sharp family-immigration attorney will have to be ingenious and persuasive.

OP, no one here can really give you any more that what you've gotten. Start interviewing very, very sharp family-immigration attorneys, and visit immigrate2us.net for any further advice.

Also, why was there a Stokes interview for a visa interview? The USC spouse isn't even required to be there for a visa interview at the embassy. It seems odd to me YOU were being questioned at the visa interview. You would have been better off not going, if that's the case.

The Dominican Republic is one place where the petitioner is expected to attend. Failure to be there almost guarantees denial. At least this embassy lets it be known up front that the petitioner is supposed to be there, unlike Ecuador.

is blue better than other colors - green etc?
what do the colors mean? how many are there?

OP, your timeline says that your consulate is "Armenia." You didn't specify your consulate in your timeline, and "Armenia" is the default, which means that your record is screwing up the data for two countries. Please complete your information immediately.

Whilst they can be useful if you get lost in the process in getting things going again, there is nothing they can do to speed up AP.

Si, man. Furthermore, Congressmen can't intercede directly with consulates or embassies because it's a violation of the Congressional Code of Ethics. That's why staff members do this work.

Because no politician proposes anything without an ulterior motive, some might conclude that this effort is to legalize some currently "undocumented Democrats" in time to vote for Obama.

Perhaps so. However, the doubters could instead claim that the proponents of the new legislation are trying to turn out the vote from the legal family members of those whom the legislation would directly affect.

Truly sorry to hear of your situation -- crushing to you, certainly.

You can try for intervention from your Congressman or Senator, but the reality is that some beneficiaries are ineligible for objective reasons that the COs interpret "by the book." You didn't say for sure, but were other (perhaps newly discovered) reasons cited besides the drug usage?

Perhaps you could move to a third country that's safer and more palatable, si man...

I left the U.S Before I turned 18 1/2 (more than 180 days but less than 1 year). So I know for a fact that I didnt accrue any unlawful presense in the U.S since I left before even being 180 days.

You can visit the CBP office on your way out, but what assurance would the CBP have that you would actually cross the border?

This is a good and fair question. If she simply showed up and explained her situation, a CBP agent could annotate her passport and walk her across the international boundary or simply outside the CBP building to the south. If she's driving, something similar could be arranged. If she's flying, she could consult the airport CBP personnel.

Regardless of method, I'd recommend that she call ahead to the planned "port of exit," speak with the shift supervisor or Port Director, and find out exactly what documentation she would need in order to get her passport stamped (at least, one would presume, her birth certificate). Planning ahead like this could even enable her to have notes put into the CBP computers, which could be referenced later as part of the visa process. She should get the name of whomever she speaks with.

The CBP thrives on the truth. If she's forthright in explaining her situation and her later intentions to do things legally and correctly, I bet that the CBP will be very willing to accommodate her, si man.
