Be prepared to do a waiver, fortunately you left country voluntarily, I would think that the 90 days is added to the 130, but still not a problem, your overstay either way is less than 1 year anyway.

Any time you see an A- number that is the alien registration number, Look on the NOA2 from the I-129F that you filed as part of your K-3 petition. The A# should be above the beneficiary's name.

(5) Labor Certifications

(9) Aliens previously Removed

So 212(a)(2) = Criminal activity

(A) indicates conviction

So that makes 212(a)(2)(A) = Conviction for some criminal activity.

Where you convicted of a crime at some time?

If so if only one conviction then you should be able to file an I-601 waiver.

I can not find any restriction on using the Visa Waiver Program multiple times. I have read before that the CBP tends to prefer seeing 2 months between departure and re-entry. If he has been away for 5 months he should not have problems visiting.

I would recommend having evidence of strong ties back home, like a letter from an employer, or copy of an apartment lease agreement.

This is a waiver used in certain cases where a visitor would be ineligible to visit the USA for many reasons covered under Section 221g, the purpose of the waiver is for things like humanitarian reasons such as medical grounds like not being able to get medical treatment in their country.

A waiver under section 212(d)(3) of the I.N.A. allows nonimmigrant applicants to overcome many grounds of inadmissibility. Some of the grounds that are covered by the waiver include permanent grounds of inadmissibility, such as fraud or criminal conduct, as well as some grounds that are limited in duration, such as previous unlawful presence.

I dont think so, I think they are checking to see if you are honest, people make mistakes.

I was sited a few years ago for speeding, things like that are normal things that happen.

Just answer questions honestly, things will work out fine.

There is a number in the passport that is recorded at the border, that number should not change even if you change your name, or lost the passport. When you apply for a new passport they will still request your birth certificate for identification and will give you a new passport but with the number from your old one.

As far as the POE, and Customs officer you are just a number.

Sort of like the social security number assigned by the us government, it is assigned for life no matter if a name was changed.
