It depends on what they were arrested for.

A criminal record's impact on immigration, in general, depends on several things:

no. court documents are needed for the petition submittal.
police clearance report is needed for the interview day (or NVC doc intake, if CR-1/IR-1 visa chasing)

I suggest police clearance report so that SHE can see what the police say about her.

IMO, even if she was arrested, detained, put on trial, etc etc etc and has court documents to prove that,

if the police clearance report comes back clean or empty, well, her record of whatever was expunged prior.

hope that makes sense? IMO, prior to filing, calling GUZ IV is useless.

There's a China Students Association at the University of Ill/Chicago - you can talk with the pres of that student association and see what's what. Lots of Chinese students there take in translation jobs for pocket money.

I have no idea about Champaign.

However, just make certain there's that translators attestation statement on the last page of the translated page. That's sufficient for USCIS submission. [and photocopies are all that they require]

Since you're posting again, do you have some news about the police clearance report, or no ?

OP if you legally live in Germany it is one of the few places in the world that has DCF so if you were to reapply, you could do so at the US embassy in Frankfurt. DCF takes significantly less time than the normal IR1 route.
But you should be able to get some better answers in this forum about your waiver issues. Best of luck.


I wanna echo this,

as

 

if'n yer still in Germany, you qualify for filing DCF, and

 

that one month window you need will fall inside of the timeline for filing to approval, so it'll all fall off prior to visa interview.

 

That's my 2 cents about it, anyway.

look at the I-601-A waiver instead of the I-601. 

 

It's a special waiver that many Mexican illegal aliens qualify for when chasing a spousal visa (interview in Mexico) but the main difference is that he is allowed to remain in the USA whilst the I-130 and I-601-A are processing. 

 

 

and that's all I know about it.  There's more - a LOT MORE - you should find it and study a bit/lot.

I have a friend that married an undocumented immigrant here in the USA. 16 years and 5 children later they are still fighting the system (With a good Lawyer) to keep her here. He said he made several mistakes during the process and would do things different if he had another chance. To be short he said he would marry her in Mexico not here cuz marrying in USA then proves she still here illegally. In his case he is fighting to keep her here because of a second issue of entry illegally in the USA. In your case marry in Mexico apply for IR-1 / CR-1 Visa? The second time someone is caught illegally they will/can ban him/her for life. Your fiance has been caught once. You have to weigh your options rather than take the easy road.. first fix everything (With a good Lawyer) other wise face extreme consequences like my friend, he is awaiting trial in September to ban his wife for life or allow them to continue the process (16yrs later). Take care of it now you may have to sacrifice a few years apart/visiting instead of face the constant shadow over your shoulder...when they take your husband when you least expect it and deport him... Good Luck on your journey in Love...

 

 

The 601-A waiver seems useful - I hope the OP chases after that and can learn more about it and it's usage and validity of usage.

my wife's interview went well, but she still got the 221g for some documents .. I sent them to her within 2 weeks, she lobbed it over the fence via CITIC bank courier, and she was ISSUED her visa about a month after interview day.   Timeticks in my profile - click my name or the twins, have a look.

they kept her passport and the things asked for were originals on the I-864 plus a tax transcript. She not go in for any second interview - we went what was asked, they reviewed, they issued.  

 

CCP?  IMO, that's a higher level of review, taking more time - unsure about the turn-around time, sorry.  If they not keep her passport then expect a longer time for turn-around.

I think it's a good thing. 

 

Suggest you have the USCitizen call into USCIS on Monday, get a Tier 2 Human, and inquire for casefile status.  Don't waste time with a CSR, the first human that answers the phone, ask to speak with an ISO. 

 

You, the beneficiary, cannot make that phone call. They won't talk with you about this.

I am so Angry i think im going to blow up i swear to you. I Called the DOS and i got this stupid rude lady I realy wish pepole like her would not even work for the DOS or NVC, cuz they piss me off. i asked for an update on my Case and she put me on hold for a couple of minuets and says "Your husbands case is still in AP IN W.DC!" Im like umm what? when i called before you guys said its at the embassy. and she like "No it always been in w dc. and i said "ok how long am i expected to wait" she like you can call back but you wont be contacted your its between the embassy and w dc. what the hell I am the one who is doing the freaking visa ok its my husband. so i told her i have emailed the embassy and i get nothing. and she says you can call back bye and hangs up in my face. how dare she. i swear some people. What the heck why is it in W.DC NOW!?


whatever im done with this calling and emailing DOS #######. they just mess up my day and i end up pissed off and crying.


I suggest one more attempt - i.e. -

Call DOS - ask for supervisor - then
1. ask for current status with the date/time stamp of that status, and casefile location AND
2. the last three 'status changes', with date/time stamps of each status.

If you get these 4 data points, and compare the answers over a month's time, you'll see how the movement 'went'. Don't waste time with the person that answers the phone - ask for a supervisor, each and every time -
and

pare back yer calls to about 3/week.

Darnell, every time I've called DOS I've asked for the latest date stamp and status as you suggested - even getting that is difficult, let alone the previous three. However, I was unaware that I can ask for a supervisor - I will do that the next time I call...thanks.


It's a trick I learned , reading other's dialogs about it, specifically for Guangzhou-bound petitions, where was some mondo nasty problem after interview day.

It does work, when ya get a supervisor, to retrieve those 4 data points. The thing that has ALWAYS chapped my @ss is that - the front level tele-operator is rarely trained how to read the screen, and usually does not have the same access that a Supervisor does. I do know - the one thing you'll NEVER be told - is any of the Case Notes from a ConOff/VO , on the casefile. grrrrr

Do you think it would help at all if my husband went to the embassy? or are you not alloud to do that? cuz i was realy upset when i spoke with him and he said he would go if it would make me feel better and ask them some questions but i said "NO! then they wont give us the visa for sure!" lol IDK
