looking back at last years numbers.. we are way down for the number of petitions going through HCMC... there were over a dozen VJ members last year in Nov and Dec alone.. this year we are seeing only 3 for those same two months... If this is any reflection on the number of actual petitions, they should be smoking through them at a faster rate than they seem to be...

Also looking at the rate of denials... it is looking better than we let on to be when it comes to approval numbers. We like to say that HCMC is a difficult consulate to go through, but its looking better in some respects.... look back at the fisrt page of this thread and look at the number of denials and we can also see the reasons for many of them... the thing that still does not make any sense though is those in AP for a ridiculous period of time...

take the docs to the window, they will likely tell her to wait a bit, then they will call her up, and they will ask for passport then and give her the pink slip... in cases like this... the visa has already been approved, they just need the docs to wrap up loose ends... the passport will be needed so they can put the visa in it.. they will likely tell her come back a week or so later to pick up the passport with the visa inside... tell her to expect the translator may ask her some interview type questions again... its just the interviewer showing off.. the CO doesnt care at this point because they are pretty much done with you.. but if the interviewer was to ask something that she should obviously know and doesnt.. the CO can always rethink the decision...

If you are saying you are in same situation (AP, and they sent a letter asking for new police certificate and medical.. that is great news... Keep in mind that the police cert is good for 1 year and even though they may say bring a new one, as long as the last one is still current, there should be no issue as that is what happened with us... the medical would likely have to be done again as they are only good for 6 months... be sure to have her get every shot needed while she is there.. saves alot of headaches down the road...

Hang came in to turn in the PC. They confirmed that they had received the Medical but didn't ask her any question, just told her to go home and wait. I am prepared a new DS230..anticipating a new interview but don't know when..I guess I have to wait for the interview date before fly back :(
ps: to make the situation bad..she lost her cell phone in the taxi when she got dropped off at the Consulate.



I swear those taxi drivers have a racket on used cell phones.. my BiL lost his Iphone not too long ago in the taxi.. within minutes the phone was turned off and history...

That really sucks that they didnt have the case buttoned up when she was there... likely they will end up sending her a new interview letter based on that last email... shouldnt be too much longer....

She got the letter and I got the reply email telling her to come in to submit the PC and she will get another interview afterward. I do not know if it is another questions session when she comes in or will be a full scheduled interview at a later date. Hang will come in Monday and will find out..This is really frustrating, they're really dragging it out so one thing after the other expired..I feel like we're going in a loop.

nope they didn't ask her anything (no interview). when she come in to turn in the paper at window B the lady just take her paper and said wait. when she came out she give my wife the pink slip and told her to come back next week (10/29/10) to pick the VISA.

Scott is your wife here yet?. she got her visa already right?..

They just informed us that Hang needed to be interview again after turn in the Pol. Cert..since the last interview is over one year. I wonder if it is a full interview like last time or just a short one..anyone?



They interviwed Thuy the last time but it wasnt an hour long thing like before... a quick few questions that the CO took no part in.. the pink was sitting there from the git go

I have to wonder ####### with your case.. Marc Ellis told me they have 1 year from the interview date to issue the visa.. in other words.. the visa application which she started the day of the interview is only valid for 1 year and after that a new application/docs were required... her interview was over a year ago now so I wonder what they sre doing about the 1 year limit...

Well, today, October 18, my wife finally received the OF-194, but it wasn't good. Almost a year since her interview and they were anable to issue a visa.They stated 5 points.
They say she didn't say my son's name correct, but when she had the interview they asked her to spell his name and she did. Maybe they didn't hear her clear.
My wife doesn't know about my hometown.She couldn't describe the city. But she did say about a landmark near my hometown.
They say she told them I lived in only one house my entire life, but she told them I lived in my hometown my entire life. She knew I bought a new house back in 2008.
They say we don't have a common language. I can't speak VN, but she speaks english with me.
Thy say we became engaged before meeting in person. After many months of webcam conversations, I asked her if she was ready to get married. After we met in person, we had an engagement ceremony.
So they say the case is closed, and its dated Oct. 8

What can we do now? Anyone know how long things will take?


look at Huongs case.. they had something similar happen.. they are back at the consulate stage again now... It may not be the results you wanted, but at least you have some control of what happens now... Get everything together for when the letter comes... thoroughly address everything they had an issue with...

Spot on!... The application has been approved and they just want those documents so all requirements are met.. when she delivers those documents they will 99.9% give her a pink slip saying come back in a week.. then there is a 50% chance the visa will be ready on that day... in any case you are good to go IMO... just a matter of jumping this one last obstacle..

Ask them when was the last update in the case. And what the update was... they can only see whats on the screen but they can drill down a few screens if they have any experience with the system.
Your congressman may be able to do an inquiry asking what the issue is since it has been so long... not a status check but a request for explanation of delay.

Ok. I called the DoS again. They told me I asked for a congressional expedite, so all papers were sent from NVC to HCMC.Thats why they said all papers were received. Is this a good thing? Has anyone had any luck with this? I hope they do something soon.



That does not make much sense since the hard copy of the file had to be at the consulate for them to do the initial interview. So I dont understand what they sent from NVC... I dont understand how the documents got to NVC if in fact they were sent from NVC.. There is no congressional expedite that I am aware of as the congressman has no say in the process only that the consulate must respond to a congressional status inquiry.

It really sounds like you keep getting rookies at DoS when you call... I hope something is actually happening in your case

A consular officer reviewed Ms. Tran’s file for a visa on September 24 and provisionally approved the issuance of her visa. Ms. Tran now needs to submit new medical examination results and a new police certificate. Notification (OF194) of this request has been sent to Ms. Tran.
Ms. Tran may submit the additional information either by mail or in person at the Consulate between 1:00 p.m. - 2:00 p.m., any working day. Ms. Tran should include the OF-194 refusal sheet that she received asking for additional information.

When did she get the first police certificate? Its good for 1 year.. they likely lost it and if she got an extra copy as Thuy did, you can shave a month off of the wait by submitting the one she already has.....

They sent Thuys letter on the 8th and I think she got it on the 13th or 14th... that was in Hanoi.. she cant get the medical without a letter but she can go to the consulate and ask for a copy...

I call DoS today they said HCHC office had request my wife to get her police report and medical exam redone, didn't said when they send it out.. is that a good news or what.

Bob, its got to be the DOS person on the phone didnt know how to read what was in front of them or didnt take the time to check any other sources of information. There had to have been some action taken on your case since her interview. Try calling again this week, see if you get better results. Good to hear your congressman used some strong language in his inquiry, I hope that produces something positive soon.

Many of the people at DoS have no clue what they are talking about... they use the terms under review and undergoing Additional processing very loosely.. when you call and they say that a CO reviewed the case on a specific date, that is IMO real info.. Looking at the variety of timespans for those in AP, it could be much longer for you... dont let it get to you.. keep in mind that it has not been denied at this point.. keep checking with DoS but not too often.. checking too often can increase the stress/frustration level.. ask them when the date of last review was... and what is the last activity noted..

I was sleeping and my wife call me at 4 o'clock in the morning and said she got Pink! Now am so happy can't go back to sleep, so I got on here to share it with every1!

*well she went in today to turn in the medical and police report at window B 1-2pm. When she turn it in the lady at the window said wait so she waited for 45min. 45min later the lady call her and give her the Pink slip woohooo.

You're going to get a NOID and you have to file a rebuttal for it. Failure to file a rebuttal will place a stigma on you and SO for fraud.

Start making your file for the rebuttal challenging every thing the CO had issue with.
