I called the DoS today and got Sara. She was very nice, the nicest person since this whole nightmare began. She told me the chimps in Vietnam (yes, she used the word 'chimps') touched our file at the end of July but nothing has been decided.

Man, talk about BS. Why don't those monkeys just get it over with? I'd even be happy to hear 'NO!' right now. Being in limbo is just terrible.


A touch is good. We too would like an answer, we dont want a "No" But at this point (almost 10 months in AP) we need some resolution, one way or another.

DoS says that as of last Friday we are undergoing final review and that our police cert is missing (the congressman actually inquired for me months ago to be sure that it was received and no issues present and they responded confirming AOK) and the medical is expired (we knew this). hopefully this week the letter will be sent or a call will finally be made..


Thats great news Scott. Its about time theres some developments on our cases. I called DOS today and talked to Chris, all he would tell me is our case is currently being processed. What are you asking to get any additional answers from them? Were so ready for this to be over.

If your case was updated one would think they are working on it so whats the "Pending Review"? Maybe they are gathering their intel and then will make their review.
I called DOS today as well and was told our case "Is Under Review". Like you, were waiting for the letter from the consulate. One would think after almost 10 months in AP, its got to be anyday.

they had 4 people making calls on our case all at the same time... I assumed it would be one person calling one after another... I was wrong with that assuption...... when the people that got the calls last year, they got the letter not long after... so if all goes as it did for them we should hear something...
I was surprised that they had those female VN clerks doing the calls and not a CO... that is wrong on so many levels...

Thuy has a good friend getting married in HCMC this weekend so we decided for her to check with the consulate on Friday.. is she limited to the 1-2PM afternoon window hours or can she check with them before or after that hour? should she take the letter they sent her or does she need anything to ask them the status when she is there?


Duyen said the afternoon hours are from 1-3:30, Thuy needs her passport and blueslip. Shes checking on our case this week and will see about any morning hours. I'll post when I know.

My wife had her interview November 9, 2009. After the interview she received blue asking for additional papers. We brought everything they requested to the Consulate on November 13,2009 and was told to go home and wait for a letter. Well, its been 10 months....no letter, no phone call, no investigaters. I really don't know what their major malfunction is? Any ideas?

hi guys...first of all, thanks for posting these valuable information...I was in the same situation for months and this post keeps me hope until now. I was recently requested of PC and medical but not the passport. My fiancee still has her passport in hand. I don't know what are my chances here because I assume the Consulate will need to stamp the visa into passport if we got issued a visa. Can you guys please share if your passport is requested to have visa stamped or how it is done? Thanks.




We really have no idea of your circumstances at all since there is no timeline filled in and you have given us little info but usually but not always them asking for just those two things mean they are done with you and you can expect the visa to be forthcoming. Make sure to take the passport with you when you turn in the requested documents.

Is this the first time, second? What did the blue sheet say? Like I say it is hard to answer any questions with little info. Good luck and God bless.

Yaaaaaaaaahooooooooooooooooo !!!!!

I was sleeping and my wife call me at 4 o'clock in the morning and said she got Pink! Now am so happy can't go back to sleep, so I got on here to share it with every1!

*well she went in today to turn in the medical and police report at window B 1-2pm. When she turn it in the lady at the window said wait so she waited for 45min. 45min later the lady call her and give her the Pink slip woohooo.

You will NOT get a NOID UNLESS you file again, and even then you might not get a NOID. A NOID is a Notice of intent to deny. If you hurry and refile you could possibly get a NOID, like Frank did, and at that time they had Mark Ellis handle it and they got sent through, and they are having their interview on the 2nd of November. But this is about 1 year after their denial that this is happening, maybe a bit longer. Good luck, and before you refile, wait to see if you really get a chance to do a rebuttal do it, if not make sure you can confront each and EVERY reason they gave for a denial, because if they do issue a NOID you will have to fight it or risk getting a p6 fraud marker attached to your file meaning it will be all but impossible to ever get her to the states. Good luck, and hang in there!

Frank and H&P had petitions go through CSC. Bob went through VSC. I haven't heard anything lately about VSC using the same tactic as CSC, and sending a NOID on the second petition. As far as I know, VSC are still readjudicating returned petitions. If you've heard anything different please let me know.

Anyway, if VSC readjudicates the returned petition then they'll either reaffirm it or send a NOID. This could take anywhere from a couple of months to a year or more. If they do what CSC has been doing then they'll send a letter saying they're not going to readjudicate the petition because it's expired, and then send a NOID when they file a second petition.

However it happens, since either route could end up with him receiving a NOID, and since he'll have a limited amount of time to respond to it, it wouldn't be a bad idea to begin preparing a response now.

Here are the results from the members which have contributed Jan 2010 till May 26 2011 tracking of statistics from HCMC:

My opinion of the info gathered:
The odds of getting a pink at the interview are about the same as getting a blue... up a bit over the past 6 months...
The odds that the case will ultimately get approved and not sent back to USCIS is 85% ... lookin better, up 3 % over the last 6 months

This is very good information. Approved rate is 82% based on our pool - that is very good.
I was just wondering that how many members have contributed to our 2010 in total?
Can we some how find the over all approval rate in HCM for 2010? Does anyone know?



They dont post the approval %'s at DOS.. they do show the total number of visas processed by category.. and if I recall the number of visas issued... been a while since I looked for that data... as it didnt give us enough insight into what was going on when it came to pinks blues etc...

the number of 2010 VJ members in the calculation was 42.. there are 3 still pending results and a few that did not provide results so were not counted in the statistics... its all on page 1 of this topic...

Of those getting out of AP in 2010 only 1 in 6 was denied.. the rest were approved.. 83% approval rate

Be prepared to get a blue at the interview as it happens 12% more than a pink.... there is an 82% chance the visa will ultimately be approved (good news IMO).. but half of those wont happen at the interview but later... AP may take a while but its not an automatic denial...

looking back at last years numbers.. we are way down for the number of petitions going through HCMC... there were over a dozen VJ members last year in Nov and Dec alone.. this year we are seeing only 3 for those same two months... If this is any reflection on the number of actual petitions, they should be smoking through them at a faster rate than they seem to be...

Also looking at the rate of denials... it is looking better than we let on to be when it comes to approval numbers. We like to say that HCMC is a difficult consulate to go through, but its looking better in some respects.... look back at the fisrt page of this thread and look at the number of denials and we can also see the reasons for many of them... the thing that still does not make any sense though is those in AP for a ridiculous period of time...
