It is an investigation, that is part of the processing of the application... I think thats why they call it AP rather than an investigation... AP can cover any time delay in processing that is not normal.

It is personal for all of us... I get pissed off half of the time when I call NVC to check the staus of our case and they say the same scripted statement every time (you are in AP and there is no timeframe for this process).. Some care and you can hear it, but its not personal to them or the ones actually handling the case.. its just a job and they are showing up at work each day and doing what we pay them to do...

It just so happens that those that end up in AP have some red flag associated with the case that causes them to not be able to sign off on it withoud further investigation... they could be looking at phone records.... calling relatives.... looking on Facebook... we never know what they are doing in this investigation... or the decision process that takes place when they are done "investigating" but it all is additional time and processing that they otherwise would not have had to do if we had not had the red flags...

I found out why I got pulled into AP @ NVC based on Gary's discussions with the VSC director last week... Having a security clearance is grounds enough for them to want to know who we are sleeping with and how it may affect our clearances so most of us in NVC AP have government clearances.. not all.... Because of my role with institutions that are on military bases around the world, the DoD wanted us to have certain clearance levels so there would be no issues if something came up during a lecture regarding technology. Its ridiculous, but I actually am glad that they are doing something to keep our bases safe...

We all know that there are still many people in our government that consider us as "sleeping with the enemy".... That may be the guy that saw my file and said OMG what is he up to?

You made an interesting point when you said that the CO gives a blue slip requesting evidence that you already have available for the CO to see that same day at the interview. What I still do not understand is how other people have gotten the CO to actually look at the evidence and get a pink slip. Those that got the pink slip did something different then those who got the blue slip. There just has to be something that the blue slip people are missing. I looked at the list of people that got blue slips or are in AP and it looks like the common denominator is the time line. Just about everybody has listed the time line as a reason for the blue. I also see list of relatives for the beneficiary and evidence of bonafide relationship....which brings me back to the evidence for the interview date issue. There has to be a link from the evidence submitted with the I-129F to the evidence that needs to be presented on the interview date. That "link" should force the CO to look at the evidence. I don't know. Im just trying to figure all this out before I file my petition I guess. Am I thinking wrong? Somebody please shed some light on this.

I know that it's frustrating getting into the Consulate and get the same generic answer but don't get too pushy. I know you have your way of doing it but it's best for us to present ourselves professionally. I was there talking to them and they actually takes note of what you said. I thank you for your opinion, we have decided to just email them. I was never going to get pushy, or at least never intended to, I just wanted to feel out the waters and ask some straight forward questions, like if they are supposed to be looking for evidence of a bonafide relationship why did they not even look at 300 plus pages that we had, and also why they did not want to look at the time line that we had, and the evidence of where my ex wife currently lives?, and ask why they would have refused to look at it then give us a blue requesting the same information, all in a polite way, but if at the time I was talking with him I sensed he was in a pissy mood I was not going to mention any of it, and just simply ask when they thought they might actually get to our case, but instead we will email them and mention these facts to them but not question why just mention that we had and still have over 300 pages of information that proves we have a ongoing relationship as well as this was my 3rd trip to HCMC to be with her. Honestly, I think its personal choice. they judge on how pressured they are at the moment and really how they feel at the time. its this right? well no, no its not at all. but its how it is. if they are still in doubt, they will just ask for anything. so they have more time to go over the case.

I had a Timeline, but it was not notarized, only signed and dated. she did not pass her medical. so we got a blue slip for that BUT only that. I did not have a list of relatives. but my fiancee did interview in English, I was there for the interview. We did have an engagement ceremony. We had Tons and tons of pictures. but not just pictures of me and her and her family in Vietnam. we had pictures of my city and my house and things like this mixed in. we pretty much brought everything we had. tons and tons of chat longs. but they didnt look at them. they didnt even look at out engagement ceremony pictures. only pictures from my city, snow, me fishing with friends and things like that. Anything that i sent her to explain how my life was here in the states she brought with her. which i think helps to show that everything is real, were not 2 strangers and we do everything we can to communicate. we also had pictures of my fiancee and my self doing things together and having genuine fun. if they dont see you together doing things and just hanging out... then they are going to wonder whats up.


just my input from personal experience. by the way, I filed for a K1 visa on feb 2 2009, and we just got approved on the 16th of October 2009.

What can I say they were Additionally Processing us. I think it had a lot to do with the VN translator and our lack of knowledge of the process. We will never know the entire reason. Maybe they lost the file for a while.

I have to disagree w/ you Fred. I do believe that they are doing additional processing, and I am glad that they are. Yes, it affects many of us, but think about all the cases that are fraudulent. We see alot of cases get by, but never hear of those that don't.

This additional time should not affect our relationship with our loved ones, they should make it stronger. People entering into relationship with other individuals from different countries are and should be aware of the commitment they are entering. People in AP need to realize that it isn't personal, there are just things on paper that seem out of place. Those people who entered into fraudulent engagements/marriages did the right things and covered all their bases--they fooled the system--but that will catch up with them sooner than later!

After I was placed into AP, I went and visited the embassy to find out the status of our case. The woman at the window said that our case is pending and left it at that. I was the one that initiated wanting to speak with the CO in charge of our case. If I hadn't asked, I probably would still be in AP. The reason I said this is because when I did come back to speak to the CO, he did ask me to clarify some things for him. Call that additional processing or investigating, I'm glad that my case was picked. It just goes to prove that the COs are doing their jobs to the best of their abilities.

To all those that are in AP or find themselves in AP, hang in there. Be patient, be persistent! Goodluck and all the best!!

Ok if you want to call it Additional Processing you can. The man told me investigation.

Maybe for you it is not personal but, when in an interview they ask about a Wedding date knowing they are not going to give the visa I take that personal. When Dao's two sons come here and go to school it will be hard enough to start in a foriegn school, now because the Consulate drag their feet they have to start late in the year without summer english tutoring. I take that personal. When I have to figure out when and how to get attention from a government employee that is too busy for me. I take that personal. I laid all my information out for the Visa process expecting to be treated fair and with respect, the Consulate did niether. I take that personal.

I agree with you. If I hadn't spent the time to go to the Consulate and bang on window 15 I think we would still be in AP. Also agree that our commitment to or relationship is stronger but I think it would be the same without AP/investigating.

The consulate wasted my time. I take that personal too. Does anyone else take it personal?

The only good thing is that I have already been investigated for fraud based on that phone call from DoS asking for my wife.. not likely I will get AP for that again... I like what another VJer did by having his fiance include pictures of his house ect at the interview to show where he lives and what he does for fun... that along with pictures of where we will get married and honeymoon will address an issue that a recent denial got hit with... just running down that red flag list everyother day to try to be as prepared as possible... she is actually having someone rudely ask her ridiculous questions to prepare her for the real thing...

I wonder if they would do something for her knowing she was from the north.. say she asks them, hey if I stick around a day or two can I pick up my visa before I fly back to Ha Noi? I really want to get married fast so we can get that tax deduction this year.. he he he...

Ly should be out next week... She went to the consulate last night and they said not done... we will notify you.. likely Tuesday or so before they are done if the timeframe after Johns call is the same as Ly's....
I got the call from DoS yesterday and I am out of NVC AP today.. so that scheming call is for sure an indicator that something is about to happen... with luck I will fax and email the DS230 and DS 2001 on Tuesday as they will get the file on Monday and I could get an interview as early as Dec 21 or 22... fingers crossed... if all goes well she could be here b4 the end of the year and married b4 Jan 1.... woo hoo on that tax deduction!!!!

If anyone else gets a call from HCMC let us know.. this is a good sign and we can count from that day how long it takes...

I have been in AP at NVC for a month now and someone called me from there asking for my ex wife... I knew who it was and what they were trying to do. I gave them her cell # and said call her if you want to talk to her but we are divorced and have been for some time. I expect to be off to the consulate tomorrow... Having been invesigated at NVC the way they just did, I expect no AP @ HCMC... This means interview before the end of the year.. but I dont see any way for her to get a visa before the end of the year and get married this year for tax purposes...

Hey there is no Replacement for Displacement! Haha I learned the hard way. I use to race 4 cyl, 6 cyl, and my next project will be a V8 for sure. All was and will be 600hp and up. I am thinking Ford fox body though cause they are pretty cheap to make fast. Right now I am just cruising around in my Lexus GS until after we have our baby then I'll get back into the hobby.

this is my first big block.. 396.. alot of weight... but I had to do alot of work to the rear to hold it all together with that much torque...

Michael and Kha have a case similar to Tuan.. the denials were very similar... We had not talked about where we were going to get married or honeymoon.. that was minor compared to this ordeal... We are working on the details of the wedding etc now so she will be better prepared for the interview...

John's fiance went to the consulate and the woman at the window said your case was approved last week, return later today with your passport so we can give you your visa....

With that.. We expect Ly to be approved Later this week if he has not been approved already... it appears the mystery call may be the sign that the investigation is almost over... one can only wonder what they do if they call and nobody is home...

Just got a text from another person in AP HCMC that just got the same mystery call (not a VJ member)..... looks like they are working hard on clearing out the cases in AP....

I guess that my request reached the feet of the right person then. Kat said she would talk to Captain Ewok about it and then the next day it was pinned. No news on our case yet either. We got the automated response, and we are waiting on the other one. I figured we would get it after I get on the plane in the morning, just hope within the next 2 weeks we will hear something. I got the call from DoS yesterday and I am out of NVC AP today.. so that scheming call is for sure an indicator that something is about to happen... with luck I will fax and email the DS230 and DS 2001 on Tuesday as they will get the file on Monday and I could get an interview as early as Dec 21 or 22... fingers crossed... if all goes well she could be here b4 the end of the year and married b4 Jan 1.... woo hoo on that tax deduction!!!!

If anyone else gets a call from HCMC let us know.. this is a good sign and we can count from that day how long it takes...


So she'll travel as soon as she gets the approval?? I think you're being too hopeful if you think she'll get her visa by the 31st though...lol. Unless you can get Thuy to explain to the consulate officers that she needs her visa that same day because ya'll wanna take advantage of the filing status!! LOL.... smile.gif (It's possible though...I guess.)

We were not emailed when we were approved. I emailed them weekly, and when I nagged my husband to go out to the consulate and he finally did they told him they had completed processing his paperwork and to come back the next day with his passport to exchange slips.

John's wife also went to the window where she was told their case had been approved and to return later with the passport...

It looks like a good indication (2 cases--Mine & John's) that if your SO makes inquiries at the window, you'll hear faster than by mail/phone/e-mail...

My wife just got her license about 2 months ago so we are going to get her an SUV to take the family around, I still have my Lexus GS that can seat 5, and I need a hobby car to play on weekends and hopefully one day hand a fast car down to my kids when they get older.... innocent.gif
