I'm glad WeatherEmperor got out of AP. My case is now 255 days in AP. WeatherEmperor got called in beginning of February but we didn't get a call or anything even though we are in AP only a few days apart (I'm ahead of a few days in AP). A recent call to DoS and the status didn't change. DoS stated that the last event was a Congressional inquiry on my behalf in January.
When the Consulate said they did the case in order, they must meant doing in the order of the cases handle by the individual CO. I got Congressman involved, and tried faxing the requested info from my senator, but the senator office has not response. Crazy waiting!!!

I'm in the boat as WeatherEmperor. We resulted in AP in the same month. I called DoS on Friday and I couldn't get anymore out of the them, all she said was my case is still in AP. Does anyone know if a notification of denial sent to us, how long before the Consulates send the package back to the US? I just wanted to know if there is time for me to fly back and talk to the US Consulates. Just preparing for the worst case.

Recently, I went back to speak with a Consulate Officer. Been in AP for slightly more than 6 months. Officer told me they are aware of my case and said that the Officer who handle my case does not have time to review it yet. He wrote note into my case via the computer while i'm standing there saying that I was here and he asked for a phone # in vietnam where they can reach me while i'm in Vietnam if needed. I submitted some additional documents to update my profile since it hasd been awhile. He took it and said he'll make sure those will be in my file.

The Consulate Officer acted very professionally unlike a Vietnamese National worker (interpreter?) that I met the last time I was there with my fiancee to submit docs listed in the Blue paper.

I've been in AP for 6 months now. I contacted my Congressman and he asked specific about my case. I told him that I filed my case 1.5 years and I've been in AP for 6 months. I also told him that the reasons I suspected the Consulate hold my case are because a few red flags which triggered my case into AP. I told my Congressman that those red flags are nothing but just a coincident.

After a few days, my Congressman replied to me and said that he sent mail to the Consulate and said that he would like them to look at my case as soon as possible. He also told the Consulates about my concerns about the potential red flags. These red flags are, same last name, lot of relatives in the US,...ect

Do you think this is going to help me or make it worse? I didn't expect my Congressman to send that but just to explain to them what I think is going on.

2 1/2 years in AP is over, visa in hand. Finally got it. Submitted updated medical July 3. Emailed consulate July 12 re: no news from consulate or EMS. July 13 consulate reply; visa approved, wait for EMS. July 18 10am VN time SMS delivered visa. And its a good thing too because I was just clearing customs at the airport in HCM at the time. She was at the airport to meet me and got the call. Yeah, I know, "don't make travel plans until you have the visa" but I rolled the dice & got lucky. Serendipity happens. This time we get on the airplane together. I guess I better start reading up on POE stories. Thank you all for your support. We are so happy, hanh phuc to be together at last.

The reason I asked (to be completely sure) is my wife is not coming to USA until 2-3 months later, but I have to fill out a Secret Security Clearance for a new job contract work for the Department of Defense.

Therefore I have to be sure to check the box "Single" or "Married" on Marital Status section.

Right after my wife turned in the updated health and justice record, she was asked to turn in her VN passport and pay for the visa processing, and passport would be returned within 2 weeks, etc... (that was what my wife told me but she could be wrong...).

Does it mean that her visa is approved and she just needed to wait about 2 weeks for it to be done?

My senator sent me the e-mail response from the HCMC Consular with the following:

The case file is still pending review by a consular officer. Unfortunately, we encounter a significant number of visa applicants who are involved in fraudulent relationships entered solely for the purpose of obtaining immigration benefits. This requires that all officers take time to fully consider all aspects and facts of a case, requiring at times more in-depth investigation to verify certain facts. Due to staffing and other resource limitations this often means long waiting periods for applicants.
We will notify Ms. Nguyen directly after our assessment is completed and a determination is made on her case.
I hope this information is useful in responding to the concerns of your constituent.

Look like our case may be one of the victim affected by the fraudulent...it is so much frustrated even though they've seen evidence of our pictures and daily Yahoo's video call, etc...

Hope our case would be considered soon as we suffer each day passes by...

I asked two Senators in my state to write letters requesting case update recently.

Hello everyone,

About 2 months ago, two Consular representatives (one American and one Vietnamese) went to my wife's residence to check for evidence (looking at pictures, receipt money was sent, daily Yahoo video calls, etc...) while calling me directly from my wife's cell phone (she has my number on her phone along with our many pictures) to verify my existence. They asked me similar questions they asked my wife to double check. At the end of that visit, my wife asked them how long she has to wait and was told by the Vietnamese representative that "it won't be long as the last time" (the last time my wife had interview was last July when she received the white slip for Additional Processing as was discussed in another topic). My wife then told me they were talking to each other about our evidence matched, etc...

It has been more than 2 months and we still haven't received any response regarding the case beside the general response (when we sent e-mail) such as "the case is still under additional processing....etc..). We've also had a Senator writing letter requesting the case update and also receiving the "general" response.

What should we do? Please advise. Thank you very much for your help.

I didn't send in any evidence so I am worry about that part for the interview. I wasn't thinking about keeping records and evidence since we worked and stayed together in Vietnam for a few months. But I didnt have any Rfe. What is the commit to marry? Are you guys married or fiancé status?

Hey guys I have a question concerning notarizing the timeline of relationship. Can I type it up in English, sign it and then mail it to Vietnam and have them translate over there because it is cheaper. Over here I go to Catholic Charities and they charge me $50. There has to be another way. Thanks for answering.


The notary has to witness your signature. No need for a translation.

After reading all of the posts, I am still wondering what the main purpose of having the timeline? Did anyone find out why? There are talks to about having in English version and Vietnamese version. Do I need both or just one?

I didn't submit the timeline with the I-129f package, should I submit it now before the interview or wait until the interview and then give it to my fiance at that time? Can I email the timeline with notary (scanned with color) to the HCMC before the interview so that the CO can at least read it first and my fiance has the original copy at the interview?



You do not need to do a timeline in both languages. English is fine. Just have it prepared so that if it is asked for you can present it at the interview and/or respond to the blue slip promptly.

They are not likely to accept it at this point. A few folks seemed to be able to get it in to the file midstream, but things have changed.

I have questions regarding to the Police Certificate. Is it 1 of requirement documents apply for all applicants (whether traveled out country or not?) My Fiance is not been travel out country at all so Police Certificate requires for who traveled or requires for all applicants? Anyone? Please advise. Thank you.



Every filer MUST submit a recent Police certificate for every country they have resided in for more than 6 months. If the Fiance has lived in VN the entire life then the VN police cert is the only one required. no visa can be issued without a police cert.

The timeline is only required when they issue a blue slip asking for it. And then it is requested that it be notarized.

I included a timeline with my petition, but not like the format listed and not notarized. So my question is, now her interview is Monday. How can I get her that notarized sheet in time? I want to consider speed, reliability, and cost.



Fed ex is the only way I would use but IMO not worth the stress given the circumstances.. They usually dont accept it anyway and if it is requested in a ble then you have a month to get it there...

she went to the local police office in Hatay rather than the justice center in Hanoi since she lived in Hatay... they dont want small town anything and the local police office didnt even know what was needed whereas the justice center knew exactly...

my fiancee main residence is up north near thanh hoa...she got a justice record check there. she also went into saigon for a couple years to work. is it required to get a justice record check in there also? i would imagine no as her main residence is TH and if anything happens in saigon they'd just forward the info up north?

of course in VN getting things expedited=$$$. record check 25 days wait=100,000ng. getting in in 5 days and they mail it to your home=700,000ng



They only need 1 but be sure that it looks like the example lindal posted in her photo section.. we initially had the wrong thing from the wrong office..

Its common for viet kieu relatives to pay someone to marry a VN citizen relative for immigration purposes only... bringing relatives over that way is too common and the consulate was called to task on it several years ago when immigration fraud rings were busted......

Not exactly true.. The Consulate does not require the document from the beneficiary to be in English.. Thats what those translators are there for... The only documents required in english are outlined in the VJ Guides... Nowhere has it been posted that a blue slip requiested 10 year residence of B "in English"...
