Same here, we've been in AP for more than 60 days now. I'm going back in December for a visit if no words from the consulate by then.

ViQuoc...Congrats!!!! Another person off the AP list.

Scott, I have no clue as to what their doing there. I dont think there is a year limit from interview to decision as there are others that have been in AP longer than us, but who knows, certainly not me. The inquiry my senator made for me produced a letter from the acting consular section cheif (unsigned) stating our case is pending further review by a consular officer to determine if a bonifide relationship exists between Duyen and I.

I cant friggin cant believe that. And they refer to her as "Ms. and not Mrs. I considered writing them about that but decided to to cause trouble.
Now one would think, with the resources they have availabe plus ALL the information (sworn and notarized) I have given them, all the additional info we both have given them and my 4 trips that they would have come to the conclusuion that our marriage and relationship is indeed legit. All they need to do is LOOK AT THE FACTS, it doesnt take a sleuth to see the truth, it shouldnt take a year or more to finish any investigation. All I can say is they better get it right.

*hey frank i know that is stupid how they refer our wife as "MS. not Mrs." but i guess that how they do it.
like you know my senator got an e-mail from Sarah K. Bellman Acting Consular Section Chief three week ago and she did the same thing too, she refer my wife as Ms. not Mrs. but whatever don't worry about it.

*************again i like to said thank you to everyone here for there blessing***********

for the past 3days my wife and i are trying to decide which hospital to go to for her medical exam.! BV cho ray or IOM , at cho ray we have to wait until 11/11/10 to get in but at IOM we can get in within a day or two. so we hear IOM is faster and ez but will not recommended for anyone with lung problem.
anyway it went really smooth at IOM she was there at 7:30 today and got everything done at 10..
she on her way home and be back tomorrow to IOM office to get the stuff.

*so anyone here who wife's need to get there medical report done fast and have no problem with there lung or health i really recommend go to IOM it cleaner, faster, and it got AC  ....

BTW thank you everyone here for being on our side and helping us with question and problem for many month. specially to Scott . thank you ya'll

weir! so my wife got her OF194 in the mail. it said to

*please provide a police certificate from the Department of Justice office.
*Please submit your medical examination results.

and ofcouse there a lot other stuff but it not important blah blah blah blah.
so the weir thing is that there's NO RESUBMISSION DATE, it just said once we have the two item done turn it in at window B on any working day between 1:00-2:00, window will be open at 12:30. SO NO RESUBMISSION DATE ..

ANY IDEA SCOTT ? ANYONE?

When did she get the first police certificate? Its good for 1 year.. they likely lost it and if she got an extra copy as Thuy did, you can shave a month off of the wait by submitting the one she already has.....

both of it are expired. i don't worry to on the police cert taking long, i got people in VN to get it done in a week.
just like my married certificate and the police report before that, i got it done in a 8-9day..

They sent Thuys letter on the 8th and I think she got it on the 13th or 14th... that was in Hanoi.. she cant get the medical without a letter but she can go to the consulate and ask for a copy...

Thank Scott i was being impatient but about an hour ago got a e-mail from my senator.

Consulate General of the United States of America
Ho Chi Minh City, Vietnam
September 29, 2010

Re: HCMxxxxxxxx, Ms Tran's

Dear Senator Lugar:

This is in follow up to our response of September 13 regarding the immigrant visa application of Ms.Tran (HCM2009xxxxxx). This case is of interest to your constituent, Mr. Thang. I regret the delay in my response to your inquiry.

A consular officer reviewed Ms. Tran?s file for a visa on September 24 and provisionally approved the issuance of her visa. Ms. Tran now needs to submit new medical examination results and a new police certificate. Notification (OF194) of this request has been sent to Ms. Tran.
Ms. Tran may submit the additional information either by mail or in person at the Consulate between 1:00 p.m. - 2:00 p.m., any working day. Ms. Tran should include the OF-194 refusal sheet that she received asking for additional information.
I hope this information is useful in responding to the concerns of your constituent.

Sincerely,

Sarah K. Bellman

Acting Consular Section Chief

Any one know how long before we receive the NOID?
Anh bobMaleVietnam2010-10-21 02:16:00
VietnamHCMC Interview roll call
Well, today, October 18, my wife finally received the OF-194, but it wasn't good. Almost a year since her interview and they were anable to issue a visa. They stated 5 points.
They say she didn't say my son's name correct, but when she had the interview they asked her to spell his name and she did. Maybe they didn't hear her clear.
My wife doesn't know about my hometown. She couldn't describe the city. But she did say about a landmark near my hometown.
They say she told them I lived in only one house my entire life, but she told them I lived in my hometown my entire life. She knew I bought a new house back in 2008.
They say we don't have a common language. I can't speak VN, but she speaks english with me.
Thy say we became engaged before meeting in person. After many months of webcam conversations, I asked her if she was ready to get married. After we met in person, we had an engagement ceremony.
So they say the case is closed, and its dated Oct. 8

What can we do now? Anyone know how long things will take?
Anh bobMaleVietnam2010-10-19 08:48:00

I don't know if I'm doing it correct when I call the DoS. I call 202-663-1225 and when someone answers, I say I want to check on the status of my wife's visa. They only tell me what they see on the computer screen, which is "my wife's case is pending review". I ask them if they know more, and they don't. As far as I know, they haven't done anything with this case in almost a year.

Ok. I called the DoS again. They told me I asked for a congressional expedite, so all papers were sent from NVC to HCMC.Thats why they said all papers were received. Is this a good thing? Has anyone had any luck with this? I hope they do something soon.
Anh bobMaleVietnam2010-09-30 01:45:00

Its odd.. having given it a bit of thought I am surprised that it would say documents recieved and not say that you are missing an updated police certificate and medical..

What did they say to the congressman? same copy paste BS?

What DoS said confused me. They said its no longer with the NVC, and everything was sent to HCMC. I tried to tell the woman my wife had an interview almost a year ago, but she could only tell me what it said on her computer screen. So I really don't know whats going on, unless she didn't check the correct case number. Yes, I know we need to update the police and medical, but haven't received a letter asking for that.

The congressman sent 2 e-mails. 1st one he received has Bennett's name saying the same copy and paste. Then he sent a 2nd one because he said he wasn't happy with their response, asking them why its taken over 10 months. He said he told them loud and clear, and if I don't hear from them by Nov. 1 to let him know.

Congrats Scott and Thuy.

I have a question. I called the DoS on 9/22/2010. I was told that the Consulate wrote in their computers that all documents were received, and was dated 9/21/2010, 1 day before I called. After my wife had her interview, on November 13,2009 we brought all the documents to the consulate. I was told before that they received them. Also, my Congerssman has sent them a few e-mails asking about the delay. Why would they say the documents were received on 9/21??

This is very good information. Approved rate is 82% based on our pool - that is very good.
I was just wondering that how many members have contributed to our 2010 in total?
Can we some how find the over all approval rate in HCM for 2010? Does anyone know?

take the docs to the window, they will likely tell her to wait a bit, then they will call her up, and they will ask for passport then and give her the pink slip... in cases like this... the visa has already been approved, they just need the docs to wrap up loose ends... the passport will be needed so they can put the visa in it.. they will likely tell her come back a week or so later to pick up the passport with the visa inside... tell her to expect the translator may ask her some interview type questions again... its just the interviewer showing off.. the CO doesnt care at this point because they are pretty much done with you.. but if the interviewer was to ask something that she should obviously know and doesnt.. the CO can always rethink the decision...

thank you Scott..that definitely clear up things for me...i'm crossing my fingers now..:D

thanks for the reply, my fiancee got interviewd last December and put under AP since. Last month, we were told to update those 2 documents and we will hand those in next week or so. I guess I will tell my fiancee to bring her passport just in case. So should we turn in all the documents and passport at the same time at the window or just turn in those 2 requested documents and wait for their instructions. Thanks.

hi guys...first of all, thanks for posting these valuable information...I was in the same situation for months and this post keeps me hope until now. I was recently requested of PC and medical but not the passport. My fiancee still has her passport in hand. I don't know what are my chances here because I assume the Consulate will need to stamp the visa into passport if we got issued a visa. Can you guys please share if your passport is requested to have visa stamped or how it is done? Thanks.

Should have next interview in May/June or so.... she will need to renew some documentation between now and then...

Nothing surprises me when they are asking questions... Some of the stuff they asked us was a surprise, but we went along with them like you did. There still may be a couple of guys poking around in the coming month. Its great news that the CO didnt want to deal with the senators... other CO's have just scoffed at them...

Have a feeling it is more like a superior started asking why nothing is being done yet. The CO realized that maybe they were putting it off too much. Just glad they are doing something.
luckytxnMale02012-03-30 09:58:00
VietnamHCMC Interview roll call

It's is now 1AM pacific time. I can't sleep because I'm quite happy that the Consulate called me at 11:30PM while I was sleeping. I spent 20 minutes answering questions to the Consulate. A lot of questions... I meant a lot, these questions are designed so that if you are honest and are truly know&love your fiancee/wife and families/relatives attended your engagement/wedding, then no one should ever be worry about failing. I will not go over all the questions they asked us. The bottom line is that the answers should sync between everyone's answers. The lesson learnt is that always be honest even if the question might be embarrassing or too personal (for example, did you have sex with her, but it does not matter if it a yes or no as long as the answers are the same)

They immediately called my fiancee right after they finished talking to me, and then immediately call my Aunt and Uncle who live in the farm area in Vietnam. Don't try to call your fiancee right after they call you. It's lightning speed.

DoS CO didn't lie when she said that they tried to expedite my case when I called DoS 3 days ago. The reason is because the CO I talked today started out by saying they are expediting my case because of my Senator and they are calling me now.

You gotta believe this, they asked for my fiancee email address and password while talking to her and they check her mail immediately. They said my doesn't send much email to me, but my fiancee said that is because we talk on the phone a lot and also chat.

I'm glad this is almost over! and I hope what I shared here will help people who are in AP right now or in the future.

Overall, I'm pretty confident that we passed.

Awesome news. You better post and let us know when the pink is coming. Have y'all updated the medical and stuff? If not get the babe hopping and do it.

That would be great. I expect that at sometime the calls will happen. Be ready. The CO is probably figuring better get on it.
