I was sleeping and my wife call me at 4 o'clock in the morning and said she got Pink! Now am so happy can't go back to sleep, so I got on here to share it with every1!

*well she went in today to turn in the medical and police report at window B 1-2pm. When she turn it in the lady at the window said wait so she waited for 45min. 45min later the lady call her and give her the Pink slip woohooo.

Any one know how long before we receive the NOID?



You will NOT get a NOID UNLESS you file again, and even then you might not get a NOID. A NOID is a Notice of intent to deny. If you hurry and refile you could possibly get a NOID, like Frank did, and at that time they had Mark Ellis handle it and they got sent through, and they are having their interview on the 2nd of November. But this is about 1 year after their denial that this is happening, maybe a bit longer. Good luck, and before you refile, wait to see if you really get a chance to do a rebuttal do it, if not make sure you can confront each and EVERY reason they gave for a denial, because if they do issue a NOID you will have to fight it or risk getting a p6 fraud marker attached to your file meaning it will be all but impossible to ever get her to the states. Any one know how long before we receive the NOID?

Starting from the day that we received a letter stating that our petition got returned to uscis for further action, I believe it's around 6months for me to get a NOIR. After receiving that letter, we have around 23 days to turn in our Rebuttal. During this time, I contact my congressman for help and get them to be familiar with me. Told them about our situation and ask them to do a regularly check on your petition. They call NVC/USCIS once every week to check on immigration stuff. I was in Vietnam when I receive my NOIR. During that 6 months, I told my wife to go see MARC ELLIS. He's a well known lawyer here on VJ. We gave him most of our stuff so they can get a file going for me. When I got there, we went in and see him along with some more evidences. There were 2 backpack full of stuff. Make sure you keep all of your post office stamps vietnam and u.s. After getting the NOIR and hearing from them takes about 3 more months so all together is around 9-10 months to get to where we are. Right now, NVC forward our case back to the consulate in HCMC. We're waiting for package 4 I guess cuz she might have to do the vaccination and police report, etc. What ever they want I guess.
It's a tough road to go on and don't feel like you're going by yourself. Keep it up man. Dont be discourage. Your better half might feel worse than you so try to comfort her a little. You know how it is when you fail something. From the date that we got the denial to now is around 1 year. We've seen each other 3 more times since then. Now I total of 5 trips added into our legit relationship, maybe we get a better chance this time.

I'll be surprised if they dont ask for another DS230... since its been an entire year+ after the first interview.. does she have to wait for them to schedule it?


Hang came in to turn in the PC. They confirmed that they had received the Medical but didn't ask her any question, just told her to go home and wait. I am prepared a new DS230..anticipating a new interview but don't know when..I guess I have to wait for the interview date before fly back :(
ps: to make the situation bad..she lost her cell phone in the taxi when she got dropped off at the Consulate.

She got the letter and I got the reply email telling her to come in to submit the PC and she will get another interview afterward. I do not know if it is another questions session when she comes in or will be a full scheduled interview at a later date. Hang will come in Monday and will find out..This is really frustrating, they're really dragging it out so one thing after the other expired..I feel like we're going in a loop.

It's now 3 months in AP purgatory. Ugh...what a miserable feeling :(

Received a letter from Senator Nelson to give the Consulate until November to process our case. Funny thing is that last week my fiance went to the Consulate in person and one of their robot employees told her to wait an ADDITIONAL 1 year :unsure:

It is obvious that the Consulate is just pulling numbers out of their rear end. I guess they are nicely trying to tell us to f&*# off until they feel like getting to our case. I see that about 50% of cases in this AP thread are resolved in 3 months or less. Now our case is going into the other 50% of those waiting beyond 3 months. I really hope that the Consulate will begin the preliminary investigations into our case in the next month or so. The signs I am looking for are random phone calls to my residence or to Thu's residence, random visits by Consulate investigators to Thu's residence or village to question people, etc. This may not be the case for us because some members reported that none of this happened while they were in AP.

On a personal level, I am still in school doing my MBA online. I also will begin job hunting next month. My current job is manageable but the pay is lousy. I am also looking to move up state to Central/Northern Florida. I also got a new phone a few weeks ago (HTC EVO 3D). This is my first ever Android phone so it will take me a while to get used to this smart phone stuff :) Thu got sick a few days ago because she got soaked by a rain storm while on her way back from the Consulate. She is doing a lot better now. She wanted to get a job at a Nike factory not too far from her home but the fumes made her feel nauseous so she quit after 1 day.

Other than that everything else is okay. Once again, I hope the Consulate gets moving on our case soon considering it has been 3 months now. If we don't hear anything by Thanksgiving, I am considering pushing Senator Nelson harder and harder to try to do something. That's it for now. I hope to report something more positive next month. Well today marks 2 months (60 days) in AP. Sent the Consulate an email a couple of weeks ago. They say my case is still pending. Involved Senator Bill Nelson. Thu calmed down a lot from last month. Still expecting this to drag on for another 4 to 5 months.

For those that are also going through AP, please try to find something to keep yourself busy. Start doing some night classes or learn to cook some different dishes or take a painting class. Find distractions or this waiting will make you go insane. Will update next month :)

My thinking on this is that the CO has made a recommendation and the case is going to the big cheese to look at. I think this is what happens to all cases. The CO makes a recommendation and then it goes to the section head to get a stamp, at least this was what happened to our case when it got kicked back to the Vermont.

I have no clue but I feel a little optimistic since the email said, "next steps in processing her case shortly". If they were going to deny us again, there wouldn't be those words.

But then, again, what do I know? It might be canned response #3,9541.

December 25, 2010 will be our FIVE-YEAR ANNIVERSARY.

*please provide a police certificate from the Department of Justice office.
*Please submit your medical examination results.


and ofcouse there a lot other stuff but it not important blah blah blah blah.
so the weir thing is that there's NO RESUBMISSION DATE, it just said once we have the two item done turn it in at window B on any working day between 1:00-2:00, window will be open at 12:30. SO NO RESUBMISSION DATE ..

ANY IDEA SCOTT ? ANYONE?


I think you guys are good to go! Just my opinion, but I think that means you are approved once those items are updated (resubmitted).

I just got the same canned response from Charles. They dared to include my e-mail inquiries & their canned responses as actions taken. My take is that requests from our congressperson does very little. Yes, if an entry into the computer makes any difference, then, yes, it's something.

That's normal in Vietnam, at least it is where I work. We call everybody Mr. and Ms., regardless of marital status.


Yeah I get that, but at the time it seemed like a dig from the consulate, especially when reffering to my wife with my US representative. Im over it and have my patient hat back on.

Scott, I have no clue as to what their doing there. I dont think there is a year limit from interview to decision as there are others that have been in AP longer than us, but who knows, certainly not me. The inquiry my senator made for me produced a letter from the acting consular section cheif (unsigned) stating our case is pending further review by a consular officer to determine if a bonifide relationship exists between Duyen and I.

I cant friggin cant believe that. And they refer to her as "Ms. and not Mrs. I considered writing them about that but decided to to cause trouble.
Now one would think, with the resources they have availabe plus ALL the information (sworn and notarized) I have given them, all the additional info we both have given them and my 4 trips that they would have come to the conclusuion that our marriage and relationship is indeed legit. All they need to do is LOOK AT THE FACTS, it doesnt take a sleuth to see the truth, it shouldnt take a year or more to finish any investigation. All I can say is they better get it right.

Well, today, October 18, my wife finally received the OF-194, but it wasn't good. Almost a year since her interview and they were anable to issue a visa.They stated 5 points.
They say she didn't say my son's name correct, but when she had the interview they asked her to spell his name and she did. Maybe they didn't hear her clear.
My wife doesn't know about my hometown.She couldn't describe the city. But she did say about a landmark near my hometown.
They say she told them I lived in only one house my entire life, but she told them I lived in my hometown my entire life. She knew I bought a new house back in 2008.
They say we don't have a common language. I can't speak VN, but she speaks english with me.
Thy say we became engaged before meeting in person. After many months of webcam conversations, I asked her if she was ready to get married. After we met in person, we had an engagement ceremony.
So they say the case is closed, and its dated Oct. 8

What can we do now? Anyone know how long things will take?

My Senator has made an inquiry for me, havent heard back from them yet but I did call dos today and they said the case was updated by thier inquiry but were still in AP. Its got to be all the additional evidence I turned in. I think Jerrome hit it on the head. Every visit I've made to VN I went to the consulate with tons of stuff and Duyen has also gone several times to turn in both our phone records. Havent turned anything in for a month or so, so we'll see. Planning my 5th trip for TET already but hoping something will happen so we can celebrate it here.

What DoS said confused me. They said its no longer with the NVC, and everything was sent to HCMC. I tried to tell the woman my wife had an interview almost a year ago, but she could only tell me what it said on her computer screen. So I really don't know whats going on, unless she didn't check the correct case number. Yes, I know we need to update the police and medical, but haven't received a letter asking for that.

The congressman sent 2 e-mails. 1st one he received has Bennett's name saying the same copy and paste. Then he sent a 2nd one because he said he wasn't happy with their response, asking them why its taken over 10 months. He said he told them loud and clear, and if I don't hear from them by Nov. 1 to let him know.


Bob, its got to be the DOS person on the phone didnt know how to read what was in front of them or didnt take the time to check any other sources of information. There had to have been some action taken on your case since her interview. Try calling again this week, see if you get better results. Good to hear your congressman used some strong language in his inquiry, I hope that produces something positive soon.
